Opis:
Wyodrębnienie kategorii pojęciowej „umowy prawnorolne” spełnia funkcję porządkującą w ujęciach doktrynalnych dotyczących mechanizmu umowy (konsensu) w naszym systemie prawnym. Terminem „umowy prawnorolne” można określać wszelkie konsensualne czynności prawne, służące realizacji celów polityki rolnej (aspekt funkcjonalny), mające charakter i konstrukcję umów cywilnoprawnych bądź konstrukcję umów administracyjnych, będących obligatoryjną formą działania podmiotu administrującego. Umowa administracyjna, jako prawna forma działania administracji, jest swoistym odpowiednikiem umowy cywilnoprawnej – czynności prawa prywatnego – na gruncie regulacji prawa publicznego. Ten status „odpowiednika” wynika z różnic konstrukcyjnych między obydwiema umowami, toteż wszelkie doktrynalne klasyfikacje umów cywilnoprawnych mogą być przymierzane do umów administracyjnych co najwyżej „odpowiednio”. Prawo rolne jest tą gałęzią prawa, która w swojej funkcji regulacyjnej korzysta zarówno z mechanizmu umów cywilnoprawnych, jak i administracyjnych. Z tego względu zachodzi konieczność zintegrowania badań nad umowami prawnorolnymi, co jednoznacznie przemawia za zachowaniem odrębności prawa rolnego.
Distinguere la categoria concettuale di „umowy prawnorolne” (contratti di diritto agrario) svolge una funzione ordinativa negli approcci dottrinali, i quali riguardano il meccanismo del contratto (accordo), nel nostro ordinamento giuridico. Con il termine „contratti di diritto agrario” propongo di chiamare tutti i negozi giuridici consensuali, i quali sono volti a raggiungere gli obiettivi della politica agricola (aspetto funzionale), e il cui carattere e la cui costruzione sono quelli dei contratti di diritto civile oppure dei contratti amministrativi, i quali, a loro volta, sono una forma obbligatoria di funzionamento dell’ente amministrativo. Un contratto amministrativo, in quanto forma giuridica di attività amministrativa, è un particolare equivalente di un contratto di diritto civile – di un negozio di diritto privato – sullo sfondo delle regolazioni di diritto pubblico. Lo status di "equivalente" è dovuto alle differenze strutturali tra i due contratti, pertanto tutte le eventuali classificazioni dottrinali dei contratti di diritto civile possono essere rapportate a quelli amministrativi, al massimo "rispettivamente". Il diritto agrario è quella branca del diritto che nella sua funzione di regolazione utilizza sia il meccanismo dei contratti di diritto civile sia quello dei contratti amministrativi. Per cui è opportuno svolgere una ricerca integrata sui contratti di diritto agrario, il che va decisamente a favore della necessità di mantenere il suo carattere distinto.
Distinguishing the conceptual category of “agricultural legal agreements” fulfills the ordering function in doctrinal approaches which concern the mechanism of agreement (consensus) in our legal system. I propose to use the term “agricultural legal agreements” to define all consensual legal actions that serve to implement the objectives of agricultural policy (the functional aspect), and have a nature and construction of civil-law contracts or a construction of administrative contracts that are an obligatory form of action for the administering entity. An administrative contract, as a legal form of action of an administrative body, is a specific equivalent of a civil law contract – an action in private law – taken on the grounds of public law regulations. This “counterpart” status results from structural differences between both contracts, therefore all doctrinal classifications of civil law contracts can be applied to administrative contracts, according to their “appropriateness” at best. Agricultural law is that branch of law which in its regulatory function uses both the mechanism of civil law and administrative contracts. Therefore, there is a need for an integrated research on legal contracts in agriculture, which unequivocally speaks for the need for keeping agricultural law separate.

The general normative model of spatial planning is not adequate to the current needs of the organization of rural development. Expanded and procedurally unwieldy local spatial development plan serves well as an instrument of organizing urban development (within the administrative boundaries of cities). Used for rural development focuses on the use of the agricultural production space, notwithstanding the fact that rural areas are not only the areas of agricultural production but also a multifunctional areas, inhabited by people working outside agriculture. The doctrinal proposal is the postulate to consider the legitimacy of separation two categories of local spatial development plans: urban and rural.

Opis:
Ecological agriculture, understood as agricultural production compliant with natural environment rules, in Poland is the subject of EU regulations and Polish legislation applied to incorporate provisions of the Common Agricultural Policy of EU. The ecological production method fulfills a double social role: on the one hand, it supplies goods to the specific market of ecological products; on the other hand, it is an activity conducted in public interest, as it facilitates environmental protection and development of rural areas. Depending on the social function of ecological agriculture that a given legal regulation focuses on, ecological agriculture regulations are divided into two groups. One may raise objections that the economic phenomena regulation is to detailed. Thus, in order to ensure its improvement, it is advisable to introduce the notion of an “ecological farm”.

