    Artykuł dotyczy kontroli okresowej pracownika samorządowego, której negatywny wynik może prowadzić do rozwiązania z nim umowy o pracę. Natomiast ustawa o pracownikach samorządowych nie przewiduje odwołania od negatywnej oceny okresowej do sądu pracy. Możliwe będzie to jedynie w razie rozwiązania z nim umowy o pracę. W artykule omówiono dotychczasowe orzecznictwo sądowe w tym zakresie oraz poglądy przedstawicieli doktryny.
    This article concerns the periodic assessment of a local government employee, which may lead to the termination of his/her employment contract if its result is unfavourable for the person assessed. However, the Polish Local Government Employees Act (Ustawa o pracownikach samorządowych) does not provide for an appeal to the labour court against an unfavourable periodic assessment. A claimant would have access to such a measure only once his/her employment contract was terminated. The article discusses the previous jurisprudence in this respect and the views held by representatives of the legal doctrine on this issue.

    W artykule przedstawiono unormowanie prawne Europejskiej Konwencji o Ochronie Praw Człowieka i Podstawowych Wolności w zakresie ochrony prawa do strajku. Warto podkreślić, że Konwencja nie wyraża wprost prawa do strajku. Jednak prawo to zostało ujęte w Europejskiej Karcie Społecznej. Art 11 EKPC stanowi, że każdy ma prawo do swobodnego, pokojowego zgromadzania się oraz do swobodnego stowarzyszania się, włącznie z prawem tworzenia związków zawodowych i przystępowania do nich dla ochrony swoich interesów. W ostatnim czasie Europejski Trybunał Praw Człowieka podjął dwa istotne rozstrzygnięcia, w których wskazał, iż art. 11 EKPC chroni także prawo do rokowań zbiorowych, a także prawo do strajku. W swoich rozstrzygnięciach Trybunał nawiązał do dorobku Międzynarodowej Organizacji Pracy. Trzeba jednak dodać, że również Konwencje MOP nie przewidują wprost ochrony prawa do strajku.
    This article gives an overview of the European Convention of Human Right’s protection of the right to collective action. It is very important to underline that European Convention does not express directly the right to strike. However, the right to strike is expressly recognized only in the European Social Charter. Art. 11 ECHR states only that everyone has the right to freedom of peaceful assembly and to freedom of association with others, including the right to form and to join trade unions for the protection of his interests. But two recent rulings by the European Court of Human Rights (ECHR) state that the exercise of the right to form and join trade unions includes the right to collective bargaining and the right to strike. With these cases the ECtHR found guidance with the ILO standards and followed its recommendations and jurisprudence. It should be added that the right to strike is not explicitly mentioned that there is no clear guarantee of the right to strike in the ILO Constitution or Conventions.

    The article analyses the problem of termination of fix term employment in Polish labour law. It should be mentioned that lately in Poland number of fixed-term contracts is increasing. The reason of this increase could be that fixed-term contract may be terminated at any time, with two weeks notice regardless of its duration. The employer is neither obliged to present a reason of dismissal. In 2008, Constitutional Tribunal held that regulation about fixed-term employment in Labour Code is consistent with Polish Constitution, but there was one separate opinion of judge T. Liszcz. The purpose of this article is to discuss this issue one more time and provide new arguments, especially that there will be amendment to the Labour Code.
    Artykuł dotyczy kwestii rozwiązywania umów o pracę na czas określony w świetle polskiego prawa pracy. Warto wspomnieć, że w Polsce liczba umów o pracę na czas określony wzrasta w ostatnim czasie. Przyczyną tego trendu może być to, że pracodawca, rozwiązując taką umowę, nie musi podawać przyczyny wypowiedzenia. W 2008 roku tą kwestią zajmował się Trybunał Konstytucyjny, uznając, że kodeks pracy w tym zakresie jest zgodny z Konstytucją, przy czym zostało wyrażone zdanie odrębne sędzi T. Liszcz. Opracowanie odnosi się do postulatu uzasadnienia wypowiedzenia umowy o pracę na czas określony, wskazując argumenty za takim rozwiązaniem, które można uznać za istotne, zwłaszcza że trwają obecnie prace nad nowelizacją kodeksu pracy.

