Border Guard
Opis:: In the position of the Sejm a statement was proposed that the appealed provision of the Act on the Border Guard, in the area in which it stipulates that an officer entitled to a functional allowance is not entitled to time off from service in exchange for service overtime exceeding service standards, is compliant with the indicated provision of the European Social Charter drawn up in Turin on 18th October 18 1961. The Applicant emphasized that the legislator did not comply with the provisions of the ESC, for he deprived Border Guard officers serving in independent or managerial positions of the right to free time or remuneration for the time of service performed in overtime. In the justification of the position, it was stated that Article 4 of the ESC does not determine the extent of additional remuneration that employees are entitled to for overtime work. Therefore the national legislator has been left with far-reaching freedom to define the rules of remuneration of employees.

Opis:: E-recepta, wprowadzona 25 maja 2018 r. w ramach pilotażu w dwóch miastach, początkowo spotkała się z wieloma barierami (nieufność i opór wobec nowych rozwiązań IT, niekompatybilność systemów gabinetowych z platformą P1, brak odpowiedniego sprzętu komputerowego w gabinetach, nieadekwatne łącza internetowe), obecnie jest jednym z najbardziej znanych i najczęściej wykorzystywanych e-narzędzi w usługach medycznych. Jej zastosowanie nabrało specjalnego znaczenia w czasie pandemii COVID-19, kiedy wymuszona izolacja utrudniała kontakty z personelem medycznym. Pacjenci, pozostawieni bez opieki medycznej, w bardzo ograniczonym zakresie mogli korzystać z usług ochrony zdrowia. Wówczas teleporady oraz cyfrowe recepty okazały się doskonałym remedium na tak problematyczną sytuację. Właściwie to pandemii COVID-19 zawdzięczamy rozwój wielu e-narzędzi oraz rozpowszechnienie ich zastosowania. Znaczenie e-recepty dla systemu i podmiotów świadczących usługi medyczne jest nie do przecenienia. Za jej pośrednictwem zarówno do systemu, jak i do wymienionych podmiotów trafia wiarygodna i dokładna informacja (np. o ilości przepisywanych leków, o stanie zdrowia polskich pacjentów czy wysokości kwot refundacji). E-recepta to nie tylko zapis, jaki lek powinien przyjąć pacjent, lecz również zbiór danych, które wykorzystane w odpowiedni sposób mogą stanowić drogowskaz dla dalszego rozwoju usług medycznych, programów profilaktycznych i kierunków zmian w systemie opieki zdrowotnej. Artykuł przedstawia informacje z zakresu wdrożenia i stosowania e-recepty przez personel medyczny w Polsce w latach 2018-2022. Informacje zawarte w opracowaniu mogą stanowić podstawę dla kolejnych opracowań w kraju i za granicą, dla międzynarodowych komparatywnych analiz, ze względu na ich aktualność i szczegółowość. Celem artykułu jest przedstawienie stopnia wykorzystania e-recepty przez personel medyczny w podmiotach ochrony zdrowia. Dla realizacji celu wykorzystano następujące metody badawcze: analiza krytyczna literatury przedmiotu i stron internetowych prezentujących rozwiązania cyfrowe dla systemu ochrony zdrowia, analiza materiałów źródłowych i danych liczbowych Centrum e-Zdrowia (CeZ).
E-prescription, introduced on February 16, 2018, as part of a pilot program in two cities, initially met many barriers (resistance and doubts of medical staff, incompatibility of IT systems and inappropriate computer equipment or its lack in medical offices), and is currently one of the most well-known and the most frequently used e-tools in medical services. The usage of e-prescribing was crucial during the COVID-19 pandemic, when forced isolation made contacts with medical staff difficult or even impossible. Patients, left without medical care, could use health care services to a very limited extent. Then, teleconsultations and digital prescriptions turned out to be an excellent remedy for such a problematic situation. In fact, we owe the development of many e-tools and the spread of their use to the COVID-19 pandemic. The importance of e-prescription for the system and medical service providers cannot be overestimated. Through it, the system and health care entities receive reliable and accurate information (e.g. about the number of prescribed drugs, the health condition of Polish patients, or the amount of reimbursement). An e-prescription is not only a record of what medicine the patient should take, but a set of data that, when used in an appropriate manner, can constitute a guide for the further development of medical services, preventive programs and directions of changes in the health care system. The article presents information on the implementation and use of e-prescriptions by medical staff in Poland in 2018-2022. The information contained in the article may constitute the basis for subsequent studies in Poland and abroad, for international comparative analyses, due to their timeliness and detail. The aim of the article is to present the degree of use of e-prescriptions by medical staff in health care entities. To achieve the goal, the fol-lowing research methods were used: critical analysis of literature and websites presenting digital solutions for the health care system, analysis of source materials and numerical data from the e-Health Center (CeZ).

