“Particular Churches, in which and from which, the one and only Catholic Church exists, are principally dioceses. Unless the contrary is clear, the following are equivalent to a diocese: a territorial prelature, a territorial abbacy, a vicariate apostolic, a prefecture apostolic and a permanently established apostolic administration” (canon 368 of the Code of Canon Law). In December 2016, the Bishop of Tarnów convened the 5th Synod of the Diocese of Tarnów. The main purpose of a Synod – in the opinion of the Bishop of Tarnów – was to demonstrate the spiritual, pastoral and material heritage of the Christ’s Church in the Diocese of Tarnów; to revive faith, hope and love in the personal and community relationship with Christ in the Church; and to indicate new pastoral ways in the changeability of the world towards the unchangeability of Christ. Taking this into consideration the article analyzes the following issues: the definition of a synod; the purpose of a synod; convocation of and presiding over a diocesan synod; the preparation of a synod; Pope Francis about synodality, and finally “The Church is our neighbour” – a synod as an expression of love for the Church.

A military ordinariate as a particular Church was further specified in the SMC Constitution and the statute. Pope John Paul II, as a son of Polish army officer, felt an urge to regulate the situation of military chaplaincy in the universal Church, especially in those countries where religious freedom was non-existent and barracks were closed to chaplains. After the World War II, Catholic Poland found itself in the Soviet zone of atheist influence. The Soviet Union systematically secularised soldiers through its political officers. A military ordinariate fulfils all requirements that the Code of Canon Law specifies with relation to a particular Church, and therefore it enters diocesan canons. A field bishop holding the rank of a general is part of the Conference of Polish Episcopate and performs the duties of a diocesan bishop. Military pastoral work is conducted in an analogical manner to the one in a diocese. A typical feature of a military ordinariate is personal jurisdiction, not territorial, and cumulative way of exercising authority in the case of a field bishop. It is true that the verb assimilantur stirred a discussion among canonists, yet military ordinariates possess significant features of a particular Church, although they are ecclesiastical districts of a unique character sunt peculiars circumscriptiones ecclesiasticae (SMC I), which does not belittle their legal status.

This article analyses the last four synods of the diocese of Tarnów, highlighting their structure and course. Diocesan synods grow out of the needs of the particular Church; they shape the ecclesial reality most clearly by the formulated disciplinary, pastoral and spiritual proposals, reaching the very basic ecclesiastical and social environments. Each synod has its specific meaning in the history of the diocese, and its impact is certainly not limited to the formulated proposals. A diocesan synod has a very important function in the process of formation of the particular Church. The synods of the Diocese of Tarnów were the place of meeting of and dialogue between the bishop, the clergy and the laity of the Church in Tarnów. The present article discusses five points : ”Legal grounds”, “First Synod of the Diocese of Tarnów – 1928”, “Second Synod of the Diocese of Tarnów – 1938”, “Third Synod of the Diocese of Tarnów – 1948”, “Fourth Synod of the Diocese of Tarnów – 1986”.

Cyklicznie powracające do głównego nurtu teologicznych rozważań zagadnienie relacji Kościoła powszechnego i Kościołów lokalnych pozostaje wciąż otwarte na nowe pytania i problemy badawcze. Ostatnie lata przyniosły mu na nowo rozgłos za sprawą debaty kardynałów Josepha Ratzingera i Waltera Kaspera, których poróżniło spojrzenie na ontologiczne i czasowe pierwszeństwo Kościoła powszechnego przed Kościołami lokalnymi. Punktem wspólnym ich rozważań stało się communio – pojęcie uznawane za klucz do zrozumienia soborowej eklezjologii. Stąd zasadna wydaje się analiza adekwatności użycia tego pojęcia dla określenia relacji między Kościołem powszechnym a lokalnym głównie na podstawie tekstów Magisterium Kościoła, ale także współczesnych artykułów naukowych.
Periodically returning to the mainstream of theological considerations, the issue of the relationship between the universal Church and the local churches remains open to new questions and research problems. Recent years brought him new renown thanks to the debate of cardinals – Joseph Ratzinger and Walter Kasper, who diffused their view of the ontological and temporal priority of the universal Church in front of the local Churches. The common point of their deliberations became communio – a concept considered to be the key to understanding the ecclesiological council. Therefore, it seems reasonable to analyze the adequacy of the use of this concept to determine the relationship between the universal and local Church, mainly based on the texts of the Church’s Magisterium, but also modern scientific articles.

Kodeks Prawa Kanonicznego z 1983 r. reguluje pojęcie prowincji kościelnej, która jest zespołem sąsiednich Kościołów partykularnych. Celem utworzenia prowincji kościelnej jest wspólne działanie pasterskie oraz ożywianie kontaktów między biskupami diecezjalnymi. The 1983 Code of Canon Law provides that a church province comprises neighboring particular Churches. Church provinces are created to promote the common pastoral activities of neighboring dioceses and to foster the mutual relations of diocesan bishops. The authorities a Church province are: the metropolitan and the provincial synod which is composed of a conference of bishops and other representatives of particular Churches constituting the same province.

Prawodawca w Kodeksie Prawa Kanonicznego z 1983 r. stanowi, że konferencja biskupów bądź poszczególni biskupi mogą ustanowić urząd lub radę, których zadaniem będzie poszukiwanie i sugerowanie słusznych rozwiązań między autorem i adresatem aktu administracyjnego (kan. 1733 § 2). Chociaż prawodawca nie określa, czy takie uprawnienie przysługuje w Kościołach partykularnych zrównanych w prawie z diecezją (kan. 381 § 2), zwierzchnicy stojący na czele tych wspólnot wiernych – zarówno terytorialnych, jak i personalnych – mogą również erygować organy mediacyjne. Należy zauważyć, że wierni mają prawo otrzymywać pomoce od swoich pasterzy z duchowych dóbr Kościoła (kan. 213). W sytuacji sede vacante, administrator diecezji ma te same obowiązki i władzę co biskup diecezjalny, z wyjątkiem tego, co jest wyłączone z natury rzeczy lub na mocy prawa (kan. 427 § 1), zgodnie z zasadą sede vacante nihil innovetur (kan. 428 § 1). A zatem, nie ma prawnych przeszkód, aby administrator diecezji posiadał uprawnienie do erygowania urzędu lub rady mediacyjnej. 
The legislator in the 1983 Code of Canon Law states that the conference of bishops or individual bishops can establish a mediation office or council whose function is to seek and suggest equitable solutions between the author and recipient of an administrative act (can. 1733 § 2). Although the legislator does not determine the possibility of establishing such organs in those particular Churches that are legally on a par with diocese (can. 381 § 2), persons who head the other communities of the faithful – both territorial and personal – can also establish the mediation organs. It should be noticed that the Christian faithful have the right to receive the assistance from the sacred pastors out of the spiritual goods of the Church (can. 213). In the situation of sede vacante, the diocesan administrator is bound by the obligations and enjoys the power of the diocesan bishops, excluding those things which are excepted by their very nature or by the law itself (can. 427 § 1) in accordance with the principle sede vacante nihil innovetur (can. 428 § 1). Thus, there is no legal obstacle for the diocesan administrator, to establish a mediation office or council.

Opis:
The conferences of bishops follow the meetings of the apostles. They were established on a grassroots initiative and initially had a private character. The aim of such meetings was to establish the same method of teaching the truths of faith and 19 normalizing church discipline. The Holy See understood the need for such meetings of bishops and allowed them. From the pontificate of Pius IX, the form of meetings of bishops forming conferences began to be appreciated and supported. During the council discussions, the need for legal regulation of this institution in the Church was noticed. The conference of bishops found its regulation in the 1983 Code of Canon Law. The legislator gave the conference of bishops legislative, executive and judicial powers. These competences, included in the individual dispositions of the codex legislator, constitute a catalogue of matters requiring regulation by the conference of bishops.
Konferencje biskupów są następstwem spotkań apostołów. Powstały z inicjatywy oddolnej i początkowo miały charakter prywatny. Celem takich spotkań było ustalanie jednakowego sposobu nauczania prawd wiary i normowania dyscypliny kościelnej. Stolica Apostolska rozumiała potrzebę takich spotkań biskupów i na nie zezwalała. Od pontyfikatu Piusa IX zaczęto doceniać i wspierać formę spotkań biskupów tworzących konferencje. Podczas dyskusji soborowych dostrzeżono potrzebę regulacji prawnej tej instytucji w Kościele. Swoje uregulowanie konferencja biskupów znalazła w Kodeksie Prawa Kanonicznego z 1983 r. Ustawodawca przyznał konferencji biskupów kompetencje ustawodawcze, wykonawcze i sądownicze. Kompetencje te, zawarte w poszczególnych dyspozycjach ustawodawcy kodeksowego, tworzą katalog spraw wymagających uregulowania przez konferencję biskupów.

