Georg Wilhelm Friedrich Hegel was one of the philosophic giants of the nineteenth century. Well versed in both ancient and more recent philosophical tracts, he rejected the individualism of Hobbes and Locke, as well as their notion that the state was an agency set up in the first place to protect life and property, and, drawing inspiration from Aristotle, outlined a vision of the state as an agency bound, in the first place, to protect the weak and the powerless. Hegel further rejected Kant’s individualistic ethics and counseled that ethical behavior had to be understood as taking place in a social context, with real duties toward other people. For Hegel, an individual had rights and duties within the context of the family, in the community, and, as a citizen, vis-à-vis the state. He emphasized the network of duties in which each individual finds himself, urging political moderation and concern for the good of the entire community. He has been condemned as a proto-totalitarian, lauded as a democrat of sorts, and described variously as liberal, anti-liberal, authoritarian, conservative-monarchist, and constitutionalist. This essay will argue that Hegel came to champion a constitutional-legal order (Rechtsstaat) under an autocratic monarch, with protection for liberal values. The absolute authority of the monarch, thus, was limited to those powers which he needed in order to advance and protect the interests of the citizens of the realm.

The hierarchy of the rule of law in the Antipodes shows undoubtedly how various legal norms, unwritten and those codified ones, protect the democratic system with all its principles, along with the rights and freedoms of citizens and persons residing in these two countries.

After the collapse of the non-democratic regime in the early 1990s, public opinion surveys became important factor in the process of democratic decision-making. Author is analysing the results of public opinion surveys, which bring together data on the attitude of the general public towards democracy, (dis)satisfaction with the political situation and (dis)satisfaction with most important political and administrative institutions with special emphasis given to the public’s (dis)trust toward the rule of law. Based on the data obtained article allocates Slovenia’s position compared to other established European democracies as well as post-communist countries from Central and Eastern Europe (CEE) on the scale of the relationship of the dimensions of societal (dis)trust in political power.

F. Ancora w swoim studium zajął się przeanalizowaniem fundamentalnych pojęć prawoznawstwa: rule of law, stato di diritto (państwo prawa, praworządność) oraz pojęciem pewności prawa. Analiza ta dowodzi, że – zdaniem jej autora – wspomniane pojęcia ewoluują, nie są w swej treści absolutnie niezmienne. Cechę tę F. Ancora uważa za istotną, ale i pożądaną. Umożliwia to bowiem dostosowywanie treści podstawowych kategorii prawnych do zmieniających się warunków społecznych, ekonomicznych, politycznych. Choć może zagrażać pewności prawa.
In his study, F. Ancora is exploring the fundamental concepts of jurisprudence: the rule of law, the state of law and the concept of legal certainty. This analysis proves – according to its author – that the aforementioned concepts evolve and that they are completely unchangeable in their content. F. Ancora considers this feature to be not only important, but also desirable. It makes it possible to adopt the content of basic legal categories into changing social, economical and political conditions, even if it may threaten legal certainty.

