The powers of the chairman of the communal council, as provided for in Article 21a, are clearly defined in terms of subjective and objective matter. The author claims that there are no legal obstacles for a Deputy to incidentally fulfill his duties out-of-parliament by using, for this purpose, vehicles such as a bus. However, that sort of activity hast to stay within the limits of exercising a parliamentary mandate and, thus, stay within the scope of functioning of a Deputy’s office. As the Marshal’s of the Sejm Order No. 8 states, an enumeration of probable expenses which may be covered in lump sum to cover costs related to the functioning of a Deputy’s office, is only of an exemplary character. Such sort of costs might be covered from the above-mentioned source only when they concern “Deputy’s transport”. The author underlines that a Deputy does not have an obligation to use a bus which is a property of Deputy’s office. The Deputy may also use a vehicle provided for use by volunteers or by a non-governmental organization. That kind of activity ought to stay within limits of exercising of the mandate of a Deputy and ought not to be used for the purposes of sponsorship.

The Sejm, as a body of legislative power, is not a public administration body within the meaning of the Code of Administrative Procedure. Thus there is no obligation to apply the provisions of this act. The Sejm committees, which are internal organs of the chamber, also have no obligation to do so. They cannot be a party to proceedings before an administrative court. The Code of Administrative Procedure provides for the possibility of referring a complaint to the Sejm or its internal body (committee), but there are no legal provisions regulating the procedure of examining complaints against state authorities other than executive organs.

Opis:
Article 184 para. 1 of the Standing Orders of the Sejm obligates the Marshal of the Sejm to give the floor regardless of the orders of the day for the sitting or in respect of the debate to claim rectification. Only the Deputies to the Sejm are entitled to make rectifications. Rectifications can only refer to “statements that has been misunderstood or imprecisely quoted,” and notice of intention to use the remedy of rectification under this procedure is a direct response to the statement of another Deputy or any other participant in the sitting of the Sejm. For assessing the admissibility of rectification request it does not matter whether the author of the rectified statements directly mentioned the specific individuals whose statements he/she quotes giving their names. Presented rectification is not subject to debate or vote. A rectification should take the form of indicative sentence. In a situation where the Deputy’s statement does not satisfy the requirements relating to rectification, the Marshal of the Sejm has the right, and even the obligation, to reproach the Deputy, and to discontinue his/her speech.

A Deputy who enters into the mandate contracts or service contracts with natural persons using the financial resources designated for funding of a parliamentary office is not an entrepreneur within the meaning of the Act on Freedom of Economic Activity or legally established “other organizational unit”. This opinion aims to present legal status of spouses of the President of the Republic of Poland, the Prime Minister and an ambassador. Legal situation of a spouse of the President of the Republic of Poland is not legally regulated. Although there is no formal prohibition of his/her professional activity, there is an accepted practice that the spouse performs only representative functions “by the President’s side”. This activity is not remunerated and, thus there is no deduction of pension contributions. Under separate regulations spouses are entitled to benefits and health care. A similar situation occurs in the case of a spouses of the Prime Minister, but in practice they do not perform representative functions, but continue their professional activity. A different situation takes place in case of a husband/wife of an ambassador, because their legal status is governed by the Act of 27th July 2001 on the Foreign Service.

In the opinion of the author of the opinion, a communal council may include in a communal statutes issues related to interpellations and questions submitted by councillors. The provisions of the statutes in this respect may not repeat or modify the provisions of the Act on Communal Self-government, in particular the statutes of the commune may not provide for any other form of submission of these documents than a written one. There are no legal obstacles to including in the agenda of a session of the communal council an item concerning the information on the number of submitted interpellations and questions by councillors, their contents and the answers given to them.

According to the author, the bill raises constitutional doubts. In her opinion, the proposed obligation to order a referendum by the Sejm in the event of submitting 200,000 signatures of citizens under the motion is incompatible with the Constitution. The proposal to establish a Referendum Day is also problematic. Issues resolved during such a mandatory referendum may become obsolete before a vote takes place. The provisions concerning the Referendum Day limit the constitutional powers of the Sejm.

The author indicates that according to the provisions of the Act on the Exercise of the Mandate of a Deputy or Senator, only Deputies and Senators may form parliamentary groupings. The opinion shows that, specifying the range of entities that can participate in closed committee meetings, the Standing Orders of the Sejm expressly states that such meetings may be attended by Deputies who are not members of that committee and the persons whose participation the committee deems indispensable. There is no legal basis for the admissibility of participation of MEPs in closed meetings of Sejm committees that involve classified information. The author of the opinion notes that the possible attendance of a Member of the European Parliament at such a meeting would implicate the recognition by the Commission of their attendance “as indispensable” and the requirement to present of an appropriate security clearance.

The opinion indicates that from the literal wording of Article. 1 and 2 of the Act on the Social Dialogue Council one may, prima facie, conclude that the procedure of giving opinion by the Council is to be applied to all the bills and drafts of other law enactments whose scope of regulation contains the issues referred to in Article. 1. However, on the basis of these provisions of the Act, it is not possible to precisely define which bills and drafts are subject to opinion-giving procedure. According to the author, government bill – irrespective of the referral for an opinion to employers’ organizations and trade union organizations – must be submitted for opinion to the Social Dialogue Council.

The opinion provides an assessment of the legal acceptability of limiting the form of submission of interpellation and Deputies’ questions to the format an electronic document. The analysis of Article 193 (2) of the Standing Orders of the Sejm currently precludes such a possibility, as both interpellations and Deputies’ Questions must meet the formal requirements that include, inter alia, the need to be in writing. The Standing Orders of the Sejm do not contain a legal definition of the phrase “in writing”. From literal interpretation it follows that it is a paper document, signed in person by its author. The inability to accept that the meaning of the written form can also include the form of electronic document is proved by an absolute requirement to append two copies to an answer to a Deputies’ question. The imposition of an obligation for interpellations and Deputies’ question to be submitted in the form of an electronic document therefore requires amendment of Article 193 (1) and (2) of the Standing Orders of the Sejm.

The opinion deals with the participation of a Deputy to the Sejm in a recruitment interview in the capacity of observer. The author address the issue in the context of an informal activity of a Deputy and claims that his/her attendance during a recruitment interview could only be admissible with consent of those participating in the interview. She also examines the issue of exclusion of public nature of particular information during such interview, stating that an attendance of a Deputy is inadmissible when such information is protected by secrecy under the provisions resulting from statutes other than the Act on the Protection of Classified Information.

In the author’s view, active participation in the voting of Members staying outside the Sejm, both at plenary sittings and during the voting taking place at the meetings of Sejm committees, is impossible. The Act on the Exercise of the Mandate of a Deputy or Senator imposes on MPs an obligation to actively participate in the work of the Sejm and the implementation of this obligation requires their attendance at the place of such work.

Joint committee meetings are a form of cooperation between two separate bodies of the Sejm. In accordance with Article 163 Paragraph 1 of the Standing Orders of the Sejm of the Republic of Poland, the joint meetings are chaired by one of the chairmen of committees. If a consensus on the issues of determining the guest list and indicating a chairperson cannot be reached, the Rules of Parliamentary procedure contain points preventing the effective block of the work of parliamentary committees.
