    Opis:
    Under the present Polish law there are no provisions to regulate directly reassignment surgery. However, it is indirectly accepted as legal because administrative and civil law activities in files of the birth and death register much depend on it. In other jurisdictions conditions of such medical surgery are not determined, either. From the penal law point of view the surgery may result in meeting a definition of a crime of heavy damage to one’s health. In consequence a person may be deprived of procreation capacity which corresponds to a description of an act punishable under art. 156 § 1 p. 1 of the Polish penal code. This study is an analysis of the problem and suggests legal potential solutions to the issues discussed here.

    Opis:
    W niniejszym artykule, odnosząc się do wykładni, przedstawiono niektóre informacje na temat znamion art. 192 § 1 k.k. Szczególna uwaga zwrócona została na próbę ustalenia, czym jest zabieg leczniczy, czym powinna charakteryzować się zgoda pacjenta oraz w jakich przypadkach jej brak może być podstawą do zwolnienia sprawcy z odpowiedzialności karnej. W drugiej części skupiono uwagę na zagadnieniu tzw. znamion negatywnych. Wbrew części przedstawicieli doktryny prawa karnego starano się wykazać, że zgodnie z założeniami logicznymi nie można nazywać „znamionami negatywnymi” tych elementów, które w konkretnym przepisie zostały przez ustawodawcę umieszczone (nawet jeżeli określają one pewien sytuacyjny brak).
    The article, referring to the interpretation, presents some information on the constituent conditions of Article 192 § 1 of the Criminal Code. Particular attention has been paid to the attempt to determine what is a medical treatment is, what the features of a patient’s consent should be and in which cases the lack of this consent can be the basis for the exemption of an offender from criminal liability. The second part focuses on the issue of the so-called negative conditions. Contrary to some representatives of the criminal law doctrine the author tries to prove that, in accordance with the assumptions of logic, we cannot use the term „negative conditions” to name the elements that have been laid down by the legislator in a specific provision of the Criminal Code (even if they define a situational absence of something).

    The issue of doctors’ civil-law, administrative-law and criminal-law liability for negligence of adequate care in terms of providing healthcare services is multifaceted. It covers various actions and omissions. The analysis of the presented jurisdiction of courts of law shows that actions or omissions, which meet the criterion of negligence of adequate care, are diversified. They include, e.g., incorrect testification of medical records (or even a lack of relevant documentation), omission of giving comprehensive and intelligible information to patients and use of improper medical products. Patients claiming their rights to have healthcare services provided – based on current medical knowledge, according to the rules of professional ethics, with solicitude – use legal path (civil-law, administrative-law, criminallaw). These proceedings are not mutually exclusive.

    Niemiecka dyskusja na temat podstawy legalności interwencji leczniczej koncentruje się zasadniczo, podobnie jak w Polsce, wokół pytania, czy interwencja taka wyczerpuje istotę czynu zabronionego. Odpowiedzi pozytywnej udziela koncepcja określana jako Rechtfertigungslösung zaś koncepcja zwana Tatbestandslösung odpowiada na to pytanie negatywnie. Pierwsza z tych koncepcji, reprezentowana od ponad stu lat przez niemieckie orzecznictwo i część doktryny, opiera się na założeniu, że interwencja lekarska, naruszająca integralność cielesną wyczerpuje ustawową istotę czynu zabronionego uszkodzenia ciała z § 223 1 StGB, niezależnie od jej leczniczego celu lub skutku oraz od zachowania reguł sztuki przez lekarza. Legalność takiej interwencji wymaga zaistnienia okoliczności wyłączającej bezprawność (Rechtfertigungsgrund), jaką jest prawnie skuteczna zgoda pacjenta. Druga z wymienionych koncepcji przyjmuje – z pewnymi różnicami w kwestiach szczegółowych – że interwencja lecznicza, wynikająca ze wskazań medycznych i przeprowadzona lege artis nie wyczerpuje istoty czynu zabronionego z § 223 StGB. Część zwolenników Tatbestandslösung uniezależnia powyższą oceną od zgody pacjenta, a część wymaga zaistnienia zgody, uznając ją okoliczność wyłączającą istotę czynu zabronionego. Tytułowy spór jest w istotnej mierze uwarunkowany brakiem w prawie niemieckim odrębnej podstawy ochrony karnej prawa pacjenta do samostanowienia i poszukiwaniem jej w § 223 StGB. Fundamentalnym przedmiotem przedstawionej dyskusji jest jednak też pytanie, czy uwzględniać w ocenie prawnej uboczne i nieuniknione dolegliwości dla ludzkiego organizmu, nieuchronnie związane z interwencją leczniczą.
    The German discussion on the grounds of the legality of therapeutic intervention is essentially focused, as in Poland, around the question of whether such an intervention fulfils the statutory elements of a prohibited act. The affirmative answer is provided by the conception referred to as the Rechtfertigungslösung, while the conception called Tatbestandslösung responds negatively to this question. The first of these positions, represented for more than a century by German jurisdiction and part of the doctrine, is based on the assumption that therapeutic intervention violating the integrity of the body fulfils the statutory elements of the criminal act of § 223 1 P.C., regardless of its healing the purpose or effect and compliance with the rules of art by the doctor. The legality of such an intervention requires the existence of a circumstance excluding unlawfulness (Rechtfertigungsgrund), which is the valid consent of the patient. The second of the concepts mentioned above assumes – with some differences in specific issues – that therapeutic intervention resulting from medical indications and carried out lege artis does not fulfil the statutory elements of the crime of bodily harm. Some supporters of Tatbestandslösung make this assessment independent of the consent of the patient, but some require consent, recognizing it as an exclusion of the statutory element of a prohibited act. The title dispute is to a large extent conditioned by the lack of a separate basis in German law for the criminal protection of the right of the patient to self-determination and seeking it in § 223 P.C. The fundamental subject of the presented discussion is, however, the question of whether to include in the legal assessment the side and unavoidable ailments for the human organism, inevitably occasioned by therapeutic intervention.