Purpose: is to show judicial reporting in relation to the rule of law. The text focuses on the considerations and analysis of the relativity of judicial reporting to the rule of law as a kind of values and subjective rights of civil society. An additional assumption is to indicate the essence of the issue in an interdisciplinary perspective, drawing attention to its importance, multidimensionality, connection and social significance, leaving room for own research. Design/methodology/approach: The research method used in the article is the analysis of scientific studies, supplemented by the author's observations and experience. The research procedure included a review of Polish and foreign literature, an analysis of legal acts and court decisions, a case study and deductive reasoning. The above text evokes, in the author's opinion, a separate understanding and application, more and more commonly, also by journalists, of the concepts of justice, the rule of law and law. Findings: A high level of influence of judicial reporting on the rule of law has been demonstrated. Great demand for this type of message and its values, which should be implemented by the rule of law - judgments of common courts, to be considered the most desirable form of the system. Social development in the face of values as an interdisciplinary concept in terms of direction and field allows you to maintain what is with what should happen in the future. It is important not only what intentions people have, but also what competences they have and according to what values they operate. The conducted analysis shows that the correctness of the message and the understanding of the meaning of the rule of law in the area of law are important and vice versa. An autocratically governed society can be fully governed by law, the courts can issue judgments and the court rapporteurs publicly present them, which does not necessarily mean that we are dealing with the rule of law and the rule of law. Research limitations/implications: Limitations of the obtained results may result from a limited text sample, small text size. Originality/value: The presented research and conclusions provide practical tips not only to people of science, but above all to average citizens, mainly those who are not aware that the world of values surrounds people, but depends on them, what values they pay attention to and to which he remains indifferent. Man has the freedom to choose what suits him best, but is rarely able to use it rationally and in an appropriate form and time. Among values, man does not have to do anything and can do much. The less complex and understandable the forensic message, the closer to the concept of simple principles of human life and action. Every aspect of judicial reporting contributes to strengthening the rule of law in the spirit of a democratic rule of law. Like the world to the world, there were processes and comments, and what resulted from them socially (...).

The European Union is founded on a set of common principles of democracy, the rule of law, and fundamental rights, as enshrined in Article 2 of the Treaty on the European Union. Whereas future Member States are vetted for their compliance with these values before they accede to the Union, no similar method exists to supervise respect of these foundational principles after accession. This gap needs to be filled, since history proved that EU Member State governments’ adherence to foundational EU values cannot be taken for granted. Against this background this article assesses the need and possibilities for the establishment of an EU Scoreboard on EU values; viable strategies and procedures to regularly monitor all Member States’ compliance with the rule of law on an equal and objective basis; and the nature of effective and dissuasive sanction mechanisms foreseen for rule of law violators.

The speech by Linda Klein – immediate past president of the ABA – has been presented as opening remarks during Poland-US Conference on the Rule of Law in Warsaw on 24 June 2018. In her speech Klein stated that the rule of law is expressed by the vigorous and independent legal profession and judicial branch of government. Lawyers must take the lead as advocates for the rule of law. Principles of the rule of law must never, ever yield to any perceived or actual emergency of the moment. Independent legal profession cannot and must not bend to the will of government, that independent courts must not be influenced by public or political pressure, and that access to justice is assured for all, even for the least powerful. The most important responsibility organized bar in every nation is to promote these principles and oppose any efforts to erode them. The core principles of the legal profession articulate the fundamental missions and activities of bar associations the world over. As a global leader of the rule of law issues and the world’s largest voluntary bar association, the American Bar Association has consistently supported efforts to build a strong, cohesive global movement to promote these fundamental principles.

Aim. This research aims to discuss the importance of the principle of rule of law in protecting the judiciary’s role, especially the independence of constitutional adjudication and its functions. Methods. The study applies the case study approach and comparative method to investigate the constitutional court systems of some countries of the Association of Southeast Asian Nations  (ASEAN) and their independence. Results and conclusion. The resultsreveal a lack of the judiciary’s independence, even among the top branches that are trying to implement democracy in Myanmar. The judiciary is under the control of the executive and legislature branches as their members belong to political parties. Moreover, a constitutional court is established with the members who are elected and nominated by the legislature and executive. Sometimes there can be conflicts when constitutional law does not mention the division of powers among governmental organisations like Myanmar, which results from the impractical functions of the Constitutional Tribunal of Myanmar. Cognitive value. This research highlights possible ways to solve the constitutional issues among the three great branches. This initiative is in the interest of Myanmar citizens and citizens of all nations as these are international issues.

