Decentralizacja, rozumiana jako brak hierarchicznego podporządkowania, jest podstawowym warunkiem podziału administracyjnego w Polsce, przyczyniając się do tworzenia modelu demokratycznego państwa prawa. Baza tej struktury władz lokalnych, w tym okręgów samorządowych związanych z koncepcją decentralizacji, jest wyrazem zasad politycznych przyjętych w Polsce po 1989 roku. Powiązane koncepcje zostały także wskazane. Charakter władz lokalnych, ich oddziały utworzone na potrzeby zarówno rządowej, jak i samorządowej administracji, zostały tu również objaśnione. Analizując zagadnienia związane z lokalną administracją, omówiono tu także zasadę pomocniczości – znajduje ona zastosowanie w polskim systemie prawnym, jak i katolickiej nauce społecznej. Samorząd jest formą zaangażowania człowieka w sprawy publiczne o charakterze lokalnym. Dzięki temu przyczynia się do tworzenia społeczeństwa obywatelskiego, które zakłada wspólną i świadomą artykulację, pogłębianie i obronę wspólnych interesów, potrzeb i aspiracji.
Decentralization understood as the absence of hierarchical subordination makes a basic condition of district government in Poland, contributing to creating the model of democratic law–governed state. On account of that structure of local authority, including district government connected with the concept of decentralization is an expression of political principles adopted in Poland after 1989. Related conceptions have been also pointed out. The nature of local authorities, their divisions created for the need of both governmental and self-government administration have been explained. Analysing issues connected with the local administration, the principle of subsidiarity has been mentioned – being widely used in the Polish legal system as well as in catholic social learning. Local government is form of man’s involvement in public matters of a local character. Owing to this, it contributes to the formation of civil society that assumes common and conscious articulating, advancing and defending common interest, needs and aspirations. The problems of self-government, of looking into the needs of local communities, belong to the citizens themselves. Owing to this, those who are involved immediately have a real influence on the course of public matters.

Issues related to national security problems have long been of interest to many research centres. National security, due to its role and importance for the functioning of both the state and society, has become an important research area not only for military specialists, but also civilian experts. However, despite the unquestioned principle of the need to study the problems of national security, dispute issues are increasingly appearing that require new solutions based on scientific foundations or a fuller interpretation of the applicable rules of conduct. Security as a research area is multidimensional, it is analysed primarily in terms of organisation and subject. Therefore, there is no doubt the thesis that ensuring security is a fundamental duty of the state, because it really determines the sense of its existence. The security of the state is of course also the security of its citizens. Since the dawn of human history, the security of the individual has been associated with state-forming processes. Unfortunately, security, like many other common phenomena of everyday life of individuals and societies is intuitively made aware and does not succumb to unambiguous definitions, which is why a number of discussions arise and not only in the scientific community. The national security of the Republic of Poland is a specific range of challenges generated for the state. The article looks at the conditions of external and internal national security of the Republic of Poland, which is the starting point for research on national security. National security was defined and its typology made.

The article presents an analysis of military law in the legal system of the Republic of Poland. On the one hand, it is a very specialized area of law, and on the other, it is a very extensive field regulated in several hundred national legal acts of varying importance (universally and internally binding), as well as by international law. The author attempts to organize the subject matter of military law and to specify its elements divided into subject-specific blocks. At the same time, in order to ensure a better understanding of the nature of military law, the article discusses the role of the Armed Forces of the Republic of Poland in times of peace, crisis, and war.The author used critical analysis of literature on legal science and security sciences, and source materials: mainly acts of universally binding law (the Constitution, acts, and regulations), as well as acts of internally binding law (instructions, ordinances, resolutions, decisions, guidelines, and agreements of various state authorities).

