Opis:
The issue of applicability of general principles included in Articles 6–16 of the Code of Administrative Procedure is a controversial and a disputable one. Applicability of general principles in jurisdictional procedure, in other procedures regulated by the Code of Administrative Procedure and in the procedures regulated by provisions other than those included in the Code of Administrative Procedure, will be analysed. The doctrine presents different opinions concerning the force of applicability of general principles in those procedures. One thing is certain: general principles of the Code of Administrative Procedure are legal norms which have been singled out in jurisdictional administrative procedure where they fully apply. The range of applicability of general principles of the Code of Administrative Procedure is not limited only to jurisdictional administrative procedure; some principles apply fully to summary procedures due to their nature and specificity. Additionally, general principles of the Code of Administrative Procedure should be also applied to procedures not regulated by codes, which are regulated by other acts concerning administrative procedure.
Problematyka zakresu obowiązywania zasad ogólnych sformułowanych w art. 6–16 k.p.a. ma charakter sporny i dyskusyjny. Przedmiotem analizy w niniejszym artykule będzie obowiązywanie zasad ogólnych w postępowaniu jurysdykcyjnym, w innych postępowaniach unormowanych w k.p.a. oraz w postępowaniach unormowanych poza k.p.a. W doktrynie prezentowane są zróżnicowane poglądy co do mocy obowiązywania zasad ogólnych we wskazanych postępowaniach. Nie budzi wątpliwości jedynie fakt, że zasady ogólne k.p.a. są normami prawa, które zostały wyodrębnione w jurysdykcyjnym postępowaniu administracyjnym i obowiązują w nim w pełnym zakresie. Zasięg obowiązywania zasad ogólnych k.p.a. nie ogranicza się tylko do jurysdykcyjnego postępowania administracyjnego. Niektóre zasady ogólne mają pełne zastosowanie w postępowaniach uproszczonych z uwagi na istotę i specyfikę tych postępowań. Ponadto zasady ogólne k.p.a. należy stosować również w postępowaniach pozakodeksowych, unormowanych w innych aktach regulujących procedurę administracyjną.

The paper presents a legal analysis of a party’s claim for examination of evidence in the courseof preliminary investigation. Procedural powers of a party to claim examination of evidence providesthe party with a possibility of submitting facts or evidence which the party has. Additionally, itprovides the party with a possibility of active participation in the proceedings as well as that of havingan influence on the process of establishing factual findings and effective defence of the party’sinterests. It needs to be emphasised that the adjudicating agency is not bound by the party’s claimfor examination of evidence because it is the agency that decides whether to accept the evidencepresented by the party or to reject it. The agency has to accept the party’s claim for examination ofevidence if the object of the evidence involves circumstances which are important to the case. Theobjective of the paper is to present a discussion concerning a party’s claim for examination of evidencein the context of the stipulations adopted in the doctrine as well as made in judicial decisions.

The todayʼs religious education is coming across a lot of problem. They result not only from character and contents of the religious transmission, but also from the social-cultural context. In the catechesis of young people addi-tional difficulty is the age of the recipients. Young people are critical of reli-gion, particularly if werenʼt supposed to observe the chance of compliance of behaviours and attitudes with propagated principles. Young people often judged unilaterally assigning its negative traits. Also an unconcern is being accused young people with religious sphere. Such evaluations are hurting for young people. Often their attitudes are a word of the opposition to adults which stopped being authority. In catechesis it is necessary to devote more concern to young and support the transmission of the message with the witness of faith. You must also re-convince them of the truth that is not determined in the way of human compromise and agreement, but comes from God. The religious for-mation of young people should be based on the values transmitted by word and behavior. Among the categories of education are truth and mercy. Taking them into account can considerably influence to religious attitudes of young people and including them in the circle of pupils of Jesus.