Opis:: Cultural, educational and professional frameworks recognised by our civilization have been formulated as texts. Translation is the only method allowing for their global dissemination. Religions, literatures, learning theories and organizational cultures are products of translation. Yet, the relevance of translation is not only a matter of the past. It is argued in this article that translation is relevant today. In its educational aspect, translation can help realize that language differences are a resource in text comprehension and meaning making. Professional benefits of translating include language fluency that is more than a technical skill: it enables recognising nuances of meaning and sense, allowing for realistic language use. It can be a core advantage for specialists in creative industry, for industry analysts and for lots of other professionals engaging in cross-cultural interactions. Finally, being a translator one has a transversal competence of service provision.

Opis:: Przedmiotem artykułu jest charakterystyka stosowanego przez Komisję Europejską specyficznego pojęcia i marketyzacyjnej koncepcji modernizacji usług (świadczonych) w interesie ogólnym (UIO – services of general interest) na tle powszechnie używanego ogólnego pojęcia usług publicznych, przedstawienie wewnętrznej struktury UIO, funkcjonalnego uzasadnienia tego pojęcia oraz jego odniesienia do niektórych regulacji prawnych w zakresie pomocy publicznej i zamówień publicznych. W artykule wyjaśniono przesłanki i implikacje prawne obecnej polityki Komisji Europejskiej związane z realizacją traktatowo zastrzeżonej, wyłącznej kompetencji unijnej do ustanawiania reguł konkurencji niezbędnych do funkcjonowania rynku wewnętrznego oraz kompetencji koordynacyjnych w obszarze polityki społecznej. Tym samym marketyzacyjna koncepcja UIO stanowi ważny punkt odniesienia dla modernizacji polityki społecznej i usług publicznych w krajach członkowskich. Niemniej pojawiły się istotne i wymagające rozwiązania problemy osłabiające potencjalną efektywność i wiarygodność społeczną promowanych rynkowych mechanizmów świadczenia usług publicznych. Należą do nich m.in. deformacje uczciwej konkurencji wynikające z unikania płacenia podatków przez duże koncerny międzynarodowe wkraczające na krajowe rynki usług publicznych, a także konsekwencje zjawiska tzw. asymetrii konstytucyjnej.
The subject-matter of this article is a characterization of the specific notion and concept of the market-oriented modernization of “services of general interest" (SGI) applied by the European Commission, against the commonly used general notion of public services, as well as a presentation of the internal structure of SGI, its functional justification and reference to regulations on state aid and public procurement. The article explains the rationale and legal implications of the current policy of the European Commission related to the implementation of exclusive competence of the EU to establish the competition rules necessary for the functioning of the internal market and coordination competence in the field of social policy. Thus, the market-oriented concept of SGI constitutes an important reference point for the modernization of social policy and public services in member states. However, serious problems requiring a solution emerged which weaken the potential effectiveness and social credibility of the promoted marketization of public service provision. Among them are the deformation of fair competition and public service financing by tax-avoiding multinational corporations and the consequences of the “constitutional asymmetry” phenomenon.

