    Celem artykułu jest określenie poszczególnych elementów prawnej definicji rodzinnego gospodarstwa rolnego jako podstawy ustroju rolnego w Polsce. Przedmiotem analizy były przepisy Konstytucji RP i ustawy o kształtowaniu ustroju rolnego z 2003 roku. Rozważania prowadzą do krytycznej oceny obowiązujących rozwiązań. W końcowej części opracowania przedstawiono wnioski de lege ferenda.
    The paper presents issues of legal regulation of the definition of family farm as the basis of the agricultural system in Poland. According to Article 23 of the Constitution of 1997 family homestead is the foundation of the Polish agrarian system. The analysis are the provisions of the Constitution and the Act on shaping the agricultural system which reveals current tendencies of the Polish agrarian system. The main aim of this paper was to identify individual elements of the legal definition of the family farm. Considerations lead to a critical assessment of the existing solutions. In the final part of the study presents the conclusions de lege ferenda postulates.

    Poruszone zostały problemy prawnej ochrony wzorów użytkowych. Zwrócono uwagę na poszczególne elementy definicji ustawowej, stanowiące przesłanki zdolności ochronnej wzorów w Urzędzie Patentowym. Przedstawione zostały instrumenty ochrony wzorów użytkowych w ramach udzielonego prawa ochronnego. Opracowanie stanowi także analizę porównawczą wzorów użytkowych i wynalazków.
    The main purpose of this elaboration is to determine the protection ability of the utility models. The paper concerns the discussion of the problems related to the issue of legal protection for utility models. The attention was paid to the individual elements constituting the legal definition of the conditions suitable for registration for utility models in the Patent Office. Author presented the following instruments of protection ability in Polish law: novelty, technical nature, usefulness and permanent character of the model. The article also provides a comparative analysis of utility models and inventions protection. Coming to conclusion - without the doctrine and judicial attitiude the decisions of registration ability conditions of utility models would be really difficult.

    Celem badań było określenie zasad ubezpieczania rolników świadczących umowy cywilnoprawne oraz prowadzących pozarolniczą działalność gospodarczą w Kasie Rolniczego Ubezpieczenia Społecznego. Zwrócono uwagę na poszczególne elementy definicji ustawowej rolnika oraz pozarolniczej działalności gospodarczej. Przedstawiono również sytuację rolników wyłączanych dotychczas z KRUS z tytułu wykonywania umów zlecenia. W rozważaniach konieczne było uwzględnienie kwestii ochrony tych podmiotów przez pryzmat funkcji gwarancyjnej i kompensacyjnej ubezpieczeń społecznych. W końcowej części opracowania przedstawiono wnioski de lege ferenda.
    The paper describes the problems of insuring farmers that are performing civil law agreements and conducting nonagricultural business in the Agricultural Social Insurance Fund. The attention is paid to the individual elements of the statutory definition of a farmer and an attempt to define the term of non-agricultural economic activities. The main purpose of this elaboration is to define the exposure of farmers – entrepreneurs and farmers insurance providers of civil contracts in ASIF on the conditions of the Act of 20 December 1990. It should be also analyzed the personal scope of the subject of insurance through the prism of the social security protection. In the final part of the aticle the conclusions and de lege ferenda arguments are presented.

    Artykuł porusza kwestię przedawnienia roszczeń o jednorazowe odszkodowanie z ubezpieczenia wypadkowego rolników. Celem rozważań jest próba udzielenia odpowiedzi na pytanie, czy roszczenie o to świadczenie z tytułu wypadku przy pracy rolniczej może ulec przedawnieniu? Analiza problemu została dokonana na podstawie obowiązującej regulacji prawnej i z uwzględnieniem aktualnej linii orzecznictwa sądowego.
    This elaboration presents problems of claim limitation of single indemnity in accidental insurance in farm. The main purpose of the considerations presented in the paper is the answer to the question: Could the claims of single indemnity in Polish current law regulation be limited? Farmers are often late to notify the insurer about an accident, despite the requirement that such an agricultural accident at work should be reported not later than 6 months following its occurrence. However, there are no legal sanctions if this date is not met. Therefore in practice, a late report does not result in any direct legal consequences, and a late claim is rejected on grounds of unnecessary delay only if late reporting has impaired the possibility of ascertaining the actual circumstances of the accident. The analysis leads to the conclusion that the limitation of the right the casualties of accidental events at work to single indemnity in Polish current regulation is not possible.

