Opis:: An essential element of the teaching system, which is of vital importance, is the set of educational methods. A prominent place amongst these is occupied by those methods that develop creative activity; this is because the main element that results in the maximizing of the child’s developmental chances is its creative activity. The article presents the following methods that actively develop the nursery school pupil’s creativity: the project method, the construction of board games, Celestyn Freinet’s techniques, Maria Montessori’s method, Carl Orn’s method of physical expression through actions, Alfred and Maria Kniess’ method of rhythmical gymnastics, Weronika Sherborne’s Developmental Movement, Josef Gottfrid Thulin’s method of making stories through physical actions, Emil Jagues-Dalcroze’s method, Edwin E. Gordon’s method of developing the love of music, Bati Strauss’ method of active listening to music, theatre, drama, music therapy, Maxwell Malz’s method of forming a positive image of oneself, and the practise of creative visualization for children. The methods listed above are dinerent ways of working with children that rely on releasing their free creative expression, in contrast to traditional teaching methods that oppose those methods that activate the educational process. They are educational and developmental methods for children who are at nursery school, and they facilitate unconstrained activeness and creation.

Opis:: While analysing the legislative output of the interwar Republic of Poland, most Polish researchers highlight the significant achievements of the so-called Codification Commission established in 1919, whose twenty years of efforts resulted in the drafting of a host of important codes and other acts of high legislative value. This output, however, could only be put to a very short-lived use in the 1930s. Its full potential was not unleashed until after the Second World War, in a completely changed political reality. On a day-to-day basis, the Polish state of the interwar period faced a number of issues that it either desired to overcome or was forced to do so. One of them was the crippled legal status of women, particularly jarring in the reality of the interwar times. Although the reborn Polish statehood, true to lofty democratic ideals, immediately took it upon itself to change the clearly underprivileged legal status of women, the final effect, that is the legislation in force as at the outbreak of the Second World War, looks meagre. The modern codification had not been adopted, the legal particularism in the scope of civil law had been maintained, the anachronistic codification of the preceding century upheld – the ideals of equal rights for women were made a very much imperfect reality. In this article, we attempt to trace the history of how this came to be by examining difficulties in introducing the principle of equality of women’s rights. The example we have chosen serves to shed light on the mundane efforts to overcome the mounting problems with realizing ideas of modernization upon the underlying legal foundations of a country which, at first sight, seems utterly ill-prepared to tackle this task properly.

Opis:: In the 21st century such words as saving money, financing and electronic money are very popular. It is difficult to discuss about functioning in the society without the ability to efficient movement in the field of finances. The need to propagate financial education since the early age is gaining popularity. This is strictly connected with the development of a wise consumer’s attitude and the ability to manage in various financial situations, as well as passing respect towards money among small children. Both parents and teachers are responsible for promotion of economic ideas. Knowledge gained by children within every day’s life is the source of information for forming financial programs. Children accompany their parents during visits at a bank, shop, post office and other institutions offering financial services. A pre- school child should not only know where such places are and how they look like, but also their duties and the basic rules of functioning. The following article has been devoted to such subject matter. It presents the list of words which are commonly used by children at the age of four or five. To collect the base of the words the method of brainstorm was used and the map of thoughts was created. Finally, the list of the subject matters within financial education for children of the pre-school age has been elaborated.

Opis:: The French Code de commerce was adopted in the Polish territories in 1809 and remained formally binding for over 120 years. It was nonetheless transferred from post-revolutionary France into a feudal reality, where no commercial code had been in place before, without the necessary preparatory works, implementation of the legislation accompanying the Code de commerce or even an official translation. Moreover, legal scholars paid scarce attention to it in the first decades. Taken together, all these factors affected its application. Being a contribution to the complex study of the issue, the present publication examines selected notarial deeds documenting individual commercial transactions to show how the process of practical implementation of the norms of French Commercial Code developed in the Polish territories.
Francuski Code de commerce recypowany został na ziemiach polskich w 1809 r. i obowiązywał formalnie przez ponad 120 lat. Przeszczepiony został jednak z porewolucyjnej Francji do realiów feudalnych, w których nigdy wcześniej nie obowiązywał żaden kodeks handlowy, bez koniecznych prac przygotowawczych, implementacji ustawodawstwa okołokodeksowego związanego z Code de commerce czy ofi cjalnego tłumaczenia i przy znikomym zainteresowaniu nauki prawa w pierwszych dekadach obowiązywania, co w znacznym stopniu wpływało na jego stosowanie. Niniejsza publikacja, stanowiąca przyczynek do kompleksowego studium tego zagadnienia, obrazuje, w oparciu o analizę wybranych aktów notarialnych dokumentujących poszczególne czynności handlowe, jak przebiegał proces praktycznej implementacji norm francuskiego Kodeksu handlowego na ziemiach polskich.