Opis:: The main objective of this paper is to present and analyse the findings of research which aims to measure the services that a locally-based SME (Small-Medium Enterprise) campus store of a farm school provides to its customers. The examined start-up store is operated by the College students in the context of their entrepreneurship, business and marketing classes. After one year of operation students decided to evaluate the quality of the store’s services and measure the customers’ satisfaction by applying the well-known SERVQUAL model. The deployment of the model revealed at first the importance of the store know-how to measure services from the consumers’ perspective so as to better understand their needs. Secondly, the findings of the research highlighted ‘Security’, ‘Reliability’ and ‘Empathy’ as the most significant dimensions. The findings of this research can help small and medium enterprises to improve the services they provide to their customers by focusing on these three important dimensions.

Opis:: The General Lighthouse Authorities of the United Kingdom and Ireland (GLA) provide marine Aids-to-Navigation (AtoNs) for the benefit and safety of all mariners within their waters. These AtoNs include traditional lighthouses, buoys and various radionavigation systems. It is recognised that GPS, or more generally Global Navigation Satellite Systems (GNSS), have become the primary means of obtaining Position, Navigation and Timing (PNT) information at sea. Mariners may have come to believe that GPS is infallible, yet it is known to be vulnerable to solar activity, interference and system failures. The Sun continuously releases random bursts of energy and highly charged particles. The impact of these emissions on the Earth is known as space weather. Bursts of electromagnetic energy can result in radio blackouts; bursts of high energy particles can increase ionising radiation and affect space craft performance; and bursts of magnetised plasma can result in the degradation and potential loss of radionavigation signals on Earth. The amount of solar activity is linked with the natural sunspot cycle, which shows the number of sunspots peak approximately every 11 years, with the next peak due in 2013. Sunspots occur almost continuously, but normally give rise to weak solar events that generally go by unnoticed. However significant storms can occur at any time and as we approach peak activity, the number of space weather events will increase. AtoNs generally report their position using radio systems, whether through the Automatic Identification System (AIS), public networks or dedicated links; and often use GNSS to calculate their position and to obtain timing information. Mariners use GNSS for PNT information; with this information integrated into many different bridge systems. Powerful solar storms can affect GNSS performance and the reception of their signals, which may lead to different correlated events, both on and off the ship. During very extreme and very rare storms, national power systems may be switched off to protect the infrastructure which would clearly affect those services relying on mains power without backup. This paper reports the output of a study into the potential effects of space weather on GLA AtoN service provision and presents mitigating actions, where appropriate. The outcome of this study will help the GLA to continue to provide the highest level of AtoN availability, helping to ensure the safety of all mariners.

