Opis:
The analysis of the current state of law indicates that the committees of the Sejm and the Senate competent in European affairs could be equipped by the legislator with instruments to allow them to participate in political discourse with the EU institutions and the committees of other national parliaments. The implementation of this objective requires amending the statute and the rules of procedure of both Houses of Parliament. However, the legislature‘s failure to act cannot stand in the way of the Parliament‘s exercise of powers relating to the integration process. It is necessary to redefine the interpretative assumptions regarding the relevance of the Constitution in determining the position of the Parliament in the legal order determined not only by national legal provisions but also by the EU law.

The opinion concerns formation of the new Deputies’ Club of the Polish People’s Party and the Union of European Democrats composed of Deputies from different political parties. The principle, which implies that these independent parties retain their organisational and programmatic difference, is politically binding for the new club and it is not contrary to the Standing Orders of the Sejm or other acts. Opis:
The Act on the Exercise of the Mandate of a Deputy or Senator constitutes legal basis for requiring by the Deputy the access to recordings from the session of a communal council. However, there are no sanctions in case of local self-government unit’s infringement of such an obligation towards Deputies and Senators. The lack of specific legal instruments does not exclude the possibility of taking action on general terms, i.e. on the basis of provisions concerning control and supervision over local self-government. A Deputy may demand, from the chairperson of the council, an explanation of reasons for the inability of the realization of such right.

The concept of “non-performance of Deputies duties” covers all kinds of acts that violate legal norms determining the manner of exercising the parliamentary mandate. At the same time, this concept does not include acts leading to non-performance of such Deputies’ duties, the violation of which is threatened by a legal sanction set out in other legal provisions. It is not possible to indicate a full catalog of duties, whose breach casuses a liability under Article 22 of the Standing Orders. “Non-performance of Deputies’ duties” covers, among others, cases of violation of duties related to the participation in the composition of another state authority, related to the function of representing the Sejm in proceedings before other authorities and in interparliamentary relations.

Opis:
In the author’s opinion, the following provisions (sections) of a bill project referred to committee should not become subjects of voting by the committee, but the committee should vote only on motions aimed at their modification (substantive and editorial amendments and motions for deletion of a provision). A different manner of work of the committee may lead to the deletion of a given provision, if the provision is not approved in voting, even in case of the lack of motion to delete it. The Sejm should decide upon legislative motions and legislative postulates included in the committee’s report on the bill, prepared in the form of a consolidated text.

The author analyses the above-mentioned provisions, discussing the problem of a potential disclosure of documents and other materials collected by an investigative committee to authorities conducting criminal proceedings. In case of a convergence between the investigation conducted by the Central Anticorruption Bureau (CAB) and the matter examined by the investigative committee there are no formal obstacles to the realisation of a request for on submission of materials concerning the work of the committee to the CAB.

In the opinion of the author, the scope material immunity includes the fulfilment of Deputy’s obligation to inform voters about the work of a parliamentarian and about the activities of the body to which he or she was elected. This obligation may be fulfilled through a direct information to voters at meetings with them as well as through the media. The scope of formal immunity is covers the Deputy’s responsibility for an infringement of the rights of third parties by means of informing voters about his work and the activities of the Sejm. In the light of the Supreme Court’s findings, it can be assumed that suing a Deputy to a civil court for infringement of personal rights in a statement made at a press conference in which he or she reports on his or her activities falling within the sphere of the execution of the parliamentary mandate, requires a prior consent of the Sejm.

Opis:
Notification to committee members about a committee sitting (date and agenda) should take place at least three days before the sitting, unless the meeting was convened as a result of decisions taken at the sitting of the Sejm. The discussed rule allows each member of the committee to plan a calendar of activities taking into account all individual responsibilities. The author emphasizes that with Article 152 para. 5 of the Standing Orders of the Sejm causes a few interpretation concerns, what indicates a need of its amendment.

A shareholder’s right of access to information concerning a company, in accordance with the Commercial Companies Code, is a form of exercising ownership supervision. The entity exercising the rights attached to the State Treasury shares is obliged to take advantage of this right in order to protect the interests of the State Treasury. Procedures regarding interpellations may be used only to obtain information that the addressee of the interpellation has obtained in the course of ownership supervisions. However, these procedures cannot serve to incurring a binding effect on the exercise of rights relating to ownership supervision.