    Although it may be challenging to unambiguously recognize and define it, the notion of experiencing happiness, a constituent of psychological well-being, is undoubtedly one of the key traits featuring every person, whether intellectually fit or disabled. The feeling of happiness plays a significant role when coping with various types of situations including also the circumstances faced by an intellectually disabled person. Due to the diversity and multeity of the dimensions where it occurs, the experience of happiness can be subject of analyses from various stances, including the viewpoint of an intellectually disabled person. It seems that the disabled individual’s ability to deal with difficulties, which also influences efficiency of the rehabilitation process, is actually determined by the feelings of happiness, content and optimism, all of which remain in a relation with one’s personality, life situation,and conditions in which they live. The article draws attention to the subject of experiencing happiness by and psychological well-being of intellectually disabled people. It emphasizes the possibility of both theoretical and practical applications of assumptions of positive psychology as a requisite condition for the optimization of functioning of intellectually disabled people. Beyond any doubt, due care for the intellectually disabled people’s experience of happiness and psychological wellbeing is one of the most crucial requirements of their rehabilitation process as “positive states of mind (…) provide the power to struggle with adversities of life”

    W prezentowanym artykule poddano analizie, jakże często pomijaną w literaturze przedmiotu, problematykę poczucia szczęścia rodziców dzieci niepełnosprawnych, zwłaszcza niepełnosprawnych intelektualnie. Zdecydowana większość prac dotyczących niepełnosprawności intelektualnej poświęcona jest tematyce negatywnej, dotyczącej przede wszystkim problemów rodzin osób niepełnosprawnych intelektualnie, ich deficytów, chorób i zaburzeń wynikających z tej niepełnosprawności. Z tego też względu w opracowaniu niniejszym podkreśla się konieczność skoncentrowania się w teorii niepełnosprawności, badaniach oraz praktyce również na jej pozytywnych aspektach oraz zwraca uwagę na fakt, że dobrostan psychiczny pełni niezwykle ważną funkcję motywacyjną, bowiem nie tyle stanowi wynik doświadczeń życiowych i działań, co przede wszystkim decyduje o owych doświadczeniach oraz działaniach, jak również o ich rezultatach. Poczucie szczęścia odgrywa niezwykle istotną rolę w radzeniu sobie z różnego rodzaju sytuacjami, w tym również z sytuacją posiadania dziecka z niepełnosprawnością intelektualną, determinuje jak się wydaje umiejętność radzenia sobie z trudnościami wynikającymi z owej sytuacji, tym samym decydując o efektywności procesu rehabilitacji dziecka z niepełnosprawnością intelektualną. W artykule zwrócono uwagę na problematykę poczucia szczęścia rodziców dzieci z niepełnosprawnością intelektualną, podkreślając możliwość wykorzystywania zarówno w teorii, jak i praktyce pedagogicznej założeń psychologii pozytywnej jako warunku optymalizacji oraz funkcjonowania osób niepełnosprawnych intelektualnie oraz ich rodzin.
    The article presents the analysis of the problem of sense of happiness of parents of children with disabilities, especially intellectual disabilities, which is often ignored in source literature. The vast majority of works concerning intellectual disability take a negative approach, mostly focusing on the problems faced by families of persons with intellectual disabilities, their deficits, diseases and disorders resulting from the disabilities. Therefore, this study emphasizes the need to concentrate on the theory of disability, as well as on research and practice, including the positive aspects of disability. It also highlights the fact that mental well-being plays an extremely important motivational role, because it is not really the result of life experiences but it actually determines those experiences and actions, as well as their effects. The sense of happiness plays a very important role in coping with various situations, including the situation of having a child with intellectual disability. It seems to determine the ability to cope with difficulties resulting from this situation, and thus, it affects the efficiency of the process of rehabilitation of a child with intellectual disability. The article points to the issue of the sense of happiness of parents of children with intellectual disabilities, emphasizing the possibility to apply, both in theory and in educational practice, the assumptions of positive psychology as the condition of optimization and functioning of people with intellectual disabilities and their families.

    FREEDOM OF ASSOCIATION OF ATYPICAL EMPLOYEES, PERSONS EMPLOYED ON THE GROUNDS OF CIVIL CONTRACTS, AND THE SELF-EMPLOYED Summary This article discusses the freedom of association of atypical employees, persons employed on the grounds of civil law contracts, and the selfemployed. Polish law guarantees the right of association to employees on the grounds of its labour law (kodeks pracy). However, the International Labour Organisation Convention denies the right of association to members of the armed forces, police, and public administration. In 2011 a complaint was submitted to the Committee on Freedom of Association, which has drawn up recommendations for Polish law. The author analyses the solutions of Polish law in the context of the Committee’s recommendations on freedom of association for atypical employees, persons employed on a civil law contract, and the self-employed.

