Opis:
In the Act of 7 January 1993 on family planning, human embryo protection and condi- tions of permissibility of abortion, in a solemn preamble preceding the text we read that life is a fundamental good of man, and that concern for the life and health is one of the fundamental obligations of the state, society and citizen. In the provision of Article 1 of the Act we notice a statement that the right to life, including its prenatal stage is protect- ed within the limits laid down in the Act. It can therefore be argued that, on the basis of applicable law, right to life of nasciturus is not absolute, and therefore in the conditions referred to in the Act there is a possibility to have an abortion. All the conditions for law- ful termination of pregnancy are the subject of numerous comments and analyses. For some, They are an example of restrictiveness of the Polish anti-abortion law, for others - on the contrary - they are the reason for the criticism indicating that the legislator does not sufficiently protect an unborn life.

The opinion discusses the compatibility of the government bill with the Directive 2011/24/EU of the European Parliament and of the Council, pointing out in particular the need to remove from the project and clarify the vague concepts of questionable issues. The author shows that the bill imposes numerous restrictions on patients, related both to the need to obtain prior authorization of healthcare and spending limits for a given year, as well as the constraints of a formal nature that may hinder the patients from using cross‑border healthcare serivces. In conclusion, it she notes that the objective to reduce the proportion of patients who wait for treatment would not be achieved.

Opis:
The article presents the current model of out-of-court compensation for medical damages. In particular, the aim of the publication is to analyze the legal nature of proceedings before the Provincial Committees for the Ruling of Medical Events, which are to determine the existence of a medical event. Originally, the entity responsible for medical events was to be primarily the insurer. As a result of the legislative changes which led to the abolition of the insurance obligation, the entity responsible in the procedure before the Commission became de facto hospital. The author describes the subject of the commission procedure and then confronts it with the subject of compensation proceedings before the civil court. She also considers the nature of the proceedings before the Commission in comparison with the mediation proceeding. Against this background, she formulates de lege ferenda postulates which, without pretending to propose final legal solutions, are intended to provoke a discussion on possible ways of repairing the described model.

Opis:
The legal status of a patient’s partner in Polish medical law is determined by entitle- ments granted to “real guardian” and to “close person”. The items are not unambigu- ously defined in art. 3, section 2, points 1 and 2, of the Patient’s Rights and Patient’s Rights Ombudsman Act. In the author’s opinion based on the act, the patient’s partner might be recognized as the guardian and/or close person. The guardian’s rights are limited to express a substitute permission for basic examination, whereas the close per- son has the right to decide on medical intervention if the situation requires. The access to medical records is restricted only to the people authorized by the patient.

The purpose of the article is to present and analyze the method of compensation for a special type of medical damage – neurological perinatal damage – which arises in connection with childbirth and is neuropathological in nature. This damage is irreversible and the cost of medical care, which sometimes continues throughout the child’s entire life, is very high. Claims involving this type of damage generate the highest compensation amounts, which means, from the liability insurance point of view, that it is a “hard-to-insure” injury. This is true for both the Polish and US liability systems, even though they are legal orders apart. What we are dealing here is, on the one hand, the need to support the family of the injured child, so that, thanks to the money obtained, they can begin their treatment and rehabilitation as soon as possible, and on the other hand, the need to take into account the interests of gynecologists and obstetricians, so that their occupations do not become deficit occupations. The idea is to increase the sense of legal security for these socially important medical professions. Given the above, attempts to seek an alternative to the judicial model of liability as a means of compensating this type of medical damage should come as no surprise. An example of an alternative liability model is the legislation enacted in two US states: Virginia and Florida (so-called “slice” no-fault liability models). These models, in effect for more than 35 years, are described in the first part of the article. In the second part, the author compares them with the main principles of the Polish judicial model of liability and the extrajudicial model, which, due to recent amendments to the law have undergone a major transformation. Then (due to the comprehensiveness of the subject matter), using the example of selected representative court cases, the author analyses the types of compensation claims and the amounts of benefits awarded in cases of perinatal neurological damage. The discussion ends with conclusions comparing the US and Polish models.

Polish Patient Ombudsman (PPO) was established to protect individual and collective patients’ rights. Contrary to original plans, it was established as an organ of central government administration. Therefore, the name may be confusing, as it suggests that PPO belongs to the group of entities similar to traditional ombudsmen. In fact, it implements government policy. This lack of independence is associated with the necessity of giving PPO the power to impose penalties for breach of the so called “collective patients’ rights”. Accordingly, PPO can be considered as a kind of “subtype” of the Ombudsman only from the perspective of competencies in relation to violation of the individual patient’s rights. The article analyzes the origins of the Patient Ombudsman institution in Poland, its place in Polish polity and its legal prerogatives in comparison to other bodies that offer protection of patient’s rights. The authors analyze in detail the competence of the Patient Ombudsman in case of violation of individual and collective patients’ rights.

This commentary evaluates the problem in assessing the role of a causal connection between damage and the use of a defective medical product, specifically a vaccine. The judgment of the Court of Justice of the European Union (CJEU) in the Sanofi Pasteur Case, which allowed the possibility of recognizing damage claims, even in cases where the prevailing scientific theory claims that there is no scientific evidence of a causal link between a vaccination and the disease, became a base for consideration. Consequently, procedural solutions (such as the standard of proof required, the admissibility of prima facie evidence reasoning and other solutions in cases of an uncertain causation) remain to be decided by national law. The authors assessed two legal systems: the French and Polish legal systems in the context of how to resolve these dilemmas and to describe the impact of the above-mentioned judgment on the case-law of French and Polish courts as regards the application of Directive 85/374/EEC. As a result, they concluded that the most important interpretative motive has become the individual interest of the vaccination’s victim as a consumer of medical services. It seems to be in accordance with Directive 85/374/EEC, which is motivated by the necessity of approximation of the laws of the Member States concerning the liability of the producer for damage caused by the defectiveness of his products. However, since the existing divergences may distort competition and affect the movement of goods within the common market and entail a differing degree of protection of the consumer against damage caused by a defective product to his health or property, in countries belonging to the European Union, the authors wonder how the commented judgment will affect the further development of consumers protection against defective vaccines.
