    The protection of Hungary’s external Schengen border is a priority which affects both the security of our country and the whole Schengen Area. Border surveillance is considered safe if it can prevent unlawful acts and proceed against offenders. The implementation of the tasks requires special staff and technical readiness. In the framework of the border protection of our country, it is the Police’s basic task, but in case a state of crisis resulting from mass migration is declared, the Hungarian Defence Forces take part in it. Border surveillance is a constant activity which aims to prevent illegal state border crossings; due to this, its efficiency cannot be measured exclusively based on numerical data. Border surveillance is also effective if it ensures the apprehension of people illegally crossing state borders and if it prevents them from accomplishing that; thus, the ‘physical’ presence itself contributes to the task execution in a manner meeting the requirements. Continuity plays a decisive role from the point of view of border surveillance. Border surveillance shall be considered a component. Thus, the border surveillance system consists of successive system elements which do not go without each other. The border surveillance system is built on border policing strategies, it can be operated based on leadership decisions which shall be in accordance with the border surveillance principles as well. Similarly to the border surveillance system elements, border surveillance principles are those rules which have constant influence/effect on border surveillance/in the field of border surveillance, the practical implementation of which ensures state border surveillance which meets the requirements/is reliable; moreover, it enables the targeted application of the forces and tools available. The operability of the system can only be granted if the principles apply jointly.

    In the era of extremely rapid technological development, the state is directing particular interest towards security in cyberspace and cyber security is becoming a dominant value in its policy. Such a policy may cause a number of negative consequences, such as the willingness to introduce legal regulations that may limit civil rights and freedoms, and in the next stage may lead to violence. As a result, their implementation causes excessive, and often unauthorized, interference of public authorities in the sphere of citizens’ privacy. It should also be stressed that the global nature of the Internet means that mechanisms based on territoriality in a rather limited way ensure effective protection of individual rights against violations by public authorities in cyberspace. In addition to significant physical damage and direct financial losses, the mere likelihood of future cyber threats may cause social distrust and unwillingness to work with new technologies.
    W dobie niezwykle szybkiego rozwoju technologicznego szczególne zainteresowanie państwo kieruje ku bezpieczeństwu w cyberprzestrzeni, a dominującą wartością w jego polityce staje się cyberbezpieczeństwo. Tego rodzaju polityka może wywołać szereg negatywnych konsekwencji, do których można zaliczyć m.in. chęć wprowadzenia regulacji prawnych, które ograniczać mogą prawa i swobody obywatelskie, a w następnym etapie mogą prowadzić do stosowania przemocy. Skutkiem tego, ich realizacja powoduje nadmierną, a niejednokrotnie nieuprawnioną ingerencję organów publicznych w sferę prywatności obywateli. Należy też podkreślić, że globalny charakter Internetu sprawia, iż mechanizmy oparte na terytorialności w dość ograniczony sposób zapewniają skuteczną ochronę praw jednostek przed naruszeniami ze strony władzy publicznej w cyberprzestrzeni. Obok dużych szkód fizycznych i bezpośrednich strat finansowych, samo prawdopodobieństwo wystąpienia przyszłych cyberzagrożeń wywoływać może społeczną nieufność i niechęć do pracy z nowymi technologiami.

    The activity which States undertake when conducting extensive non-directed surveillance programmes is seen as one of the major threats to privacy at the time of the information society. This problem has a special dimension in the European Union because the surveillance activity of individual Member States may be an obstacle to the functioning of a single internal market, particularly when it comes to ensuring the freedom to transfer personal data. Due to the supranational character of contemporary means of communication, and especially Internet communication services, guarantees related to the protection of privacy ought to be analysed not only through the prism of domestic regulations but also in the light of international law provisions. Results of an analysis of the relevant primary and secondary EU law have been presented. A special focus was put on Directive 95/46 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data and Directive 2002/58 on privacy and electronic communications. The formal eff ects of the rulings of the Court of Justice which determined invalidity of the retention directive have been analysed as well, mainly from the perspective of the validity of national provisions implementing the general obligation to retain the data in legal orders of EU Member States. Particularly interesting seems to be the analysis of the grounds for non-directed surveillance programmes and comparison of the fi ndings with the rulings of the CJEU and the ECHR, particularly the recent CJEU’s judgment in Tele2 and the ECHR’s judgment in Szabo v. Hungary. The judicial decisions analysed in the paper may not only be useful in solving matters related to surveillance instruments used in individual cases but may also serve as a helpful tool in establishing the directions of development of domestic regulations in line with international standards. The latter may also be related to the provisions of the surveillance act and anti-terrorist act recently binding in Poland.

