Opis:
Problematyka funkcjonowania Sejmu w czasie pandemii wirusa SARS-CoV-2 stanowi zagadnienie, które ze zrozumiałych względów cieszy się obecnie znacznym zainteresowaniem doktryny. Celem artykułu była dogmatyczna analiza tych przepisów konstytucyjnych, które rzutują na zakres możliwości modyfikacji sposobu organizacji posiedzeń Sejmu w okresie pandemii, co pozwoliło na sformułowanie wniosków dotyczących konstytucyjności tzw. hybrydowego modelu posiedzeń izby wprowadzonego wskutek przyjęcia zmian regulaminowych 26 marca 2020 roku. Doceniając praktyczną użyteczność przyjętego wówczas modelu organizacji posiedzeń w sposób hybrydowy, tj. z możliwością zdalnego udziału posłów, trzeba stwierdzić, że rozwiązania te wywołują zastrzeżenia konstytucyjne. Zarazem należy podkreślić, że stanowisko doktryny odnośnie do tej kwestii nie jest jednolite. Osobny wątek rozważań poświęcony został możliwościom reorganizacji posiedzeń Sejmu na podstawie ogólnych, obowiązujących od lat przepisów regulaminowych, tj. w hipotetycznej sytuacji, gdyby w marcu 2020 roku nie dokonano jakichkolwiek zmian normatywnych dotyczących tej kwestii.
The problem of functioning of the Sejm in time of the SARS-CoV-2 pandemic is currently a matter being, due to obvious reasons, often discussed by Polish legal doctrine. The purpose of the paper was to carry out a dogmatic analysis of constitutional rules with determine the allowed scope of modification or organising plenary sittings of the Sejm, what allowed to draw conclusions regarding the constitutionality of the so-called hybrid model of sittings introduced as a result of the adoption of the amendments of the Standing Orders on 26th March 2020. While a practical value of the model of hybrid plenary sittings, i.e. with a possibility of a remote participation of Deputies, cannot be questioned, the legal solutions in question raise doubts as to their conformity to the Constitution. Still it should be mentioned that there various doctrinal standpoints regarding this matter. A separate part of the paper was focused on the possibilities of reorganising plenary sittings of the Sejm on the basis of general, having been in force for many years, rules of the Standing Orders, i.e. in a hypothetical situation, if no normative changes regarding this issue had been in March 2020.

Opis:
Committees of the Sejm which, according to Article 106 para. 2 of the Standing Orders of the Sejm of the Republic of Poland, consider respective parts of a budgetary bill, are not entitled to adopt a resolution on holding a public hearing. In the course of work on the budgetary bill only the Public Finances Committee may be classified as “the committee to which the bill has been referred for consideration”, i.e. as an entity which, according to Article 70a para. 2 of the Standing Orders, possesses an exclusive right to adopt a resolution on holding a public hearing (in the phase of work specified in Article 70a para. 4 of the Standing Orders.

Opis:
The discussed Article specifies the acceptable subject matter of points of order. The assumption that they may concern matters being the subject of orders of the day and the course of sittings means that the subject matter of the point of order cannot become a matter to be considered in the future, i.e. during any of subsequent sittings. In the author’s opinion, it is in principle unacceptable to submit pro futuro points of order. Article 184 para. 2 of the Standing Orders of the Sejm refers only to the subject of the point of order and not to the motives of the motion submitted by the applicant. This means that, on justifying the point of order, a Deputy may rely on external circumstances, i.e. not related to a group of matters considered by the Sejm during a given sitting.

The institution of intervention was constructed in the Act on the Exercise of the Exercise of a Mandate of a Deputy or Senator in a relatively inaccurate way. The author of the opinion states that in the analyzed situation a Deputy is not entitled to participate in the inspection carried out by the County’s Inspectorate of Construction Supervision. The only legal requirements concerning the intervention concern informing the Deputy about the state of consideration the case, being the subject of the intervention, and defining the date of “the final consideration of the case”.

The author of the opinion supports a dominant position among Polish constitutional lawyers, according to which rejection of bill during the first reading is constitutionally acceptable. He shows that the possibility of rejection of bills during the first reading is an institution firmly rooted in the Polish parliamentary tradition. Removing it would cause extension of the work on bills, because of a likely “ritualization” of three readings. The author claims that such situation would lead to a weakening of the role and importance of the institution of readings of bills.

