    Opis:
    The author analyses the rules of reimbursement for medications contained in the Reimbursement Act of 12 May 2011, against the background of the regulations of the Health Act of 27 August 2004, in the context of the constitutional duty to provide citizens with equal access to health care services financed from public funds. He also discusses the dynamics of the performanceof the above duty as an example of actions of the legislature aimed to satisfy the provisions of art. 68.2 of Poland’s Constitution.
    Przedmiotem opracowania jest przedstawienie zasad dotyczących refundacji leków ustalonych w ustawie refundacyjnej z 12 maja 2011 r. na tle przepisów ustawy zdrowotnej z 27 sierpnia 2004 r. w kontekście konstytucyjnego obowiązku zapewniania obywatelom równego dostępu do świadczeń opieki zdrowotnej finansowanej ze środków publicznych. Pokazano w nim również dynamiczną realizację tego obowiązku jako przykład działania ustawodawcy prowadzącego do urzeczywistnienia zasady z art. 68 ust. 2 Konstytucji RP.

    Opis:
    The protection of individuals regarding to the processing of personal data is one of the fundamental rights. The General Data Protection Regulation (GDPR) lays down rules relating to the protection of natural persons with regard to the processing of personal data and rules relating to the free movement of personal data. Data concerning health is one of the areas the GDPR defines as special personal data, the so-called sensitive data. With regard to these data, the GDPR allows their processing only on an exceptional basis, in certain situations. According to Art. 6 sec. 1 let. e GDPR and art. 9 sec. 2 let. b GDPR, data processing is allowed, inter alia, when such processing is necessary for the purposes of meeting the obligations and exercising specific rights of the controller or of the data subject in the field of employment and social security and social protection law. In turn, Art. 9 sec. 2 let. h GDPR permits the processing of health data that is necessary for the purposes of providing health or social care or treatment, or for managing health or social care systems and services on the basis of European Union or Member State law. The article discusses the national legal regulations regarding the collection and processing of personal data concerning health in the light of the organization of the health care system and the tasks of the National Health Fund (NFZ) as a placeholder, whose task is only to manage financial resources and conclude health care contracts on its own behalf with independent healthcare providers and their accounting. Against the background of the GDPR, the author discusses the provisions of the acts on health care services financed from public funds and on the information system in health care. Finally, specific regulation regarding the COVID-19 pandemic are presented.

    Celem artykułu jest omówienie zagadnień związanych z roszczeniami płatnika o zwrot od ubezpieczonego obciążającej go części składki na ubezpieczenia społeczne i zdrowotne. W oparciu o dorobek judykatury i doktryny polskiej, niemieckiej i austriackiej autor przedstawia możliwości konstruowania przez płatnika roszczeń o zwrot zapłaconych z jego środków należności z tytułu składek na ubezpieczenia społeczne/zdrowotne w części, która powinna być sfinansowana ze środków ubezpieczonego, w przypadku późniejszego ustalenia, że ubezpieczony wykonujący pracę na postawie umowy cywilnoprawnej był zatrudniony na podstawie stosunku pracy lub że samozatrudnienie ubezpieczonego miało charakter pozorny.
    The aim of the article is to discuss the issues related to the payer's claims for the return of part of the contribution charged to an insured. Based on the achievements of the Polish, German and Austrian jurisprudence and doctrine it will be shown the possibilities of the payer's claims for reimbursement of social security contributions paid by the payer from his funds in the part that should be financed from the insured's funds in the cases of a posterior statement, that the insured person working under a civil law contract was employed on the basis of an labour employment relationship, or that the insured's selfemployment was of a bogus nature.

    The subject of the article is to present and analyze, from the Polish perspective, the proposals of the Council of the European Union regarding the directions of changes in social security regulations regarding the coverage (formal and effective) of platform workers to social protection, the possibility of preservation, accumulation or transferring rights and the adequacy of the level of protection (including the amount of benefits), in the context of the specific conditions related to the performance of platform work, as formulated in the Council Recommendation of 8 November 2019 on access to social protection for workers and the self-employed.
