Opis:: So far, the parties to administrative proceedings, in order to counteract the slowness of the body conducting the proceedings, have been able to file a complaint about not handling the case on time or on the lengthy conducting of the proceedings themselves. The legislator, taking into account the experience to date, as a result of the amendment to the Code of Administrative Procedure, decided to replace the complaint with a reminder. The article describes the constituent elements of this form of urgency, as well as practical issues related to the application of this measure by the parties and authorities conducting the proceedings.

Opis:: The Constitution of the Republic of Poland, in Art. 21, par. 2, permits constitutional expropriation only if this is made for public purposes and with just compensation. It is the highest degree of interference in the ownership of the individual and, therefore, it is important to ensure that the proceedings which are legally carried out implement the basic principles of the administrative procedure and are run in accordance with the provisions of the Act on Real Estate Management. Due to the guarantee of protection of the individual, special attention should be focused on the conditions determining the initiation and conduct of expropriation proceedings in the form of public purpose execution, negotiations to conduct an administrative hearing, determination of “just” compensation, and return of property in cases specified in the Act.

Opis:: Performing tasks in the field of managing local roads is one of the commune’s own tasks. As part of managing these roads, the commune authorities take actions to regulate the legal status of real estate occupied for local roads. This article will introduce examples of such proceedings, which will then allow us to analyze the values of administrative law such as public interest and public good. Due to the relativity of the concepts of values and anti-values, one should also consider the insecurity of the individual related to expropriation proceedings.