The paper discusses the missionary task carried out by the particular Church and shows the missionary character of the Catholic Church, as well as her missionary nature on various levels in each diocese. At the beginning, we have defined the term „particular Church”. Canon 781 contained in the Code of Canon Law concerns the meaning of missionary activities in the Church Universal, those activities that are targeted at nations and cultures. Canon 781 also instructs as to the fundamental duties of the people of God have, and all the Christian faithful to recognize the „signs of times” in the contemporary world at the moment. The most important obligation that all the members of the Catholic Church have is to bear witness to Good News proclaimed by Jesus. The canon law in question reads as follows: „Since the entire Church is missionary of her nature, and since the world of evangelization is to be regarded as a fundamental duty of the people of God, all the Christian faithful, being aware of their own responsibility in this area, are to assume their role in the missionary work”. The study is based on the publications and papers written by different authors. We have especially concentrated on the documents of Vatican Council II and the Popes' teaching. The conciliar documents are the main sources of the new Code: the Constitution Lumen Gentium, the Decree Ad Gentes, the Decree Christus Dominus, the Decree Presbyterorum ordinis, the Exhortation of Pope Paul VI Evangelii Nuntiandi and John Paul II's Exhortation Christifideles Laici. Fundamentally, we have grounded our study on the Code of Canon Law of the Catholic Church and the Code of Canon Law for Eastern Churches of 1990. We have presented our interpretation of the documents in question. The paper depicts different categories of people who are responsible for the missionary activities in the Catholic Church. We mean here Bishops Conference, individual bishops, and bishops in the Church, the hierarchy in the Catholic communities: priests, Missionary Institutes and Laity with a special category of catechists.

Ordynariaty personalne dla anglikanów ustanowione na mocy konstytucji apostolskiej Anglicanorum Coetibus są nowym personalnym okręgiem kościelnym w Kościele, który pozwala na zbiorowe włączenie byłych anglikanów do plena communio z Kościołem katolickim, przy jednoczesnym zachowaniu specyficznych elementów angliańskiego dziedzictwa duchowego i liturgicznego. W artykule Autor przedstawił krótką historię wspólnoty anglikańskiej, genezę ordynariatów personalnych dla anglikanów oraz odnoszące się do nich normy prawne. Na podstawie analizy norm prawnych zawartych w Kodeksie Prawa Kanonicznego, Anglicanorum Coetibus oraz Normach Uzupełniających wydanych przez Kongregację Nauki Wiary, Autor przedstawia pogląd, że ordynariaty personalne dla anglikanów są realizacją kan. 372 § 2 Kodeksu Prawa Kanonicznego, który zezwala na erygowanie Kościołów partykularnych, wyróżniających się obrządkiem wiernych lub z innej podobnej przyczyny, a zatem można je nazwać personalnym Kościołem partykularnym.
Personal Ordinariates for Anglicans established under the apostolic constitution Anglicanorum Coetibus are the new personał ecclesiastical circumscription in the Church, which allows to collective incorporation former Anglicans into the plena communio with the Catholic Church, while maintaining the specific elements of the Anglian spiritual and liturgical heritage. In this article, the Author showed the short history of Anglican Communion, the origins of the Personal Ordinariates for Anglicans and legal norms referring to them. Based on analysis of legal norms contained in Code of Canon Law, Anglicanorum Coetibus and the Complementary Norms issued by the Congregation for the Doctrine of the Faith, the Author presents view that the Personal Ordinariates for Anglicans are the realization of Can. 372 § 2 Code of Canon Law, which allows to erected particular churches distinguished by the rite of the faithful or some other similar reason, and therefore they can be called a personal particular Church.

Opis:
Life of the Church from the very beginning was characterized by participation of the local community in solving the current problems connected with its existence. The eastern Canon Law appoints conventus eparchialis (eparchial convention) as the most important one among the organs supporting the eparchial bishop in managing the eparchy (diocese), in this way indicating its role and task in the life of the particular Church. The origin of the term conventus (convention) should be seen in the Greek source term synodos, from which it was derived. The very Greek word synodos means “to take together a common route to an appointed aim”. Hence the discussed concept contains two elements in it: convention and solving common problems. An eparchial convention is summoned by the bishop – its pastor. It unites the eparchial bishop, the clergy, monks and nuns in one living and active organism – communio fidelium. It has its own structure that reflects its constitutive elements. It has a representative character and presents the synthesis of God’s People of the given particular Church. An eparchial bishop has an opportunity to meet his Church at an eparchial convention, and a particular Church has the right to express its opinion in front of its bishop. Apart from the pastoral dimension an eparchial convention also prepares particular legislation. It is supposed to be finalized in the form of an actual document with a legal character, through which it contributes to creating the good of the Church, for which it was summoned. The eparchial bishop also remains the only legislator, as it is he that promulgates the texts of acts, declarations and decrees that are binding for all the faithful living in his eparchy. The institution of the eparchial convention emphasizes joint work, in which, through coparticipation, common responsibility is born for building an ecclesiastical community – a particular Church.

Opis:
The article aims to present the munus docendi, i.e. the task of teaching the diocesan bishop who plays an important role in the Church. With consecration, the bishops are charged with the task of teaching, sanctifying and governing. The diocesan bishop should carry out the task of teaching personally, and coordinate its implementation through his co-workers who support him in proclaiming the Word of God. The article focuses on the subject and style of preaching and the ways of communicating God’s Word. The diocesan bishop, in addition to his personal preaching, is also to care for other proclaimers of the Church’s doctrine. The competences and relations of the diocesan bishop towards the clergy, lay faithful, catechetical teaching, schools, Catholic universities, church universities and faculties, the media of social communication and theologians were presented. Bishops are authentic teachers and, what is worth emphasizing, they remain only an instrument in God’s hand called to teach the Word of God. The preached Word of God must be adapted to the current problems of people, the environment and culture. The bishop must also implement the word of God in his life, because through his testimony the preached Gospel gains value. The entire deposit of faith is to be the subject of the proclamation of the diocesan bishop. The diocesan bishop is to communicate the Gospel to all the faithful, both believers and non-believers, and to those who have departed from religious practice and faith.
Artykuł ma na celu ukazanie munus docendi, czyli zadania nauczania biskupa diecezjalnego, który pełni ważną rolę biskupów diecezjalnych w Kościele. Wraz z konsekracją zostaje nałożony na biskupów obowiązek wypełniania zadania nauczania, uświęcania i rządzenia. Biskup diecezjalny zadanie nauczania powinien wykonywać osobiście, a także koordynować jego realizację przez swoich współpracowników, którzy wspierają go w głoszeniu Słowa Bożego. W artykule została zwrócona uwaga na przedmiot i styl przepowiadania oraz sposoby przekazywania Słowa Bożego. Biskup diecezjalny poza osobistym głoszeniem ma również troszczyć się o innych głosicieli doktryny Kościoła. Ukazane zostały kompetencje oraz relacje biskupa diecezjalnego w stosunku do duchowieństwa, wiernych świeckich, nauczania katechetycznego, szkół, uniwersytetów katolickich, uniwersytetów i fakultetów kościelnych, środków społecznego przekazu oraz teologów. Biskupi są autentycznymi nauczycielami i, co warto podkreślić, pozostają tylko narzędziem w ręku Boga, powołanym do nauczania Słowa Bożego. Głoszone Słowo Boże musi być dostosowane do aktualnych problemów ludzi, środowiska i kultury. Słowo Boże biskup musi również wprowadzać w swoje życie, gdyż przez jego świadectwo głoszona Ewangelia zyskuje na wartości. Przedmiotem przepowiadania biskupa diecezjalnego ma być cały depozyt wiary. Biskup diecezjalny ma przekazywać Ewangelię wszystkim wiernym zarówno wierzącym jak i niewierzącym oraz tym, którzy odeszli od praktyki i wiary religijnej.

Ustawodawca w Kodeksie Prawa Kanonicznego z 1983 r. stanowi, że ci, którzy otrzymali święcenia, zdolni są do sprawowania, zgodnie z przepisami prawa, władzy rządzenia, która jest w Kościele z Bożego ustanowienia. W wykonywaniu tej władzy mogą współdziałać wierni świeccy, zgodnie z przepisami prawa (kan. 129). Autor analizuje w artykule podstawy współdziałania we władzy rządzenia wiernych chrześcijan świeckich oraz ich uczestnictwo w organach kolegialnych Kościoła partykularnego, tj. w radzie ds. ekonomicznych, radzie duszpasterskiej i radzie mediacyjnej.
The legislator in the Code of Canon Law of 1983 states that those who have received sacred orders are qualified, according to the norm of the prescripts of the law, for the power of governance, which exists in the Church by divine institution. Lay members of the Christian faithful can cooperate in the exercise of this same power according to the norm of law (can. 129). In the article the author analyzes the basics of the cooperation of faithful lay faithful in the power of governance and their participation in the collegial organs of the particular Church, i.e. the finance council, the pastoral council and the mediation council.

Synod diecezjalny powinien zostać zwołany, gdy uzna to za konieczne biskup diecezjalny. W diecezji ełckiej, która została erygowana w 1992 r., synod został zapowiedziany dnia 18 maja 1997 r. Pierwsza Sesja Synodu odbyła się 25 marca 1998 r. Autor w artykule przeanalizował znaczenie synodu diecezjalnego w procesie organizacji Kościoła partykularnego. Następnie scharakteryzował ustawodawstwo diecezji zgodnie ze statutami Synodu Diecezji Ełckiej, definicję synodu, a także przygotowanie, przebieg i zadania synodu.
The diocesan synod should be convened when it is deemed necessary by the diocesan bishop. In the Diocese of Ełk, which was erected in 1992, the synod was announced on May 18, 1997. The first session of the synod was held on March 25, 1998. The Author analyzed in the article the importance of the diocesan synod in the process of organization the particular Church. Then he characterized the legislation of the diocese according to the statutes of the Synod of the Diocese of Ełk, the definition of the synod and the preparation, conducting and the competences of the synod.

