Opis:
W artykule przedstawiono analizę prawną relacji wzajemnych lotniczo-morskich w świetle regulacji prawnomiędzynarodowych i praktyki, a także doktryny. Ukazano współzależności tych relacji i zasady korzystania przez lotnictwo cywilne i wojskowe z przestrzeni powietrznych nad obszarami morskimi, według ich systematyki przyjętej w Konwencji NZ o prawie morza (1982). Określone płaszczyzny korelacji uregulowań prawa morza, prawa morskiego i prawa lotniczego dotyczą relacji między statusem prawnym i reżimem różnych akwenów morskich a prawem statków powietrznych do przelotu nad nimi. Zasygnalizowano także sytuacje prawne i praktyki państw odmienne od powszechnie przyjętych standardów. Przedmiotem analizy są także wybrane zagadnienia bezpieczeństwa morskiego, m.in. w obliczu zagrożenia piractwem oraz zagadnienia ochrony środowiska morskiego – w kontekście działań wspomagających – podejmowanych przez lotnictwo pozostające w służbie państwowej, w świetle regulacji prawnych i praktyki.
The article provides legal analysis on co-dependence between nautical and aviation regulations in international law and practice. The study focuses on overflight rights with respect to civil and military aviation across distinct types of waters as defined by the United Nations Convention on the Law of the Sea (UNCLOS 1982) where the Author differentiates the common legal standard from particular legal regulations giving rise to divergent practices of some countries. The article touches also a number of issues relating to maritime security (including the threat of piracy) and to environmental protection in the context of regulation and practice of airborne activities carried out by states’ authorities and services.

The author discusses the main sources of marine environment pollution and measures to prevent, reduce, and control to ensure effective protection, and cooperation on a global or regional basis. Legal measures have been included for enforcement with respect to the marine environment from harmful effects that may arise from pollution from land-based sources, pollution by dumping, pollution from vessels, and pollution from activities in the Area. Enforcement comprises proper measures by flag and port States as well as coastal States. Topical issues have been discussed rules and principles regulated by the United Nations Convention on the Law of the Sea (1982). i.e. uses of the seas and oceans, the conservation of their living resources" and the study, protection, and preservation of the marine environment. Also, the same selected matters of the marine environment protection and regional co-operation in Europe as well as in Asia and Pacific rims have been included.

Opis:
The author of this article presents the notion and meaning of international protection of the marine environment and offers a solid legal and philosophical background to this issue. He points at and systematically analyzes a kind of compendium of selected main legal and philosophical principles as environmental values, included in the United Nations Convention on the law of the sea (1982). The author discusses both environmental management at seas as a global system and topical issues in the light of international legal instruments, doctrine, and some practical experiences. He also shows the environmental law as an increasingly important area of new interdisciplinary study and addresses how this law and science may best able to address the key issues facing the marine environment in the 21st century.