    The article presents a legal assessment of physiotherapeutic errors. It was not unimportant for this assessment that the regulation of the physiotherapist’s profession was proven, which made it possible to confirm that errors in physiotherapeutic art are in fact medical errors. In turn this allowed us to consider the possible criminal liability of this occupational group for medical errors. Final conclusions have finally confirmed that physiotherapists can be held liable for medical errors under Articles 156, 157 or 160 PC.

    The subject of the article is the issue of the obligation to notify about a crime in relation to medical confi dentiality. Medical workers may obtain information indicating the commission of a criminal act while performing medical services. An important issue is whether, in such a situation, they can or should notify law enforcement authorities. In order to resolve these issues, the legislator defi nes the legal and social obligation to denounce. The legal obligation of a medical worker to notify about a crime relates to the offences specifi ed in Art. 240 (1) of the Act of June 6, 1997 — Penal Code. Among the enumerated types of generic acts covered by denunciation, particularly important due to the issues raised, are the crime of murder (Article 148 of the Penal Code) and deprivation of liberty (Article 189 of the Penal Code). A medical worker having obtained reliable information about the commission of a criminal act is obliged to notify law enforcement authorities. It is irrelevant whether they learned about it while carrying out professional activities or without a connection with their performance. The criminal sanction for failure to comply with the obligation under Article 240 (1) of the Criminal Code is a prison sentence of up to 3 years. However, the social obligation to denounce is introduced by Art. 304 (1) of the Act of June 6, 1997 — Code of Criminal Procedure. Failure to fulfi l obligations of this nature does not result in any criminal consequences. The social obligation to denounce does not include offences prosecuted on private accusation or on request of the victim. It is worth noting that this obligation does not repeal any of the laws regulating medical secrets. In this case, a medical worker who has learned of a crime in connection with the exercise of their profession has no obligation to denounce. It should be emphasised that a medical worker may fulfi l the obligation to denounce only if the patient or their legal representative has consented to it, or if there are premises for presuming the consent.

    The article raises the question of the influence of the EU clinical trials of medicinal products legislation on the Polish criminal law. Although this issue does not fall within the scope of the Article 83 of the Treaty on Functioning of the European Union, its significant importance results from the expected beginning of application of the Regulation No. 536/2014 of the European Parliament and of the Council of 16 April 2014 on clinical trials on medicinal products for human use, and repealing Directive 2001/20/EC. The impact of the EU legislation on member states’ criminal law in the field of clinical trials is based on the principle of pri- macy. Three directions of this impact can be distinguished concerning Regulation No. 536/2014. The first is the exclusion of the unlawfulness of the acts prohibited by the chapter 19 of the Polish Criminal Code within the scope of the prerequisites for the admissibility of clinical trials. The second is the de facto depenalisation of the behaviors described by in Article 126a (1) (3–5) of Pharmaceutical Act. The indicated two effects may take place ex lege with the beginning of application of Regulation No. 536/2014, if there is no change in the Polish law beforehand. The realisation of the third direction depends on the decision of the Polish legislator, who is required to introduce effective, proportionate and dissuasive penalties applicable to infringements of the Regulation No. 536/2014. The type of these measures is left to the discretion of the member states, but the current legal situation combined with the principle of assimilation prompts us to suppose that the choice of criminal penalties will be sustained.