Jednym z aspektów władzy biskupa diecezjalnego jest sprawowanie władzy ustawodawczej po-przez wydawanie aktów normatywnych – dekretów ustawodawczych i dekretów wykonawczych, które rządzą się przepisami o ustawach. Kongregacja ds. Biskupów w dyrektorium z 2004 r. Apostolorum successores określiła ogólne wytyczne, jakie powinny zostać zachowane przy redagowaniu aktów normatywnych. Również w dokumentach roboczych II Polskiego Synodu Plenarnego ojcowie synodalni zwrócili uwagę na to, aby wszystkie ustawy partykularne były redagowane popraw-nie, pod względem merytorycznym i formalnym. Jednak do tej pory nie udało się określić konkretnych wymogów, jakimi powinien się kierować biskup diecezjalny. W związku z tym Autor w artykule proponuje sięgnąć do aktualnych i przyjętych dyrektyw prawodawczych, wypracowanych na gruncie prawa świeckiego, zgodnych jednak z powołaniem i misją Kościoła, które służyłyby pomocą prawodawcy partykularnemu, wskazując mu, w jaki sposób rozwiązywać typowe problemy legislacyjne. Jeden z podziałów dyrektyw wydaje się odpowiedni do próby dostosowania go do wymogów prawodawcy kościelnego, zawiera on pięć typów kryterium podziału dyrektyw, mianowicie: 1) język; 2) jednolitość i kompletność; 3) systematyka; 4) adresat; 5) forma regulacji.
One of the aspects of authority of the diocesan bishop is to exercise legislative power through the issuing normative acts – legislative decrees and executory decrees governing the legal provisions of the Laws. Congregation for the Bishops in the Directory from 2004 Apostolorum successores, has defined general guidelines which should be complied with drafting normative acts. Also in working documents of II Polish Plenary Council, the Synod Fathers, drew attention to the fact, that all particular Laws should be drafted correctly in terms of the substance and the procedural. But until now, did not determined the specific requirements which should be guided by the diocesan bishop. Consequently, the Author in the article proposes to reach for a current and adopted legislative directives, developed on the basis of state law, however, according with the vocation and mission of the Church, which would serve the particular legislator, pointing him how to solve common problems of legislative. One of them seems appropriate to try to adapt it to the requirements of ecclesiastical legislator, it contains five types of criterion of division directives and it is as follows: 1) language; 2) the uniformity and completeness; 3) systematics; 4) the addressee; 5) the form of regulation.

Przedmiotem artykułu jest charakterystyka obowiązku biskupa diecezjalnego wizyty ad limina Apostolorum. Na początku autor wyjaśnia z czego wynika taki obowiązek i jakie podmioty są zobowiązane do wizyty u progu Apostołów. Powinność ta spoczywa na biskupie diecezjalnym, ale także na innych rządcach Kościołów partykularnych, którzy są zrównani z nim w prawie, tj. na wikariuszu apostolskim, opacie terytorialnym, prałacie terytorialnym i administratorze apostolskim administratury apostolskiej erygowanej na stałe. Zobligowanymi są także przełożeni Kościołów partykularnych utworzonych z racji motywów personalnych, tj. ordynariusz wojskowy, ordynariusz sprawujący władzę w Ordynariacie Personalnym dla byłych anglikanów czy administrator apostolski Personalnej Administratury Apostolskiej Świętego Jana Marii Vianney’a. Następnie autor przedstawia przygotowanie do wizyty ad limina, które obejmuje dwa elementy: przygotowanie dalsze oraz przygotowanie bliższe. Pierwszy etap obejmuje przygotowanie pięcioletniej relacji dotyczącej stanu diecezji. Drugi etap, w którym szczególne zadanie ma Sekretariat Konferencji Biskupów oraz Urząd ds. Koordynacji Wizyt, zawiera ustalenie terminu takiej wizyty oraz jej programu. Autor opisuje każdy element wizyty ad limina Apostolorum, tj. nawiedzenie grobów świętych Apostołów Piotra i Pawła, spotkanie z Biskupem Rzymu oraz wizyty w dykasteriach Rzymskich.
The subject of the article is to characterize the obligation of diocesan bishop of a visit ad limina Apostolorum. At the beginning the author explains what such a duty results from and what entities are obliged to a visit ad limina Apostolorum. The obligation of a visit ad limina Apostolorum rests on the diocesan bishop and other high ecclesiastical officials who are equal to him under law, i.e. apostolic vicar, territorial abbot, territorial prelate, apostolic administrator of an apostolic administration which has been erected on a stable basis, military ordinary, personal ordinary of personal ordinariates for anglicans entering into full communion with the catholic Church and apostolic administrator of Personal Apostolic Administration of Saint John Maria Vianney. Then the author presents the preparation for a visit ad limina Apostolorum which includes two elements: remote preparation and immediate preparation. The first stage concerns the preparation of quinquennial report on the state of the diocese. The second one, in which particular task has the Secretariat of the Episcopal Conference and the Coordinating Office for the Visit, includes establishing a date and the schedule of the visit. The author describes each element of the visit, i.e. venerate the tombs of the Blessed Apostles Peter and Paul, meeting the Roman Pontiff and visiting the Roman dicasteries.

As for the internal ordering of particular Churches, the actual Code of Canon Law mentions a few collegial organs, which assist in managing the diocese (cann. 460–514). The object of this paper is not to analyze all the auxiliary collegial organs mentioned by the Code, but to consider only those organs, which are councils – the councils, which support the diocesan bishop. Such councils are: the finance council; the episcopal council; the presbyteral council; the mission council and the college of consultors; the pastoral council – all of them support the bishop, especially in the pastoral service as well as in managing the spiritual and temporal goods of the diocese. The diocesan bishop, apart from these “canonical” councils, can also institute in his diocese other councils, which are not in the Code, for example: the decanal council, the religious council, the council concerning young people, the catechetical etc. All these serve as consultative organs of the bishop. Their opinions, advices or proposals should support the diocesan bishop and assist him in managing his diocese in a proper way.
Jeśli chodzi o wewnętrzną organizację Kościołów partykularnych, aktualny KPK wymienia kilka organów kolegialnych, które pomagają w zarządzaniu diecezją (kan. 460–514). Celem niniejszego opracowania nie jest analiza wszystkich pomocniczych organów kolegialnych podanych przez kodeks, ale jedynie tych, które są radami – radami wspierającymi biskupa diecezjalnego. Należą do nich: rada do spraw ekonomicznych, rada biskupia, rada kapłańska, rada misji i kolegium konsultorów, rada duszpasterska – wszystkie wspomagają biskupa przede wszystkim w posłudze duszpasterskiej, a także w zarządzaniu dobrami duchowymi i doczesnymi diecezji. Biskup diecezjalny obok tych „kanonicznych” rad może również ustanowić w swojej diecezji inne, których nie ma w kodeksie, na przykład: radę dziekańską, radę zakonną, radę do spraw młodzieży, radę katechetyczną itp. Wszystkie one są organami doradczymi biskupa. Ich propozycje, porady czy opinie powinny wspierać biskupa diecezjalnego i pomagać mu w prawidłowym zarządzaniu jego diecezją.

The Pope Francis’ 2015 reform of declaring the nullity procedures introduced a new process which is briefer than the ordinary process and have brought the followers closer to the church structures. The new form of this procedure has contributed to it considerably: briefer process – processus brevior. The Supreme legislator appoints a bishop the sole competent person to make a judgement within this process. The purpose of this article was to indicate the entities competent to perform the function of a judge in the briefer process. The fundamental question was this: is the ordination of a bishop a requirement to hold such a function? and thus whether every ordinated bishop may be iudex in the processus brevior. Another question was whether a clergyman who was not ordained may conduct such a process. This article shows that the legislator’s will, despite the nomenclature used in Motu proprio, is completely different. The Bishop of Rome has linked the functions of a single judge in the briefer process to the office of the head of a particular church. It shows that the iudex function in processus brevior is not of sacramental nature. A particular church is above all a diocese headed by a diocesan bishop. The legal order in the Latin church anticipates that other territorial and personal structures are equal to a diocese. Their governors are equal by law to a diocesan bishop. If they have judicial powers in scope of marriages, they are competent to conduct a briefer process. In some cases the governors of the particular churches, which are equal by law to a diocese, are not elevated to the rank of a bishop. Not being ordinated to a bishop, however, does not make them incapable of being iudex in the processus brevior coram Episcopo!
Reforma procesu o stwierdzenie nieważności małżeństwa dokonana w 2015 roku przez papieża Franciszka przyczyniła się do skrócenia procedury procesowej oraz przybliżyła wiernych do struktur kościelnych. Znacząco do tego przyczyniła się nowa forma procedury: proces skrócony – processus brevior. Najwyższy Ustawodawca ustanawia biskupa jedynym kompetentnym podmiotem do sądzenia w tym procesie. Celem niniejszego artykułu było wskazanie podmiotów kompetentnych do pełnienia funkcji sędziego w procesie skróconym. Fundamentalnym pytaniem było: czy wymogiem do pełnienia tego zadania są święcenia biskupie, a zatem: czy każdy wyświęcony biskup może być iudex w processus brevior? Nasunęło się również inne pytanie: czy duchowni niemający święceń biskupich mogą prowadzić taki proces? Niniejszy artykuł ukazuje, że wola ustawodawcy, mimo nomenklatury używanej w Motu proprio jest zupełnie inna. Biskup Rzymski powiązał funkcje jednoosobowego sędziego w procesie skróconym z urzędem głowy Kościoła partykularnego. Pokazuje to, że funkcja iudex w processus brevior nie ma zakorzenia w charakterze sakramentalnym. Kościołem partykularnym jest przede wszystkim diecezja, na czele której stoi biskup diecezjalny. Porządek prawny w Kościele łacińskim przewiduje, że z diecezją zrównane są również inne struktury terytorialne i personalne. Ich rządcy są zrównani w prawie z biskupem diecezjalnym. Jeśli posiadają władzę sądowniczą w zakresie małżeńskim, są kompetentnymi podmiotami do prowadzenia procesu skróconego. W niektórych przypadkach rządcy Kościołów partykularnych zrównanych w prawie z diecezją nie są wynoszeni do godności biskupiej. Jednak brak święceń biskupich nie czyni niezdolnymi powyższe podmioty do bycia iudex w processus brevior coram Episcopo!

