    При выполнении лабораторных и практических занятий в процессе изучения биологических и медицинских дисциплин центральное место принадлежит животным. Развитие технологий и достижение этической мысли позволили изменить взгляд на отношение исследователя-экспериментатора к объекту своего исследования. На кафедре физиологии в Санкт-Петербургском университете преподаватели постепенно отказываются от использования животных при выполнении практических занятий, активно внедряя альтернативные методы обучения студентов-медиков. Такие перемены происходят благодаря тому, что студенты все чаще отстаивают свою позицию не причинения вреда животным. Замена животных альтернативными методами не наносит вреда качеству образования и содержит ряд существенных преимуществ: скорость и глубину обучения, индивидуальный подход, повторяемость, легкость контроля и оценки результата, возможность самообучения, позитивного отношения к живому.
    Podczas wykonywania ćwiczeń laboratoryjnych i praktycznych na studiach biologicznych i medycznych centralne miejsce zajmują zwierzęta. Rozwój technologii i osiągnięcia myśli etycznej pozwoliły zmienić pogląd na stosunek badacza-eksperymentatora do przedmiotu jego badań. Na Wydziale Fizjologii Uniwersytetu w Petersburgu wykładowcy stopniowo rezygnują z wykorzystywania zwierząt w ćwiczeniach praktycznych, aktywnie wprowadzając alternatywne metody nauczania studentów medycyny. Takie zmiany zachodzą ze względu na fakt, że studenci coraz częściej bronią swojego stanowiska, aby nie szkodzić zwierzętom. Zastąpienie doświadczeń ze zwierzętami metodami alternatywnymi nie wpływa na jakość kształcenia i ma wiele zalet: szybkość i dokładność szkolenia, indywidualne podejście, powtarzalność, łatwość monitorowania i oceny wyników, możliwość samokształcenia, pozytywny stosunek do życia.
    Animals are at the heart of biological and medical disciplines when carrying out educational and research exercises, both in the laboratory and in the classroom. Recent technological developments and the advancement of ethics have made it possible for traditional views on the relation of the researcher-experimenter to the research subject to evolve. At the Department of Physiology at St. Petersburg University, teachers are gradually abandoning the use of animals in practical exercises, actively introducing alternative methods of instruction to medical students. Such changes are taking place due to the fact that an increasing number of students defend the position that animals ought to remain unharmed. Replacing animals with alternative methods of research does not impair the quality of education and has a number of significant advantages: speed and depth of training, an individualistic approach, repeatability, ease of monitoring and evaluating results, the potential for autodidactic study, and a positive attitude to life.

    W artykule przedstawiam podstawy prawne działalności Komisji Etycznych ds. Doświadczeń na Zwierzętach w Polsce i w Unii Europejskiej, a także genezę i ewolucję zasad etycznych im przyświecających. W szczególności koncentruję się na stanie realizacji tzw. zasad 3R (zastępowanie, ograniczenie i udoskonalenie) w praktyce badawczej oraz w opiece nad zwierzętami laboratoryjnymi i biorącymi udział w doświadczeniach naukowych. Wiele instytucji i organizacji (NIK, Komisja Europejska, Komitet Etyki w Nauce PAN i organizacje pozarządowe) wskazuje na niedostateczne wdrażanie tych zasad w Polsce. W artykule identyfikuję główne obszary tych deficytów, a także formułuję praktyczne wskazówki dla badaczy. Tekst diagnozuje też obszary sporne oraz konflikty wartości związane z działalnością komisji etycznych. Społeczna percepcja zagadnień bólu, emocjonalności i świadomości zwierząt zmienia się wraz z postępem wiedzy biologicznej, co rzutuje na realizację wartości etycznych w praktyce badawczej. W procesie tym pośredniczą komisje etyczne.
    Im Artikel stelle ich die Rechtsgrundlage für die Aktivitäten der Ethikkommissionen für Tierversuche in Polen und in der Europäischen Union sowie die Entstehung und Entwicklung der ethischen Grundsätze dar, die sie leiten. Insbesondere konzentriere ich mich auf den Stand der Umsetzung der sogenannten 3R-Prinzipien (Ersatz, Reduktion und Verbesserung) in der Forschungspraxis und in der Pflege von Labortieren und Tieren, die an wissenschaftlichen Experimenten teilnehmen. Viele Institutionen und Organisationen (NIK, die Europäische Kommission, der Ausschuss für Wissenschaftsethik der Polnischen Akademie der Wissenschaften und Nichtregierungsorganisationen) weisen auf eine unzureichende Umsetzung dieser Prinzipien in Polen hin. In dem Artikel identifiziere ich die Hauptbereiche dieser Defizite und formuliere praktische Tipps für Forscher. Der Text diagnostiziert auch strittige Bereiche und Wertekonflikte im Zusammenhang mit der Tätigkeit von Ethikkommissionen. Die öffentliche Wahrnehmung der Themen des Schmerzens, der Emotionalität und des Bewusstseins der Tiere ändert sich mit dem Fortschritt des biologischen Wissens, was sich auf die Verwirklichung der ethischen Werte in der Forschungspraxis auswirkt. An diesem Prozess sind Ethikkommission.
    The article presents the legal basis of the Ethical Commissions for Animal Experiments in Poland and in the European Union as well as the genesis and evolution of the ethical principles guiding them. In particular, it focuses on the implementation of the so-called 3Rs (replacement, reduction, and refinement) in research practice and in the care of laboratory animals and animals participating in scientific experiments. Many institutions and organizations (the Supreme Audit Office, the European Commission, the Ethics Committee of Science of the Polish Academy of Sciences, and non-governmental organizations) indicate insufficient implementation of these principles in Poland. The article identifies main areas of these deficits and provides practical guidance for researchers. The text also diagnoses main problems and axiological disputes related to the activities of ethical committees responsible for guarding the welfare of experimental animals. Social perception of the issues of animal pain, emotionality, and awareness changes with the progress of biological knowledge, which affects the implementation of values in research practice. This process is mediated by ethics committees.

