    Opis:
    Public access to the legislative process is one of the principles governing Parliamentary law. This process primarily entails public debates, the public nature of motions and submissions, public voting, the public adoption of resolutions, and the public availability of documents constituting the basis for the work of the Sejm – the Lower House of Parliament. Thanks to modern means of communication and live broadcasts, the public has unrestricted access to Parliamentary debates and the legislative process. While searching for, or generating, information by automated means, recipients can follow the legislative process in the form of video broadcasts. Therefore, all types of Internet attack constitute a clear threat for the validity of the legislative process, and can lead to the disruption of information disclosure as part of the public debate.

    The principle of non-retroactivity is not recognised by doctrine or the Constitutional Tribunal as a mandatory directive. Such a situation occurred in the case of adopting amendments to the Act of 2 March 2020, referred to as “COVID-19”. In these circumstances, a schedule of deviations from the principle of non-retroactivity was identified, and it therefore became necessary to assess the relevance of the retroactive implementation of the norms for each specific case governed by the Act under consideration. In these cases, the legislator was guided by the need to safeguard social and economic freedoms and interests.

    Trybunał Konstytucyjny postanowił o utracie mocy przepisu art. 57 § 5 pkt 2 ustawy z 14 czerwca 1960 r. – Kodeks postępowania administracyjnego (Dz.U. 2018, poz. 2096 oraz 2019, poz. 60, 730 i 1133), w brzmieniu obowiązującym do 2 lipca 2019 r., w zakresie, w jakim różnicuje skutki nadania pisma procesowego w zależności od miejsca położenia operatora pocztowego na obszarze Unii Europejskiej, uzależniając skuteczność zachowania terminu wykonania czynności od nadania pisma wyłącznie w polskiej placówce pocztowej operatora wyznaczonego w rozumieniu ustawy z 23 listopada 2012 r. – Prawo pocztowe (Dz.U. 2018, poz. 2188 oraz 2019, poz. 1051), jest niezgodny z art. 32 i art. 78 Konstytucji Rzeczypospolitej Polskiej oraz z art. 21 ust. 1 Traktatu o funkcjonowaniu Unii Europejskiej (Dz.U. 2004, nr 90, poz. 864/2).

    Artykuł jest poświęcony opracowaniu tekstów jednolitych dekretu. Istota tekstu jednolitego dekretu opierała się na dwóch funkcjach. Pierwszą z nich było stworzenie wzorcowej treści konkretnego aktu prawnego, drugą – funkcja informacyjna. Analizą objęto trzy dekrety, dla których wydano teksty jednolite. Modyfikacje dekretów powodowały trudności w ustaleniu ich obowiązującej treści. Tekst jednolity dekretu był szczególnym rodzajem tekstu jednolitego dla dekretu, który uwzględniał wszystkie zmiany dokonane w tym akcie. Teoretycznie każdy dekret mógł mieć tekst jednolity, w zależności od liczby związanych z nim zmian.
    The article is dedicated to the study of uniform texts of a decree. The essence of the uniform text of a decree was based on two functions. The first one was to create model content of a specific legal act, while the function of the second one was to provide information. The analysis covered three decrees for which uniform texts had been issued. Modifications to the decrees led to difficulties in establishing their binding contents. The uniform text of a decree was a special type of a uniform text for the decree which included all the changes made in this act. Theoretically, every decree could have a uniform text depending on the number of changes connected with it.

    The justification of the bill on the amendment of the Constitution must be attached every time the petitioner files a bill on the amendment of the Constitution to the Sejm. The regulations of the Sejm in the art. 34 § 2 stipulate the required provisions of the justification. Lack of justification with regard to the bill on the amendment of the Constitution will cause the Speaker of the Sejm to return the petition and require the petitioner to complete it. In the event of a failure to complete the justification, the right of legislative initiative on the amendment of the Constitution will not commence the legislative process. Justification to the bill on the amendment of the Constitution is obligatory to initiate the legislative proceedings in the Sejm.
    Uzasadnienie projektu ustawy o zmianie Konstytucji musi być załączone za każdym razem, gdy wnioskodawca składa projekty ustawy o zmianie Konstytucji do Sejmu. Regulamin Sejmu w art. 34 ust. 2 określił, co powinno zawierać uzasadnienie. Brak uzasadnienia do projektu ustawy o zmianie Konstytucji skutkuje tym, że Marszałek Sejmu może zwrócić projekt wnioskodawcy celem uzupełnienia. Nieuzupełnienie braków w uzasadnieniu powoduje, że inicjatywa ustawodawcza o zmianie Konstytucji nie rozpoczyna procesu ustawodawczego. Uzasadnienie do projektu ustawy o zmianie Konstytucji jest koniecznym elementem do wszczęcia procedury ustawodawczej w Sejmie.