W obecnym kontekście Kościoła powszechnego „jedyne Corpus Iuris Canonici” staje się konkretną rzeczywistością. Kościół oddycha dwoma płucami, wschodnim i zachodnim. Kanony Kodeksu Kanonów Kościołów Wschodnich uzupełniają Kodeks Kościoła łacińskiego, gdy kanon, który odnosi się do Kościoła sui iuris, ale z kontekstu jasno wynika, że przedmiotowa kwestia dotyczy relacji z Kościołem łacińskim.
In the present context of the Universal Church, “the only Corpus Iuris Canonici” is becoming a concrete reality. The Church breathes with two lungs, one in the East and one in the West. The eastern canons supplement the western canons: they do so when a canon refers either to the Latin Church or a Church sui iuris and the when the context makes it clear that the case concerns relations with the Latin Church.
Nel contesto attuale della Chiesa Universale, “l’unico Corpus Iuris Canonici”, diventa realtà concreta. La Chiesa respira con due polmoni, quello dell’Oriente e dell’Occidente. I canoni orientali forniscono il diritto suppletivo ai canoni occidentali: lo fanno quando un canone si riferisce all’ Ecclesia sui iuris e il testo e il contesto rendono chiaro che la questione implica relazioni con la Chiesa Latina.

Opis:
The article addresses the issue of synodality in three dimensions. First, it discusses synodality in the light of can. 212 § 3 of the Code of Canon Law. Secondly, it addresses the issue of obligatory disclosure of oneʼs opinions arising from the above-mentioned canon. This is an attempt to answer the question whether participation in the synodal process may oblige a faithful to manifest his or her opinions concerning the good of the Church, and if so, on what basis. Thirdly, the article expands the question about the existence of legal grounds for the obligation to manifest oneʼs opinions in the canons regarding the existing councils of a particular Church. This extension of the analysis is justified by the principle that synodality does not require the creation of new structures. This leads to the final conclusion that existing canons already contain provisions regulating speaking in the synodal process.
W artykule poruszono problematykę synodalności w trzech wymiarach. W pierwszej artykuł omawia synodalność w świetle kan. 212 § 3 Kodeksu Prawa Kanonicznego. Po drugie, porusza kwestię obowiązkowego ujawniania swoich poglądów wynikających z wyżej wymienionego kanonu. Jest to próba odpowiedzi na pytanie, czy i na jakiej podstawie uczestnictwo w procesie synodalnym może obligować wiernych do ujawniania swoich poglądów dotyczących dobra Kościoła. Po trzecie, artykuł poszerza kwestię istnienia podstaw prawnych obowiązku ujawniania swoich poglądów w kanonach dotyczących rad istniejących w Kościele partykularnym. To rozszerzenie analizy uzasadnione jest zasadą, że synodalność nie wymaga tworzenia nowych struktur. Prowadzi to do ostatecznego wniosku, że istniejące kanony dotyczące Kościoła partykularnego zawierają przepisy regulujące wypowiadanie się w procesie synodalnym.

Artykuł ukazuje pewne elementy eklezjologii episkopatu, jakie wyłaniają się z ksiąg liturgicznych odnowionych po Soborze Watykańskim II. Biskup jest oblubieńcem Kościoła, ponieważ od momentu święceń biskupich uobecnia on sakramentalnie w stopniu najwyższym Chrystusa Pasterza i Oblubieńca Kościoła. Chociaż biskup wykonuje swoją posługę uświęca-nia i kultu w całej diecezji, to jednak kościół katedralny, będący jakby kościołem matką i centrum Kościoła partykularnego, jest miejscem właściwym, w którym on rozwija funkcję „szafarza łaski najwyższego kapłaństwa” wobec swojej owczarni, zwłaszcza gdy przewodniczy liturgii w dniach uroczystych, gdy poświęca olej krzyża oraz udziela święceń. Postać biskupa celebrującego liturgię w kościele katedralnym jest wyjaśniana przez symbolikę elementów przestrzeni liturgicznej. Do tych symbolicznych „ikon” należą m.in.: katedra biskupia, ołtarz, prezbiterium, ambona, chrzcielnica, także zakrystia.
The article shows some elements of ecclesiology of the episcopate, which appear in liturgic books renewed after the second Vatican Council. The bishop is the spouse of Church, because since the moment of bishop ordination he represents Christ the Shepherd and the Spouse of Church on the highest level. Although the bishop does his duties connected with sanctification and worship in the whole diocese, it is the cathedra church which ist somehow mother church and the centre of particular church and it is the proper place where it develops its function of the minister of the grace of the high priesthood for its sheepfold, especialy when he leads the liturgy on special celebratory days, blesses the oil of chrism and admini-strates the sacred ordinations. The figure od the bishop who aministrates liturgy in cathedral church expresses its whole imagery through its presence in icons of liturgic space to which belong bishop’s cathe-dra, presbyterium, ambo or amboes, baptismal bowl and sacristy.

Die Autoren haben ein Problem untersucht, das in der polnischen Literatur zu diesem Thema nur begrenzt bekannt und unzureichend erschlossen ist, zumal es sich bei der Veröffentlichung um eine wertvolle Sammlung von Normen und Hinweisen für die Praxis handelt, die auf den Quellen des allgemeinen und besonderen Kirchenrechts beruhen. Aus diesem Grund ist diese Monographie ein hervorragendes Kompendium für Kanonisten, die sich mit Pfarreien unter den betrachteten Aspekten befassen. Die Publikation enthält praktische Forschungsinhalte, die auf der Ebene der Tätigkeit der einzelnen Kurien oder Pfarreien angewandt werden müssen. Die durchgeführten Untersuchungen weisen auf neue Annahmen hin, die auf eine neue Evangelisierung abzielen, "die durch die volle und verantwortungsvolle und engagierte Beteiligung der Laien möglich sein wird".
The authors undertook a study of a problem known to a limited extent and undeveloped in the Polish literature on the subject, all the more so because the publication is a valuable collection of norms and indications in the practical dimension based on the sources of the universal and particular Canon Law. For this reason, this monograph is an excellent compendium for canonists dealing with parishes in the aspects under consideration. The publication brings practical research content that needs to be applied at the level of the activity of individual curia or parishes. The research carried out points to new assumptions aimed at undertaking a new evangelisation, "which will be possible through the full and responsible and committed participation of the lay faithful".

Artykuł podejmuje problematykę poszukiwania istoty relacji Kościoła powszechnego z Kościołami partykularnymi w myśli ks. José Ramóna Villara. Prezentuje osie podziału na Kościół powszechny i Kościoły partykularne. Poszerza się zagadnienia pierwszeństwa Kościoła powszechnego, wzajemnego oddziaływania między Kościołami powszechnym a partykularnymi. Prezentowane są formy obecności Kościoła powszechnego w partykularnym oraz natura i misja episkopatu w Kościele. Całość rozważań ma charakter analityczno-syntezujący. Praca wpisuje się w nurt rozważań nad eklezjologią eucharystyczną i przede wszystkim nad teologią Kościoła partykularnego. Zagadnienia te w myśli J.R. Villara pokazują w sposób wyrazisty, jak rozumieć relację Kościoła partykularnego do powszechnego.
The article deals with the problem of searching for the essence of the relationship between the particular and the universal Church. It presents the pivots of division into the universal Church and the particular Churches. The issue of the universal Church’s primacy and the interaction between them is extended. Presented are the forms of the presence of the universal Church in the particular and the nature and mission of the episcopate. The consideration is analytical and synthesizing. The work is part of the current of reflections on Eucharistic ecclesiology and the theology of the particular Church. These issues in the thought of J.R. Villar show how to understand the relationship of the particular Church to the universal.

W Motu proprio Mitis Iudex Dominus Iesus z 15 sierpnia 2015 r. Franciszek przypomniał biskupom diecezjalnym, że zgodnie z kan. 383 § 1 KPK obowiązani są do opieki nad małżonkami pozostającymi w separacji lub rozwiedzionymi. Troska ustawodawcy o łatwy dostęp do pomocy prawnej i duszpasterskiej dla rozwiedzionych małżonków znajduje odzwierciedlenie w wielu inicjatywach mających na celu towarzyszenie takim osobom w ich życiu i ułatwienie dostępu do sądu. Włoskie archidiecezje Trani–Barletta–Bisceglie i Pescara–Penne są przykładami pożytecznych inicjatyw, które mają pomóc rozwiedzionym małżonkom w rozeznaniu ich sytuacji życiowej oraz we wniesieniu powództwa o unieważnienie małżeństwa. Podjęto tam cenne instytucjonalne formy pomocy tym małżonkom.
In the Motu proprio Mitis Iudex Dominus Iesus of August 15, 2015, Francis reminded the diocesan bishops that under can. 383 § 1 of the CIC are obliged to care for separated or divorced spouses. The legislator's concern for easy access to legal and pastoral assistance for divorced spouses is reflected in many initiatives aimed at accompanying such people on their way of life and facilitating their access to court. The Italian archdioceses of Trani–Barletta–Bisceglie and Pescara–Penne are examples of useful initiatives to help divorced spouses discern their life situation and to assist them in bringing proceedings for annulment of their marriage. Valuable institutional forms of helping these spouses have been undertaken there.