Abstrakt angielski: The article discusses relations between labour (working people) and capital (businessmen, employers) from the perspective of the Constitution of the Republic of Poland. The notion „labour” in the Constitution denotes any gainful employment done by man for another subject, regardless of the legal basis of doing it. By capital we mean the owners as well as subjects of other property rights to the means of production performing business activity using hired labour. This activity requires cooperation between these two factors, but at the same time there occurs a natural conflict of interests between them. According to Art. 20 of the Constitution, the Polish economic system, defined as “social market economy, is based on private property and freedom of business activity as well as on solidarity, dialogue, and cooperation of social partners (i.e. of labour and capital). The principles of cooperation between labour and capital in the form of prognoses and making collective agreements are defined by Art. 59 of the Constitution. The Constitution protects “capital” by special protection of private property (Art. 21 and Art. 64) and by freedom of business activity (Art. 20 in conjunction with Art. 22). It also protects labour, stating in Art. 24 that “Labour is under protection of the Republic of Poland. The State supervises the conditions of performing labour”. Labour protection, i.e. protection of working people is justified mostly by the fact that people earning money for living by working for another subject they are economically dependent on, have weaker economic and social position, which may lead to their exploitation. The duty of the State is to counteract exploitation, which is mostly done by means of semi-imperative rules of labour law and ruling implements of supervision of observance of these rules by the employers. The principle of labour protection from Art. 24 of the Constitution has been developed in its other resolutions concerning labour freedom, minimum remuneration for work (Art. 65), the rights to safe work conditions and to recreation (Art. 66). The Constitution assumes cooperation between labour and capital, trying to preserve balance between the interests of both parties.

Purpose: The aim of the study is to show that war games and simulations used in the Armed Forces to improve military personnel bear the hallmarks of edutainment. Design/methodology/approach: The study is of a theoretical and empirical nature. The theoretical methods used, such as: analysis, synthesis, inference, analogy and abstraction based on literature and other available media specialist sources on the discussed topic. The use of empirical methods was in the form of observations and methods of collecting judgments and opinions with the informal interview technique with representatives from the Centre for Simulation and Computer War Games (CSiKGW). Findings: This researches were aimed at explaining the essence of the concept of edutainment, the concepts related to it, explanation of determinants determining the development of new forms of improvement off human resources in organisations and in the Armed Forces of the Republic of Poland. It was shown that edutainment is new, interesting form of educatin in so specific hierarchical organisations, such as Armed Forces. Originality/value: Author has obtained expert's opinions on the perception of war games and simulations as an effective form of improvement combining learning with elements of entertainment, i.e. as edutainment. Additional, in the theoretical research showed that edutainment is a successful form of learning and creating knowledge in innovative way.

The discussion about justification for the very existence of Senate, as it was the case in previous years, also took place prior to the 2015 parliamentary elections. Postulates for the second chamber of parliament to be abolished are the inseparable element of election campaigns in Poland. Announcements of total abolishment or change of: form, competencies or number and the election principles for members of Senate, although they found their expression in the 2015 election programs of some of the political parties, but they were never applied after elections. The single member Senate constituencies secured seats almost exclusively for candidates supported by one of the two strongest political parties, that is the Law and Justice (PiS) and the Civic Platform (PO). Even if in the result of 25 October 2015 elections four independent candidates were elected for senators, three of them used support of political parties, using a rule well proven four years earlier: there is not senator without a political party protector. The 40% support for PiS which turned into 61% of seats indicates that the election system for Senate leads to overrepresentation of election winners.

The consequence of systemic and political changes in Poland involved reorientation of Polish policy in terms of perceiving security. It was reflected in newly defined policy directions which expression involved a search for the new guarantees of security. The problem of ensuring state security in new geopolitical conditions is expressed in the adopted hierarchy of priorities of implementation of the Polish national interest. The exercise of the specified policy priorities means Poland’s obtaining a solid security basis. The Polish Army, the armed forces of the Republic of Poland, has become an element of NATO’s broad security system. The implementation of the policy in this regard by the Polish government has recently been more and more unidimensional. Only cooperation with the USA is at the target of the Polish security policy. Issues related to its costs remain outside its determinants. There is no reflection on being dependent on another egoistic player.

