Opis:
This article aims to present the concept of two-sided markets on the example of payment card systems, which have attracted the attention of regulatory and antitrust authorities in recent years. First, the paper offers a few insights into the basic economic theory behind two-sided markets. Second, it presents a brief description of payment card systems and their features. The following analysis focuses on arguments that speak in favour of a regulatory or antitrust intervention into payment card systems. Finally, some of the potential problems that antitrust authorities must face when assessing two-sided markets are presented on the basis of an assessment of the decisional practice of the UOKiK President and the European Commission.

The article recounts the ongoing changes with regard to the legal definition of payment cards, alterations procured by the entrance into force of an amendment to the Payment Cards Act, dated 12 July 2013. Furthermore, the article expounds the principles of liability in connection with unauthorized transactions that are aimed at protecting the users of payment cards. The legislative direction adopted by the Polish lawmakers is in line with Directive 2007/64/EC pertaining to payment services within an internal market, which sets out to establish a framework for protecting funds accumulated on the clients’ accounts. Various innovative security systems being implemented on the payment card market are referred to in the last part of the article. It is submitted that the introduction of biometric and nanotechnology solutions in automatic identity verification processes may eventually lead to the elimination of payment cards in their physical form. However, these innovative solutions carry various risks. The underlying issue is associated with potentially unlawful breach of the constitutional right to privacy in cases where the identity of a person is verified automatically. For this reason, it is important to establish whether biometric data or nanoparticles containing information on payment card holders constitute personal data within the meaning of the Personal Data Act. Such analysis should include how both systems conduct the automatic personal identification process and the manner in which the personal data is gathered, processed and stored.

Opis:
Electronic payment systems used for urban services are implemented and funded by the public sector. Those are rather big investments, characterized by high costs, but they also allow for gaining profits – mainly connected with the transport offer optimization and with more effective price management. When preparing the documents, among other papers concerning functionality or technical and technological solutions, it is necessary to prepare a feasibility study, in which the assessment of the effectiveness of such investments is an important part. To do so, one ought to identify and assess the costs and the profits connected with the realization of such projects. Such assessment ought to be performed within the frame of financial analyses (from the perspective of the unit implementing and using the solutions) and of economic analyses within which the external costs and profits should also be considered.