Opis:: Readiness to learn to read must be shaped at the level of preschool education. One of the innovative methods of teaching pre-school children to read is the natural language teaching method developed by Wenda Pye. The programme consists in the teaching of listening, speaking, reading and writing using games and creative activities. The learning process is accompanied by children’s creative activity. Therefore, the natural language teaching method is perceived not only as the process of language learning but also, and most importantly, as educating through language, where language is both a means of communication and a thinking tool. The concept is based on the belief that child’s language is a specific phenomenon determined, on the one hand, by natural child development and, on the other hand, by child’s interactions with the environment. Consequently, child’s language education should be enhanced by a subtle help from an adult, who – by the use of provocation, arrangement and gentle encouragement to take actions – opens up a new, unknown space to the child, i.e. the world of writing. Language plays a role of a factor that integrates various fields of knowledge and different types of child’s activity in reality perception and acquisition. Natural situations used in the teaching of reading, which create occasional educational situations, inspire the child and simultaneously introduce him into the world of writing. Thus, learning to read should be accompanied by learning to write. The discovery of new values that the novel language of signs has with regards to information acquisition increases child’s motivation to verbalise his own thoughts and to learn to read and write. Emotional engagement facilitates memorizing a story or new vocabulary. It sensitizes the child to the graphical, phonological and semantic dimension of a given word by making a direct link between the graphical representation and the sound. A point of departure for natural language teaching is a short and simple text and illustrations that highly relate to it. Texts form stories included in little books entitled “Sunshine Library”. There is a series of 40 books designed for pre-school children self-study of reading. The books are graded at four levels of difficulty. Didactic aids used in the series are very well organised and introduce already consolidated semantic structures, providing new contents regarding language competence at a slow pace. Each book is composed of three stories. Typically, the first story includes one text with carefully selected new language structures. The following two stories serve the purpose of material consolidation. The essence of the books are pictures, which should be in line with the text because the basis of reading is to associate an image with its graphical representation. The print used in the books is large, legible, the words are clearly separated, and every sentence starts with a new line. The stories are simple and presented with repetitive sentence patterns. Natural language teaching develops and deepens child’s natural willingness to speak, read or draw graphical symbols. Speech is here not only the foundation of child’s expression and learning to read and write, but also a support for child’s paralanguage activity. The article presents the use of the natural language teaching method in pre-school children education.

Opis:: Currently we are witnessing migration, which for different reasons exhibits a growth tendency. It does not just concern big cities, but also smaller towns, where we can encounter people with different cultural backgrounds, religion, dialect, and values. Opis:: The article focuses on the issue of personal jurisdiction of commercial tribunals in selected judgements issued by the Appellate Court of the Free City of Krakow. Considering the fact that court records held in Polish archives (related not only to commercial cases) have been mostly destroyed, and commercial judicature in the territories of the so-called former Galician departments only functioned for a few years, its output deserves special attention. Especially since this matter as provided for in the Commercial code was unclear and ambiguous, and the Krakow judges adjudicated in compliance with the French line, which had shaped not only based on the provisions of the Code de commerce, but above all based on the successively produced in France additional legal acts related to the commercial law, rich case law and legal science that supplemented the code. They had not been adopted in the Polish territories, and publications aiming to familiarize the Polish lawyers with them did not start to appear until the ‘40s of the 19th century, and Polish scholars did not exhibit a serious interest in the area of commercial law until the ‘60s of that century.
Artykuł koncentruje się na zagadnieniu właściwości osobowej trybunałów handlowych w wybranych wyrokach Sądu Apelacyjnego Wolnego Miasta Krakowa. Biorąc pod uwagę fakt, iż akta sądowe w archiwach polskich (nie tylko odnoszące się do spraw handlowych) w większości uległy zniszczeniu, a sądownictwo handlowe na terenach tzw. departamentów pogalicyjskich funkcjonowało jedynie przez kilka lat, jego dorobek orzeczniczy zasługuje na szczególną uwagę. Tym bardziej, iż we wzbudzającej wątpliwości i niejednoznacznie uregulowanej w samym Kodeksie handlowym kwestii krakowscy sędziowie orzekali zgodnie z obowiązującą wówczas linią francuską, kształtującą się w oparciu nie tylko o normy Code de commerce, ale przede wszystkim namnażane sukcesywnie we Francji ustawodawstwo okołokodeksowe, bogate orzecznictwo i doktrynę związana z kodeksem. Nie obowiązywały one na ziemiach polskich, a publikacje je przybliżające zaczęły w większym nasileniu pojawiać się w latach 40. XIX w. O poważnym zainteresowaniu polskich przedstawicieli nauki prawem handlowym można mówić dopiero właściwie od lat 60. XIX stulecia.

