    In his article, the author presents the data anonymization procedure introduced in the Act of 15th July 2011 on audits in the government administration. He discusses the issue from numerous aspects, analysing anonymization of data on persons who give evidence, explanations or provide documents during the audit proceedings. This is a very useful tool, however, due to the lack of comprehensive legal regulations in the area, it has not been applied in this kind of proceedings. This situation may be changed if regulations based on European laws are introduced.

    Opis:
    Przedmiotem niniejszego opracowania jest problematyka dotycząca zagadnienia tzw. doręczenia komorniczego. Regulacja art. 1391 k.p.c. została wprowadzona na mocy ustawy z dnia 4 lipca 2019 roku o zmianie ustawy – Kodeks postępowania cywilnego oraz niektórych innych ustaw. W opracowaniu podjęto próbę sprecyzowania zakresu zastosowania art. 1391 k.p.c., w szczególności zakresu podmiotowego i przedmiotowego. Przy omawianiu zakresu przedmiotowego wskazano katalog pism, które podlegają doręczeniu za pośrednictwem komornika sądowego. W szczególności omówiono, czy doręczeniu komorniczemu podlega wniosek o zawezwanie do próby ugodowej, wniosek o zabezpieczenie dowodu składany przed wszczęciem postępowania, postanowienie o przekazaniu sprawy do innego sądu oraz zarządzenia i zobowiązania sądu. Ponadto poczyniono szerokie rozważania dotyczące zakresu podmiotowego omawianej regulacji i udzielono odpowiedzi na pytanie, czy art. 1391 k.p.c. ma zastosowanie wobec osób prawnych. Niniejszy artykuł został opracowany na podstawie obowiązujących regulacji prawnych zawartych w ustawie Kodeks postępowania cywilnego, w szczególności w art. 1391 k.p.c. Został przy tym wykorzystany dotychczasowy dorobek literatury oraz orzecznictwo. W pracy zostało uwzględnione stosowanie regulacji przewidzianej w 1391 k.p.c. w praktyce sądowej. Wzięto także pod uwagę praktykę sądów z obszaru apelacji łódzkiej i warszawskiej, wykorzystując do tego celu dorobek kancelarii adwokackiej, w której jest zatrudniona autorka.
    This study addresses issues concerning the so-called service by a court enforcement officer. The provisions specified in art. 1391 of the Code of Civil Procedure were implemented under the Act of 4 July 2019 amending the Code of Civil Procedure and certain other acts. This study constitutes an attempt to define the personal and material scope of application of art. 1391 of the Code of Civil Procedure. Along with the analysis of the material scope, a catalogue of documents which are subject to service by a court enforcement officer is specified. The author discusses in particular whether the following documents are subject to service by a court enforcement officer: petitions for summons to a conciliation session, petitions for securing evidence submitted prior to initiation of the proceeding, decisions to refer the case to a different court for adjudication, court orders and obligations toward the court. In addition, the personal scope of the provision in question is broadly reflected upon and it is determined whether art. 1391 of the Code of Civil Procedure shall apply to legal persons. This study is based on the provisions of law in force laid down in the Code of Civil Procedure, in particular in art. 1391 of the Code. Moreover, the author make use of the professional literature and judicial decisions issued hitherto. The study concerns the application of the provisions of art. 1391 of the Code of Civil Procedure in the jurisprudence. More precisely, I take into consideration the decisions of courts of appeal competent for the area of Łódź and Warsaw by using the documentation gathered in the legal office I work in.

    Artykuł omawia zmiany przepisów dotyczących doręczeń pism kierowanych do przedsiębiorców w ramach postępowania cywilnego. Kodeks postępowania cywilnego został w tym zakresie zmieniony ustawą z 4.07.2019 r. o zmianie ustawy — Kodeks postępowania cywilnego oraz niektórych innych ustaw (Dz.U. z 2019 r. poz. 1469). Artykuł koncentruje się w szczególności wokół kwestii dopuszczalności stosowania fikcji doręczenia pierwszego pisma w sprawie kierowanego do przedsiębiorcy. Poza omówieniem nowej regulacji dotyczącej doręczeń, celem artykułu jest również przedstawienie propozycji jej zmian w zakresie dotyczącym przede wszystkim przedsiębiorców.
    The article discusses changes in the provisions regarding the delivery of letters addressed to entrepreneurs under civil proceedings. The Code of Civil Procedure has been amended in this respect by the Act of 4.07.2019 amending the Act — Code of Civil Procedure and some other acts (Journal of Laws of 2019, item 1469). The article focuses in particular on the issue of the admissibility of using the fiction of delivery (serve by default) of the first letter in a case addressed to the entrepreneur. In addition to discussing the new regulation on delivery, the aim of the article is to present proposals for changes in the said document in the area primarily concerning entrepreneurs.

    Opis:
    The validity of acts of service in Polish civil procedure law depends on the moment at which it is carried out. Unfortunately, the current statutory regulation does not seem to be a holistic regulation. The structure of acts of service adopted in the aforementioned regulation refers only to the character of daily rhythm of life of a natural person who is an addressee or recipient of a document. It certainly does not take into account the specificity of functioning of some groups of legal entities with a more complicated organizational and functional structure, in particular those having the status of an entrepreneur (including natural persons) and conducting their activity in other time of day than those specified by law or within the framework of continuous movement. Moreover, aforementioned legal solution referring only to the conventional procedure of service of documents has not been adopted at all for the purposes of electronic delivery trading. The current code regulation pertaining to the appropriate moment of service seems, by virtue of its function, to be in all measure necessary, protecting the important sphere of privacy of entities engaged in the field of service as addressees of documents. However, it should be comprehensive in nature. In the context of the procedural law, with a few exceptions, delivery cannot be successfully made on public holidays and at night. Due to the flexibility of creating a work schedule at individual employers, the current solution does not seem to be optimal. The addressee’s consent to service on a public holiday or during night time – in the absence of a prior order of the president of the court – it does not invalidate such action, it remains ineffective. The effectiveness of service, preceded by a relevant order of the president of the court, is independent of the addressee’s consent to receive the letter in the indicated time frames. De lege ferenda, one should consider either separating the structure of the determination of the appropriate moment of service of documents from the existing system of working time distribution adopted on the basis of substantive labor law regulation (which selectively and unjustifiably predestines only one group of addressees of letters – natural persons being employees), or adapting it in a systemic way to the existing solutions in the field of labor law.