    The article is devoted to the right of legislative initiative deriving from the principle of popular sovereignty. The right of legislative initiative is one of the forms of participatory democracy. The popular initiative is regulated by the Art. 118 par. 2 of the Constitution of the Republic of Poland and by the act on exercising rights of legislative initiative by citizens of 24 June, 1999. The right of legislative initiative is exercised by collection of 100 000 signatures with regard to the bill. Once the required number of signatures have been collected, the bill in the form of the right of legislative initiative is filed to the Speaker of the Sejm. The Speaker then processes such a case.

    Trybunał Konstytucyjny postanowił o utracie mocy przepisu już nieobowiązującego w systemie prawnym. Na mocy orzeczenia sygn. akt P 1/18 art. 57 § 5 pkt 2 Ustawy z dnia 14 czerwca 1960 r. – Kodeks Postępowania Administracyjnego został uznany za niezgodny Konstytucją. Przepisy te mają wymiar historyczny, chociaż przez chwilę były częścią systemu prawa oraz mogły być właściwie stosowane przez organy władzy publicznej. Orzeczenie zostało wydane w dniu 30 października 2019 r., czyli po wejściu w życie nowelizacji tego artykułu. Niezależnie od działań ustawodawcy Trybunał Konstytucyjny musiał wydać wyrok jako orzeczenie historyczne, które jest logiczną zasadą wypracowaną na podstawie art. 190 Konstytucji.
    The Constitutional Tribunal has ruled that a regulation which is no longer binding in the legal system – expires. By way of the Decision file no. P 1/18, Art. 57 § 5 point 2 of the Act dated 14 June 1960 – Administrative Procedure Code was found incompatible with the Constitution. These regulations are of historical character, although they were temporarily part of the legal system and could be adopted by the public authorities. The judgement was pronounced on 30 October 2019, that is after the amendment to this article had come into force. Irrespective of the legislator’s actions, the Constitutional Tribunal had to issue a judgment as a historical decision which is a logical principle elaborated on the basis of Art. 190 of the Constitution.

    The subject of this elaboration is legal effect of the ruling of the Constitutional Tribunal, that arises after it has been published. The purpose of this elaboration is to present doubts related to application of rulings of the Constitutional Tribunal, based on the art. 8 para. 2 of the Constitution due to the art. 118 and 190 of the Constitution. Pursuant to these articles, the ruling is given legal effect after its publication, not earlier. By adjudicating with regard to the provision being at variance with the Constitution, the Constitutional Tribunal actually imposes the effect on the legal system in the form of repeal of this provision. On the one hand the legal system becomes constitutional but on the other a legal loophole may arise from lack of regulations.
    Przedmiotem niniejszego opracowania czynię skutek prawny orzeczenia Trybunału Konstytucyjnego, który powstaje po jego bezpośrednim opublikowaniu. Celem opracowania jest uwypuklenie wątpliwości, które dotyczą realizacji orzeczeń Trybunału Konstytucyjnego, na mocy art. 8 ust. 2 Konstytucji w związku z art. 118 i 190 Konstytucji. Zgodnie z tymi artykułami orzeczeniu nadaje się moc prawną po jego opublikowaniu, nie wcześniej. Trybunał Konstytucyjny orzekając w przedmiocie niezgodnego z Konstytucją przepisu tak naprawdę wywiera na system prawny skutek w postaci uchylenia tego przepisu. System prawny z jednej strony staje się konstytucyjny z drugiej może powstać luka prawna ze względu na brak regulacji.