Przez wiele ostatnich dekad akademicka eklezjologia katolicka była skoncentrowana głównie na Kościele powszechnym. Nadszedł czas by „odkryła” obecność Boga także w Kościołach lokalnych i partykularnych, ich historii, wyjątkowych osobach (świętych, błogosławionych, męczennikach), wkładzie w kulturę, życie społeczne i moralne. Katolicka eklezjologia powinna otworzyć oczy na wyjątkowość i tożsamość lokalnych i partykularnych Kościołów. Dotychczas pojęcie „tożsamość” w języku eklezjologicznym było zarezerwowane do Kościoła powszechnego i rozumiane jako jego statyczna natura oraz przymioty. Niniejszy artykuł jest metodologicznym zarysem rozumienia tożsamości Kościołów lokalnych i partykularnych. Inicjuje go wprowadzenie do właściwego, nieredukcyjnego, rozumienia pojęcia „tożsamość Kościoła”, po czym omówione zostały główne tychże Kościołów rodzaje tożsamości wraz z ich komponentami: tożsamość teologiczna (tożsamość w Bogu, tożsamość eklezjologiczna, teologiczna auto-tożsamość, tożsamość personalistyczna, pastoralna, tożsamość w znakach wiarygodności, tożsamość w kontekście aktualnych wyzwań), tożsamość historyczna (geneza, główne okresy dziejów, tożsamość stanowiona, ogólna tożsamość historyczna, aktualna tożsamość historyczna), tożsamość etyczno-moralna, tożsamość kulturowa i inne (tożsamość religijna, aktualna auto-tożsamość, tożsamość komparatywna). Autor ma nadzieję, że nowa metodologiczna perspektywa, ukazana w artykule, może wzbogacić eklezjologię, uczynić ją bardziej realistyczną, „żywą” oraz otworzyć ją na nowe sposoby uzasadniania wiarygodności Kościoła.
According to the Catholic faith the Church established by Jesus Christ subsistit in the Catholic Church as the Universal Church (Ecclesia universalis, Catholica). This Church is also communio Ecclesiarum and subsistit in local and particular Churches, and in community among them. Joseph Ratzinger, following the teaching of the Catholic Church, reminds that a local Church (Ecclesia localis) means a patriarchy or a `specific community of traditions and rites' and a particular Church (Ecclesia particularis) means a community of believers subjected to one bishop (a diocese). Post-conciliar Catholic ecclesiology has been mostly focused on the Universal Church. Such `universal' ecclesiology earned mature methodologies. But meantime, the Universal Church has also been present in local and particular Churches which are making their own history and identity day by day. For example, in 2016 the Catholic Church in Poland celebrated 1050th Jubilee which itself offered an opportunity to describe its main dimensions and identity. So-called young Churches are on their way to establish their identity. By no means, in our times and eyes the `identity' becomes one of the key-words in theological refection on the Church. The more secular the modern world and culture become, the more clearly one can see the difference between them and the Church. This paper offers a methodological outline of the identity of local and particular Catholic Churches. Its purpose is to name and shortly describe main kinds of such identity (theological, historical, ethical-moral, cultural) and their components. But first, making some remarks as introduction is very much required.

In the above presentation the Diocese of Tarnow has shown its commitment to the missionary work at the time of celebrating its 225 jubilee. It covers the last 38 years because during that time the bishops of Tarnow have regularly sent forth the missionaries to different countries. This commitment by reading the spirit and intentions of Vatican II, had been started by archbishop George Ablewicz and then continued by successive bishops of Tarnow: namely by bishop Joseph Życiński and the bishop Victor Skworc. So far they have sent forth 118 priests to three different continents. This act harmonizes with the fourth Synod of the Diocese of Tarnow which took place in 1986. Its main motto was “Ad imaginem Ecclesiae universalis”. This life of the particular Church which in Tarnow is following the example of the universal Church is mainly expressed by sending forth the missionaries and then in cooperation with them. Their work is a huge contribution to the evangelization of the few countries in Africa, South America and more recently Kazakhstan in Asia. Upon this commitment has been placed a seal of the martyrdom of one of the sons of the Diocese of Tarnow – namely the priest John Czuba, the fideidonist, who was killed in the Republic of Congo in 1998. The missionary cooperation of the Diocese is both spiritual and material. It is done thanks to the Diocesan Missionary Work. It is expressed in constant prayer for the missionaries undertaken especially by the rosary groups, but also by maintaining the missionaries, purchase of the means of transport for them or making investments, among which are: hospitals, schools, kindergartens or home for the street children. They are used by children and adults and the priest of Church of Tarnow tend them. At present in the Diocesan Missionary Work there are 46 missionaries from Tarnow region. They work in different parts of the world: 14 of them stay in Africa, 27 work in South America and 5 in Kazakhstan. This represents approximately 15 per cent of all fideidonists in Poland. To this number we may add the secular missionaries who work in the following countries: Cameroon – there is one missionary, the Central African Republic – there are two missionaries and two other volunteers in this very country.

The article aims to discuss the main features of church particular administrative acts and compares them with administrative acts known in polish administrative law. There will be analysed important aspects of duties division and Church authority competence. Authors will approximate definition of church administrative act and examine appropriate canon law provisions. The main assumption of the article is to indicate common features of administrative acts in canon and administrative law.

The establishment of a new church unit in the Opole region followed some changes of the Polish borders after the Second World War. By virtue of special jurisdictions from the Holy See, Cardinal August Hlond decided to establish the Opole diocese from the Wrocław archdiocese, and create a separate administrative church unit. The nomination of apostolic administrators was an important factor that stabilised the structures of the Church in the Regained Territories. The state-party authorities, however, treated their activities as attempts to maintain the temporary procedures in the church board at the affiliated territories. Therefore chapter priests selected under coercion by local consultants were imposed. In the end of 1956 a new political situation emerged, which had brought about positive changes in the situation of the Church in Poland. On December 1st, 1956, Cardinal Stefan Wyszyński nominated the Rev. Dr. Franciszek Jop, an auxiliary bishop in the Sandomierz diocese, to Opole. The article discusses the problem of regulations as regards the clergy in the years of pastoral ministry of Bishop Franciszek Jop in the Opole Church.

Katolickie Kościoły wschodnie ze względu na swoje zróżnicowanie obrządkowe wnoszą odrębny wkład w całościowe dziedzictwo chrześcijańskie. Każdy obrządek wschodni emanuje samodzielnym i autentycznym zbiorem cech liturgiczno-kultycznych typowych dla określonego nurtu tradycyjnego. Posiadanie własnych przymiotów praktyki sakramentalno-rytualnej jest nieodłącznie związane z przywilejem działania Kościoła partykularnego i wpływa bezpośrednio na kształtowanie jego tożsamości. Jakkolwiek elementy zewnętrzne i obrzędowe w Kościele wschodnim spełniają rolę pomocniczą, lecz są one niezbędne i niezastąpione. Ich moc odziaływania przyczynia się najczęściej do pełniejszej integracji wspólnoty wiernych i jej zjednoczenia modlitewnego. Powoduje prawdziwe zespolenie tychże wiernych wokół idei jednego i rodzimego obrządku, który jawi się dla nich życiodajna siłą duchową. W artykule podjęto ważne aspekty formułowania się tożsamości obrządkowej w obrębie Katolickich Kościołów wschodnich. Wskazując zarazem na uwarunkowania duszpasterskie, które niekiedy wymuszają na wschodnich katolikach dostosowanie się do rodzaju eksperymentu obrządkowego.
Eastern Catholic Churches, due to their ritual diversity, make a separate contribution to the overall Christian heritage. Each Eastern rite exudes an independent and authentic collection of liturgical and cultic features typical of a particular traditional current. Having your own attributes of sacramental-ritual practice is inherent in the privilege of the particular Church and directly affects its identity. Although the external and ritual elements in the Eastern Church play an auxiliary role, they are necessary and irreplaceable. Their power of influence usually contributes to a more complete integration of the community of the faithful and its prayer union. It brings about a real fusion of these faithful around the idea of one and native rite, which appears to them as a life-giving spiritual force. The article addresses important aspects of the formation of a ritual identity within the Eastern Catholic Churches. At the same time, he points to pastoral conditions, which sometimes force Eastern Catholics to adapt to the type of ritual experiment.