    The aim of this paper was to answer the question if the peculiarity of features of the biotechnological inventions and legal premises of patent abilities facilitate protection of this particular category of invention? Author presents the peculiarity of biotechnological invention and particular aspects of their protection within the given patent. The article provides a comparative analysis of the individual elements constituting the legal defi nition of the conditions suitable for patent ability of the biotechnological inventions in the Patent Offi ce. Elaboration presents also practical problems related with protection of this category of invention in Poland. As a result of conducted considerations it should be concluded, that the legal regulations don’t facilitate the creators a protection of biotechnological inventions.

    The purpose of this paper is to identify the practical and financial issues that may arise from the application of the recently introduced provisions regulating a new type of contract - the harvest help contract. It can be concluded between a farmer and a farm worker providing help in agricultural activities during seasonal work. Attention was paid to new statutory definitions, with particular reference to the concept of a farm worker. The basic elements of the contract, the rights and obligations of the parties, including the financial duties imposed on the farmer regarding the performance of the contract and the obligation to insure the worker at KRUS were presented. The analyzed regulation raises many doubts, especially when determining the worker’s status. A farm worker may be a person providing help only to statutory limited specific harvest crops. Insurance protection is available only to some persons performing some specific activities and is limited to accident and health insurance only. It generates high costs for farmers who conclude short-term contracts with workers. The contract does not give the assistants any guarantee of minimum wage protection. This could lead to the risk of economic exploitation of assistants in the future.
    Celem opracowania jest określenie kwestii praktycznych i finansowych, mogących wyniknąć ze stosowania wprowadzonych przepisów regulujących nowy typ umowy – tzw. umowę o pomocy przy zbiorach. Może być ona zawarta pomiędzy rolnikiem i pomocnikiem świadczącym pomoc w działalności rolniczej przy pracach sezonowych. Zwrócono uwagę na nowe definicje ustawowe, w tym przede wszystkim na pojęcie pomocnika rolnika. Ukazano podstawowe elementy analizowanej umowy, prawa i obowiązki stron, obowiązki finansowe ciążące na rolniku w związku z zawarciem i wykonaniem zobowiązania ze szczególnym uwzględnieniem obowiązku ubezpieczenia pomocnika w KRUS. Analizowana regulacja budzi wiele wątpliwości, a najwięcej z nich występuje przy ustalaniu statusu pomocnika. Pomocnikiem rolnika może być osoba świadcząca pomoc tylko przy ustawowo wskazanych zbiorach produktów rolnych. Obowiązkowe ubezpieczenie tych podmiotów sprowadza się do ochrony w zakresie ubezpieczenia wypadkowego i zdrowotnego. Generuje to wysokie koszty dla rolników zawierających z pomocnikami krótkoterminowe umowy. Umowa o pomocy przy zbiorach nie przyznaje pomocnikom gwarancji ochrony wypłaty minimalnego wynagrodzenia. Może to prowadzić w przyszłości do wyzysku ekonomicznego pomocników.

    Poruszono problemy związane z problematyką wypadków przy pracy rolniczej. Zwrócono uwagę na zagrożenia, które mogą się pojawić podczas wykonywania czynności związanych z prowadzoną działalnością rolniczą. Przedstawiono najczęstsze przyczyny i skutki zdarzeń wypadkowych w rolnictwie. Opracowanie stanowi także analizę porównawczą zjawiska wypadkowości przy pracy z wybranymi krajami zachodniej Europy.
    This paper concerns the existing problems in scope of accidents at work in agriculture. The main reasons and results of accidents at work in this sector have been presented. The range of its definitions has been changed. Authors have stressed main hazards which may occur during the farming. In comparison to selected west European countries, must be stated that not only in Poland the agriculture caused the most number of accidents. Coming to conclusion - there's a downward trend in Poland in the accident occurance in agriculture, unfortunately, the technological development may get stronger.
