Walerian Pańko, who originated from the Professor Andrzej Stelmachowski school of agricultural law as his first promoted doctor, developed an innovative concept of understanding ownership as a presumption of general competence to use and dispose of real property. In his work entitled O prawie własności i jego współczesnych funkcjach (Ownership Right and Its Contemporary Functions, Katowice 1984), he stated, that “[…] the crux of ownership right is most simply – and most fully – expressed as the idea of presumed competence”. In his monograph Dzierżawa gruntów rolnych (Agricultural Land Tenure, Warsaw 1975), W. Pańko discussed the problem of “proprietary” protection of the possessor within the context of tenure, stating openly that the process of expansion of possessory protection is an outcome of the crisis of ownership rights. Walerian Pańko has put forward a thesis of pivotal significance for the values protected by the law, that “the strength of ownership right lays in the sensation of real stability, certainty and continuity of law. In protecting the basic value of ownership right, we are not protecting egoistic monopoly, but rather the presumption of exclusivity of the owner”.

Opis:
The process of globalization in the production and distribution of food, ongoing for many years, causes a number of problems. Agreement on the Transatlantic Trade and Investment Partnership (TTIP), negotiated since 2013 by the US and the EU, is one of the instruments to manage of globalization process. The Agreement is aimed at liberalization of trade of goods and services. This article presents the US and the EU regulation on genetically modified food and assessment of the consequences of TTIP Agreement for the regulation of GM food in the EU. The analysis leads to the conclusion that the approach to genetically modified food in the legal regulations of the EU and the US vary significantly. In the US, it was assumed that GM food is not different from conventional food and, consequently, the consumer does not need to be informed on GM food contents. In opposition to the US approach the EU law separately regulates GM food and gives the consumer the ability to make choice of food which differs only by the usage of genetic engineering. Authors conclude, that the signing of TTIP and the full opening of the EU market for food from the US may result in loss of supervision over genetically modified food by EU public authorities as well as the collapse of the EU model of consumer protection based on the precautionary principle.
Postępujący od wielu lat proces globalizacji w produkcji i dystrybucji żywności wywołuje szereg problemów. Instrumentem służącym do zarządzania tym procesem jest w szczególności negocjowana od 2013 r. przez USA i UE umowa o Transatlantyckim Partnerstwie Handlowo-Inwestycyjnym (TTIP). Ma ona na celu wzajemną liberalizację handlu towarami i usługami. Celem artykułu jest przedstawienie amerykańskiej i unijnej regulacji dotyczącej żywności genetycznie zmodyfikowanej oraz ocena konsekwencji zawarcia porozumienia TTIP dla regulacji żywności GMO w UE. Analiza prowadzi do wniosku, że podejście do żywności genetycznie modyfikowanej w regulacji prawnej UE i USA jest zupełnie odmienne. W USA przyjęto założenie, iż żywność GMO nie różni się od żywności konwencjonalnej, a w konsekwencji konsument nie musi być informowany o żywności GMO. W przeciwieństwie do regulacji amerykańskiej prawo UE odrębnie reguluje żywność genetycznie zmodyfikowaną i daje konsumentowi możliwość dokonywania samodzielnego wyboru żywności różniącej się wyłącznie zastosowaniem inżynierii genetycznej. W konkluzji autorzy stwierdzają, iż zawarcie TTIP i pełne otwarcie rynku UE na żywność z USA może spowodować utratę nadzoru nad żywnością GMO przez władze publiczne w UE i załamanie unijnego modelu ochrony konsumenta opartego na zasadzie ostrożności.

Food law is currently starting to separate itself as a new branch of law. It is gaining autonomy owing to its particular object of regulation, that is food, which requires a special system of protection; therefore the ‚product-oriented’ nature of this law must be emphasized. Nowadays, the purpose of food law is to protect health and life of human beings (food safety), as well as economic interests of consumers, the wellbeing of farm animals, the health of plants and of the natural environment. Food law worldwide has been developing since ancient times, and in Poland - since the Middle Ages. Following Poland’s accession to the European Union, it has been to a large extent unified with the EU laws. Food law is an academically separate area, it is taught at law departments of universities, numerous Master’s or Ph.D.’s theses have been devoted to this subject, as well as a habilitation thesis. The development of food law is clearly destined toward codification, whose weakness would be to consolidate the current regulatory loopholes. All the more so, codification is not currently possible under national legislation.

Opis:
Ensuring food security, i.e. achieving the state of relative physical and economic availability of safe food, is becoming one of the most critical challenges of the present day, both on the scale of individual countries and the entire world. In this context, a closer look at the limitations and guidelines resulting from the Constitution of the Republic of Poland for the directions of creating the national food security policy become a topical issue. So far, no consideration has been given to the constitutional legal framework for such a policy in Polish literature. Based on the analysis carried out, it has been indicated what guidelines for such a policy result from the crucial food security principle of protecting family farms and other provisions of the Polish constitution.

Opis:
At present in Poland there exist many registers of business activities on the food market (their number varying depending on the adopted criterion of classification). Therefore, it is obvious that many problems of both practical and theoretical nature may be encountered in this regulatory area. For the purposes of the article an analysis of regulations of the registers was carried out. Selected key legal problems of these regulations were discussed, including the following aspects: classification of registers of food market business activities; conceptual problems related to the functioning of registers of operators, business activities, and establishments; the way of formulating registration obligations and exemptions from them; sanctions related to registration obligations and the scope and availability of information collected in the registers. Finally, de lege ferenda comments were offered as to developing of a single, central, electronic register of (agro)food market business activities (Agro-Food Register).