The subject of the amendment was modification of the content of the protocol. The essence of the amendment is to include in the protocol an information on the remark sent to the Marshal of the Sejm by the Deputy Chief of the Chancellery of the Sejm regarding the resumption of voting. In the author’s opinion, the amendment falls within the general framework of the amendment to the protocol set out in the Standing Orders of the Sejm and should be considered by the Sejm in the manner provided for in those provisions.

The author indicates that the legal structure of the Polish immunity regulations excludes the possibility of adopting a resolution by the Sejm on giving consent to bring several deputies to responsibility. In each individual case, the Sejm should consider a separate motion and adopt a separate resolution. Referring to the principle of discontinuity, the author concludes that regarding the two former Deputies, new motions for consent to bring them to a civil law liability should be submitted, while in the case of a Deputy holding a mandate also in the 9th term, the proceedings on the motion concerning him should be continued.

Sending out holiday greetings by regular mail does not involve the exercise of rights and duties of Deputies, also within a broad meaning of this term, and could not be recognized as an activity aimed at the creation of an organizational framework for the exercise of the mandate. Therefore, it cannot be classified as the exercise of a Deputy’s mandate, or activity substantially connected with the performance of the function of a Member of Parliament. In the author’s opinion, holiday greeting cards cannot be distributed by Deputies with the use of postage-paid envelopes provided by the Sejm.

The author is of the opinion that the loss of the mandate by a Deputy, who has supported the motion to convene a sitting of the committee in accordance with Article 152 para. 2 of the Standing Orders of the Sejm, does not affect the effectiveness of the motion, even if it will result in the number of members supporting the motion (putting their signatures thereupon) being less than 1/3 of the committee membership. An obligation to establish the date and time of the sitting of the committee arises at the time of submission of the properly formulated motion, and should be satisfied immediately. It cannot be accepted that the tardiness in the implementation of the obligation, which arose at the time of submission of the motion, could have an impact on its binding efficiency.

It does not seem possible to formulate an exhaustive list of instances in which it would be permitted to make access to a complete records of the meeting of the Special Services Committee, marked as classified. Typical examples where such access is allowed include actions by the public prosecutor’s office taken within the framework of criminal proceedings and by special services for the detection of crime or actions related to the conduct of inspection under the Act on the Protection of Classified Information. The Marshal of the Sejm is a body competent for making decisions on the provision of classified documents providing the record of the Committee meeting. The head of one of the special services, who at the invitation of the Committee participated in the committee meeting, has the right to be acquainted with the text “working” or preliminary version of the minutes of the meeting. This, however, does not preclude that the activities of services (subordinate to him) provided for in the Act will require reading of the final text of the minutes marked as classified.

The subject of the opinion is an assessment whether the Deputies’ Ethics Committee should examine cases concerning violating the Rules of Deputies’ Ethics by former Deputies. According to the author – and the rule of discontinuation – proceedings started in the former term of the Sejm and not concluded with a decision of the Committee might not be examined by the Committee in the following term. The author analyzes the normative model derived from the Standing Orders of the Sejm and confronts the theoretical assumptions with parliamentary practice accompanying the procedure for election of the Marshal of the Sejm, based on its similarity to the procedure for recall of the Marshal of the Sejm. He argues that the general principles set out in Chapter 2, “Debates of the Sejm” in Section III of the Standing Orders of the Sejm, should apply to this matter in question. The said provisions do not provide for specific powers that would give the Deputies subject to the motion for the recall of the Marshal of the Sejm the right to speak in the debate in accordance with the rules different from those defining the procedure for taking floor by other speakers. It should be assumed that in the debate on a motion to recall the Marshal of the Sejm the questions in the debate can be responded by their intended addressees, i.e. a person subject to the motion or the designated candidate. There is no specific basis in the Standing Orders that would allow giving a speech by the Deputy subject to the motion when no question has been addressed to him/her during the debate.