Opis:: Purpose – to assess the tourism industry development and its impact on Ukraine’s economy, to identify a set of problems hindering the significant development of the tourism industry, and to justify ways to increase competitiveness in the world market. Design/Method/Approach of the research. System approach, synthesis, analysis and comparison to assess the tourism development dynamics in Ukraine, correlation and regression analysis to determine the impact level of increasing the number of hotels and tourist-recreational enterprises on GDP growth in Ukraine, logical generalization to identify a set of problems holding back the significant development of local tourism and ways justification of increasing its competitiveness on the world market. Findings. This article presents the results of assessing the tourism dynamics, particularly the tourist flows, the number of resorts, the number of tourists served by tour operators and travel agents. The authors substantiated the ways of increasing the local tourism sector's competitiveness. Practical implications. The work results can make the basis for the development of fundamental and scientific-applied provisions contributing to the significant system formation of increasing the competitiveness of Ukraine's tourism industry by state and local authorities, establishing cooperation among market participants and forming optimal logistics flows, developing business models to optimize the flows of health and recreational facilities. Originality/Value. The research value is that its applied scientific provisions can be implemented in the strategy of economic development of local tourism in analytical and mathematical justifications of the relationship between economic growth and tourism development, which ultimately increases Ukraine regions’ competitiveness for sustainable development of the country’s economy. Research limitations/Future research. Future research should focus on identifying mechanisms to improve the procedure for increasing tourism enterprises' competitiveness and improving provided service quality. Paper type –empirical.
Мета – оцінити розвиток туристичної галузі та її вплив на економіку України, виокремити комплекс проблем, які перешкоджають ефективному розвитку туристичної індустрії та обґрунтувати напрямки підвищення конкурентоспроможності на світовому ринку. Дизайн / метод / підхід дослідження - системний підхід, синтез, аналіз та порівняння для оцінки динаміки розвитку туризму в Україні,кореляційно-регресійний аналіз для визначення рівня впливу збільшення кількості підприємств готельного та туристично-рекреаційного типу на нарощення ВВП України, логічне узагальнення для виокремлення комплексу проблем, які унеможливлюють ефективний розвиток вітчизняного туризму та обґрунтування напрямів підвищення його конкурентоспроможності на світовому ринку. Результати дослідження. У цій статті представлені результати оцінки динаміки розвитку туристичної сфери, зокрема обсягу туристичних потоків, кількості санаторно-курортних закладів, кількості туристів, що обслуговуватися туроператорами та турагентами. Автори обґрунтували напрями підвищення конкурентоспроможності вітчизняної туристичної сфери. Оригінальність/Цінність/Наукова новизна дослідження. Цінність дослідження полягає в тому, що його прикладні наукові положення можуть бути використані при реалізації стратегії економічного розвитку вітчизняного туризму в контексті аналітичного обґрунтування та математичного обґрунтування взаємозв’язку між економічним зростанням та розвитком туризму, що у підсумку сприятиме нарощенню конкурентоспроможності регіонів України для забезпечення сталого розвитку економіки країни. Практичне значення дослідження. Результати цієї роботи можуть стати основою для розробки фундаментальних та науково-прикладних положень, які сприятимуть формуванню ефективної системи нарощення конкурентоспроможності туристичної галузі України органами державної та місцевої влади й територіальних громад, налагодження взаємодії між учасниками ринку та формування оптимальних логістичних потоків, розробки бізнес-моделі оптимізації потоків в санаторно-рекреаційних установах. Обмеження дослідження/Перспективи подальших досліджень. Подальші дослідження доцільно направити на визначення механізмів удосконалення процедури нарощення конкурентоспроможності підприємств туристичної галузі та підвищення рівня якості надаваних послуг у даній сфері. Цель – оценить развитие туристической отрасли и ее влияния на экономику Украины, выделить комплекс проблем, которые делают невозможным ее эффективное развитие и обосновать направления повышения конкурентоспособности на мировом рынке. Дизайн/Метод/План исследования. Системный подход, синтез, анализ и сравнение для оценки динамики развития туризма в Украине, корреляционно-регрессионный анализ для определения степени влияния увеличения количества предприятий гостиничного и туристско-рекреационного типа на наращивание ВВП Украины, логическое обобщение для определения комплекса проблем, которые делают невозможным эффективное развитие отечественного туризма и обоснование направлений повышения его конкурентоспособности на мировом рынке. Результаты исследования. В этой статье представлены результаты оценки динамики развития туристической сферы, в частности объема туристических потоков, количества санаторно-курортных учреждений, количества туристов, обслуживаться туроператорами и турагентами. Авторы обосновали направления повышения конкурентоспособности отечественной туристической сферы. Оригинальность/Ценность/Научная новизна исследования. Ценность исследования заключается в том, что его прикладные научные положения могут бать использованы при реализации стратеги экономического развития отечественного туризма в контексте аналитического обоснования и математического обоснования взаимосвязи между экономическим ростом и развитием туризма, в итоге будет способствовать наращиванию конкурентоспособности регионов Украины для обеспечения устойчивого развития экономики страны. Практическое значение. Результаты этой работы могут стать основой для разработки фундаментальных и научно-прикладных положений, способствующих формированию эффективной системы наращивания конкурентоспособности туристической отрясли Украины органами государственной и местной власти и территориальных общин, налаживание взаимодействия между участниками рынка и формирования оптимальных логистических потоков, разработки бизнес-модели оптимизации потоков в санаторно-рекреационных учреждениях. Ограничение исследования/Перспективы дальнейших исследований. Дальнейшие исследования целесообразно направить на определение механизмов совершенствования процедуры наращивания конкурентоспособности предприятий туристической отрасли и повышение уровня качества предоставляемых услуг в данной сфере. Opis:: The article is aimed at resolving doubts regarding whether people who seek pharmaceutical services in pharmacies can be assigned the status of patients within the meaning of the Patient Rights and the Patient Rights Ombudsman Act. The article presents a historical justification for granting the professional staff working at pharmacies the competence to undertake activities similar to medical assistance. Common features of pharmacies and health care facilities are also specified. This analysis leads to the conclusion that the professional provision of pharmaceutical services can be regarded as performing a specific type of medical treatment. Furthermore the basic professional activities carried out in pharmacies are analysed in the context of the fulfillment of premises for health benefits within the meaning of the Medical Activity Act. This research justifies the conclusion that some pharmaceutical services have the status of providing health benefits and people who seek pharmaceutical services in pharmacies are most often patients.
Rozważania zawarte w artykule mają na celu umożliwienie rozstrzygnięcia wątpliwości odnośnie do nadania osobom poszukującym usług farmaceutycznych w aptekach statusu pacjentów w rozumieniu ustawy o prawach pacjenta i Rzeczniku Praw Pacjenta.W opracowaniu zaprezentowano historyczne uzasadnienie przyznania fachowemu personelowi apteki kompetencji do podejmowania działań podobnych do pomocy lekarskiej. Określono też cechy wspólne aptek oraz zakładów leczniczych. Analiza ta prowadzi do wniosku, że profesjonalne świadczenie usług farmaceutycznych można uznać za wykonywanie działalności leczniczej szczególnego rodzaju. Ponadto, zbadano podstawowe czynności fachowe dokonywane w aptece w kontekście spełnienia przesłanek świadczenia zdrowotnego w rozumieniu ustawy o działalności leczniczej. Pozwala to stwierdzić, iż niektóre usługi farmaceutyczne mają status świadczenia zdrowotnego, a osoby poszukujące usług farmaceutycznych w aptekach najczęściej są pacjentami.

