Opis:
The leading motif in the Church’s teaching is the inborn and supernatural dignity of each human being that is the only and supreme moral norm. It is from this norm that human rights and other principles follow. The first and fundamental way of the Church is recognizing each human being’s dignity, and reminding: Respect the dignity and freedom of every human person! During the meetings of the OSCE the Holy See mainly promoted the right to freedom of conscience and of opinions in connection with all human rights. It postulated recognition of human rights as a principle of the international law. Overcoming the dispute concerning the contents of the concept of human rights was possible, among others, at the Vienna Conference. There it was said that all human rights follow from the dignity of the human person and from the human being’s inherent value; it was also stated that the human person is the main subject of human rights and fundamental freedoms, so he should be their main addressee and actively participate in the realization of the rights. In the document accepted at the Copenhagen Conference the human person was recognized as the supreme value that is the foundation of the inborn and inalienable human rights. Moreover, the contents of the concept of the right of man to freedom of conscience, to religious freedom and to freedom of opinions is contained in Art. 18 and 19 of the Universal Declaration of Human Rights and developed in the same articles of the International Convention for Personal and Liberation Rights. The human rights may be protected in democracy and in a law-governed state. John Paul II stressed that real democracy is possible in a law-governed state on the basis of the correct concept of the human person. The essence of democracy is respecting all the human rights.

The development of biomedical sciences and techniques, despite the undeniable positives, brings with it new threats, also for human rights and democratic society. The most serious concern is possibility of modification of the biological nature of human beings –which might entail limitations of human freedom. The modification of the human genome, brain and mind control, mechanization of human body, creating digital copies of human beings are now the most widely discussed threats , for human rights and the rule of law. Aside to the mentioned risks directly related to the development of biomedical technologies, the subject of much controversy is the relationships between the beneficiaries of progress in biomedicine (patients), and those who provide defined benefit plans (primarily physicians). The question is whether the physician is obliged to provide every medical service or may refuse to provide those which are opposed to his ethical judgements? The problem of the status of conscientious objection arises in above mentioned context. This paper presents the issue of conscientious objection from the perspective of the Council of Europe regulations.

Our primary aim is to analyze the impacts of technology on people with disability. Persons with a disability can be encouraged to fully engage in society by using specific types of technology (medical devices that target particular limitations). Many experts argue that medical exoskeletons or wheelchairs with motorized stand-up function provide people with severe disabilities with new possibilities. Impact of these opportunities is enormous and they directly influence the quality of life. Philosophers Amartya Sen and Martha Nussbaum in their "capability approach" assume that any form of impact that enables a person to pursue what they deem as essential influences quality of their life. Similarly, Eva Feder Kittay (philosopher) argues that care for the elderly, disabled, or children is crucial for any society. These authors will provide a philosophical basis for our arguments for the enrichment of human rights through technology for persons with disabilities.

Implementation of human rights is often criticized because it is perceived as being imposed on the rest of the world. In this case, human rights start to be seen as a sole abstraction, an empty word. What are the theoretical arguments of these critics and can we determine any historical grounds for them? In this paper, I will try to point at similar critics after the French Revolution – like that of the Historical School and Hegel – and try to show if some of these critics are still relevant. And I will compare these critics with contemporary arguments of cultural relativists. There are different streams and categorizations of human rights theories in today’s world. What differentiates them is basically the source of the human rights. After the French Revolution, the historical school had criticized the individuation and Hegel had criticized the formal freedom which was, according to him, a consequence of the Revolution. In this context Hegel drew a distinction between real freedom and formal freedom. Besides the theory of sources, the theories of implementation such as human rights as a model of learning, human rights as a result of an historical process are worth attention. The crucial point is about integrating human rights as an inner process and not to use them as a tool for intervention in other countries, which we observe in today’s world. And this is the exact point why I find the discussion of the sources more important. This discussion can help us to show how the inner evaluation of a society makes the realization of human rights possible and how we can avoid the above mentioned abstraction and misuse.

This article deals with the universal nature of human rights recognised by all civilisations and legal systems. The important thing is that the actions of the state are consistent with the content of these rights is justified by the fact that they protect the dignity of every human being and enable cooperation between people. Universal treaties impose the same international legal obligations in the field of human rights on as many states as possible. Regional treaties perform this function in relation to a group of states. It seems, however, that for the full protection of an individual’s rights, the ideas of universalism and regionalism of human rights need to complement each other. No regional system can exist if it is inconsistent with the norms and principles of the Universal Declaration of Human Rights.

In the ECtHR’s case-law free expression constitutes one of the most protected human rights, particularly when it addresses matters of public interest. A recent judgment (Eon v. France, March 14, 2013) dealt with a conviction for exposing of a poster: “Get lost, you sad prick”, during President Sarkozy’s visit to one of the constituencies. The ECtHR held that the conviction had been in violation of Article 10 of the Convention as – in its substance - it contained a political message and – in its form – it duplicated the formula used once by the President himself. The Eon court followed several earlier judgments and decisions in which the ECtHR challenged those criminal law provisions that provided for a particular punishment for insulting the head of state (Colombani and Others v. France, 2002; Pakdemirli v.Turkey, 2005; Artun and Guvener v.Turkey, 2007; Otegi Mondragon v. Spain, 2011). Also the Constitutional Court of Poland had recently (2011) an opportunity to examine a similar provision of the Polish Penal Code. It seems that it took less generous interpretation of the freedom of expression than the one adopted by the ECtHR.

