The investigatory procedure carried out by an administrative organ during administrative proceedings is indispensable. There is no doubt that “lex specialis”, in several cases, tend to detail this process, however, it needs a “lex generalis” act which will regulated principally all the important elements of the investigatory procedure. The Code of Administrative Procedure is an act, which naturally poses its problematic, however it is very important for prescribing such institute of administrative proceedings. Due to such significance, the analysis of judicial means being available to an organ of public administration for evaluating complexly the totality of facts and proofs and certainly for identifying present problems, is the central pillar of this report.

Opis:
At the core of preventing and managing conflicts of interest are a set of principles that underlie the functioning of a democratic state and service of its citizens. Thus, principles such as transparency and impartiality in decision-making, the integrity of officials and keeping in mind the best interest of potential public during the decision-making, public confidence and increase his confidence in the government, form the basis of identifying policies and management of conflicts of interess or civil servants. Albanian law to prevent conflicts of interest is a law in its entirety, permeated by a spirit of somewhat stringent restrictions on civil servants. Such limitations have been given as the need to secure a decision as fair and impartial in the public interest, and the current state of the low level of public trust and confidence in the integrity of government institutions. The policy followed for identifying and managing conflicts of interest can be analyzed by doing, at first, a distinction between direct action policies in the field of conflict of interest (which are intended to prevent potential situations of conflict of interest through the specific regulatory provisions as laws and regulations) - and indirect action policies (aimed at preventing these situations by organizing public administration reform). In the context of direct action policies should distinguish between: cases in which the legislator has aimed to identify the ex - ante (before that happens) situations which could lead to conflicts of interest and cases or decisions designed to determine the important rules and non-specific prevention clause requiring verification on a case by case ex - post (as is) in order to decide whether an individual case is inconsistent with the general framework legislative described above (ie the ex-ante). Indirect action policies intended to prevent situations of conflict of interest by reforming the organizational structure of Public Administration and designed to create favorable conditions to prevent civil servants, recruited by the political institutions “to invade” the area in which administrative discretion is exercised.

The aim of this study:This study aims to pick up the transparence and the efficence in the managmnet of human resource, through the presantion of the state of the Law “ For the civil service” in the Republic of Albania and especially in the administration of the local government, recommending some ways to go on in this field, that will be the basis for the good progress in the local goverment. Methodology: Five municipalities were chosen to realise this study. Concretely, they are Vlore, Berat, Durres, Shkoder and Elbasan, where the study visists were applied and then the interviewing of the white collars through questions. Two forms of questionnaires were prepaired. The first one for the white collars of differnt levels and the second is for the responsabile administrators for the human resource. Results:This study will introduce efficence in the managment of human resource in the chosen municipalities, through elaboration, analisys and the interpretion of the information, seeing the civil service in the point of view of the white collars themselves of the different levels and from the point of view of the responsible authority for the human resource. Also in the study will be combined the analysis of the result based on the identified causes with the actual legislation for the civil service in Albania. The conclusion:Through this study will be aimed to be realised a reflection of the reality state of the managment of human resource and will become possible the awareness of the responsible authority for the human resource, in order to follow on wards the best selection of specialists according to the job describtion and of the civil employment service and their qualification based on the legislation of the civil service and also provision of continuous protection , wheterver the political changes may be. Let this study be an incitement to evaluate more the white collar, the way of his selection according to the law of “Civil Services in the Albanian Republic” and also the implementation of this law in order to consolidate the public administration at local level.

Setting up public administration which operates effectively and taking over responsibilities, both crucial on the point of view of the democracy indicators, requires great effort from all social stake holders in setting up and maintaining a public service organization. This notion implies the setting in function of the instruments and procedures that prevent undesirable behavior and provide encouragement of good behavior among operators of those services. While doing this, communication as a main component of the public service, calls for structure and control. Ethics or standards of behavior in the public sector are important political and public issues for every country, which is always held as a fundamental prerequisite for “good behavior” (good governance). The Code of ethics by which are expressed the values and standards in the civil service is one of the ethical elements of infrastructure. It enhances the function of orientation (giving instructions for action and behavior), and aims: respect for the law, respect for individuals, personal and professional integrity and efficiency in managing public resources, reinforcing the role and importance that the communication strategies and tools have. Professional association helps to develop judgment and of the necessary skills to enable white collar workers to apply communication strategy and tools and ethical principles in real circumstances. Objective progress can help create an environment where the white collar workers are willing to face and resolve communication problems and ethical disputes, they can even develop essential skills for effective communication and ethical analysis. The mechanisms of awareness about mission and processes of the public service, orientation and internal consulting in the civil service should be available to help white collar workers to apply basic communication and ethical standards in the workplace. Improvements in the legal framework is necessary for the proper functioning of public service, namely: to gain and maintain public confidence.