The article is to illustrate the development of this important part of the Canon law and catholic teaching in the universal Church and in Poland.The first part outlines the history of this catechetical formulation of basic catholic obligations, from the time of the Council of Trent until mid 20th century, including the perspective of the Church in Poland. Fundamental issues, namely the obligation of celebrating Sunday, Easter duty or the fasting precept, have been the same throughout the catholic world, even though their specific wording evolved depending on time and place.The second part touches upon the formulation of the commandements of the Church in the Catechism of the Catholic Church. This fundamental document of the catholic doctrine was first published in French in 1992, while its revised version in Latin was promulgated in 1997. Finally, in 2005 there was issued Compedium of the Catechism. The article contains an analysis of exact wording of the Church precepts in all above mentioned editions of the catechism. The matter is of great importance, since the it refers to the first official and universal formulation of the precepts.The third part deals with the Polish version of the commandements, promulgated by the Polish Episcopal Conference in 2003. Polish bishops took advantage of their right to adjust the universal text to specific needs of particular Church. With approval of the Holy See, the Polish pastors dispensed from certain feasts of precept and introduced the obligation to abstain from dances during Lent and on Fridays throughout the year. In the 2014 revised version the latter ban was lifted and since then only Lent has been the period of party abstinence.Not only does the article highlight the correlation between canon law and pastoral practice of the Church, but refers to the role of implementation of the universal law in the life of particular Churches.
L’articolo espone lo sviluppo di una parte importante del diritto canonico e dell’insegnamento cattolico nella Chiesa universale e in quella presente in Polonia.Nella prima parte viene descritta la storia delle formule catechistiche riguardanti i principali obblighi del fedele dal tempo del Concilio di Trento fino alla metà del ventesimo secolo, prendendo in considerazione la prospettiva della Chiesa cattolica in Polonia. Le indicazioni fondamentali – l’obbligo di festeggiare la domenica, il precetto della confessione e della comunione pasquale, le esigenze circa il digiuno – sono presenti in tutto il mondo cattolico, anche se le specifiche condizioni del tempo e del luogo hanno influenzato la loro forma concreta.Nella seconda parte è dibattuto il problema dei precetti ecclesiali nel Catechismo della Chiesa Cattolica. Questo documento fondamentale fu pubblicato per la prima volta in lingua francese nel 1992. Dopo molte correzioni, nel 1997 è stata presentata l’editio tipica in lingua latina. Infine nel 2005 papa Benedetto XVI ha ordinato la pubblicazione del Compedio del Catechismo della Chiesa Cattolica. Nell’articolo vengono analizzate le formule dei precetti ecclesiali in tutte e tre le versioni del catechismo. Va notato che, malgrado 500 anni di storia della propagazione dei precetti della Chiesa, solo adesso sono stati formulati come vincolanti in tutta la Chiesa universale.La terza parte verte sulla versione polacca dei precetti della Chiesa, promulgata dalla Conferenza Episcopale Polacca nel 2003 e riformata nel 2014. I vescovi polacchi hanno approfittato della possibilità di accomodare il testo dei precetti agli specifici bisogni e aspettative delle Chiese particolari. Con il consenso della Sede Apostolica, i pastori della Chiesa cattolica in Polonia hanno esonerato i fedeli dall’obbligo di festeggiare alcuni giorni festivi, ma nello stesso tempo hanno confermato la proibizione di partecipare ai divertimenti durante la Quaresima, ampliandola anche a tutti i venerdì dell’anno. Nel 2014 fu introdotto l’ultimo cambiamento nel testo dei precetti, con la decisione di lasciare la proibizione dei divertimenti solamente nel tempo di Quaresima.In conformità con il suo titolo, l’articolo espone il profondo legame tra il diritto e la pastorale, ma anche la relazione tra il diritto universale e il suo adattamento nel diritto particolare.

The official reception of the conciliar legislation in medieval Poland was greatly influenced by the papal legates, ambassadors endowed with papal authority, who brought conciliar canons to the country ruled at the time by the Piasts and made them public at councils convened with the participation of papal legates, closely monitored the observance of Canon Law and its scope expansion, concurred statutes of Polish provincial and diocesan councils, approved or rejected nominations of bishops, etc. They also acted as intermediaries in personal interventions of popes in their involvement in the functioning of the Church in Poland. Their duties also included inspections in dioceses. Visits of papal legates in Poland were relatively frequent and their main goal was to enforce and implement ecclesiastical reforms in the country. In some instances, a strict relationship between a stay of a papal representative in Poland and the process of the creation and spread of schools is clearly observable. The article examines source accounts concerning the visits of papal legates in Poland, as well as analyses the available statues of legate councils in terms of the provisions included in them regarding education of representatives of the clergy and laymen alike.

The purpose of the article is to present the issue of the use by the episcopal conferences of optional norms of the Code of Canon Law in the scope of the munus docendi of the Church. The Code obliges or enables episcopal conferences to issue norms complementary to the Code of Canon Law, among others regarding the teaching office of the Church. In three cases, the Code provides for the issuance of possible arrangements for an episcopal conference regarding the munus docendi of the Church (canon 755 § 2, 766, 804 § 1). The author presented and evaluated the provisions of selected episcopal conferences in the field of the teaching office of the Church. The whole article concludes with a summary and bibliography.

Po 1945 roku Kościół Katolicki na Węgrzech został poddany szeroko zakrojonym represjom. Władze komunistyczne zerwały stosunki dyplomatyczne z Watykanem, rozwiązały szereg stowarzyszeń katolickich, szkoły podlegające kościołowi oraz większość zakonów. Na kościele wymuszono podpisanie szereg umów z państwem (w roku 1950 i 1960), które spowodowały całkowitą zależność Kościoła od państwa. Duchowni byli zobowiązani składać przysięgę na wierność państwu. W latach 60. duchowieństwo węgierskie wzięło udział w Soborze Watykańskim II ale reprezentowali tam –poza nielicznymi wyjątkami – punkt widzenia państwa komunistycznego. W 1969 roku wprowadzono na Węgrzech reformy soborowe. Kościół był bardzo słaby ale zdarzały się przypadki niesubordynacji (np. aktywność księdza Györgya Bulányiego), a więzienie nieposłusznych duchownych było powszechne, ostatni duchowny został uwolniony dopiero w 1977 roku.
After 1945, the Catholic Church in Hungary was exposed to wide repression. The communist authorities broke off diplomatic relations with the Vatican, dissolved a number of Catholic associations, schools lead by the Church, and most of the orders. The church was forced to sign several agreements with the State (in 1950 and 1960), which resulted in a total dependence of the church on the state. The clergy were required to take an oath of allegiance to the state. In the 1960s Hungarian clergy took part in the Second Vatican Council and represented – with few exceptions – point of view of the communist state . In 1969, Hungary introduced the conciliar reform. Catholic church was very weak but arranged antistate actions (eg. activity of priest György Bulányi), the prison for disobedient clergy was widespread. Last cleric was released from prison in 1977.

The members of the Catholic Church have both rights and responsibilities, which result from the nature of the human being, as people are called to follow their vocation in life. However, to make it possible people and their activities must be protected by the rights and duties. Code of Canon Law sets out the rights and responsibilities of those who believe. It should be emphasized that these rights and duties permeate each other. A human being, as a member of the community of the Church through baptism, has the right, but also the obligation to promote holiness in life and thus strive to achieve it, since not only does it enrich inner life, but it also affects family life making it more human and more Christian. Parents should enjoy the right to educate their children according to their own beliefs and systems of values, and the state authorities cannot infract or destroy these systems. The right to education is a part of the idea of evangelization, which should originate from the closest members of a family. At the same time members of the Church, including both parents and children, can rely on help from the clergy in achieving salvation. They have the right to form associations and the right to defend the good name.

During a pastoral visit the faithful make voluntary offerings. Part of the funds collected is paid for diocesan and parish needs, whereas the remaining amount is transferred to the clergy. Although specific solutions vary from one diocese to another, offerings made on a pastoral visit are substantial material support for presbyters, and thus constitute the implementation of the clergy’s right to decent support.

The purpose of the article is to present the issue of the use by the episcopal conferences of obligatory norms of the Code of Canon Law within the purview of the munus docendi of the Church. The Code obliges or enables episcopal conferences to issue norms complementary to the CCL, among others regarding the Magisterium of the Church. In three cases, the Code obliges episcopal conferences to make arrangements regarding the munus docendi of the Church (can. 772 § 2, 788 § 3, 831 § 2). The author presented and evaluated the provisions of selected episcopal conferences in the field of the teaching task of the Church.
Celem artykułu jest ukazanie zagadnienia wykorzystania przez konferencje episkopatów norm obligatoryjnych Kodeksu Prawa Kanonicznego w zakresie munus docendi Kościoła. Kodeks zobowiązuje albo umożliwia konferencjom biskupim wydanie norm komplementarnych do KPK m.in. w zakresie zadania nauczycielskiego Kościoła. W trzech przypadkach Kodeks zobowiązuje konferencje biskupie do wydania ustaleń w zakresie munus docendi Kościoła (kan. 772 § 2, 788 § 3, 831 § 2). Autor przedstawił i ocenił przepisy wybranych konferencji episkopatów w dziedzinie nauczycielskiego zadania Kościoła.