Opis:: Many aspects of the application of the French 1807 Commercial Code gave rise to doubts and disputes, which had to do with the much lower level of legislative technique than in the case of the Civil Code. One of such problems was the issue of jurisdiction of commercial tribunals, resting, among others, on the premise of performing commercial acts, whose legal defi nition was not provided by the Code de commerce. In France, the code was accompanied by successively produced other legal acts related to the commercial law and by a rich output of legal science and case law. Th e former were not adopted in the Polish territories along with the adoption of the Commercial Code in the 19th century, and the other elements of French legal culture concerning this area were very hard to come by, as the Polish scholars were scarcely interested in the domain of commercial law. As an eff ect, the judges, oft en adjudicating in difficult and complex cases, were left to their own devices. The article presents then the way how the judges applied code norms. This is illustrated by some examples of selected judgments issued by the Appellate Court in the Free City of Krakow, which concern the topic of commercial activities and jurisprudence of commercial tribunals.
Wiele kwestii związanych ze stosowaniem francuskiego Kodeksu handlowego z 1807 r. wywoływało wątpliwości i spory – nie bez związku ze zdecydowanie niższym poziomem techniki legislacyjnej niż w przypadku Kodeksu cywilnego. Jedną z nich była kwestia właściwości trybunałów handlowych, opierająca się m.in. na przesłance dokonywania czynności handlowych, których jednakże legalnej defi nicji w Code de commerce zabrakło. We Francji kodeksowi towarzyszyło sukcesywnie namnażane ustawodawstwo okołokodeksowe oraz bogaty dorobek doktryny i orzecznictwa. Do przyjęcia tego pierwszego w ślad za Kodeksem handlowym na ziemiach polskich w XIX w. jednak nie doszło, a zapoznanie się na początku stulecia z pozostałymi elementami kultury prawa francuskiego w tym zakresie w wysokim stopniu utrudniał fakt niemalże całkowitego braku zainteresowania przedstawicieli polskiej nauki dziedziną prawa handlowego. W efekcie, orzekający w nierzadko trudnych i skomplikowanych sprawach sędziowie pozostawieni byli sami sobie. Sposób stosowania przez nich norm kodeksowych na przykładzie wybranych orzeczeń Sądu Apelacyjnego Wolnego Miasta Krakowa dotyczących zagadnienia czynności handlowych i związanej z nimi właściwości trybunałów handlowych stanowi przedmiot niniejszej publikacji.

A second language was introduced as a compulsory subject in kindergarten and primary school and two compulsory foreign languages in general lower and upper secondary schools. English is the most popular of all languages in all types of schools, regardless of the level of education they represent. Globalization of the English language, the process which can be observed nowadays, has a significant impact on actions taken by schools to popularize learning this language. Therefore, the research was performed with a view to achieving a better understanding of the popularization of English language learning in primary schools in the larger context of a variety of factors. Basing on the analysis of research results, the conclusions reflecting real needs of learners as far as the more effective English language learning is concerned have been drawn. Sharing the research findings with the primary schools which participated in the research will contribute to their practical application.

Opis:: Niniejsza publikacja ma natomiast na celu wykazanie, że już w XVII w. prowadzone były w zakresie prawa cywilnego materialnego prace kodyﬁkacyjne. W ich efekcie opracowano projekt kompleksowego i nowatorsko usystematyzowanego aktu prawnego, który mógł z powodzeniem pełnić rolę kodeksu cywilnego. Nie doczekał się on wprawdzie promulgacji, niemniej jednak korzystał z niego w XVIII w. kanclerz H.F. d’Aguesseau w pracach nad swoimi ordonansami, które następnie zostały inkorporowane do treści Kodeksu cywilnego z 1804 r. Korzystała z tego projektu także sama komisja napoleońska J.É.M. Portalisa, a wiele jego postanowień zostało później skopiowanych w Kodeksie Napoleona.