    Artykuł poddaje analizie znaczenie tzw. procesu lekarzy przed Amerykańskim Trybunałem Wojskowym nr 1 w Norymberdze z perspektywy prawa karnego. Przedmiotem tego procesu, zakończonego wyrokiem z 19 i 20 sierpnia 1947 r., była odpowiedzialność karna sprawców eksperymentów prowadzonych w hitlerowskich obozach koncentracyjnych. Przyjęta w wyroku ATW nr 1 kwalifikacja prawna uznała te praktyki za sposób popełnienia zbrodni wojennych i zbrodni przeciwko ludzkości. Znalazła ona kontynuację w prawie konfliktów zbrojnych, chociaż nie powiodły się próby szerszej kryminalizacji w prawie międzynarodowym badawczego wykorzystania człowieka. Proces norymberski ukazał zarazem nieadekwatność klasycznych instytucji wyłączających bezprawność czynu do eksperymentu badawczego, dając podstawy dla wykształcenia się szczególnych warunków dopuszczalności badań medycznych opartych na zasadzie prymatu człowieka nad interesami zbiorowymi.
    The article analyses the significance of the so-called “Medical Case” before the United States Military Tribunal I in Nuremberg from the perspective of criminal law. The object of this trial, which resulted with a judgment of 19th and 20th August 1947, was the criminal liability of perpetrators of experiments conducted in Nazi concentration camps. The legal qualification adopted in this judgment recognized these practices as a way of committing war crimes and crimes against humanity. It has found continuation in the law of armed conflicts, although attempts to criminalize in international law the research exploitation of a human at a more extensive scope failed. The Nuremberg trial also demonstrated the inadequacy of classical institutions excluding the unlawfulness of an act to the research experiment. At the same time, it provided a basis for the development of specific conditions for the admissibility of medical research, grounded on the principle of primacy of the human being over collective interests.

    The aim of the article is to analyze the phenomenon of “patient’s autonomy” as an object of criminal law protection. The article is divided into two parts. In this part, attention is focused on discussing possible grounds for criminal liability in case of violation of patient’s autonomy. It should be stressed that, of course, only some of the behaviors violating the legal good of patient’s autonomy is regulated by criminal law and may therefore result in criminal liability. The authors analyze offences whose commission by medical personnel may violate patient’s autonomy. In addition, they present statistics on the number of medical crimes for 2019.
    Celem artykułu jest analiza zjawiska „autonomii pacjenta” jako przedmiotu ochrony prawnokarnej. Artykuł został podzielony na dwie części. W tej części uwagę skupiono na omówieniu możliwych podstaw odpowiedzialności karnej w przypadku naruszenia autonomii pacjenta. Należy podkreślić, że oczywiście tylko część zachowań naruszających dobro prawne, jakim jest autonomia pacjenta, jest regulowana przez prawo karne, a zatem może skutkować odpowiedzialnością karną. Autorzy dokonują analizy przestępstw, których popełnienie przez personel medyczny może naruszać autonomię pacjenta. Dodatkowo przedstawiają statystyki dotyczące liczby przestępstw medycznych obejmujące rok 2019.

    This text is a review of the monograph devoted to the criminal law boundaries of innovative medical intervention. The title concept of an innovative medical intervention covers various types of medical influences on humans that affect their physical or mental integrity and are new in relation to the current state of medical knowledge and practice. Another characteristic feature of an innovative medical intervention is that it is not sufficiently tried or – regardless of the degree of its testing – it is directed to broaden medical knowledge.

    Artykuł odnosi się do instytucji tzw. klauzuli dobrego Samarytanina – regulacji wprowadzającej możliwość wyłączenia odpowiedzialności karnej za wskazane przestępstwa przeciwko życiu i zdrowiu, popełnione przez przedstawicieli zawodów medycznych w związku z udzielaniem przez nich świadczeń zdrowotnych, w ramach zapobiegania, rozpoznawania lub leczenia COVID-19. W tekście przeanalizowano poszczególne przesłanki tej klauzuli w kontekście błędu lekarskiego, występującego przede wszystkim w związku z udzielaniem w czasie pandemii koronawirusa porad lekarskich na odległość przy użyciu systemów teleinformatycznych lub systemów łączności (teleporady).
    This article discusses the Polish version of the “Good Samaritan Law” as applicable to medical professionals engaged in the prevention, diagnosis, and treatment of COVID-19. It analyzes the particular provisions of this regulation in the context of medical error in a doctor’s provision of remote medical consultation services online or using another telecommunication system during the corona virus pandemic.