Mimo obszernej literatury badania nad dziejami konwentu Paulinów we Włodawie, a zwłaszcza XVIII-wiecznym wyposażeniem dwóch, funkcjonujących przez pewien czas obok siebie budowli sakralnych przystosowanych lub przystosowywanych do pełnienia funkcji liturgicznych – wymagały uzupełnień. Istnienie przyklasztornej kaplicy jest faktem niemal nieznanym badaczom przedmiotu. Przeprowadzona analiza jej wyposażenia potwierdziła: kult jasnogórskiego obrazu Matki Boskiej Częstochowskiej praktykowany we Włodawie na długo przed wzniesieniem kościoła Paula Antonia Fontany, tj. przynajmniej od 1711 r., a potem nieprzerwanie przez kolejne dziesięciolecia; kult Pięciu Ran Chrystusa rozwijany przynajmniej od 1745 r., zwłaszcza za sprawą przykościelnego bractwa modlitewnego; kult Trójcy Świętej silny ok. 1755 (założenie włodawskiego bractwa Trójcy Przenajświętszej), a możliwe, że realizowany w kolejnych dziesięcioleciach oraz lokalny kult św. Józefa. Antycypując publikację na temat włodawskiego malarstwa Gabriela Sławińskiego zauważmy, że wszystkie cztery zjawiska znajdują odzwierciedlenie w programie fresków i obrazów w świątyni projektu Fontany. W ujęciu całościowym prace nad kluczowym wyposażeniem fontanowskiego kościoła z różnym natężeniem toczyły się w okresie od ok. 1753 (pewnie już od 1752, pomijając okres gromadzenia materiałów od 1751 r.) do ok. 1785 r. W okresie 1776–1777 niektóre nabożeństwa celebrowane w kaplicy przyklasztornej przeniesiono do nowego kościoła, ale praktyki maryjne nadal koncentrowały się w kaplicy. Nowe datowanie snycerskich elementów ołtarzy bocznych oraz fresków zachowanego kościoła pozwoliło ustalić, że transfer cudownej kopii obrazu Matki Boskiej Częstochowskiej z przyklasztornej kaplicy do fontanowskiego kościoła mógł mieć miejsce ok. 1785 r., a na pewno przed 1788 r. W podobnym okresie także obrzędy bractwa Pięciorańskiego przeniosły się z kaplicy do nowego ołtarza patronalnego w kościele Fontany. Nie oznacza to jednak zburzenia kaplicy jak podejrzewano. W toku wywodu przywołałam kilka dat świadczących o możliwości ciągłego funkcjonowania przyklasztornej kaplicy, z których najpóźniejsza to 1818 r.
In spite of comprehensive literature, studies on the history of the Pauline convent in Włodawa, and in particular on the XVIII-century-furnishings of the two, for some time coexisting, sacral buildings which were adjusted or were being adjusted to performing liturgical functions – required supplementing. The existence of a chapel adjoining the cloister is a fact that remains almost unknown to the subject’s researchers. The conducted analysis of its furnishings has confirmed: the cult of the Jasna Góra painting of Our Lady of Częstochowa was being practised in Włodawa long before the erection of the Paulo Antonio Fontana church, i.e. at least since 1711, and thereafter continuously throughout the following decades; the cult of the Five Wounds of Christ – developed at least since 1745, in particular thanks to the prayer confraternity operating by the church; the cult of the Holy Trinity – potent around 1755 (foundation of the Włodawa confraternity of the Most Holy Trinity), and possibly performed in the following decades, as well as a local cult of St. Joseph. Anticipating a publication about the Włodawa painting of Gabriel Sławiński, let us notice that all the four phenomena are reflected in the frescos and paintings’ programme in the church designed by Fontana. In their entirety, the works on the key equipment of the Fontana church were carried out, with varying intensity, in the period of time from approx. 1753 (and most probably already since 1752, discounting the period of storing materials since 1751) until approx. 1785. In the period between 1776–1777 some services celebrated in the chapel adjoining the cloister were transferred to the new church, but the Marian practices were still centred in the chapel. The new datation of the woodcarving elements of the side altars and frescoes of the preserved church has allowed for an ascertainment that the transfer of the miraculous copy of the Our Lady of Częstochowa painting from the chapel adjoining the cloister to the Fontana church could have taken place around 1785, and certainly before 1788. In the similar period of time, also the ceremonies of the Five Wounds of Christ confraternity shifted from the chapel to the new patronal altar in the Fontana church. This does not, however, imply a demolition of the chapel as had been suspected. In the course of the disquisition, I have evoked several dates attesting to the possibility of continuous functioning of the chapel adjoining the cloister, out of which the latest is 1818.

W części historycznej znajdują się informacje o pierwotnej strukturze Kościoła Nowoapostolskiego powstałej w 1830 r. w Anglii oraz o działalności Kościoła Nowoapostolskiego na ziemiach polskich począwszy od drugiej połowy XIX wieku (1863 r.). Wskazywany jest szczególnie atrybut uznania prawnego posiadany przez Kościół na podstawie ustawodawstwa państw zaborczych. Autor zauważa, że uznanie prawne omawiana wspólnota posiadała także w okresie II Rzeczypospolitej. Opisano losy tego Kościoła w okresie PRL oraz wspomniano, że w 2013 r. Kościół Nowoapostolski obchodził 150-lecie swojego istnienia.
This article deals with the legal status of the New Apostolic Church in Poland, its teaching and organizational structure. It presents Church’s efforts to receive a new legal regulation of its status in Poland in the form of separate act of parliament (particular act). In the historical part it explains the original structure of the New Apostolic Church founded in 1830 in England and history of that denomination in Poland since the second half of the nineteenth century (1863). Special emphasis is laid in the fact that the New Apostolic Church had a legal recognition on the basis of legislation made by the states occupying the then Poland. The author informs that the Church had a legal recognition in the time of the Second Republic of Poland. Also the text deals with the denomination’s history in Poland during the Communist period and informs about the celebration of 150th anniversary of New Apostolic Church in 2013.

Primate Stefan Wyszyński engaged in a series of administrative and diplomatic activities related to the institution of the Polish Church organisation in the Western Lands. In the years 1948-1967 he exercised his authority over the Church in this area. He initially supervised apostolic administrators in Wrocław, Opole, Gorzów Wielkopolski, and in Olsztyn and Gdańsk, and after their removal in 1951 he sanctioned vicar capitulars elected by the state authority to preserved unity of the Church in Poland. In 1956 his attempts resulted in the restoration of the relevant bishops to their posts. In 1967 at his request the Pope Paul VI excluded the Church organisation in the Western Lands from the jurisdiction of Primate of Poland and subordinated it directly to the Holy See, instituting apostolic administrations there. primate repeatedly conducted negotiations with the Holy See in case of the institution of the Polish Church organisation in this area, which ended only after the ratification of the Polish-German treaty in 1972 by the announcement of the apostolic constitution Episcoporum Poloniae coetus. During the entire period Primate repeatedly visited archdiocese of Wrocław and supported the activities of the hierarchs governing this area, initially priest Karol Milik, and subsequently priest Kazimierz Lagosz and since 1956 bishop Bolesław Kominek. Primate Wyszyński repeatedly emphasised the rights of Poland to these lands in his speeches and sermons delivered in Wrocław. He proved that they resulted, on the one hand from their historical embeddedness in the Polish culture (he was referring to the relations of Silesia with Poland in the Piast period), and on the other hand he pointed to the re-Catholising mission of the Church in these lands. He also indicated that these lands are the peculiar compensation for the losses incurred by the Polish nation during the Second World War. He perceived the tasks of the Church in this area during the period of the stabilisation of the Polish Church administration as the Polish reason of state.

konkluzji, że skuteczność dzieła głoszenia Słowa Bożego wymaga zwrócenia szczególnej uwagi na ochronę dzieci i młodzieży przed nadużyciami seksualnymi ze strony duchownych i innych osób podejmujących pracę wychowawczą w strukturach kościelnych. Odpowiedzią na przypadki przestępstw seksualnych jest tworzenie programów prewencyjnych mających na celu zapewnienie bezpieczeństwa osobom małoletnim. Zadania tego podjęła się zarówno Konferencja Episkopatu Polski, jak i polskie kościelne osoby prawne w postaci diecezji oraz instytutów życia konsekrowanego i stowarzyszeń życia apostolskiego. W ich ramach, w ostatnich pięciu latach, powstały instrukcje mające na celu wdrożenie zasad prewencji. Są one jednak nieliczne i wydaje się, że Kościół w Polsce jest dopiero na początku drogi sytuującej ochronę dzieci i młodzieży w centrum posługi duszpasterskiej.
Scandals that recently shocked the community of the Catholic Church lead to the conclusion that the effectiveness of the work of proclaiming the Word of God requires special attention to the protection of children and youth against sexual abuse by the clergy and other people undertaking educational work in church structures. The response to this necessity is the creation of prevention programs aimed at ensuring the safety of minors. This task was undertaken both by the Episcopal Conference of Poland as well as church legal persons in the form of dioceses and institutes of consecrated life and society of apostolic life. Within their framework, in the last five years, instructions were created to implement the prevention principles. However, they are few and it seems that the Church in Poland is only at the beginning of the way that places protection of children and youth in the center of pastoral ministry.