    Artykuł dotyczy regulacji prawnej w zakresie obowiązków pracodawcy z obszaru bezpieczeństwa i higieny pracy względem telepracownika wykonującego pracę w domu. Jeśli telepracownik wykonuje pracę w domu, pracodawca jest obowiązany wykonywać obowiązki z zakresu bezpieczeństwa i higieny pracy względem telepracownika z wyjątkiem tych wyraźnie wskazanych w art. 6717 k.p. Wyłączenie to jest uznawane za dosyć wąskie, co może być przyczyną niewielkiego zainteresowania pracodawców tą formą organizacji pracy w praktyce. Realizacja obowiązków z zakresu bhp przez pracodawcę względem telepracownika domowego może być utrudniona przez obowiązek poszanowania prywatności telepracownika. Telepraca domowa rodzi także problemy dla pracodawców oraz Państwowej Inspekcji Pracy, związane z kontrolą warunków pracy telepracowników domowych. Artykuł dotyczy głównych problemów związanych z tematem bezpieczeństwa i higieny pracy przy telepracy domowej.
    The article focuses on the Polish legal regulations regarding the employer’s obligation to ensure the health and safety of home-based telework. If the teleworker is working from home, the employer must perform the duties specifed in the Polish Labour Code with respect to the teleworker, regarding the type and conditions of the work performed, except those defined in Art. 6717. This exclusion is considered quite narrow, which may be the reason why in practice employers are not very interested in this form of work. Te implementation of the obligations stipulated in the Labour Code in the area of health and safety will not be easy, due to the requirement that teleworker’s privacy must be observed. Telework makes for difficulties for employers and Państwowa Inspekcja Pracy (Poland’s National Labour Inspectorate) in the supervision of teleworkers’ working conditions. The aim of this study is to present the main problems in this subject.

    To define what is mental well being and what are its correlates isn’t an easy job to do. It’s an ambiguous concept and it is hard to unambiguously determine it, because everyone of us can understand mental well being in his or her own way. In literature there are many conceptions of how to define mental well being that’s why we have to remember how ambiguous the term is. Despite all the differences between those conceptions of definitions they all have one common feature, all of them describe something positive, precious. Undoubtedly crucial components of mental well being are positive experiences like feeling a sense of life or experience of happiness. From the literature source follows there is a big probability that a main source of happiness which is measured by a mental well being is directly in human personality and a main factor being observed in different people is relatively stable disposition to sense those feelings. Because of that reason when taken into consideration personality factors of mental well being there were analyzed dependences between personality characteristics, experience of happiness and feeling the sense of life. When analyzed personal factors which determine the mental well being condition there was particularly payed special attention to subject personal characteristics like: extraversion, neuroticism, openness, conscientiousness, agreeableness, pattern of behavior A, locus of control, the tendency to risky behavior.

    Paraneoplastic neurological syndromes (PNS) are a group of rarely observed disorders, accompanying about 1% of cancer diseases. They have a typically aggressive course, leading to profound and essentially irreversible disability. The pathogenic cause behind PNS is damage of the nervous system structures as a consequence of the body’s immunological reaction induced by cancer. Onconeural antibodies generated as part of the reaction target the tumour tissues, but also the regular nervous tissue recognized as antigens. Presence of onconeural antibodies reveals a 50–60% sensitivity and 100% specificity in diagnosing PNS. Imaging and laboratory tests have a limited impact on diagnosis. What is crucial is the analysis of clinical systems following Graus’s criteria (elaborated in 2004). In the case presented here, the patient underwent treatment in many neurological departments due to the symptoms of progressive damage of the nervous system. She was eventually diagnosed with the stiff person syndrome related to breast cancer. In spite of the treatment, including an efficacious oncological therapy, the severe neurological deficit resulted in serious motor disability.