Irregular immigration is a phenomenon with a substantial impact for the majority of the countries. The paper analyses whether there is an adequate human rights framework for protection of irregular immigrants or whether the irregular status exempts the migrants from the protection of international human rights law. If this is the case, then the human rights universality has failed. The paper takes into consideration the developments in the International and EU Law, as well as in the jurisprudence of the international tribunals regarding protection of irregular immigrants. It is divided into three main sections. The first section informs briefly on the dynamics of irregular immigrants; the second section analyses the legislation on irregular immigration from the perspective of the state sovereignty, the third section analyses the human rights law and the protection it affords to irregular immigrants, pursuant to the interpretation of International tribunals.

W dniu 24 maja 2023 roku odbyła się międzynarodowa konferencja naukowa „Evolution of Human Rights” organizowana przez Wydział Prawa i Administracji Uniwersytetu Szczecińskiego oraz Interuniversity Master UPO-UNIA in Human Rights, Interculturality and Development Uniwersytetu Pablo de Olavide w Sewilli. Konferencja zgromadziła ekspertów, badaczy i praktyków z dziedziny praw człowieka, którzy prezentowali i dyskutowali na temat najważniejszych zagadnień związanych z ewolucją praw człowieka. Celem konferencji była analiza istniejących wyzwań, identyfikacja obszarów wymagających dalszych badań oraz promocja wartości i zasad, które stanowią fundament praw człowieka. Obrady plenarne przebiegały hybrydowo, umożliwiając zainteresowanym słuchaczom zapoznanie się z przedstawianymi na konferencji wystąpieniami on-line w czasie rzeczywistym.

Human rights are the essential elements that allow every person to live with the dignity of a human being. While the conscience of the fundamental rights of the man has broadened its horizons since the onset of the third millennium, it is nonetheless true that these widely recognised rights are constantly being violated in every corner of the world, as in these last times is happening for the migrants, whose personal dignity is often humiliated. This, in turn, leads to the pressing need of an ethical and educational commitment capable of restoring vigour and favouring education towards the development and the respect of the human rights, as these are inviolable and undeniable values, guaranteeing, at the same time, their universality, indivisibility and interdependence.

Purpose: The subject of the publication is a philosophical reflection on the idea that organizes the space of human and citizen life, of which we are contemporary beneficiaries. This idea today inspires the search for the subjective status of man, shapes the axiological system of societies, defines the duties of the human person, sets legal standards. Methodology: The publication is theoretical in nature. The analysis of the literature on the subject constituted the method of working on the publication. This method made it possible to learn about the current state of knowledge in the subject under discussion, indicated the scope of consideration of the problem, and also determined the perspective of further issues and questions that require answers. Findings: The publication discusses the values on which the idea of human rights is based, the assumption being that a person who transcends the characteristics of the zoological species participates in the moral and rational sphere, the sphere of unconditional moral imperatives that cannot be empirically determined. Social consequences: The perspective adopted in the publication discussing the idea of human rights is, first of all, important criteria and categories for the construction of the normative order, it projects the formation of social ties and the evolution of values that consolidate society. The idea of human rights in this sense is a regulator of collective life that creates social order. Originality: The publication asks what are the sources of the idea of human rights, whether the rooting of man in intellectual loyalty to reason is a sufficient motive to safeguard against the desire to invalidate them, whether man as a moral being is immune to the action of the instincts of his own nature.

This article shows the general prinicples of water protection in the international, European Union and Polish levels in the contex of human rights. Because deficit of drinking waters is very important issue not only in Africa and Asia countries but also in some state in UE e.g. in Poland with scarce water resources. The legal aspect of water protection against pollutants stemming from anthropogenic activity is complex and hence, is regulated in many conventions, directives and national laws. The very important for water protection is to limit iflows of sewage into water bodies or limit pollution at source, and effective remediation and restoration of the water damage. All contribute to improved quality of waters and ensuring their proper quality which is the basic human right to life.

The article deals with the problematic issues of human and civil rights under pandemic on the example of the practice of combating the spread of respiratory disease COVID-19 caused by the coronavirus SARS-CoV-2 civil society in Ukraine in 2020. Account has been taken of the fact that the human, his life and health are the highest social value, and that human rights and freedoms determine the content and orientation of State activities. Since every State functioned for the human, in order to protect universally recognized rights and freedoms, it was a feature of a modern democratic State governed by the rule of law. At the same time, in legal science in recent years there has been a debate about the problems of human and civil rights against the background of widespread abuse of rights, individual selfishness, conflict of rights of one person and group of people, human and society. That is to say, in the order of the day came an all-civilizational discussion about the appointment of the State, the idea of humanocentrism and sociocentrism as the fundamental foundation and expediency of the State. The problem is posed by the global challenges faced by present-day civilization: climate protection and freshwater, poverty and corruption, terrorism and military conflicts, massive ethnic displacement and pandemics. In one way or another these problems are present on all continents today, both for the world community and for each State in particular, but there is no well-established mechanism for dealing with them. With regard to combating the spread of coronavirus, it is clear that the problem is a global one in the field of medical law, and that it must be addressed both at the level of the novelization of legislation and at the level of philosophy and sociology of law, ‘cause that’s the kind of system-wide results you can use in complex under the state-creative practice today.
