The article presents a historical analysis of the content of one subject offered since 1956 to the Polish students of law, namely the “History of political and legal doctrines.” Until the 1989 this subject was treated as an introduction and presentation of only false, non-scientific ideas, confronted with the only true Marxist theory of law and state. After 1990 the subject called “Political and legal doctrines” or “Political and legal ideas” was steadily developing, it gave the broad knowledge of different political ideas like liberalism, conservatism, socialism as well as knowledge of different understanding of law, beginning with natural law, positivism and so on. At the same time the subject was depreciated and treated as a second rank, the score for students steadily diminished or the subject became non-obligatory. The article describes the long discussion of researchers and academic teachers of “Political and legal doctrines” at the faculties of law, focusing on the content of subject, the scope of coursebooks, the methodology of research and the methods of teaching. But the most important argument is, that “political and legal doctrines” became actually – together with history of law – almost the only subject, giving the students understanding and knowledge about the connection between philosophy, social science and law. The vast horizons seem necessary for lawyers, if they don’t want to be excessive positivist and dogmatic practitioners of statutes. The knowledge of different doctrines should allow them in future to have critical and broaden attitude to statutes. The conclusion is, that without the studying of “Political and legal doctrines” the studies of law change into simple dogmatic legal training.

Modern Russian philosophy of law is under the great influence of Soviet theory of state and law. The article shows its development from the beginning of the XX century, dividing this period into 6 main stages according to the historical, political and scientific changes in the country. Most attention is paid to the modern trends and personalities.

Opis:
General frames and approach of institutional theory of contracts enable the presentation of traditions and the development of homo contractus conception as well as exploration area of conflict interests between state and economy which is connected with its activity. Discussions about the beginnings of institutional doctrine and jurisprudence devoted a lot of attention to relations of three key notions. I think that from the depths of antropoethology emerged the notion of instinct. For T. Veblen – a master of “old” institutional economics – it was enough to define the “institution” notion and for modern “new” institutional economists it served as facilitation for the analysis of behavior of contractors. Jurists and economists met very early – rather as friends – on the area of the second notion – custom – and its role in establishing state laws. The agreeable cooperation was disturbed in debate about the last notion – institution. An important question arises: Is an institution a part of Justinian Code or a pattern of behavior inherited from the past? Antiquity cannot cross the border between praxis and science though it created such monuments as Hammurabi Code. Roman law is now an accepted source of science of European law. The precision of liabilities law, the synthesis of Greek and Roman thought and elasticity of authorities facilitated the adaptation of norms of tribal law. Emerging new economic doctrines – canonistic, mercantilism, physiocratism and finally classical economics − opened the area for social-economic contacts widely and helped to reach a lot compromise also in contracting. Contemporary theory of contracts occupies a prominent place in universal economic thought and is now a good partner in relations with jurisprudence. The challenge for our community are realities of integration and globalization processes causing conflicts in the area of contracts control. More and more attention is devoted to the questions of law and economics, the fame of Chicago School is growing, there are some Nobel Prizes and teaching this discipline in Poland is successful.

This paper analyses the growth of Asian economies through its export-led industrialisation policies. Such growth has been uniquely achieved without greater reliance to law, which the neoliberal approach considers integral to development. Among others, this approach relies on private laws for the protection of property and contractual rights for the efficient and smooth functioning of the market where the state has little or no intervention. In this regard, the paper discusses the role of law in development and economic growth. It is submitted that the instrumental use of law and active state intervention in the Asian examples considered in this paper raises significant doubts on the necessity of law for economic growth.

Opis:
The article focuses on justice understood as value in modern state and law. It is accompanied by a research question whether justice is a certain value, a principle that is inalienable and universal, which should accompany modern state and law, if we want to call it the rule of law. First of all, the historical faces of justice in the state and law were presented. In this part of the article, the author presents selected examples of considerations on justice in the broad sense, which took place at the turn of history, and which still remain - even partially timely. Secondly, the article presents considerations focused around the concept of “Iustitia fundamentum regnorum – Justice is the mainstay of the state.” The author presents in it reflections on the state and law, positive and natural law as well as the role of justice. also characterizes its essence. Finally, conclusions are presented.