Opis:
In the opinion of the author, the principle of discontinunity in relation to “petition proceedings” does not apply to acts carried out as part of the work of the Committee on Petitions. This should also apply to those activities of the Commission that follow the choice of how to handle the petition, e.g. to prepare projects or desiderates as part of dealing with a given petition. Petitions that were considered in the previous term of office should be reconsidered, while the Commission in the current term is not bound by the arrangements made in the previous term of the Sejm. It is not permissible to renew the legislative initiative in the event of the draft submitted by the Committee on Petitions of the previous term was discontinued at the end of the term.

The subject of the opinion is the admissibility of consideration by a committee of motions to carry out a control in connection with the lack of general principles of carrying it out set out in the Standing Orders of the Sejm. Motions to carry out the control submitted to the National Defence Committee stay within the scope of the subject matter of activities of the committee. The author claims that one of the motions rises some concerns of a legal nature. The subject of the request was defined in a problem way, whereas committee’s control relates to enforcement and executing statutes and Sejm resolutions, what leads to a conclusion that the scope of the control should be related to a given act or resolution.

The author demonstrates the admissibility of consider a petition containing a request to refrain from work on a bill submitted to the Sejm. The suggestion contained in the petition must be interpreted as a request regarding failure to adopt a bill, its rejection by the Sejm, or withdrawal by a sponsor. The analysis concerns the issue of whether a committee considering, based on the indicated provision, amendments submitted during the second reading, should vote on their acceptance or rejection separately for each amendment, or if it is possible, after consideration of the amendment, to automatically (without separate vote) draw a recommendation concerning other amendments, in case it is a logical consequence of acceptance or rejection of the former amendment. Opis:
The report, submitted by the Council for the Polish Language, entitled “Language of political information”, contains an analysis of the problem that is narrow in scope. In the light of the current parliamentary practice, the narrow scope of the Council’s reports is typical and this has not been questioned in the course of parliamentary work. The decision of the Culture and Media Committee, resulting in a refusal to consider the document in question, is an expression of negation of the decision of the Marshal of the Sejm to recognize this document as a report. Formally, the committee proceedings on the report had not been completed. The Committee should return to examining this document and complete its work, formulating an appropriate opinion.

In the author’s opinion, the bankrupt trustee may be an addressee of a Deputy’s request for information pursuant to Article 19 para. 1 of the Act on the Exercise of the Mandate of a Deputy or Senator as a manifestation of an extra-parliamentary (local) sphere of performing the mandate. However, obtaining information by the Deputy from the trustee in this manner seems possible only when the bankruptcy proceedings concern a company with a share of the State Treasury, a state enterprise or a local government enterprise.

The specificity of the proceedings in relation to petitions precludes the admissibility of discontinuance of the proceedings regarding consideration of a petition on the basis of appropriate application of Article 105 § 1 of the Code of Administrative Procedure. In case of withdrawal of a petition submitted to the Sejm, the body responsible for its consideration, i.e. the Petitions Committee, should make a decision about the way of proceeding with the petition. Withdrawal of the petition does not prevent its consideration. Given the open catalogue of the ways in which petitions can be proceeded, the Committee should be allowed to adopt a resolution to refuse consideration of the petition because of the applicant’s willingness to withdraw the petition

According to the current state of law, a Deputy who is not a member of supervisory boards and programme boards of public broadcasters is not entitled to attend meetings of these bodies, even as an observer. Deputies may, however, in the exercise of their parliamentary mandate, have access to minutes documenting meetings of such bodies. Providing a parliamentarian with such documents is conditional, as it cannot infringe on personal rights of others, as well as on provisions concerning statutorily protected secrets.

In the opinion of the author certain provisions of the proposed bill raise constitutional doubts or may cause constitutional reservations, inter alia, in the light of the principle of specificity of law, the principle of separation of powers, the scope of the subject matter of parliamentary rules of regulation. Opis:
The Deputy who represents the Legislative Committee may participate in the legislative work of a subcommittee set up within another committee but, then, he/she has the status of “regular” Deputy who is not a member of that subcommittee. The author stresses that the status of the representative of the Legislative Committee is specified by the Standing Orders of the Sejm. Moreover, he points out that the Deputy who is both a representative of the Legislative Committee and a member of the committee appropriate for the bill, cannot participate in voting on motions and amendments, which he/she submitted, acting as a representative of the Legislative Committee. There are no obstacles for the Deputy to participate in other votings. During the work of the committee, it should be determined in each case whether the Deputy fulfilling the two above‑mentioned functions acts in the capacity of a member of the committee, or as a representative of the Legislative Committee.