Opis:: Public awareness and interest in the UK armed forces has increased over the years as a result of their involvement in various conflict situations. Research has also identified the increasing support and services that the armed forces community need, including mental wellbeing and the transition to civilian life. The voluntary sector has played a key role in the social inclusion of the armed forces by providing support and services for the armed forces community in the UK. This paper argues that gaining a more in-depth understanding of the armed forces community and their needs would help the various service charities to plan and deliver their services as well as to promote themselves more effectively. The purpose of this research was to understand and identify the service needs of one cohort of the UK armed forces – officers and their families. Qualitative, in-depth interviews of case workers and the beneficiaries of a service charity working with officers and their families were carried out, as well as observations and discussions with various service charities and the attendees of outreach services for veterans. The thematic analysis of the interviews, observations and discussion notes helped identify eight specific service needs that were important to the officers and their families.
Świadomość społeczna i zainteresowanie brytyjskimi siłami zbrojnymi wzrosły na przestrzeni lat w wyniku ich zaangażowania w różne sytuacje konfliktowe. Badania wykazały również, że wzrasta zapotrzebowanie społeczności sił zbrojnych na usługi wsparcia, ukierunkowane na wzmacnianie dobrego samopoczucia psychicznego i ułatwiające przejście do życia cywilnego. Sektor wolontariatu społecznego odegrał kluczową rolę w integracji społecznej przedstawicieli sił zbrojnych, zapewniając wsparcie i usługi dla tej społeczności w Wielkiej Brytanii. Niniejsze opracowanie dowodzi, że głębsze zrozumienie społeczności sił zbrojnych i ich potrzeb pomogłoby organizacjom charytatywnym w planowaniu i świadczeniu usług, a także w skuteczniejszym promowaniu własnej aktywności. Celem przeprowadzonych badań było zrozumienie i zidentyfikowanie zapotrzebowania na usługi wsparcia ze strony jednej z kohort brytyjskich sił zbrojnych – oficerów i ich rodzin. Przeprowadzono jakościowe, pogłębione wywiady z pracownikami prowadzącymi działania wspierające funkcjonariuszy sił zbrojnych i ich rodziny, a także samymi beneficjentami organizacji charytatywnych. Ponadto, podstawą wnioskowania były obserwacje i dyskusje z przedstawicielami organizacji charytatywnych oraz uczestnikami usług pomocy dla weteranów. Tematycznie ukierunkowana analiza wywiadów, obserwacji i notatek z dyskusji pomogła zidentyfikować osiem konkretnych obszarów zapotrzebowania na usługi wsparcia, które były ważne dla oficerów i ich rodzin.