Opis:
The granting of financial assistance from the European Agricultural Fund for Rural Development is performed by means of either an administrative decision or a civil law contract. From the legal perspective, the refusal to grant assistance under a contract is not a typical administrative decision. It has the form of an administrative act in the meaning of Article 3 section 2 point 4 of the Law on Proceedings before Administrative Courts. The above mentioned provision guarantees the person interested in financial assistance the judicial-administrative protection equivalent to that in a case of administrative decision. Furthermore, in some cases this protection is even wider; e.g. when the administrative Court recognises the entitlement to financial assistance in a judgment passed pursuant to Article 146 section 2 of the above mentioned Law. This kind of entitlement is accompanied by the obligation of a State Agency to grant the assistance to the farmer. In a case when fulfilling of the obligation has the form of a contract, the beneficiary can claim its conclusion, e.g. pursuant to Article 64 of the Civil Code.

Environmental protection is an integral part (component) of actions as well as financial and legal instruments undertaken in the course of the two pillars of the Common Agricultural Policy: market and income policy and rural development policy. Such protection is the aim pursued in the programs and legal regulations of the Common Agricultural Policy, and legal mechanisms of environmental protection, act as instruments of the Common Agricultural Policy, giving reasonable assurance, flexible but effective protection of the various elements of the natural environment. Imposing an obligation to protect the environment is justified in the concept of sustainable development of agriculture, as such development meets the needs of future generations. Connection between the obligation to protect the environment, which is the public aim, with economic activity in the private farmstead, does not raise doubts from the point of view of the principles of distributive justice. The legal construction that explains such a solution is, proposed by A. Stelmachowski, the concept of agricultural property, as a complex of rights and obligations determining the legal situation of the entity – the owner of the farm. A characteristic feature of agricultural property is that these obligations relate not only to specific individuals, but to the State representing the public interest of society as a whole. In exchange for the due performance of agricultural property, the owner has the right to expect assistance from the state, when they exercise their ownership rights.

Restructuring of agricultural system after regaining independence in 1918 was of the nature of the evolutionary reform that consisted in the process of dividing surpluses over the determined size of the farms into smaller items. In the nineties of the last century there was a return to the traditional distinction between private property and public property, which is the division derived from the basic division of private law and public law. At the same time there was retained the subjective diversity between state agricultural holdings, cooperative agricultural holdings and individual agricultural holdings. Each agricultural holding as set of factors of agricultural production, which is organized as economic unit, does not serve to realize the interest, or the public purpose, therefore in the property classification into categories of public and private property, agricultural holding should be ranked as private property, regardless of the legal nature (legal entity or natural person) of the entity who is its owner. Among the total number of agricultural holding there must be extracted the following categories: individual holdings run by farmers –individual natural persons; holdings belonging to the agricultural producer groups; cooperative holdings, run by agricultural production cooperatives, and state holdings.

Professor Andrzej Stelmachowski (1925-2009) is an outstanding person, deserving huge appreciation because of his activity in various fields; as a lawyer, a prominent specialist in civil law, commercial law, family law, who played a remarkable role in the development of agricultural law. He is the creator of a new school of Polish agricultural law, as he elaborated by his scientific achievements, a theoretical basis to distinguish (in the area of doctrine and didactics) agricultural law as a separate branch of law; he has proposed an original method of research – the study of law in the process of its application, and around these ideas he organized research teams – a large group of students at such universities as: Wroclaw, Warsaw and Bialystok (Professor has promoted 23 PhDs of law). Another merit of Professor Stelmachowski was to determine the object and scope of agricultural law, the fundamental structures of agricultural law (the concept of agricultural property), as well as the legal solutions for protection of individual farming. The recognition and respect for the position of Professor at the international level are demonstrated by His numerous professional contacts and honorary doctorates that he was awarded with. The Professor was the first Polish scholar in the CEDR (the European Committee for Agricultural Law), as well as the first President of the Polish Association of Lawyers specialized in Agricultural Law. The concept of teaching elaborated by Professor A. Stelmachowski was reflected in the subsequent editions of academic books in the field of agricultural law, issued under his scientific edit in the period 1970-2008. In all areas of his involvement, despite changes in the external environment, Professor A. Stelmachowski always presented a permanent system of values, among which we should mention: rightness, fidelity to convictions and responsibility, concern for the common good, solidarity with the weak and being guided by the social doctrine of the Church, all of which gave him an unquestionable moral authority as a Person of great strength of character.