Opis:
The author is critical on the application of Article 51 (2) of the Standing Orders of the Sejm in proceedings in relation to draft law codes and bills to amend draft law codes. He emphasizes that, despite the lack of a provision which would prevent beginning the second reading of the above‑mentioned drafts immediately after the conclusion of the first reading without referral to the committee, extended work on draft law codes and on bills to amend them are useful for the reflection on this legislation which is, in principle, extensive and complex. The author concludes that Article 51 (2) of the Rules of Parliament is contrary to the reason of the law of the proceedings carried out in accordance with a law‑code.

Opis:
The author discusses formal aspects of constitutionality of an amendment introduced by a sponsor of the bill amending the Act on Family Benefits and the Act on the System of Social Insurances. It is concluded that requirements, developed by the Constitutional Tribunal, concerning the proper subject matter of amendments, do not apply to amendments introduced by a sponsor of a bill, according to Article 36 paras. 1a–1c of the Standing Orders of the Sejm. Thus, the assessed amendment is constitutionally admissible.

In the opinion of the author, the Bill meets the requirements specified in the Act on the Execution of a Legislative Initiative by Citizens. However, doubts are related to the question whether it is constitutionally permissible for a group of citizens to submit the analyzed project, because in accordance with the Constitution, relations between the Republic of Poland and the Catholic Church are determined by an international agreement concluded with the Holy See, while relations between the Republic of Poland and other churches and religious associations are determined by laws passed on the basis of agreements concluded by the Council of Ministers with their respective representatives. However, in a situation where changes in the provisions of the Act on the relations between the State and the Catholic Church in Poland do not constitute the basic matter covered by a given amending bill, it is acceptable that the initiative for such changes does not come exclusively from the Council of Ministers.

the State Sanitary Inspection is a part of government administration. Hence, regardless of the strong competence relationship with the governor of the county (starosta powiatu), the function of director of a county sanitary-epidemiological station should be regarded as belonging to the segment of government administration. The author concludes that, according to the law in force, there is no incompatibility of the function of county councillor and the function of director of the county sanitaryepidemiological station. It is therefore admissible.

Opis:
An obligation, provided for in the Standing Orders of the Sejm, of a sponsor’s of the bill to present to present outline drafts of principal executive orders is one of the core procedural regulations shaping the content of an explanatory statement of a bill. If the sponsor does not plan to issue any executive orders on the bases on the bill, it has to be indicated in the explanatory statement of the bill, as an information about legal consequences of the bill. In case when entry into force of the statute will result in the necessity of modifying executive orders being in force, it should be notified while presenting the above-mentioned legal consequences.

A former Deputy to the Sejm of the Republic of Poland, and at the same time a former member of the Parliamentary Assembly of the Council of Europe (PACE), cannot be held responsible to the Sejm. Potentially, bringing the above-mentioned person to a criminal liability may be considered, because, according to the author, in the analyzed case, that person was not protected by immunity privileges granted under international law to the members of PACE. A possible launch of this type of legal responsibility would, however, require determining of a few strictly criminal-law matters described in the opinion.

The Vice-Marshal of the Sejm, who has been authorized by the Marshal of the Sejm to take action in matters related to petitions, does not exercise the competence to assess petitions on his own, but does so on behalf of the Marshal. This action should therefore be assessed, as if it were performed personally by the Marshal of the Sejm. The provisions of the Standing Orders of the Sejm do not provide for the possibility of re-assessment of petitions. Consequently, the petitioner’s request to re-examine the petition in order to possibly amend the decision to leave it unexamined cannot be satisfied.

In the opinion of the author, a Deputy may obtain access to information on land and mortgage register numbers from a local government unit pursuant to the provision of the Act on the Exercise of the Mandate of a Deputy or Senator. However, s/he is not exempted from the obligation to pay the fee provided for in the provisions of the geodetic and cartographic law. Costs related to this expense should be paid from the parliamentary allowance to which the Deputy is entitled to cover expenses incurred in the exercise of his or her parliamentary mandate.

