hacking - Opis:
- Hacker and hacking are relatively new terms and their occurrences as entries in recently published encyclopedias and dictionaries are still rare. Hacking is now a worldwide phenomenon which has been approached by law systems of various countries at different angles, his main feature being described as “maliciousness”. The phrase “information obtainment” is traditionally interpreted by doctrine of criminal law as getting to know the contents of a message. Hacking is an intentional offence which is prosecuted on complaint by the offended party. Everyday practice has shown, however, that the repressive function of Art. 267 § 1 of the penal code, which describes the offence of hacking, is almost non-existent.
