    Opis:
    In the proposed draft position the author claims that the contested article of the Act – Geological and Mining Law is compatible with Article 45 para. 1 of the Constitution. The decision approving the concession for the extraction of minerals from the deposit is related to environmental decision - the arrangements on the environment protection and environmental impact of the project, contained in the environmental decision are binding on the entity awarding concessions. Environmental decision are subject to oversight both the appellate and court proceedings. The author argues that the instruments provided for by the legislature ensure protection of the interests of owners of property adjacent to that on which projects negatively affecting the environment (including neighbourhood) are carried out.

    Opis:
    The article contains a draft position of the Sejm relating to the application submitted by a group of Deputies to the Constitutional Tribunal in which they contested some provisions of the Act – Electoral Law adopted on 5 January 2011, and the act amending it. The purpose of the application is declaration of conformity with the Constitution of several dozen provisions of both the legal acts. An analysis of justification of the position of the Sejm focuses above all on the new instruments of electoral law that were absent or reduced in Polish law. They include inter alia: a two-day vote, a proxy vote, correspondence vote, single-seat constituencies in elections to the Senate, as well as bans on the use of large-format election posters and slogans as well as paid election radio and TV ads. Based on detailed analysis, the authors claim that none of the solutions proposed in the new Electoral Code infringes the constitutional standards.

    This draft position of the Sejm concerns the motion filed by the Council of the Municipality of Kobylnica on 6th October 2015. In the proposed draft position the author claims that the contested Article 129b para. 2 subpara. 1 of the Law on Road Traffic, insofar as it does not confer the power to control the road traffic using the recording devices to municipal (or city) guard, is in compliance with the Constitution. In the remaining scope of the motion the proceedings should be discontinued pursuant to the Article 40 para. 1 subpara. 1 of the Act of 22th July 2016 on the Constitutional Tribunal due to the inadmissibility of the judgment.

    The opinion presents Sejm’s draft position in the proceedings before the Constitutional Tribunal concerning constitutionality of the procedure for the creation of common and military courts (Ref. No. K 27/12). A group of Deputies and the National Council of the Judiciary, initiating the proceedings, challenged the transfer to create and dissolve common and military courts to – respectively – the Minister of Justice and Minister of National Defence. In the Sejm’s view, the procedure for creation common courts does not infringe constitutional standards, but the provision authorising the creation of military courts does not comply with the Constitution due to the lack of necessary guidelines.

    The presented opinion illustrates the Sejm’s position on the application lodged to the Constitutional Tribunal by the First President of the Supreme Court for an adjudication upon the conformity of the Act of 22nd December 2011 on Amendment of Certain Acts Related to the Implementation of the Budget Act (reference symbol of files K 1/12) to the Constitution. Sponsor deems the regulations retaining in 2012 the levels of judicial remunerations from previous year inconsistent with article 2, article 31(3), article 64(1–2), article 88(1–2), article 216(5), article 219(1–2), article 220(1) and article 221 of the Constitution. Sejm has rejected the sponsor’s claims, concluding that the contested regulations shall be deemed consistent with the Constitution.

    In the Sejm’s position on the Leszno City Council’s motion, it has been stated that article 40 para. 3 3 of the Act on Communal Self-government is consistent with the Constitution to the extent in which it allows the issuance of provisions for the maintenance of order only within the scope not regulated in separate acts or other generally binding regulations. The City Council filed the motion in connection with doubts as to whether it is permissible to establish by the council of the commune, by means of issuing provisions for the maintenance of order, a ban on selling psychoactive substances known as boosters. In the Sejm’s opinion, the matter covered by these provisions for the maintenance of order has been regulated by separate acts of law and therefore it is not possible to regulate this matter differently by local law.

    The request of a group of Deputies concerned the assessment of the constitutionality of the provisions of the act, according to which the termination of pregnancy may be performed by a doctor in the event when prenatal tests or other medical conditions indicate a high probability of severe and irreversible fetal impairment or an incurable life-threatening disease; in this case, termination of pregnancy is permissible until the moment of fetus becoming able to live independently outside of the pregnant woman’s body. In the position of the Sejm, it was requested that this provision be declared inconsistent with Article 38 of the Constitution in connection with the principle of specificity of legal provisions, derived from Article 2, Article 30, Article 31 para 3 and Article 32 para 1 of the Constitution.

    The provisions reviewed by the Constitutional Tribunal concern the location of wind farms in Poland. The applications of a group of Deputies contained concerns regarding, inter alia, the distance between wind turbines and residential buildings, as well as the impact of these facilities on natural environment. According to opinion, the location of the power plant only on the basis of a spatial development plan does conform to the Constitution. Before the act came into force, the construction of a wind farm could also take place in an area uncovered by the spatial development plan. On the other hand, provisions regarding cancellation of initiated or unfinished proceedings regarding a decision on development conditions relating conform to the Constitution.

    Opis:
    On the basis of the Act on the Amendment of Certain acts in Relation to the Strengthening of Landscape Protection Tools, a new type of planning act in the sphere of spatial planning and development was introduced into the Polish legal system. It is a resolution of a municipal council on the principles and conditions of location of small architectural objects, advertising boards and advertising equipment. Municipalities were given the right to influence the landscape aesthetics and ensure spatial order. Providing a retrospective effect of an “advertising resolution” in the matter of advertising panels, which were placed before its entry into force, was a deliberate decision of the legislator. The decision on the question of possible protection of acquired rights of entities that placed advertising facilities prior to the entry into force of the advertising resolution lies within the competence of the Constitutional Tribunal, not of administrative courts.