This paper presents the real sense of the classical and quantum theory of gravitation as a component of the actual picture of the universe where the volume, as the size of the expanding universe, approaches infinity, while the total of material masses goes to zero. At present, these two standard theories describe the phenomenon of gravitation but do not explain the very mechanism and the cause of this process. This constant and real lack of information on that subject is consistent with natural laws and the same with the laws of physics, which were already experimentally determined by Werner Heisenberg in 1927. The paper also presents the causes of inability to explain up to the present the actual picture of the essence of the universe.

The aim of the paper is to reconstruct the theoretical background and practical meaning of the so called war writings which emerged within the phenomenological movement during the First World War. The author exemplifies it by researching the works of two German representatives of this movement, Max Scheler and Kurt Stavenhagen. He focuses on their application of the phenomenological method to the analysis of Russian national identity, and historical as well as cultural foundations of Russian state. The paper’s main thesis is that the politicization and militarization of phenomenology consisted in both “personalization” and “sociologization” of the phenomenological approach to the problem of the state. While interpreting Scheler’s personalism as an exemplification of the approach to the state as a problem of social ontology, the author reconstructs the theoretical conditions of analyzing the Russian imperial state in terms of the “world.” The focus of the paper is particularly on the phenomenology of, as Scheler put it, Russian collective personality and Russian national consciousness or “soul” as well as on the question of legitimacy of Ukrainian resistance against Russian imperialism.

W klasycznym podziale prywatyzacji zadań państwa przyjętym w polskiej nauce prawa wyróżniono jej dwa rodzaje: 1) prywatyzację sensu stricto i 2) prywatyzację sensu largo. Pierwsza oznacza całkowite wycofanie się z danej dziedziny aktywności przez państwo, druga – zlecenie realizacji zadań państwa podmiotom niepublicznym, przy zachowaniu roli państwa jako organizatora oraz odpowiedzialności państwa za działania podmiotów prywatnych i realizację zadań. Można jednak w praktyce obrotu odnotować przypadki, w których państwo zasadniczo wykonuje swoje zadania, a jedynie określone funkcje są przekazywane podmiotom prywatnym. Możliwe jest postawienie pytania, czy w takim przypadku mamy do czynienia z prywatyzacją zadań państwa, a jeśli tak, czy przyjmowana aktualnie typologia rodzajów prywatyzacji jest wystarczająca do opisania form, jakie przyjmuje prywatyzacja w chwili obecnej. Zdaniem autora typologię należy uzupełnić o kategorię outsourcingu, która również mieści się w zbiorze działań państwa, a którą można określić jako prywatyzację, a jednocześnie nie jest ani prywatyzacją sensu stricto, ani też sensu largo.
Widely accepted in polish legal doctrine, classic typology of state tasks privatization is based on two cathegories: 1) sensu stricte privatization, and 2) sensu largo privatization. The first one refers to a situation in which state completely withdraws from a given scope of activity, while the latter relates to a situation in which the state contracts execution of specified tasks to a non-governmental entity, while retaining the organization role for itself as well as the liability for proper performance of contracted tasks. In practice, however there can be observed another, different category of situation in which, from legal perspective, the state is executing its tasks, but yet some specific actions or processes, which constitute elements of given state task are contracted to non-governmental entities. Hence it is possible to put the question, whether in this last situation it still allowed to refer to as to state tasks privatization and if so, is the commonly accepted typology of different types of privatization sufficient for description of all presently observable forms of such privatization. In authors humble opinion, classic state tasks privatization typology needs to be complemented by a third category – outsourcing, which also falls within the scope of actions generally defined as state tasks privatization, however cannot be classified neither as sensu strico privatization, nor as sensu largo privatization.
