    The article describes the most significant factors of the German identityconstructing process after the World War II comparing it to the same process in the European Union. It focuses above all on the official documents and acts concerning common identity and also asks a question if the process of embedding them in the European law legacy does constitute a tradition characteristic for European Union and forms its own part of its supranational identity. Finally it contains an attempt to answer the question about the future of both German and European identity.

    Opis:
    Germany is an example of a country which has been implementing transitional justice for decades and is still active in this field. What is more, contemporary Germans have recently come to terms with their not-so-distant past and their negligence in this area by showing the falsehood, backwardness, and injustice as negative foundations of the young Federal Republic. This article evokes the person of Fritz Bauer, the prosecutor in the state of Hessen. His struggle for human dignity and the memory of his achievements after his death exemplify an accomplished case of transitional justice and the memory of it. During his lifetime he contributed to bringing to trial numerous Nazi criminals, even at the cost of habitual threats and disregard. Forgotten for a few decades, Bauer and his legacy have been recently rediscovered and studied. Eventually, Bauer became a movie character and was finally brought back to the collective memory of Germans. The belated, but a well-deserved wave of popularity of Fritz Bauer in the German culture memory proves that reflections on the transitional justice are still topical and important.

    „Ostatni niemiecki jeniec wojenny“, „kość niezgody“, „ostatni nierozwiązany spór polsko-niemiecki“, „sztuka zabrana Niemcom jako łup“. Skarbom Pruskiej Biblioteki Państwowej, które od czasów zakończenia II wojny światowej są przechowywane w kilku polskich bibliotekach, przede wszystkim w Krakowie, nadano rozmaite epitety, spośród których większość odwołuje siȩ do terminologii wojennej albo jest wysoce afektywna. Znaczenie ,Berlinki’ dla kulturowego dziedzictwa Europy, jak i jej długa i skomplikowana historia pozwalają jednak na sięgniecie po znacznie łagodniejszy i nowocześniejszy termin: cenne książki są bowiem wyjątkowym polsko-niemieckim miejscem pamięci.
    „The last German POW“, „bone of contention“, „the last unresolved dispute between Germany and Poland“, „looted art“. The treasures of the former Prussian State Library, which since the end of the Second World War have been kept in some Polish libraries, mainly in Krakow, have often been described in a belligerent or highly emotive way. The significance of the Berlinka for European cultural heritage enables us to use a much subtler and more modern term: the precious works are a unique German-Polish memory space.
    „Der letzte deutsche Kriegsgefangene“, „ein Zankapfel“, „der letzte ungelöste deutsch-polnische Streit“, „Beutekunst“. Den Schätzen der Preußischen Staatsbibliothek, die seit Kriegsende in mehreren polnischen Bibliotheken, allen voran in Krakau, aufbewahrt werden, wurden verschiedene Bezeichnungen verliehen, die meisten von ihnen durch kriegerische oder affektgeladene Termini geprägt. Die Bedeutung der ,Berlinka‘ für das kulturelle Erbe Europas sowie ihre lange und verwobene Geschichte erlauben es jedoch, einen viel moderateren und moderneren Terminus zu verwenden: Die kostbaren Bücher sind nämlich ein besonderer deutsch-polnischer Erinnerungsort.
