Opis:: Niniejsze opracowanie stanowi próbę odpowiedzi na pytanie o charakter, pozycję i znaczenie procedury budżetu obywatelskiego w kontekście zasad określających ustrój jednostek samorządu terytorialnego w Polsce. Czy procedura budżetu obywatelskiego stanowi szczególny rodzaj konsultacji społecznych, czy też powinna zostać ujęta, jako specyficzny rodzaj referendom lokalnego, w przepisach odnoszących się bezpośrednio do tej formy demokracji bezpośredniej? Konkluzją opracowania jest stwierdzenie, że budżet obywatelski, który wykazuje cechy rozstrzygnięć o charakterze referendalnym, powinien znaleźć się docelowo w katalogu narzędzi przewidzianych Ustawą o referendum lokalnym oczywiście przy uwzględnieniu jego specyficznego charakteru. Za takim umiejscowieniem budżetu obywatelskiego przemawia przede wszystkim wiążący dla jednostek samorządu terytorialnego rezultat głosowania mieszkańców.
This study is an attempt to answer the question about the character and position and the importance of the civic budget procedure in the context of the principles defining the system of local government units in Poland. Is the civic budget procedure a special kind of public consultation or should it be included, as a specific kind of local referenda, in the regulations relating directly to this form of direct democracy? The conclusion of the study is that the civic budget, which shows the features of referendum decisions, should ultimately bein the catalog of tools provided for in the Local Referendum Act - of course taking into account its specific nature. This placement of the civic budget is supported primarily by the result of voting by the inhabitants, binding on local government units.

Opis:: Civic participation is a term used to describe the participation of the citizens in makingand realizing decisions by the public government and administration. Civic participationcan take many forms, which in theory include different degrees of citizens’ engagementin decision making: informing, consulting, co-deciding. The catalogue of participationtechniques includes, based on the example of Krakow, many ways of civic participation, e.g.:local referendum, civic budget and participatory planning and designing. The examples ofparticipatory activities in the city of Krakow listed in this article exemplify serious problemswith the effective realization of this form of governing. It is especially important in the contextof the emerging postulates of replacing the traditional model of finances management ofa territorial self government unit with a mechanism based on the civic participation anddirect democracy. The idea in which the municipality budget is constructed by the way ofdemocratic discussion, in which every citizen can decide on what part of the public money isspent, belongs to the sphere of the impossible to realize utopia.Key words: civic participation, civic budget, Krakow self-government

Opis:: Districts of the city of Krakow, in addition to decision-making powers related to the implementation of the statutory tasks, have the ability to give opinions and come up with proposals on important issues affecting local communities they represent. Districts are trying to influence the shape of both the urban and commercial investments and impact the city’s policy on spa-tial planning. Municipality support units in their activities support the demands of residents and often participate in social protest movements. The most glaring example of the promotion of social protest movements by the auxiliary units of the municipality is the attitude of districts authorities to protests of residents known as NIMBY (Not In My Back Yard), i.e. the social protest of people who express their opposition to certain investments made in their immediate neighborhood, although they do not deny that they are needed at all.

Opis:: Local governments of Krakow created the system of financing commune operations of auxiliary units. No other local government has not decided to transfer so many powers and financial resources to your districts or the settlements. Districts progressively have won competences from financial resources for administrative service of their offices up to the tasks entrusted to the expanded program. One of the main factors which influenced the delegation of tasks and competences of districts was to use social potential in such entities.