    Przestępczość farmaceutyczna stanowi ogromne wyzwanie dla ustawodawców krajowych i społeczności międzynarodowej. W ostatnim czasie możemy zaobserwować szczególny rozwój tego fenomenu, do czego przyczynił się wybuch pandemii COVID-19. Specyfika przestępczości farmaceutycznej przesądza o tym, że w przypadku nieprawidłowości w obrocie produktami leczniczymi możemy mieć do czynienia z kilkoma reżimami odpowiedzialności – odpowiedzialnością administracyjną, cywilną, karną, jak też zawodową. Na płaszczyźnie penalnej zasadnicze znaczenie będą miały przepisy zgrupowane w Kodeksie karnym i Prawie farmaceutycznym. Dokonanie prawidłowej subsumpcji fałszowania produktów leczniczych i wprowadzania ich do obrotu może wzbudzać wątpliwości praktyczne, u podłoża których leży ustalenie wzajemnego stosunku przepisów: art. 165 § 1 pkt 2 k.k. i regulacji pozakodeksowych znajdujących się w Prawie farmaceutycznym.
    Pharmaceutical crime poses a huge challenge both to the national legislators and the international community. We have recently observed a particular development of this phenomenon, also due to the outbreak of the Covid-19 pandemic. The specific nature of pharmaceutical crime determines that in the case of irregularities in the marketing of medicinal products, we may have to deal with several regimes of liability – administrative, civil, criminal as well as professional one. On the penal level, the provisions grouped in the Criminal Code and the Pharmaceutical Law will be of fundamental importance. Correct classification of counterfeiting of medicinal products and their marketing may raise practical doubts which are based on the establishment of mutual relations between provisions – Article 165 paragraph 1 point 2 of the Penal Code and non-Code regulations found in the pharmaceutical law and extra-code regulations contained in the pharmaceutical law.

    Medical care and services in accordance with the rules and standards accepted by medical science are the moral and legal duty of the physician or any health worker. The set of legal norms as institutional mechanisms that regulate the rights and responsibilities of medical professionals and their patients is the main field of this research. The article aims to present the concept and importance of the research and development of medical law in the Republic of Kosovo. The purpose of the research is to make the connection between the provisions of medical law and the field of gynecology due to the violation of the rights of patients as well as the hesitation or lack of will in reporting such cases. The theoretical method was used for data collection, with which previous studies on medical law were consulted. The statistical method was used to present the number of induced abortions in the Department of Gynecology in Pristina. The interview method was used for the purpose of collecting data that refer to practical cases where physicians may have acted in violation of the law, as well as the presentation of those situations when, due to a serious health condition, they undertook medical actions without consulting with the patient or family members. The research indicates that the Criminal Code of the Republic of Kosovo has incorporated irresponsible medical treatment and failure to provide medical assistance as criminal offenses that are closely related to the exercise of professional medical duties and responsibilities. In the Republic of Kosovo, elective termination of pregnancy is allowed at the will of the woman who is of adult age, while termination of pregnancy with the motive of choosing the gender of the fetus is prohibited. Elective termination is permissible until the end of the tenth week of pregnancy.
    Opieka zdrowotna i usługi medyczne zgodne z przepisami i standardami przyjętymi w naukach medycznych stanowią moralny i prawny obowiązek lekarza i każdego innego pracownika ochrony zdrowia. Zbiór norm prawnych jako instytucjonalnych mechanizmów regulujących prawa i obowiązki pracowników medycznych i ich pacjentów stanowią główny obszar niniejszego opracowania. Artykuł ma na celu przedstawienie koncepcji i wagi badań oraz rozwoju w zakresie prawa medycznego Republiki Kosowa. Celem badań jest określenie powiązania pomiędzy przepisami prawa medycznego a dziedziną ginekologii w związku z naruszaniem praw pacjentów oraz niechęcią lub brakiem woli przy zgłaszaniu takich przypadków. Zastosowano metodę teoretyczną zbierania danych, opierając się na istniejących badaniach w zakresie prawa medycznego. Metodę statystyczną zastosowano do przedstawienia liczby zabiegów aborcji dokonanych na Oddziale Ginekologicznym w Prisztinie. Metodę wywiadu użyto w celu zebrania danych odnoszących się do przypadków z praktyki, w których lekarze mogli działać niezgodnie z prawem, a także przedstawienia takich sytuacji, w których ze względu na poważny stan zdrowia pacjenta podejmowano czynności lecznicze bez konsultacji z pacjentem lub jego bliskimi. Badanie wskazuje na to, że Kodeks karny Republiki Kosowa uznaje nieodpowiedzialne czynności lecznicze i nieudzielenie pomocy medycznej za przestępstwa ściśle związane z wykonywaniem medycznych obowiązków i kompetencji zawodowych. W Republice Kosowa przerwanie ciąży na życzenie jest dopuszczalne na żądanie kobiety dorosłej, natomiast przerwanie ciąży ze względu na wybór płci płodu jest zabronione. Aborcja na życzenie jest dopuszczalna do końca dziesiątego tygodnia ciąży.