    Male reproductive organs are extremely sensitive to the negative influence of toxic environmental factors as well as drugs, and until now not many attempts have been made at studying the detoxication enzymes and the relationship between the activity of those enzymes and spermatozoa fertility. In the present work we studied cytosolic glutathione-S-transferases (GST, EC 2.5.1.18) from different parts (head, corpus and tail) of bull and boar epididymis. We isolated two molecular forms of GST from each part of epididymis, characterized their biochemical properties and examined the mechanism of the catalyzed reaction. On the basis of their substrate specificity and isoelectric point, the isoforms were found to belong to the near neutral GST class mi. All examined GST forms exhibited higher affinity towards GSH than towards 1-chloro-2,4-dinitrobenzene (CDNB) and bull epididymis GST forms showed biphasic Lineweaver-Burk double reciprocal curves in the presence of GSH as a variable substrate. Boar epididymis anionic GST had the -SH groups both in the GSH and the CDNB binding place, whereas the cationic GST form - arginine residues in the CDNB binding place. Bull epididymis GST forms contained neither thiol nor arginine residues essential for catalytic activity.

    Opis:
    The study, devoted to the assessment of the financial condition of cities with poviat status (CWPS) in Poland, aims (i) to position cities with poviat status in the structure of local government and (ii) to examine and assess the average financial condition of city with poviat status in Poland in the spatial aspect, using standard measures (measures referring to the budget result, income potential and the amount of expenses) and those of the authors’ (reflecting the possibility of satisfying the needs of the local government community). The study uses the methods of descriptive statistics. Detailed analyses were carried out on the basis of the authors’ own calculations, using an MS Excel spreadsheet, and the calculated measures were presented for two deliberately selected years (2010 and 2019). The analyses present different pictures of the financial conditions: while the values produced by standard measures in 2019 compared to 2010 clearly indicate an improvement in the financial condition of analysed cities in Poland, the values derived from the authors’ measures do not confirm this. Changes in the values of both groups of indicators are spatially diverse. Both groups, however, indicate that there are voivodeships whose financial condition improved more in 2019 compared to 2010 (classical indicators) or deteriorated to a lesser extent (authors’ indicators) than other voivodeships. This applies to the provinces of Western and Central Poland. CWPS in these regions, due to their location and impact in the region, as well as their attractiveness as places of employment doing business: 1) have been better prepared to start new investments and incur further commitments; 2) attract high school and university graduates and investors; 3) have a large stock of real estate, including extensive infrastructure; and 4) are less dependent on transfers from the state budget. 
    Opracowanie poświęcone jest ocenie kondycji finansowej miast na prawach powiatowych w Polsce. Jego celem jest: 1) umiejscowienie miast na prawach powiatowych w strukturze samorządu terytorialnego oraz 2) zbadanie i ocena średniej kondycji finansowej miasta na prawach powiatu w Polsce w aspekcie przestrzennym, z wykorzystaniem miar standardowych (miary odnoszące się do wyniku budżetowego, potencjału dochodowego i wysokości wydatków) i autorskich (odzwierciedlające możliwość zaspokojenia potrzeb społeczności samorządowej). W badaniu wykorzystano metody statystyki opisowej. Szczegółowe analizy przeprowadzono na podstawie własnych obliczeń, z wykorzystaniem arkusza kalkulacyjnego MS Excel, a obliczone miary przedstawiono za dwa celowo wybrane lata (2010 i 2019). Analizy pokazują inny obraz kondycji finansowej, który pojawia się na podstawie zastosowanych standardowych miar i proponowanych wskaźników autorskich. O ile wartości standardowych miar w roku 2019 w porównaniu z 2010 jednoznacznie wskazują na poprawę kondycji finansowej analizowanych miast w Polsce, o tyle wartości miar autorskich tego nie potwierdzają. Zmiany wartości obu grup wskaźników są zróżnicowane przestrzennie. Obie grupy wskazują jednak, że są województwa, w których kondycja finansowa miast na prawach powiatu w roku 2019 w porównaniu z 2010 poprawiła się bardziej (wskaźniki klasyczne) lub pogorszyła się w mniejszym stopniu (wskaźniki autorskie) niż w innych województwach. Dotyczy to województw Polski Zachodniej i Środkowej. Miasta na prawach powiatu w tych regionach, ze względu na położenie i wpływ w regionie, a także ich atrakcyjność jako miejsca pracy i prowadzenia działalności gospodarczej: 1) są lepiej przygotowane do rozpoczęcia nowych inwestycji i zaciągania dalszych zobowiązań; 2) przyciągają absolwentów szkół średnich i uczelni wyższych oraz inwestorów; 3) posiadają duży zasób nieruchomości, w tym rozbudowaną infrastrukturę; 4) są mniej zależne od transferów z budżetu państwa.
