Opis:: The subject of my contribution is the cognition in the jurisprudence. It focuses on the question of the methods used in the jurisprudence to achieve knowledge of the law and the importance of the language in this process. My considerations focus on the evaluative position of the jurist. It is based on the assumption that the choice of a view requires not only an evaluation but also a kind of hierarchization. Therefore the important question is which evaluations are displaced by jurisprudence, and which ones creep into the theoretical considerations. The arguments on this topic have been drawn from three texts by German jurists of the 19th century.
Przedmiotem niniejszego artykułu jest poznanie w nauce prawa. Autor koncentruje się na zagadnieniu metodologii stosowanej w zakresie poznania prawa w nauce o prawie oraz na znaczeniu, jakie przypisuje się językowi na drodze poznania. W centrum moich rozważań znajduje się wartościująca postawa naukowca – prawnika. Wychodzę z założenia, że dokonywany przez badacza wybór określonego poglądu jest wynikiem nie tylko jego wartościowania, ale także preferowanej przez niego określonej hierarchizacji wartości. Istotnym w tym wyborze wydaje się być decyzja o tym, z jakich rodzajów wartościowania nauka prawa rezygnuje, a które przenikają do prawoznawczych rozważań teoretycznych. Argumenty na ten temat czerpię z dwóch tekstów dziewiętnastowiecznych niemieckich naukowców – prawników.

Opis:: In my article, I present the person metaphor as the constitutive term for the theory of artificial persons. We have been dealing with various manners of reading the nature of the legal person, and consequently of law in general, especially private law (Privatrecht), since Roman times to this day. The point of departure for my deliberations, in which I try to demonstrate the nature of metaphorical expressions used in building legal theories, is a statement by Paul Kirchhof, who demanded that metaphorical expressions be eradicated from positive (statutory) law. In my article, I ask whether the demand can also be applied to theoretical deliberations of lawyers on the nature of law. Based on examples from legal discussions on the nature of the legal person, I formulate the claim that Paul Kirchhof’s demand should be applied only to positive law texts. Metaphorical expressions have no raison d’être in such texts, especially if they are meant to serve as terms. A different situation occurs where a metaphorical expression is the basis for building a legal system and relations among its components. At this phase of developing law, metaphorical expressions give rise to similarities on which its functions depend. Therefore, at the stage of structuring the meanings of legal terms, corresponding to the vagueness of the metaphor are the important processes of defining and then using legal terms.

Opis:: In der bisherigen linguistischen Forschung ist die Analyse von Fachwörtern im Allgemeinen an einzelnen Fachwörtern bzw. Termini oder an ganzen Fachwortschätzen bzw. Terminologien orientiert. Im Rahmen dieser Forschung ist bislang ein wichtiger Aspekt fachlicher Lexik weitgehend unbeachtet geblieben: Das Problem der textuellen Konstitution von Terminologie – oder anders formuliert: die Frage, wie ein Fachwortschatz in einem Fachtext eingeführt wird. Meine Überlegungen werden mit Beispielen aus den Texten der Rechtswissenschaftler der historischen Rechtsschule des 19. Jahrhunderts illustriert.
Specialist terminology analysis in linguistic research to date has generally focused on unitary specialist terms or on entire specialist vocabularies or complete terminologies. What this research has disregarded is an important aspect of specialist vocabulary: the issue of how terminologies are constituted textually or how specialist vocabularies are deployed in specialist texts. My considerations are illustrated with examples from texts by law researchers from the 19th century German Historical School of Jurisprudence.

Opis:: In my article I present Otto Gierke’s attempt to construct the phenomenon of legal entities using the means of analogy. The point of departure for my deliberations, in which I try to demonstrate the nature of metaphorical expressions used in building legal theories, is the speech given by Otto Gierke at the inauguration of his holding the post of university rector on 15 October 1902. The position of Gierke is criticized by Eduard Hölder. Hölder does not see the analogy as a suitable mean for the construction of a legal theory.

Opis:: Real versus nominal definitions in the language of 19th century German legal dissertations Definition is included in the basic (scientific) activities (methods). The results of the definition are communicated in the language. In my paper I take up the topic of functions performed by definitions in the development of knowledge about law. The basis for my deliberations are selected fragments of German scientific treatises from the 19th century. I am particularly interested in the above topic in the context of the principle of dividing definitions into real and nominal definitions adopted since the times of Aristotle. In my paper I try to establish the status of definitions used in the texts I analyse. The fundamental research problem is whether the definitions formulated by the 19th century German law theorists are certificated, real, classical essential definitions – established in the final analysis (this would be consistent with the expectations of some researchers of the language of law related to its character, i.e. its accuracy, accuracy), or whether these definitions are understood in a fallible way, subject to revision and change, which are the results of the field of law.

