    Czescy pisarze-wygnańcy w Holandii: Jana Beranová i Jan Stavinoha w holenderskim polu literackim Literatura holenderska lat dziewięćdziesiątych charakteryzuje się znacznym wzrostem liczby tak zwanych pisarzy wielokulturowych lub międzykulturowych (uchodźców politycznych i migrantów drugiej generacji). Jana Beranová i Jan Stavinoha, dwoje autorów czeskiego pochodzenia, którzy zadebiutowali w poezji i prozy na początku lat osiemdziesiątych, nie w pełni uczestniczyli w tymże nurcie. Niniejszy artykuł dotyczy odbioru twórczości ich twórczości w Holandii oraz możliwości wejścia ich twórczości. Jednym z aspektów, który został zbadany bardziej szczegółowo, jest autoprezentacja autorów, a mianowicie to, czy i w jakim stopniu podkreślali swoje wygnanie.   De Nederlandse literatuur van de jaren negentig wordt gekenmerkt door een aanzienlijke toename van het aantal zogenaamde multiculturele (of interculturele) auteurs (politieke vluchtelingen en tweede-generatie migranten). Jana Beranová en Jan Stavinoha, twee auteurs van Tsjechische afkomst die in de vroege jaren tachtig debuteerden in poëzie en fictie, namen niet volledig deel aan deze trend. Dit artikel gaat over de ontvangst van het werk van deze twee ballingen in Nederland en de mogelijkheid van hun intrede in de literaire canon. Een van de aspecten die meer in detail zijn onderzocht, is hun zelfpresentatie, namelijk of en in welke mate zij hun ballingschap benadrukten. 
    De Nederlandse literatuur van de jaren negentig wordt gekenmerkt door een aanzienlijke toename van het aantal zogenaamde multiculturele (of interculturele) auteurs (politieke vluchtelingen en tweede-generatie migranten). Jana Beranová en Jan Stavinoha, twee auteurs van Tsjechische afkomst die in de vroege jaren tachtig debuteerden in poëzie en fictie, namen niet volledig deel aan deze trend. Dit artikel gaat over de ontvangst van het werk van deze twee ballingen in Nederland en de mogelijkheid van hun intrede in de literaire canon. Een van de aspecten die meer in detail zijn onderzocht, is hun zelfpresentatie, namelijk of en in welke mate zij hun ballingschap benadrukten. 
    Dutch literature of the 1990s can be characterised by a significant boom in the so-called multicultural (or intercultural) authors (political refugees and second-generation migrants). Jana Beranová and Jan Stavinoha, two authors of Czech origin debuting in poetry and fiction in the early 1980s, did not fully participate in this trend. This article deals with the reception of these two exiles in the Netherlands, and the possibility of their entrance into the literary canon. One of the aspects investigated in more detail is their self-presentation, namely, whether, and to what extent, they assumed an exilic posture.

    Opis:
    In this contribution I am tracing the legal history of the concepts coutume and usage back from today’s international mercantile law to the Tribunal de la Conservation in early modern Lyon. From the late 19th century some theorists were regarding usage as normative when it could be derived from the consensus between contracting parties. We find this conception of usage, for example, in the CISG. On the other hand, the more romantical strain of theorists on the law merchant was stressing that customary law was normative regardless of the possibility to derive it from the parties’ agreements. In early modern Lyon merchants were invoking usages (and to a lesser extent also coutumes) at the Conservation frequently. Because of the juridification of this tribunal in the late 17th century, we expected that the use of the words coutume and usage was in line with the doctrinal conceptions of their days (according to which coutume was a form of written normative customary law and usage was a non-written normative customary law). This, however, was not always the case: sometimes the judges of the Conservation were using the words in a rather loose sense.