Opis:
The term “tax act” is used in the Standing Orders of the Sejm in the substantive sense and refers to a public levy having the features of a tax, i.e. a pecuniary, compulsory, non-returnable and nonequivalent payment imposed by law and constituting budgetary revenue of the State Treasury or local government units of general purpose. The author points out that it is irrelevant for the qualification of a bill as a “tax bill” what name the bill uses to denote a public levy, if it bears the features of a tax. The title of a tax bill also refers to the bill that repeals or modifies the scope of a tax obligation or its elements. The author concludes that any tax act amendment bill meets the characteristics of the term “tax act”, and the scope of the term “tax act” does not include public tributes other than taxes.

Opis:
The Chancellery of the Sejm is an entity obliged to disclose public information. This information concerns, inter alia, participation of parliamentarians in the work of the parliamentary grouping, i.e. persons performing public tasks. Disclosure of information about participants in a parliamentary grouping sitting is subject to limitations under the Act on Access to Public Information. Therefore, the data of persons participating in the work of the team, who do not perform public functions, cannot be made public.

Opis:
The author indicates what legislation should be taken into account under the security procedure in the event that the subject of secret debate of the Sejm comprises classified information within its statutory meaning. He also points out that these provisions do not apply in a phase in which the Sejm – without the participation of the public and the media – decides whether the debate is to be held in camera. The procedure for exclusion of open nature of debate is specified in Article 172 para. 2 of the Standing Orders of the Sejm which states that a motion in this respect may be submitted by the Presidium of the Sejm or at least 30 Deputies. The resolution whether to hold a sitting in camera is taken “without admittance to the public and the representatives of the press, radio and television, after hearing the reasons for the request – without debate”. The author concludes that the way of ensuring security (in organizational and technical terms) of resolving by the Sejm secrecy of debate is limited to the exclusion of the public and representatives of the media and does not require the application of measures identical to those associated with the procedure for secrecy of debate.

Opis:
Membership of a Deputy in the parliamentary team is not considered a type of service or work the pursuit of which requires access to classified information. This is due to the fact that the parliamentary teams are established in order to promote certain values and attitudes, and serve to achieve cross‑party public purposes. The author explains that the exercise of a Deputy’s mandate may require the use of classified information, but each time is it a consequence of the Sejm’s decision.

Opis:
Membership in international organizations does not fall into the category of additional engagement referred to in Article 33 para. 1 and 2 of the Act on the Exercise of the Mandate of a Deputy or and Senator. Consequently, the Deputy is not obliged to notify the Marshal of the Sejm his/her intention of becoming a member of a particular international social organization. The author notes, however, that in the case where that organization runs business activity and when membership would entail participation in its governing bodies, then such participation should be notified to the Marshal of the Sejm.

Opis:
The opinion deals with the exercise of parliamentary oversight functions by Sejm committees. It provides an analysis of whether the representatives of State administration might be held responsible for failure to discharge their duties resulting from Article 157 of the Standing Orders of the Sejm. In the author’s view, Sejm committees have at their disposal the means to enforce only political responsibility. Moreover, as concerns suspension of work on a bill in the event of breach of the obligations specified in Article 157 by the representatives of public administration, the author believes that the legitimacy of such action cannot be assessed in abstracto. The author does not rule out that, depending on circumstances and seriousness of the infringements, suspension of work on a bill may be justified.

Opis:
Deputies have access to information concerning the content of contracts concluded by a municipality also when, certain information included in these contracts was marked by a clause excluding their disclosure due to a business secret of a party to the contract. Exceptions to this rule are set out in Article 35 of the Act on Public Finances. Refusal to reply to a Deputy’s questions will be justified only in a case, when, following to an independent assessment of an authority applying the said provisions, information covered by the contractual clause falls within that exclusion.

Opis:
The Author concludes that the Rules Deputies’ and Immunity Affairs Committee should not continue to examine application request of the subsidiary prosecutor after the court of appeal has finally dismissed the criminal proceedings. It should be assumed that revoking of a valid procedural decision terminating these proceedings will give rise to the necessity of submitting a new application for waiver of immunity. An entity that submitted an application for waiver of immunity may freely dispose of it until the Sejm adopts a resolution regarding the consent to bring the Deputy to criminal accountability or until the Deputy’s submission of the statement referred to in Article 105 para. 4 of the Constitution.