This article examines the determinants and consequences of the rite of exorcism from the constitutional law perspective. The study was limited to exorcism in the Roman Catholic Church due to its dominance in the religious composition of population in Poland. Exorcism is clearly a manifestation of religion, and it is argued that its performance should be subject to constraints justified by the need to protect the health and the right to humane treatment of the exorcised. Therefore, it is necessary to call for the establishment of legal restrictions, both preventive (mandatory medical consultation before performing the rite, mandatory medical examination for exorcists) and ex-post (ban on performing the rite on a given category of people). On the other hand, an absolute ban on exorcisms would violate the essence of the freedom to manifest religion and would not satisfy the requirements of proportionality.
Artykuł zawiera analizę uwarunkowań i skutków obrzędu egzorcyzmu z perspektywy prawa konstytucyjnego. Zakres rozważań został ograniczony do egzorcyzmu w Kościele Rzymskokatolickim, ze względu na jego dominację w strukturze wyznaniowej Polski. Egzorcyzm jest niewątpliwie przejawem wolności uzewnętrzniania religii, a jego sprawowanie powinno podlegać ograniczeniom ze względu na konieczność ochrony zdrowia i prawa do humanitarnego traktowania osób egzorcyzmowanych. Uzasadnia to postulat wprowadzenia prawnych ograniczeń o charakterze prewencyjnym (nakaz konsultacji lekarskiej przed przystąpieniem do obrzędu, nakaz badań lekarskich dla egzorcystów) oraz następczym (zakaz sprawowania obrzędu wobec określonej kategorii osób). Natomiast całkowity zakaz egzorcyzmów naruszałby istotę wolności uzewnętrzniania religii oraz nie spełniał wymogów proporcjonalności.

Uncontrolled migration is one of the threats to the state, and as illegal immigration, it is a leading threat to international security. From the point of view of state security, illegal immigration is classified as “requiring caution.” In the case of Poland, illegal immigration is to a considerable extent handled by organised crime of transnational reach, effectively taking the form of criminal enterprises. In the present day, differentiating between migration and exile is intricate, because the reasons behind migration are unclear and depend on numerous factors, also related to migration policies in target countries. However, for criminal enterprises, which stop at nothing to maximise their business profits, both refugees seeking refuge and migrants seeking to improve their socio-economic situation are a source of substantial financial gain. Criminal organisations generate profit by committing various crimes. The proposal presented by the United Poland party (Solidarna Polska) and defined as a new constitution cannot be considered as a complete proposal of the new fundamental law. A significant number of solutions, which are a copy of the RP Constitution is decisive in this regard. Special attention should be paid to the replication of the scheme of chapters of the fundamental law of 1997. Besides, a majority of chapters was adopted without meaningful changes and the content of most articles was simply repeated. The proposal is not original, based mostly on the existing construction of the fundamental law. Nevertheless the proposed changes could be defined as significant. The most important is a modification of the executive power, expressed in the abolishment of the office of the Prime Minister and placement of the RP President as the head of the Council of Prime Ministers. A meaningful change refers to the abolishment of the Senate and return to one chamber – the Sejm. A visible and highly original is the proposal of electing the Prosecutor General in general elections. Additionally the following can be considered as original: the establishment of the Court of State Responsibility instead of the State Tribunal, the return to the verdicts of the Constitutional Tribunal which are not final, and making a referendum upon the motion of a group of citizens. These proposals include solutions both replicated but also new and interesting and in some cases also controversial.

The author describes mutual, constitutional relations between the Senate and the head of state, and asks questions about the perspectives of their modification. The political events of 1989 leading to the reinstatement of a single-member head of state and Senate in Poland made their restitution closely related. At present, the competence and functional dependence of these bodies is low. The President and the Senate share a common view on the constant presence in the doctrinal and political discussion of the problem of changing their political position.
Autor opisuje wzajemne, konstytucyjne relacje Senatu i głowy państwa oraz stawia pytania dotyczące perspektyw ich modyfikacji. Wydarzenia polityczne z 1989 r. prowadzące do przywrócenia w Polsce jednoosobowej głowy państwa i Senatu spowodowały, iż ich restytucja była ściśle powiązana. Obecnie zależność kompetencyjna i funkcjonalna tych organów jest niewielka. Wspólna dla Prezydenta i Senatu jest natomiast stała obecność w dyskusji doktrynalnej i politycznej problemu zmiany ich pozycji ustrojowej.
