The Belt and Road Initiative (BRI) is an international project involving many countries around the world. The economic development and the implementation of new infrastructural and investment projects have been giving rise to a growing number of cross-border disputes. To meet these challenges China has created specialized entities, competent to solve disputes arising from the BRI. The aim of this article is therefore to identify? the latest trends in this area and to assess whether the Chinese solutions and proposed dispute resolution methods will permanently change the global landscape.

This article review presents the current points of view regarding “hot topics” widely discussed in Chinese press. They have been compiled in the book titled “Chinese Press on the Country’s Socio-Cultural Changes at the Beginning of the 21st Century” edited by Krzysztof Gawlikowski et al. The authors endeavour to explain the most significant socio-cultural changes that have occurred recently in China. Hence, the article touches upon issues such as role of Confucianism in modern China, system of education, relation between authorities and citizens, new perspectives on hukou system as well as familial relations and health care system in China.

The Holy See (Sancta Sedes) is the specific subject of the international law. The acknowledgement of the legal subjectivity is related to the possession of the legal capacity and the capability of the legal international proceedings. The Holy See is treated as an autonomous subject which has its own rights and obligations concerning the international affairs. It has right to send and receive the minister residents (ius legationis), to enter into the international contracts (ius tractandi), to participate in the conferences and to be member of the inter-national organizations (ius foederum).

Along with the development of the „Belt and Road” Initiative, there is much more economic relations between Polish and Chinese entrepreneurs. Therefore, the disputes can arise in the future. Taking this into consideration, it is worth to protect interests of both parties and conclude an arbitration agreement. The aim of this article is thus to introduce the binding provisions concerning arbitration in China and to prove that despite China’s accession to the New York Convention and taking into account the UNCITRAL Model Law, there is still arbitration with Chinese characteristics. The article focuses primarily on the social and cultural background in China and indicates the development of the alternative dispute resolution. It describes further the historical aspects of the arbitration in China (from 1949 to 1994), when the Arbitration Law of the People’s Republic of China was adopted. Finally, it presents the features of this legal act and the elements of the arbitration agreement under Chinese law.

While analysing provisions concerning legal professions in Mainland China, we can observe that the procedure of obtaining necessary qualifications is really complicated. It requires the approval of judicial administration department (of lower and upper level) and finally, the issuance of lawyer practice’s certificate. The same rules are applicable to the Chinese law firms. However, foreign law firms, which would like to provide legal service within the territory of the People’s Republic of China, need to comply with more restrictive requirements. Moreover, we can notice some changes in the Chinese legislation concerning lawyers’ professionalism and quality of legal service. The Communist Party of China makes some efforts to reduce corruption in the Chinese legal environment. Despite mentioned reforms, China still meets challenges related to the lawyers’ independence.

Chinese legal system changes dynamically. The conception of the “socialist rule of law with Chinese characteristics”, introduced in 2014, confirms such theory. According to this idea, some legislative works in civil law were undertaken. The aim of the article is to present the historical aspects of this branch of law, its development in the Middle Kingdom and indicate as well the actual binding regulations of the civil law. The article seeks to provide an analysis of the general rules of the civil law which contains the first part of the new civil code. There are also mentioned some aspects of the marriage and property law in China.

An ombudsman is a very important institution which protects citizen’s rights and freedoms. The appropriate actions taken by this person guarantees the human rights’ protection and contributes to the strengthening of the legal authority. An ombudsman in Macau (Special Administrative Region of the People’s Republic of China) functions within the framework of the Commission Against Corruption. This institution receives complaints against the central government bodies. The article presents some cases examined by the ombudsman. The analysis of the above-mentioned examples presented in the ombudsman’s report lead to the conclusion that this institution fulfils more significant legal functions. There are still some challenges behind this authority. Especially, the civil and political rights should be guaranteed. It is indispensable to undertake further activities in order to update such fundamental principles as the equal and universal suffrage and the freedom of speech.

Chinese authorities have taken decisive steps to tackle violations of intellectual property (IP) rights in the People’s Republic of China (PRC). The National People’s Congress (NPC) adopted a new amendment to China’s criminal law on December 26, 2020. These regulations entered into force on March 1, 2021. The article aims to draw attention to the recent developments and ways to fight against the IP infringement in China. The study focuses on the IP courts in China and then analyzes the recent amendment to Chinese criminal law. Therefore, it is based on the descriptive and dogmatic methods. The article seeks to answer the question of whether the regulations are effective and significantly prevent the spread of IP infringements in China. It brings us to the conclusion that China’s accession to the WTO was a turning point that influenced the development and the improvement of domestic IP regime. Hence, China became a country with complex, multifaceted, and contentious environment regarding IP rights. One of the most significant changes concern the establishment of IP courts across China. It is too early to determine whether these solutions are effective due to the ongoing COVID-19 pandemic in China.

This article provides a comprehensive analysis of Bruce Lee’s case by presenting the intellectual property rights mechanisms in the People’s Republic of China. The aim of this paper is to bring attention to the trademark law as well as to shed new light on infringements of personality rights, in particular portrait rights, in trademarks. This begs the question as to what kind of legal action should be undertaken by Bruce Lee’s heiress to protect her rights. Moreover, the article touches upon the conflict between the public interest and trademarks and tries to answer the question how to balance private holders’ rights with the public interest. In order to provide some hypothetical scenarios, the study focuses primarily on Bruce Lee’s case background and the new amendments to trademark law in China, bringing the authors to final deliberations on Bruce Lee as part of modern culture belonging to mankind as a whole. Therefore, our research aims to find a solution to the challenging problem of reconciling intellectual property rights protection mechanisms with the common cultural heritage.
Artykuł zawiera analizę kazusu Bruce’a Lee przedstawiając ostatnie i zarazem przecierające nowe szlaki mechanizmy ochrony prawa własności intelektualnej na terytorium Chińskiej Republiki Ludowej. Celem artykułu jest zwrócenie uwagi na prawo znaków towarowych, jak również nowe spojrzenie na naruszenie praw osobistych, w szczególności prawa do wizerunku w znakach towarowych. Nasuwa się zatem pytanie, jakie czynności prawne powinny zostać podjęte przez spadkobierców Bruce’a Lee, aby chronić ich prawa. Co więcej, w artykule porusza jest również kwestia interesu publicznego w prawie znaków towarowych, a także autorzy poszukują odpowiedzi na pytanie, w jaki sposób zrównoważyć prawa prywatnych właścicieli z interesem publicznym. W celu przedstawienia hipotetycznych scenariuszy, artykuł w pierwszej kolejności odnosi się do samego kazusu oraz nowelizacji prawa znaków towarowych w Chinach, w dalszej zaś części do rozważań na temat Bruce’a Lee jako elementu składowego kultury współczesnej, należącej do całej ludzkości. Celem niniejszego artykułu jest więc znalezienie rozwiązania dla trudnych przypadków, w których celem staje się pogodzenie mechanizmów ochrony praw własności intelektualnej ze wspólnym dziedzictwem kultury.