Opis:: Introduction: The role of quality in achieving, improving, maintaining repeatable processes, service level guarantee patient satisfaction, determinants of hospitals.Objective:Identification of the mechanisms consistent quality in the provision of services in the public hospitals.Materials and methods:The study was conducted on a random sample of 104 public hospitals in the provinces of A, B, C. Author's questionnaire was distributed among 8975 participants of the medical staff. An analysis of the operating environment and documents, query literature. Was conducted individual in-depth interview with 540 medical experts from January 2007 to December 2011.Results: Diagnosed public hospitals network problems in the implementation phase of quality management system for medical services: interpretation of the requirements of the standards, development of implementation documentation, knowledge of procedures, standards. The work confirmed the theory that managers/Medical is responsible for the good/bad its functioning.Conclusions: Building on the paradigms of science organization and management expanded the scope of the study on the analysis of the factors determining the quality management of medical services based on a family of ISO standards. Factors focused on human capital and structural describing the quality of intellectual capital, supplemented by a layer of organizational and functional entities. This made it possible to get an answer in terms of phenomena, which in the area of quality in the network of public hospitals can be observed. And suggests practical solutions. Indicated tools and capabilities to implement the principles of quality in shaping the satisfaction of stakeholders.

Opis:: The article discussed the process of road transport operation planning connected with municipal waste transport and the organization of mixed waste collection on the example of shipping routes analysis carried out by means of transport of a service company in Wałcz commune in West Pomeranian voivodship. The article consists of seven parts, all of which present elements of a planning and transport process connected with municipal waste in road transport from legal, technical and economic perspective. Legal information concerning a road transport of goods was provided along with conditions that have to be met in order to perform this kind of transport and business activity. Moreover, technical and legal aspects of municipal waste transport vehicles were approached. The article covered as well the characteristics of: transport process, transport technologies, transport systems, the analysis of work capacity on the basis of drivers’ working time and a description of optimal routes for providing services in the commune taking into consideration a technological process of municipal waste transport step by step. The aim of the article is to show the most significant definitions of this field, identification, classification and packaging labeling used in waste management.

Opis:: The article aims to provide a critical analysis of the regulation of Article 138 MC, which stipulates service provider’s liability for refusal to provide a service that he or she is obliged to provide. The reasoning presented aims to determine actual scope of penalisation by indicating that liability under Article 138 MC can be considered only when a service provider is obliged to provide a service within the meaning of civil law. The obligation may result from the law but, as a rule, a contract between a service provider and a customer is its source. In general, a service provider cannot free himself/herself from the obligation to provide a service only based on religious rules or conscience (called conscientious objection). If he or she states that the provision of the service is against the rules of his/her religion or conscience, he or she can refrain from entering a contract. The article presents a few special types of contracts and indicates the way in which conscience is protected in each case (Article 53 of the Constitution of the Republic of Poland). The article also discusses doubts raised in connection with constitutionality of Article 138 MC and indicates, inter alia thanks to a comparison with other norms of the Misdemeanour Code, that the provision is not disproportional and does not violate the constitutional principle of economic freedom. Therefore, its potential change or repealing should be considered in the context of shaping criminal law policy through legislation and not questioning its compliance with the basic law. Working on the article, the author used in particular a formal-dogmatic method as well as a legal-comparative method.