    Stosowanie rozbudowanych środków inwigilacji elektronicznej jest coraz częściej wskazywane jako jedno z głównych zagrożeń dla ochrony prywatności w cyberprzestrzeni, a w konsekwencji - dla budowy społeczeństwa opartego na informacji i wiedzy. Zagadnienie to jest często wiązane z poszukiwaniem równowagi pomiędzy ochroną praw jednostek (prawo do prywatności) a bezpieczeństwem publicznym (ochrona przed najpoważniejszymi przestępstwami) i kojarzone z działaniami realizowanymi przez amerykańskie służby wywiadowcze. Rozbudowane programy inwigilacyjne są jednak również prowadzone przez niektóre państwa członkowskie UE. Działania te budzą uzasadnione wątpliwości co do ich zgodności z prawem Unii, a także z obowiązkami wynikającymi z EKPC. Szczególne znaczenie mają programy inwigilacji elektronicznej prowadzone przez brytyjskie służby wywiadowcze (zwłaszcza GCHQ). Działania te nie tylko opierają się na hurtowym gromadzeniu danych elektronicznych, ale także na ich przekazywaniu do służb specjalnych państw trzecich. Problem szeroko zakrojonych działań inwigilacyjnych prowadzonych przez władze brytyjskie pozostał nierozwiązany na poziomie prawa UE. Również orzecznictwo ETPC, w którym wskazano na brak proporcjonalności tego typu programów, nie przyczyniło się do zmiany brytyjskiej praktyki. Wyjście Wielkiej Brytanii z Unii Europejskiej i oparcie przyszłych stosunków na wydawanej przez KE decyzji o adekwatności zabezpieczeń otwiera nowe pole dla rozwiązania tego problemu. W artykule omówiono możliwy wpływ Brexitu na ramy prawne brytyjskich programów inwigilacji elektronicznej oraz przedstawiono nowe środki wpływu, które będą dostępne dla europejskich partnerów w celu ograniczenia masowych działań inwigilacyjnych prowadzonych przez władze brytyjskie.

    On 28 April 2016 the Directive (EU) 2016/681 of the European Parliament and of the Council on the use of passenger name record (PNR) data for the prevention, detection, investigation and prosecution of terrorist offences and serious crime was adopted by the 28 Member States. Regulating this complex issue, European legislator has been obliged to strike a “fair balance” between the objective of combating terrorism and serious crime and the objective of protecting personal data and respecting the private life of the passengers. The aim of this paper is to analyse the provisions which apply to the processing of PNR data in the light of the principle of proportionality.

    The paper analyses the PNR Directive as pre-emptive data surveillance practice. The 2016/681 Directive regulates the use of Passenger Name Record (PNR) data in the EU for the prevention, detection, investigation and prosecution of terrorist offences and serious crime. It obliges airlines to hand national authorities passengers’ data for all flights from third countries to the EU and vice versa, but Member States can also extend it to ‘intra-EU’ ones (i.e. from an EU country to one or more other EU countries), provided that they notify the EU Commission. Thus, PNR Directive affects all passengers who arrive in the territory of one Member State originating from a third country, or who depart from a Member State’s territory to a non-EU country, including any transfer or transit flights. Using PNR data, the individual is profiled and encoded in terms of degrees of risk.

    Jednym z największych zagrożeń i wyzwań dla współczesnych państw jest funkcjonowanie programów masowej inwigilacji i wpływ nowych technologii informacyjnych na ograniczenie prywatności. Celem niniejszego artykułu jest przedstawienie genezy, wizji funkcjonowania oraz krytyki programu Social Credit System (SCS), który powstaje w Chińskiej Republice Ludowej. Głównym problemem badawczym wynikającym z założonego celu była odpowiedź na pytania: czym jest SCS w Chińskiej Republice Ludowej, jaka jest geneza jego powstania oraz na czym polega jego funkcjonowanie? Do rozwiązania problemów badawczych zastosowane zostały następujące metody badawcze: metoda monograficzna, metoda badania dokumentów, metoda analizy i krytyki piśmiennictwa oraz metoda analizy i syntezy. Biorąc pod uwagę wstępnie przeprowadzone badania, autor postawił następującą hipotezę badawczą: SCS należy traktować znacznie szerzej niż tylko program mający na celu masowy nadzór nad chińskim społeczeństwem i powstrzymywanie zagrożeń związanych z separatyzmem, terroryzmem i buntem społecznym (kolorowymi rewolucjami). Jest on jednym z narzędzi budowania społeczeństwa opartego na tradycyjnych chińskich wartościach i tożsamości narodowej: lojalności, harmonii, prawości i uczciwości. Społeczeństwa zdyscyplinowanego, które obok silnej i innowacyjnej gospodarki umożliwi Chinom uzyskanie statusu globalnego mocarstwa, podważając tym samym jednobiegunowy „amerykański porządek międzynarodowy”. Pomimo iż Chiny nie są państwem demokratycznym, powodzenie systemu może przyczynić się do wdrożenia podobnych rozwiązań w innych krajach Azji. Tym samym zasadne wydaje się prowadzenie badań nad SCS. 
    Mass surveillance programmes and the impact of new information technologies on privacy restriction are among the greatest threats and challenges faced by modern countries. This article aims to present the origins and functional vision of, and some critical remarks on, the Social Credit System (SCS) under development in the People’s Republic of China. The underlying research issue arising from the assumed objective was to respond to the following questions: What is the SCS developed in the People’s Republic of China? What are its origins? How exactly does it function? The following research methods were used to solve the research queries: the monograph method, the document analysis method, the literature analysis and critique method, and the analysis and synthesis methods. In view of the preliminary investigation, the author formulated the following research hypothesis: the SCS should be viewed in a broader sense than merely as a programme aimed at conducting mass supervision of the Chinese society and preventing threats of separatism, terrorism, and social riot (colour revolutions). It is one of the tools to shape a society based on traditional Chinese values and national identity: loyalty, harmony, integrity, and fairness ‒ a disciplined society which, along with a strong and innovative economy, will enable China to attain the status of global power, thus questioning the American “unipolar world order”. Although China is not a democratic country, the system’s success can contribute to implementing similar solutions in other Asian countries. Therefore, it appears justified to conduct studies focused on the SCS.