Opis:: In diesem Beitrag wird auf die Problematik der Varietät in der Sprachverwendung und ihre Auswirkungen auf die in einer Äußerung (Form) zu transportierenden Bedeutungen eingegangen. Dabei wird die Präsentationsfunktion der Sprache in den Vordergrund gerückt. Ich gehe von der Annahme aus, dass zwischen Sprachstruktur insbesondere im lexikalischen Bereich, ihrer Stabilität sowie den Bedingungen für ihre Aufhebung und deren Folgen, und der sozialen Struktur eine Kovariation besteht. Eine Methode zur Beobachtung dieser Kovariation kann meiner Meinung nach die Analyse von Äußerungen sein, also von kommunikativen Einheiten, die nach ihrem Verständigungszweck und nicht wie die Sätze nach ihrer Korrektheit zu bewerten sind. Unter den Bedeutungsfunktionen der Äußerungen interessiert mich besonders die Präsentationsfunktion und die Frage, welche sprachliche Form sie im Kommunikationsprozess annimmt. In meiner didaktischen Praxis unternahm ich den Versuch, die bestehenden theoretischen Vermutungen mit empirischen Belegen zu untermauern. Diesem Zweck diente das Experiment, das ich während des Übersetzungsunterrichts mit den Germanistikstudenten im Institut für Germanistik an der Universität Wrocław durchführte.
W niniejszym artykule zajmuję się zagadnieniem wariancji w użyciu języka i jego konsekwencjami dla przekazywanego w danej formie znaczenia ze szczególnym uwzględnieniem funkcji prezentacyjnej wypowiedzi. Wychodzę z założenia, że pomiędzy strukturą języka w zakresie leksykalnym, jej stabilnością oraz warunkami jej zaburzenia i jego konsekwencji oraz strukturą społeczną istnieje pewna wzajemna zależność. Metodą pozwalającą na zaobserwowanie tej wzajemnej zależności może być moim zdaniem analiza wypowiedzi, tzn. analiza jednostek komunikacyjnych, które oceniane są pod kątem celu porozumienia, a nie jak zdania pod kątem ich poprawności. Spośród funkcji znaczenia wypowiedzi interesuje mnie szczególnie funkcja prezentacyjna oraz to, jakie formy przyjmuje ona w procesie komunikacji. W pracy dydaktycznej podjąłem próbę podbudowania istniejących założeń teoretycznych materiałem empirycznym. Temu celowi służył eksperyment, który przeprowadziłem ze studentami germanistyki w Instytucie Germanistyki na Uniwersytecie Wrocławskim.
This paper deals with the issue of variants in language use and its consequences for the meaning transfer. Special attention shall be paid to the presentative function of an utterance. The author assumes that there is a sort of interrelation between the lexical language structure, its stability, conditions for its disfluencies and consequences resulting therefrom as well as langauge social funcion. A method which may be used to observe this interrelation may be the utterance analysis (the analysisi of communication units focused on their communication aim and correctness). The author presents the results of an experiment carried out among the students of German studies at the University of Wroclaw.

Opis:: Gegenstand des vorliegenden Rezensionsartikels ist die anlässlich des achtzigsten Geburtstags von Ulla Fix zusammengestellte Festschrift „Grenzgänge: Eine Spritztour durch Text-, Stil- und Zeichengefilde“, herausgegeben von Bettina M. Bock, Steffen Pappert und Tanja Škerlavaj im Verlag Frank & Timme, Berlin. Auf Grund des im Titel der Festschrift formulierten These wird über das Wesen des philologischwissenschaftlichen Beitrags der Jubilarin vor dem Hintergrund des Modells des sprachlichen Zeichens und den terminologischen Überlegungen nachgedacht. Die in der Festschrift gesammelten Kurzbeiträge präsentieren Forschungsfelder von Ulla Fix. Diese Forschungsfelder werden thematisiert, reflektiert und weitergedacht. Es sind keine weitschweifigen Analysen, sondern lapidare, treffende Pinselstriche zu der von Ulla Fix erschlossenen und bearbeiteten Forschungsfragen. Die Konstruktion der Festschrift und der darin präsentierten Beiträge kann als modellhafte Darstellung des sprachlichen Zeichens gelesen werden. In den Beiträgen wird die semantische Ausstattung dafür geliefert, was die im Titel signalisierte Benennung beinhaltet. Sie sind der gedachte, thematisierte, reflektierte Inhalt, Begriff dessen, was die Benennung Grenzgängerin im wesentlichen bedeutet. Diese Methode der Lesung der Beiträge korrespondiert epistemologisch mit dem von Karl Popper in Opposition zur naiven Methode und zur intuitiven Auffassung des Wissens von Aristoteles erschlossenen antiessentialistischen Ansatz der Bedeutungsbestimmung. Damit werden Grenzgänge der Jubilarin zum Synonym der epistemologischen Suche nach Wahrheit im Sinne der klassischen, traditionell fundierten und zukunftsweisenden philologischen Forschung. Zukunftsweisend sind auch die Beiträge in ihrer Botschaft – mitteilend, aber vor allem befruchtend und inspirierend für jeden Sprachliebhaber – für erfahrene Wissenschaftler und für diejenigen, die es erst werden wollen.
The subject of this review article is the Festschrift „Grenzgänge: Eine Spritztour durch Text-, Stil- und Zeichengefilde“ (Border Crossings: A Journey through Textual, Stylistic and Significant Fields), edited by Bettina M. Bock, Steffen Pappert and Tanja Škerlavaj, published by Frank & Timme, Berlin, on the occasion of Ulla Fix‘s eightieth birthday. Based on the thesis formulated in the title of the Festschrift, the essence of the philological-scientific contribution of the jubilarian is reflected upon against the background of the model of the linguistic sign and the terminological considerations. The short contributions collected in the Festschrift present fields of research by Ulla Fix. These fields of research are thematised, reflected upon and thought about further. They are not rambling analyses, but succinct, apt brushstrokes to the research questions Ulla Fix opened up and worked on. The construction of the Festschrift and the contributions presented in it can be read as a model representation of the linguistic sign. The contributions provide the semantic equipment for what the naming signalled in the title contains. They are the imagined, thematised, reflected content, concept of what the name Grenzgängerin essentially means. This method of reading the contributions corresponds epistemologically with the anti-essentialist approach to meaning-making opened up by Karl Popper in opposition to Aristotle‘s naïve method and intuitive conception of knowledge. Thus, the jubilarian‘s border crossings become synonymous with the epistemological search for truth in the sense of classical, traditionally grounded and forward-looking philological research. The contributions are also forward-looking in their message - communicative, but above all stimulating and inspiring for every lover of language - for experienced scholars and for those who want to become one.