For over one-hundred and fifty years, the United States Supreme Court has been the most powerful judicial body in the world with life-tenured judges consistently invalidating state and federal laws without clear support in constitutional text or history. This paper focuses on what should be the appropriate role of life-tenured, unelected federal judges in the American system of separation of powers. The tension is between wanting judges to enforce the supreme law of the Constitution while at the same time keeping judges within their assigned roles of enforcing not making the law. Much of constitutional scholarship in the United States is devoted to resolving this tension. This article argues that the Court should take a set back and defer more to elected leaders and voters. Although structural reform might help, most needed changes would require a constitutional amendment and are therefore unlikely to occur. The Justices should take it upon themselves to act with more humility and modesty and only overturn laws where there is strong evidence of clear constitutional error.

The rule of law of the state is beginning to be of particular and increasing importance in the current political situation. This requires a revision of views on the standards and expectations that one can have towards the law-abiding state and its apparatus. The scope of the issue thus determined requires reference to the constitutional concept of a democratic state governed by the rule of law and its role in determining imperatives in the activities of the state and its organs. It also raises the need to address the issue – is it sufficient for the existence of the rule of law in a state to only respect the supreme legal force of constitutional norms?

The aim of the article is to outline the relationship between the rule of law and civic engagement in the public sphere and to attempt to answer the question whether the rule of law can be an effective tool in preventing the transformation of democracy in a tyranny of the majority; whether it can also create optimal conditions for democracy to develop. In other words, does the rule of law serve democracy and political engagement or does it rather limit the spontaneity of civic activity because stability cannot be reconciled with the freedom of citizens? The current “juridification” of the public domain (the expansion of law into various areas of social existence) marginalises the validity and scope of civic presence in the decision-making process in the name of law-abidingness and the neutrality of instruments of control and of choices made by the ruling power. Can the effective solution to this situation be the opening of the concept of the rule of law to the idea of political nature and the expansion of the domain of grassroots participation?

In the American system of justice, based on the common law method, the judge enjoys greater independence than do the judges in Civil Law systems. Independence of the judiciary is essential in a system of checks and balances where the more powerful elements of the legislature and the executive must be limited by legally enforced principles. At the same time, judicial independence is constrained within moral limits by a system of positive law rules that direct the judge to make reasoned judgments that he must justify by open opinions.
Sędzia w amerykańskim systemie common law cieszy się większym zakresem niezależności, niż sędziowie funkcjonujący w ramach kultury prawnej opartej na legislacji. Niezawisłość sądownictwa jest niezbędna w systemie opierającym się na mechanizmie równoważenia się władz. Równocześnie zaś, moralne ramy dla niezależności jaką cieszy się sędzia przy orzekaniu względem legislatywy lub egzekutywy tworzą unormowania wymagające, by wydany przezeń wyrok był uzasadniony w publicznie dostępnym wywodzie.

Promoting the rule of the law is a national responsibility. The obligation to ensure legality and advance human rights rests on the national government. This article analyzes how federalism, a system of distributing power among subnational entities, can promote this national goal. The article explores how states in the United States have played an important role in encouraging the federal government to enforce the law and safeguard rights. By means of resistance, cooperation, and redundancy, states have moved the United States closer to rule-of-law ideals. The state action sometimes takes the form of litigation, with states bringing suit against the federal government. Such suits have particular significance in challenging illegal inaction by the national government, as when the federal government fails to enforce environmental laws. Litigation by states may overcome standing barriers that would limit such suits by private individuals. States may also engage in direct action by pursuing their own policies that promote the rule of law. In these areas, the states may oppose the federal government, cooperate with the federal government, or act in an independent, parallel manner. What unites all of these modes and instruments of state-federal interaction is that the goal of states is to influence national policy. The state action may begin within the boundaries of a particular state, but what motivates the state initiative is a vision applicable to the nation as a whole. The ultimate aim of state action is not local divergence, but national uniformity. Federalism serves not as a license for local deviation from national norms, but instead as a means for states to engage actively in creating policy at a national level. In this way, independent state activity can indeed promote the national obligation to promote the rule of law throughout the country.
