    THE CATEGORIES OF “AUTHORSHIP” AND “THE WORK” IN THE DRAFT FOR THE EUROPEAN COPYRIGHT CODESummaryEconomic and technological factors have brought radical changes to the legal framework of authors’ copyright protection on both the national and international levels. Despite twenty years of directives and ECJ case law, the copyright system in the European Union is still fragmented and ill-adapted. This paper provides an insight into the Wittem Group’s European Copyright Code, established in 2002, the first draft European copyright codification. The aim of the Wittem Copyright Code is to increase the overall protection of authors and to provide a new, holistic approach to copyright. The paper presents useful clarification of the meaning of specific provisions in the European Copyright Code, and particularly of the concepts of “The Work” and “Authorship”.

    Strategies of protection and identification of intangible cultural heritage: actions taken within national cultural policies and the involvement of local communitiesThe UNESCO Convention for the Safeguarding of Intangible Cultural Heritage of 2003 has established a new, holistic approach to cultural heritage and a new set of administrative and legal instruments and strategies of identifying, preserving, managing and promoting intangible cultural heritage. The policy of intangible culture entails the conceptualisation of the elements of intangible heritage in the national cultural policy framework. Administration strategies and methods are often confronted with scientific contextualisation and various policies of representation and identification. Thus, while articulating the idea of the growing importance of intangible cultural heritage, national authorities increasingly construct national inventories through processes of worldwide networking and positioning through symbolic meanings such as “national issues” and “national culture”. The paper presents a brief review of administrative and legal measures and policies concerning the intangible cultural heritage of selected countries with a special emphasis on the community-based approach in the identification and safeguarding processes.

    Opis:
    The doctrine of droit moral, one of the most controversial issues in copyright law, has always been considered a matter where a wider international consensus is impossible due to the traditional dichotomy between common law philosophies and authors’ rights available in continental civil law systems. However, one of the most noteworthy developments in international copyright law over the past twenty years has been the adoption of statutory protection of moral rights regimes in a number of countries representing the common law tradition. The purpose of this study is to demonstrate that concepts of moral rights in continental law states also differ in structure and provide different means of protection. The article explains the content and characteristics of moral rights, and assesses the most important aspects of French and German national legislations in this area.  
    Konstrukcja dóbr osobistych twórców jest jednym z najbardziej kontrowersyjnych zagadnień prawa autorskiego, w odniesieniu do którego wprowadzenie jednolitych norm międzynarodowych jest utrudnione, przez wzgląd na tradycyjny podział na państwa tradycji copyright oraz kontynentalne regulacje autorskoprawne. Jakkolwiek, zauważalne jest dążenie do zbliżenia systemów prawnych, m.in. przez wprowadzenie do porządków krajów common law prerogatyw osobistych twórców. Należy jednak podkreślić, że mimo przyjęcia na gruncie ustaw państw kontynentalnych praw osobistych twórców, ich struktura i katalog środków ochrony są wielce zróżnicowane. W artykule została omówiona sytuacja prawnoosobista twórców w porządku prawnym Francji oraz Republiki Federalnej Niemiec. Zasadniczym celem artykułu jest analiza i porównanie konstrukcji i przedmiotu wybranych uprawnień autorskich zawartych w regulacjach krajowych wskazanych państw, jak również wykazanie istnienia wspólnych instytucji jurydycznych, dotyczących autorskich dóbr niematerialnych w poszczególnych reżimach z uwzględnieniem linii wypowiedzi orzecznictwa.

    Opis:
    Legal Protection of Intangible Cultural Heritage on the example of the Expressions of Folklore The complexity of forms and structures of traditional heritage makes it difficult to create effective tools of legal protection on different levels: national, regional and international. The emergence of the  theoretical concept of safeguarding all aspects of heritage, gave also rise to the question whether such a protection is needed and what kind of legal instruments and measures would be appropriate. At the international level, the foremost initiative is the WIPO Model Provisions for National Laws on the Protection of Expressions of Folklore Against Illicit Exploitation and other Forms of Prejudicial Action and UNESCO Convention on the Safeguarding of the Intangible Cultural Heritage, which not only offers the most sophisticated legal definition of intangible cultural heritage and folklore expressions, but also creates a listing mechanism aimed at drawing attention to intangible culture and the need for its safeguarding. Such an analysis would help answer questions whether legal protection is required and would be sufficient; what, if any, are the appropriate analogies in existing law; and whether a sui generis scheme should be developed.