Regulations concerning products such as genetically modified foods, new food products or dietary supplements all have in common the one thing, namely: significant difficulties (if not impossibility) in describing the safety of their use once marketed. The EU legislator in each of these products has “created” a singular “legislative safety standard” – considering the absence of any reliable factual standard of safety. The domain of law and science touches both on substantive as well as procedural law; the latter can significantly serve to precise the level of risk connected with introducing a product on to the market and its monitoring. This absence of a reliable factual safety standard results from a serious gap in scientific knowledge or vague areas of the product qualification, which is a consequence of the defective law. In many instances it is impossible for the producer to cite the “development risk”. The legislative standard of safety, within which there is no identification of factual risk, nor even any attempt towards doing so – brings forth the question on the boundaries of legislative experimenting. Discretion in such situations may prove to be a legislator’s virtue, according to the old principle of primum non nocere.

The concept of agricultural property as proposed by A.Stelmachowski relies on the association of the original construction of property law with its specific object, i.e. the farmstead. According to this concept, agricultural property (specified in respect of the matter of ownership) is a complex of laws and obligations describing the legal standing of the subject – farm owner. The concept of agricultural property is an important element of the doctrinal accomplishment underlying the distinguishing of agricultural law as a new branch of legislation; it may also form – on the didactic level – an axis to organise the presentation of agricultural law institutions. Core ownership issues are obviously regulated by civil law. To describe the general features of property law, as a particular legal category, A.Stelmachowski indicates that property law 1) possesses the most comprehensive content as regards the relationship of the subject to the property attributed to him; 2) awards the owner exclusive right (a certain monopoly) as regards a specified object; 3) is characterized by a singular flexibility. All of these features can be referred to various kinds of ownership, regardless of its subject, including agricultural property. The originality of A. Stelmachowski’s approach to ownership arises from a proposed construction which is different to the classic, civil law model of ownership. This model has been inherited from Roman law (triad of ownership), which stressed the absolute rights of the owner. The owner had rights but no obligations towards the others, on the contrary, they are obligated to respect the rights of the owner. The protection of agricultural property is a continuation of the essential idea of the concept Author, and thus encompasses not only the substantive nature of agricultural law but property, that is a farmstead, itself. Important are both the subject and the scope (intensity) of protection. To protect the individual components civil regulations on property are applied, and to protect the farm, it is necessary to restrict the right to dispose of its components at will. When considering the subject of protection, one should take note of two elements: 1) what goods in various historical periods effected protection of the property law, and equally 2) whose interests were taken into account when awarding the protection, in other words, this will be a query regarding the function of property law. The interest (function) which brought about protection of agricultural property in the legal order currently in place in Poland could be described as execution by farmstead proprietors of European Union legislation on the use of agricultural holdings. Similarly as in the period of socialist economy in agriculture, the legal measures are rooted in a model of farming administration developed outside Poland, and introduced here.

Professor Andrzej Stelmachowski (1925-2009) is an outstanding person, deserving huge appreciation because of his activity in various fields; as a lawyer, a prominent specialist in civil law, commercial law, family law, who played a remarkable role in the development of agricultural law. He is the creator of a new school of Polish agricultural law, as he elaborated by his scientific achievements, a theoretical basis to distinguish (in the area of doctrine and didactics) agricultural law as a separate branch of law; he has proposed an original method of research – the study of law in the process of its application, and around these ideas he organized research teams – a large group of students at such universities as: Wroclaw, Warsaw and Bialystok (Professor has promoted 23 PhDs of law). Another merit of Professor Stelmachowski was to determine the object and scope of agricultural law, the fundamental structures of agricultural law (the concept of agricultural property), as well as the legal solutions for protection of individual farming. The recognition and respect for the position of Professor at the international level are demonstrated by His numerous professional contacts and honorary doctorates that he was awarded with. The Professor was the first Polish scholar in the CEDR (the European Committee for Agricultural Law), as well as the first President of the Polish Association of Lawyers specialized in Agricultural Law. The concept of teaching elaborated by Professor A. Stelmachowski was reflected in the subsequent editions of academic books in the field of agricultural law, issued under his scientific edit in the period 1970-2008. In all areas of his involvement, despite changes in the external environment, Professor A. Stelmachowski always presented a permanent system of values, among which we should mention: rightness, fidelity to convictions and responsibility, concern for the common good, solidarity with the weak and being guided by the social doctrine of the Church, all of which gave him an unquestionable moral authority as a Person of great strength of character.

The demand for, characterized by the special quality, organic products causes ongoing development the organic food market in highly developed countries. Both in the EU and the USA has been issued legal acts on the production and distribution of organic products. On the basis of an agreement between the USA and EU systems for organic production are recognized as equivalent to each other, which means that organic food manufactured and labeled in the US and the EU can be distributed as organic, without any additional requirements respectively in the EU and the USA. In the article authors compared the EU and US regulations concerning organic food, including proposed a definition of organic food that has not been explicitly defined in EU nor USA legislation. Comparison of the two legal systems leads to the conclusion that the concept of organic food is similar in the EU and the USA, however the American regulation is more flexible and much stronger is focused on protecting the interests of entrepreneurs and farmers (and not solely to protection the interests of consumers, as is in the regulation of the EU). In both systems public aid is applied, however in the EU legislation the main aim of support is the improvement of the environment. The authors conclude that the aim of the public support should be primarily to increase the competitiveness of EU production of organic food.