Opis:: Unia Europejska zdecydowała się na pełne otwarcie rynku pasażerskiego transportu kolejowego na konkurencję. Konkurencja powinna zachęcić operatorów kolejowych do lepszego reagowania na potrzeby klientów oraz poprawy ich efektywności kosztowej. Głównym sposobem otwarcia rynku na konkurencję jest wprowadzenie zasady powierzania umów o świadczenie usług publicznych w transporcie kolejowym z zastosowaniem procedur konkurencyjnych (tzw. konkurencja o rynek). Środki regulacyjne wprowadzone przez UE w tym zakresie bazują na przepisach o zamówieniach publicznych. Jednakże poważną barierą w efektywnym ich stosowaniu jest brak dostępu do odpowiedniego taboru kolejowego. Istniejący tabor zazwyczaj stanowi własność zasiedziałego operatora kolejowego. Nowy tabor zaś wymaga znacznych inwestycji. Utrudnia to dostęp do rynku nowym podmiotom. Celem niniejszego artykułu jest analiza przepisów czwartego pakietu kolejowego, dotyczących dostępu do niezbędnego taboru kolejowego i ich wpływu na procedurę udzielania zamówień publicznych w zakresie powierzania pasażerskich przewozów kolejowych.
The European Union has decided to fully open the market of rail passenger transport to competition. Competition should encourage railway operators to become more responsive to customer needs and improve their cost-effectiveness. The main way to open the market to competition is to introduce the principle of competitive tendering of public service contracts in rail transport (so-called competition for the market). The regulatory measures established by the EU are based on the public procurement rules. However, an important barrier for the effective use of these rules is lack of access to suitable rolling stock. Existing rolling stock is usually owned by the incumbent operator. New rolling stock involves considerable capital investments. This impedes market access for new entrants. aim of this article is to analyse the provisions of fourth railway package on access to necessary rolling stock and their influence on the public procurement procedure concerning the entrustment of passenger railway services.

Opis:: The purpose of the article was to present the role and specifics of a significant function of administration, consisting in the organization and provision of public services. Therefore, an analysis was made regarding, among other things, the legitimacy of the administration to perform public tasks, using the example of the administering administration, contemporary understanding of the function of public administration and the shape of contemporary Polish public administration. The role of administration evolved from the direct provision of public (social) services through its own institutions towards direct organization of the provision of services, to limiting its role in organization and responsibility for the standard of services provided by non-public entities. The administering administration is the area of administration that is subject to ever more intense privatization processes. The forms of the administration’s operation, means, as well as entities acting within the framework of this function, have also changed. Such a system improves provision of the services. The ability to adapt public administration to challenges and expectations of modern society in connection with organizing and providing public services, becomes truly important. The administration that is responsible for organizing and providing public services should be conciliatory – it should support the development of the individual, protect them and not limit itself to the administrative and controlling role only. The role of the administration must be modified and the civic sector is a complement to its activities.

Opis:: Utility service provision is designed to satisfy basic human needs. The main objective of the research is to investigate mathematical methods for evaluating the feasibility of using a more efficient approach for utility services provision, compared to the current diversity of utility products delivered to households. Possibilities for alternative utility service provision that lead to more sustainable solutions include reducing the number of delivered utility products, on-site recycling and use of locally available natural resources. The core of the proposed approach is the simulation system that enables carrying out feasibility study of so-called transformation graph, which describes direct transformations and indirect transformations of the utility products into defined services. The simulation system was implemented in C# and .NET 3.5, while the XML database was implemented using eXist-db. The XML database stores information about all devices, utility products, services and technologies that can be used to define and solve services-provision problems. An example of such problem and its solution is presented in this paper. This research is a part of the All-in-One Project.