A Deputy does not have to inform the Marshal of the Sejm about an intention of being employed as an assistant professor in a higher education institution, because it is a creative activity of an individual nature. Such obligation would exist if a Deputy had to perform additional responsibilities (apart from a pure academic or didactic work). In such case a Deputy would lose the right to receive a salary. However, s/he could apply for a partial salary – in the sum equal to the difference between a full Deputy’s salary and an additional one (received as a result of an additional employment).

The author emphasizes the formal equality of the Deputies founded on the provisions of the Constitution. He points out the impossibility of extending the time for speech of non-aligned Deputies over six minutes for the entire sitting of the Sejm. The term “speech” should not be understood as any of the instances of taking floor by a Deputy, but only those in which they present their views on the issue considered at the meeting of the Sejm. Referring to the rules of procedure of the Sejm, he claims that posing questions by non-aligned Deputies during the third reading shall depend the consent of the Marshal of the Sejm. The author also emphasizes that, in the light of Article 45 para. 1 of the Standing Orders of the Sejm, it is not allowed to submit amendments during the second reading by any of the Deputies individually.

The opinion points out that a key role in the preparation of preliminary motions to hold persons accountable before the Tribunal of State is played by the Constitutional Accountability Committee acting in corpore. The Commission has an exclusive power to take substantive decisions concerning the conduct of proceedings relating, e.g., to an assessment of the validity of the submitted motions as to evidence. The tasks of presidium and chairperson of the Committee are, in principle, limited to organizational and technical issues, such as planning a timetable of committee meetings and proposing the agenda of the debate (presidium) and representing the Committee in external events, as well as hearing witnesses and experts (chairperson). The performance of the presidium or chairperson is reviewed by the Committee. In the event of a negative assessment of the work of these authorities, the Committee has the power to make appropriate changes in membership of the presidium, including changing its chairperson.

The opinion concerns the decision of the Marshal of the Sejm to expel a Deputy from a sitting, taken pursuant to Article. 175 para. 5 of the Standing Orders of the Sejm. In the author’s view, such decision is not final, as the Presidium of the Sejm may quash it, having considered an appeal submitted by the Deputy and – on the other hand – is immediately applicable, because the expelled Deputy is obliged to leave the Chamber and abstain from participating in further deliberations until his/her appeal is considered (or until the end of the session of the Sejm, if the Deputy has not submitted an appeal). Therefore, the expelled member does not have the right to participate in voting. Preventing the Deputy expelled from the sitting from “entering the Chamber with the purpose of voting” is necessary in order to respect Article 176 para. 6 of the Standing Orders of the Sejm.

The author argues that the inconsistency between the Budget Act and other statutes can be eliminated by way of amendment of the Budget Act or amendment of the relevant implementing provisions. Examining the possible adoption by the Presidium of the Sejm of an interpretative resolution regarding limiting the number of interpellations and Deputy’s questions on the same “matter”, the author of the opinion concludes that any restrictions in this regard should be formulated with caution. The rights of Deputies to submit interpellations cannot be only illusory. He also notes that the Standing Orders of the Sejm have already introduced a mechanism for control by the Presidium of the Sejm over interpellations and Deputy’s questions. In order to counter the practice of submitting excessive number of interpellations of similar content to the same body, the author examines the possibility of combining by the Presidium of the Sejm similar interpellations into one interpellation.

The author claims that applications for waiving the so‑called formal parliamentary immunity (Article 105 para. 2 of the Constitution) are examples of information about the activities of organs of public authority, regulated by Article 61 of the Constitution (public information). Therefore each citizen possesses the right to acquire access to such applications. However, it does not mean that each of applications may be disclosed. In some cases applications may include information that may be classified as secret under the relevant legislation or whose disclosure would violate the constitutional right to privacy. In case it happens, an application cannot be disclosed – due to the prohibition of granting access to such information provided by Article 5 of the Act on Access to Public Information.

The paper is dedicated to describing the way of reception by the Polish Constitutional Tribunal of the “chilling effect”, i.e. an institution related to such activities of public authorities that form an indirect act of deterrence regarding the execution of constitutionally guaranteed rights and freedoms, esp. the freedom of expression. The discussed concept has originated in judicial decisions of the US Supreme Court and has spread into many contemporary legal systems, including jurisprudence of the European Court of Human Rights. Although it is evident that the Tribunal “took over” that concept from the ECHR, it in fact developed its own, unfortunately internally inconsistent, understanding of the chilling effect. Four different ways of application of chilling effect may be noticed in judicial decisions of the Polish CT, while only two of them reflect the perception of this institution by the US Supreme Court and the ECHR.