    Przedmiotem rozważań podjętych przez Autorów w niniejszym artykule jest problematyka prawna związana z możliwością dochodzenia roszczenia z tytułu naruszenia dóbr osobistych w Internecie od bezpośredniego sprawcy naruszenia przez pryzmat konieczności ustalenia danych osobowych naruszyciela. Omówiono możliwość złożenia wniosku o udostępnienie tych danych do service providera, uwzględniając zarówno stanowisko wyrażane przez ETS, jak i krajowe sądownictwo administracyjne. Zwrócono uwagę na fakt, że trudność w ustaleniu tych danych (przede wszystkim zgodnie z zapisami ustawy z dnia 18 lipca 2002 r. o świadczeniu usług drogą elektroniczną) skutkuje nieprawidłową praktyką inicjowania postępowania karnego, co z kolei powoduje obciążenie organów dochodzeniowych zadaniami nie służącymi celom procesu karnego a cywilnego.
    The subject of the considerations taken up by the authors in this article is the legal issues related to the possibility of pursuing a claim for infringement of personal rights on the Internet from the direct infringer through the prism of necessity to establish the personal data of the infringer unknown. The possibility of submitting an application for making this data available to the service provider was discussed, taking into account both the position expressed by the Court of Justice of the European Union and the national administrative courts. Attention was drawn to the fact that the difficulty in establishing these data (in accordance with the provisions of the Act of 18 July 2002 on the provision of electronic services) results in an incorrect practice of initiating criminal proceedings, which in turn causes the investigative authorities to be burdened with tasks that do not serve the purposes of the criminal trial but in fact civil cases.

    Niniejsze opracowanie poświęcono szczegółowym zagadnieniom w przedmiocie przebiegu doręczenia pozwu lub innego pisma procesowego przez komornika na podstawie art. 1391 k.p.c. Omówiono, w jaki sposób powód może wykonać zobowiązanie, jeśli sąd wdroży procedurę określoną w art. 1391 k.p.c. W pierwszej części artykułu omówiono problem przedstawienia przez powoda dowodów przebywania pozwanego pod adresem wskazanym w pozwie. Wskazano, jakimi środkami dowodowymi powód ma możliwość udowodnienia, że pozwany przebywa pod adresem wskazanym w pozwie. Wyjaśniono również, jakie dalsze czynności podejmie sąd, jeśli wyda postanowienie o stwierdzeniu braku podstaw do uznania doręczenia za skuteczne z uwagi na nieudowodnienie przez powoda okoliczności przebywania pozwanego pod adresem wskazanym w pozwie. W dalszej części opracowania wyjaśniono drugie z możliwych zachowań powoda, umożliwiających wykonanie zobowiązania sądu poprzez wskazanie innego adresu przebywania pozwanego. Trzecią część artykułu poświęcono doręczeniu pozwu lub innego pisma procesowego wywołującego potrzebę obrony praw pozwanego za pośrednictwem komornika sądowego. Omówiono, jakie wymagania musi spełniać wniosek złożony do komornika sądowego, by nie został przez niego zwrócony. Na zakończenie wyjaśniono wszystkie możliwe warianty przebiegu czynności doręczenia pozwu za pośrednictwem komornika sądowego i omówiono konsekwencje każdego z wariantów. Wskazano również na możliwość zlecenia komornikowi sądowemu poszukiwania aktualnego adresu zamieszkania pozwanego. Niniejszy artykuł stanowi analizę obowiązujących regulacji prawnych zawartych w ustawie Kodeks postępowania cywilnego, a także dorobku literatury, w szczególności aktualnych opracowań komentarzowych.
    This paper focuses on the detailed issues regarding the course of service of summons or other pleadings by a court-enforcement officer pursuant to Article 1391 of the Code of Civil Procedure. It discusses the manner in which the plaintiff may perform their obligation when the procedure specified in Article 1391 of the Code of Civil Procedure has been implemented by the court. The first part of the article focuses on the plaintiff presenting evidence that the place of residence of the defendant is the same as that given in the summons. The author discusses the types of evidence by means of which the plaintiff may prove so. Moreover, the study specifies further measures the court undertakes if it issues a decision on lack of grounds to consider the service effective due to the fact that the plaintiff has failed to prove the circumstances of the defendant’s residing at the address provided in the summons. The further part of the article focuses on another possible solution through which the plaintiff may choose to perform their obligation towards the court, namely providing a different place of residence of the defendant. The third part of the article discusses the question of serving summons or other pleadings as a result of which the defendant’s rights must be defended by a court enforcement officer. It details the requirements that a petition filed with a court enforcement officer must meet to avoid dismissal on formal grounds. In the final part the author discusses all possible courses of service of summons by a court enforcement officer along with their consequences. It is noted that the court enforcement officer may be ordered to find out the current place of residence of the defendant. It would be worth devoting a separate paper to the discussion of the question of the terms and sanctions for failure to meet the obligation stipulated in Article 1391 of the Code of Civil Procedure.