W artykule został przedstawiony system finansowania kościołów i związków wyznaniowych w Republice Czeskiej ze szczególnym uwzględnieniem finansowania Kościoła Grekokatolickiego. Tekst dotyczy historii finansowania kościoła na terytorium Czechosłowacji od 1918 r., ze zwróceniem uwagi na likwidację Kościoła Grekokatolickiego po 1948 r. przez reżim komunistyczny. Po jego upadku jesienią 1989 r., w ramach przywrócenia swobodnego funkcjonowania kościołów, nastąpiło stopniowe wyrównanie majątkowe między państwem a kościołami, które doprowadziło do aktualnego modelu finansowania na podstawie obecnej ustawy o wyrównaniu majątkowym z Kościołami i związkami wyznaniowymi. Z punktu widzenia czeskiego prawa wyznaniowego Kościół Rzymskokatolicki i Kościół Grekokatolicki są dwoma niezależnymi podmiotami prawnymi. W ramach Konferencji Episkopatu Czeskiego (ČBK) Kościół Grekokatolicki zajmuje niekorzystną pozycję, ponieważ Konferencja Episkopatu Czeskiego broni tylko interesów finansowych Kościoła Rzymskokatolickiego. Finansowo Egzarchat Apostolski jest obecnie w pełni uzależniony od finansowej rekompensaty ze strony państwa i jego wkładów. W przyszłości jednak konieczne będzie poszukiwanie własnych źródeł finansowania, łącznie ze wsparciem ze strony diecezji rzymskokatolickich w Republice Czeskiej.
This article presents a system of financing churches and religious societies in the Czech Republic with emphasis on financing the Greek Catholic Church. The text deals with the history of church funding in the territory of Czechoslovakia since 1918, with emphasis on the liquidation of the Greek-Catholic Church after 1948 under the communist regime. After its fall in the autumn of 1989, within the framework of the restoration of the free operation of the churches, there was a gradual property settlement between the state and the churches, up to the current model of financing of churches and religious societies according to the Act on Property Compensation with Churches and Religious Societies. In terms of Czech Confessional Law, the Roman Catholic and Greek Catholic Church are two independent legal entities. In the framework of the Czech Bishops’ Conference (ČBK), the Greek Catholic Church has a disadvantage because the Czech Bishops’ Conference defends only the financial interests of the Roman Catholic Church. Financially, the Apostolic Exarchate is currently fully dependent on financial compensation from the state and its contributions. In the future, however, it will be necessary to look for own sources of funding, including support from the Roman Catholic dioceses in the Czech Republic.

The Polish-speaking Orthodox Parish in Brussels inaugurated in 2015 belongs to the Ecumenical Patriarchate, but it remains in close relation with the Polish Autocephalous Orthodox Church. In Belgium, the dependence of the Churches and the state forced religious groups to have a greater share of lay people in the organization of religious communities. Caring for the religious education of successive generations, both clergy and laity, double efforts to equip children and young people with the religious knowledge and experience of faith. The article deals with the participation of lay people in the life of the whole Orthodox Church in Belgium, the participation of laity in the parish life in Belgium and the participation of lay people in the life of the Polish-speaking Orthodox Parish in Brussels.

The aim of the article is to present a list of entities competent for provision of opinions to Deputies’ bills which specify the State’s attitude to Churches and religious organizations, regulate their legal status, as well as the relations between the Republic of Poland and churches and religious organizations. The author attempts to answer the question whether the constitutional standard resulting from Article 25 paragraphs 4 and 5 of the Constitution is met by referring a bill for consultation to appropriate churches and religious organizations. He concludes that the power to provide obligatory opinion concerning bills amending statutes relating to the State’s attitude to particular churches and religious organizations (the so-called particular statutes) is vested in ten churches and religious organizations. Moreover, the provisions of the statutes, which contain an obligation to seek a legally non-binding opinion from a competent body of a Church or religious organization (based on an appropriate particular statute), are inconsistent with Article 25 paragraph 5 of the Constitution which requires that statutes governing relations between the State and Churches and religious organizations should be preceded by agreements concluded by the Council of Ministers and their appropriate representatives.

Archidiecezja Warmińska po osiemdziesięciu latach przeżyła zwieńczenie kolejnego synodu diecezjalnego. Inicjatorem, a następnie zwołującym synod był bp Józef Glemp. Po jego odejściu na stolicę prymasowską synod został zawieszony. Dopiero w 2006 r. abp Wojciech Ziemba dekretem wznowił i polecił kontynuować prace synodalne. Prace te trwały przez 6 lat. Swoim zasięgiem poza komisjami ogólnodiecezjalnymi docierały w formie zespołów synodalnych do parafii i dekanatów. Zaangażowało się w synod bardzo wielu ludzi z ożywionym poczuciem odpowiedzialności za Kościół. Owocem tych prac są statuty regulujące całokształt życia Kościoła lokalnego. Integralną częścią statutów są aneksy doprecyzowujące poszczególne unormowania.
The Warmia Archdiocese, 80 years down the road, entered the crowning of the subsequent diocesan synod. Cardinal Joseph Glemp was the one who initiated and then convoked the synod. Following his nomination as a Primate of Poland, it was suspended later on. Only after 2006 archbishop Wojciech Ziemba resumed and ordered its works to be continued. It lasted consecutive 6 years and covered the whole diocese through its diocesan and vicariate forane teams. There were numbers of people involved in its works in the animated sense of responsibility for the Church. As a result of the synod there were declarations and decrees issued regulating the entirety of the local Church’s life. An integral part of the decrees constitute the annexes which specify individual regulations.

This article analyses the preparation, process and conclusions of the Plenary Council of the Catholic Church in the Czech Republic held in 1997—2005. The Plenary Council was one of the few manifestations of the collegiality of the Czech Church, because the diocesan synods are not used here as a tool. The Decree on convocation of the Assembly was announced by the Czech and Moravian bishops on 5 July 1997 in Velehrad. The council was also an opportunity for priests and laity in the country to realise their responsibility for the Church and the co-responsibility of the Church for the condition of society. The Council had a preparatory phase (1997—2003), a stage of the 1st Session (July 2003), and a second phase of the Session (July 2005) where the project was completed and followed by the process of post-conciliar steps. Three final messages were the immediate output from the Second Plenary Session: the Message of the Council to the Public; the Message of the Council to the Believers of the Catholic Church and the Message of the Council to Christians in the Czech Republic. The resulting document was published in 2007 under the title The Life and Mission of Christians in the Church and the World. It was a document of a pastoral nature, in no way of a normative nature (no rules were actually adopted despite the work of the commission and the proposals). The Czech situation is described as “post-Christian missionary territory” there and — estimated the course of the conciliar process and of the Council itself — as an introduction of more intensive implementation of synodality in the Czech Church.
In questo articolo tratterò la preparazione, il percorso e le conclusioni del Sinodo Plenario nella Repubblica Ceca, tenutosi negli anni 1997—2005. Il Sinodo Plenario è stato una delle poche manifestazioni della collegialità della Chiesa ceca, perché i sinodi diocesani non vengono indetti. Il decreto sulla convocazione del Sinodo Plenario è stato annunciato dai vescovi il 5 luglio 1997 a Velehrad. Il Sinodo doveva anche dare occa sione ai sacerdoti e laici di prendere coscienza della loro responsabilità per la Chiesa e della corresponsabilità della Chiesa per lo stato della società. Il Sinodo ha avuto una fase preparatoria (1997—2003), la prima fase della sessione (luglio 2003), seguita dalla seconda fase (luglio 2005), durante la quale si è concluso il progetto, e infine le fasi post-sinodali. Tre messaggi finali della 2a fase del Sinodo Plenario sono: il Messaggio del Sinodo alla società, il Messaggio ai fedeli della Chiesa cattolica e il Messaggio ai cristiani nella Repubblica Ceca. Il documento finale, intitolato La vita e la missione dei cristiani nella Chiesa e nel mondo, è stato pubblicato nel 2007 e. Era un documento di carattere pastorale, per nulla normativo (contrariamente all’operato del Comitato di diritto particolare e alle sue proposte, nessuna norma è stata infine adottata). La situazione ceca è stata definita come «un territorio di missione post-cristiana», e il percorso del processo sinodale è stato valutato come un’introduzione a una sinodalità più completa nella Chiesa ceca.
Dans le présent article, je traite de la préparation, du déroulement et des conclusions du Synode Plénier en République Tchèque, qui a eu lieu dans les années 1997—2005. Le Synode Plénier a été l’une des rares manifestations de la collégialité dans l’Église tchèque, car il n’y a pas de tradition de synodes diocésains en Tchéquie. Le décret sur la convocation du Synode Plénier a été annoncé par les évêques le 5 juillet 1997 à Velehrad. Le Synode devait aussi donner l’occasion aux prêtres et aux laïcs de prendre conscience de leur responsabilité envers l’Église et de la coresponsabilité de l’Église pour l’état de la société. Le Synode a eu une phase préparatoire (1997—2003), la première phase de la session (juillet 2003) a été suivie d’une deuxième phase de la session (juillet 2005), lors de laquelle le projet a été achevé, et enfin la phase d’étapes post-synodales. Les trois messages finaux de la deuxième phase du Synode Plénier sont : le Message du Synode à la Société, le Message aux Fidèles de l’Église catholique et le Message aux Chrétiens de la République tchèque. Le document final a été publié en 2007 sous le titre La vie et la mission des chrétiens dans l’Église et dans le monde. C’était un document à caractère pastoral, nullement normatif (contrairement aux travaux de la Commission du droit particulier et de ses propositions, aucune norme n’a finalement été adoptée). La situation tchèque a été décrite comme «un territoire de mission postchrétienne» et le déroulement du processus synodal a été vu comme une introduction à une synodalité plus complète dans l’Église tchèque.

The Catholic Church as a community operating in the world needs material resources to be able to fulfill its mission. The right to own property is inherent right of the Church and includes the acquire, hold, management and alienating goods. One way of obtaining material resources identified by the Code of Canon Law are pious wills. The article analyzes the provisions of pious wills contained in the Code Of Canon Law. Also have been discussed statutes of selected polish diocesan synods, which provide for the possibilities of adopting pious wills, ways of documenting and the obligation to comply with government regulations.