    The Act of February 4, 1994 on Copyright and Related Rights, which regulates issues related to the protection of copyrights, belongs to the private law system (its provi- sions protect the private interest). However, the Act includes both administrative and criminal law provisions aimed at protecting the public interest. The literature rightly points out that the systemic division into public and private law is becoming increasingly less pronounced, due to the permeation of legal domains belonging to both systems. An example of such interpenetration are the provisions of copyright law. This statement is significant for the considerations made in this article due to the statutory method of penalising certain behaviour contained in the provisions of the Copyright and Related Rights Act. Criminal law provisions, systemically related to public law and protecting the public interest, contain references to the provisions of the Copyright and Related Rights Act regulating the scope of copyright protection, i.e. private law norms. In the context of the requirements that should be met by criminal law, such a reference raises doubts, which are particularly highlighted in Art. 115 para. 3 of the Copyright and Related Rights Act. This issue is impor- tant because the Constitutional Tribunal in its judgment of 17 February 2015, Ref. K 15/13 recognised this provision as constitutional. Therefore, he concluded that the principle of the specificity of a criminal act does not preclude the legislator from using terms that are imprecise or vague if their designations can be determined. At the same time, the Constitutional Tribunal has not presented any arguments indicating that in this case the determination of the designates of Art. 115 para. 3 of the Copyright and Related Rights Act does not cause any difficulties. The author of this article attempts to determine the extent of criminal liability in the event of a violation of author’s moral rights (Article 115 section 3 of the Copyright and Related Rights Act), at the same time indicating the difficulties that are associated with the unambiguous determination of behaviour which Art. 115 para. 3 of the Copyright and Related Rights Act penalises.

    Opis:
    The issue of entering subsidies from the European Union means designed for financing industrial studies and/or developmental work as well as of implementation of the results of these studies or work in the area of economic activities of the entrepreneur within the operating program Innovative Economy 1.4-4.1 Action „Supporting Targeted Projects and Supporting Implementation of B+R work results” is a topical one because of the possibility to obtain the subsidies that companies enjoy after Poland joined the European Union. Subsidizing the completed developmental work within the „study stage” of the 1.4-4.1 Action is a „subsidy for the assets” and should be entered in the account books as the income of future periods. In the next periods the sums counted as inter-period income gradually increase the remaining operation income, parallel to amortization or remitting allowance for the cost of developmental work financed from this source. Subsidizing the building of fixed assets and nonmaterial or legal assets within the „implementation stage” of the 1.4-4.1 Action is a „subsidy for the assets” and should be entered in the account books, taking into consideration the regulations of Art. 41 section 1 paragraph 2 of the Law of Accountancy. The way the assets have been acquired does not affect the way they should be entered – it does not matter whether they have been purchased or financed by way of leasing. Subsidizing the outlays made by companies, that are operating costs belonging to the two stages of the 1.4-4.1 Action is a „subsidy for the income”. Such support should be included into the remaining operating costs.