Te author depicts genesis of Te Catechetical Directory of the Catholic Church in Poland , which is created in accordance with guidelines from General Directory for Catechesis (1997). Aſter covering the editorial board and works on the document, he presents its structure and main topics. Te article emphasises the specifics of Polish catechistic reality and the reference to it included in DOK. Finally, it notices the role which Polish Directory played in Polish modern day catechesis.
Autor w artykule przedstawia genezę polskiego dyrektorium katechetycznego opracowanego zgodnie ze wskazaniami zawartymi w „Dyrektorium ogólnym o katechizacji” z roku 1997. Po przybliżeniu zespołu autorów dyrektorium i prac redakcyjnych nad dokumentem, omawia jego strukturę i zasadnicze treści. Podkreśla specyfikę rzeczywistości katechetycznej w Polsce i odniesienie do niej założeń zawartych w DOK. Na koniec określa rolę, jaką polskie dyrektorium odegrało we współczesnej polskiej katechezie.

Opis:
Requirements in the modern world are not popular – also on the basis of teaching. However, as Pope John Paul II often emphasized, one should demand from oneself even when others will not demand. These words should include catechists in their work. They are supposed to demand from students, remembering to be demanding towards themselves. Requirements cannot be detached from love. Only a kind teacher who is kind to the student carefully guides the development of the pupil. The issue of teaching requirements – including religious teaching – is important today because of the language of record of purposes. It focuses on knowledge and skills requirements. Catechists additionally in the latest program assumptions have indications regarding attitudes shaped in the catechetical process. Both in the parish and at school, the demanding catechist – from himself and from others – is a credible witness to the truths he proclaims.

Te article introduces the problem of teaching religion within the families that start homeschooling. Aſter a brief presentation of homeschooling and its legal basis, the author analyses the communicate of Te Catholic Upbringing Board, that contains regulations for teaching R.E. in extracurricular education. In addition she presents the results of a survey conducted among the parents of the children taught at home. Moreover, she forms the conclusions and recommendations for practical catechesis, much needed in a view of systematic increase in interest in homeschooling.
Artykuł przedstawia problematykę nauczania religii w rodzinach podejmujących nauczanie domowe dzieci. Po krótkim zaprezentowaniu zjawiska edukacji domowej i jej podstaw prawnych, autorka analizuje komunikat Komisji Wychowania Katolickiego regulujący kwestię nauczania religii w edukacji pozaszkolnej. Prezentuje także wyniki ankiety nt. formacji religijnej dzieci przeprowadzonej wśród rodziców realizujących nauczanie domowe, a także formułuje wnioski niezbędne dla praktyki katechetycznej, wobec wzrastającego zainteresowania rodzin edukacją domową.

The paper shows the issue of poetry as the important supporting remedy in faith education of children in age of 3 to 6. Poetical works being full of various artistic expressions correlate with briskly developing language of small children. Simultaneously assuming the form of rhymes, songs and other forms in an accessible way they present the truths of the faith and help adopt them. Apart from understandable and simple to master the plot, the poetry carries the moral message realizing the educative function in the process. Finally by being approaching or straight out imitating the baby talk, poetry gives ready forms to teacher, with the help of which child can turn to God. The poetry at the nursery school can enrich religious education with its essential elements – biblical, theological and existential. It is also an excellent remedy supporting the accomplishment of tasks of the catechesis: education, upbringing and acquainting, and with them to achieve its main purpose – the communion with Jesus.

The article is showing chosen concerning issues of catechetics in UKSW in the historical perspective. In the first part it is portraying academic teachers of the catechetical speciality. It is describing the ones which did catechetics in former years, as well as of today’s employees taking scientific reflection over the catechesis. Hereinafter the article is presenting the activity of academic teachersof catechetics in ATK and UKSW at foreign and national catechetical centres and institutions acting for the catechesis. A publishing activity is another introduced issue of catechetics, portraying the wealth of the thought and extensive interests of employees of the catechetical specialization in ATK and UKSW. In the next point was presented activity of scientific group of students of the catechetics. During his cyclical meetings pupils can develop scientifically under direction of academic teachers. Meetings also are helping with the forming of exceptional character of human relationships on the field of the catechetical specialization.