The Marshal of the Sejm is not allowed to verify, whether an explanatory statement to a bill submitted by a group of citizens meets requirements specified in Articles 34 paras. 2 and 3 of the Standing Orders of the Sejm of the Republic of Poland. Besides, demanding enclosure – to the notification of the establishment of the Committee – of statements on accession to the legislative initiative committee and of a statement on selection of committee’s agent, is not based on rules of the Act of 24th June 1999 on Exercise of the Legislative Initiative by Citizens. Therefore the current practice of demanding the enclosure of the above documents cannot be continued in future.

The opinion concerns the problem of the scope of consultation requirements for bills, referring to the bill specified in the title of the opinion. Based on the provisions of the Constitution and of the Standing Orders, the bill should be consulted with those churches and other religious organizations whose priests would be affected by provisions of the bill. In practice, determining a list of entities entitled to be consulted on the bill may be difficult. Thus the author is of the opinion that legal rules concerning the right of churches and other religious organizations to consult bills should be reviewed and clarified.

The article deals with the question whether, in the context of the power of appropriate Sejm committees to consider individual parts of draft budgets, as referred to in Article 106 paragraph 2 of the Standing Orders of the Sejm, it is admissible to submit a motion for and to adopt a resolution on holding a public hearing (Article 70a of the Standing Orders of the Sejm). Based on the analysis of the provisions of the Standing Orders of the Sejm, the author draws a conclusion that Sejm committees do not have such a power. According to the Standing Orders of the Sejm, in the course of work on a draft budget, an exclusive right to adopt resolution on holding a public hearing belongs to the Public Finances Committee.

The opinion presents the principle of protection of citizens’ confidence in the state, which is one of the foundations of the constitutional principle of the democratic state ruled by law. Attention was drawn to the specific requirements covered by this principle, such as the guarantee of legal certainty for the individual, the prohibition of retroactivity of the law, or the order to protect acquired rights. Forms of implementation of this principle at the statutory level are presented, as well as its relationship to the so-called right to good administration.

The opinion deals with the powers of a Sejm committee to demand that the minister and a member of the State institution provide information about pending administrative proceedings and to require the committee to take position in relation to such proceedings. In the authors’ view, there are no provisions under which the motion would be found inadmissible. The committee may also express its position on the discussed issue which, however, has no binding character, and it cannot impose the content of a solution in pending administrative proceedings.

The adoption of the draft regulation constitutes a further step in the development of the electoral procedure for elections to the European Parliament. It will replace the 1976 Council Decision and the Act concerning the election of the representatives of the European Parliament by direct universal suffrage annexed to that Decision. The authors set out concerns relating to, inter alia, the proposed institution of an EU-wide constituency and common provisions for election campaigns. Further doubts are raised regarding the proposal to fix uniformly the voting day for EP elections and the institution of a ‘temporary MEP’. In the draft position of the RP, the Council of Ministers “assesses the draft regulation negatively, due to the contradiction of some of the solutions proposed in the proposal with the legal order currently in force in the Republic of Poland”.

The article contains a draft position of the Sejm relating to the application submitted by a group of Deputies to the Constitutional Tribunal in which they contested some provisions of the Act – Electoral Law adopted on 5 January 2011, and the act amending it. The purpose of the application is declaration of conformity with the Constitution of several dozen provisions of both the legal acts. An analysis of justification of the position of the Sejm focuses above all on the new instruments of electoral law that were absent or reduced in Polish law. They include inter alia: a two-day vote, a proxy vote, correspondence vote, single-seat constituencies in elections to the Senate, as well as bans on the use of large-format election posters and slogans as well as paid election radio and TV ads. Based on detailed analysis, the authors claim that none of the solutions proposed in the new Electoral Code infringes the constitutional standards.

The author stated that the lack of complying with the National Electoral Commission’s proposal on changes in electoral districts in the elections to the Sejm and Senate will result in an internal inconsistency of the Electoral Code with regard to elections to the Sejm. It will also cause a violation of the constitutional principle of equality in elections. On the other hand elections conducted in accordance with the legal framework without the NEC’s proposal will be valid. Doubts as to the validity of the elections may arise, if the Constitutional Tribunal considers the current provisions (i.e. not-amended as the NEC suggested) unconstitutional.
