Opis:
The new Albanian Family Code provides an additional measure reading the protection of the child, namely, the “loss of parental responsibility.” Differently from the measure of “removal of the parental responsibility” that is provided in the civil code provisions, this new measure has been introduced for the first time in the Albanian legal framework and is taken by court through a penal process. Thus, according to article 223 of the Family Code, “the parents of a child may loose the parental responsibility through a penal court decision that has found them guilty of committing themselves or assisting in the commitment of a criminal offense against their child. They may also loose it if they have been convicted for any of the reasons regarding the abandonment of the family and have not fulfilled the related obligations.” This paper aims to analyse and interpret the introduction of this new measure which has caused difficulties regarding its practical application by courts. The authors of the paper analyse the legal features of the measure and the controversies of the doctrine in relation to such a measure. They also suggest the categorization of the new measure as a punishment of a penal nature, i.e as a supplementary punishment. The paper also analyses the cases where the measure is likely to be applied and the terms applicable to the individual that will be subjected to this measure. The paper reviews also the time frame of the application of the new measure. The current legal framework does not contain a specific provision regarding this issue. In light of the evolution of the concept of the parental responsibility as well as the perspective of human rights protection the authors support the idea of the regulation of the time limits of the measure. The authors argue that in the determination of the time limits of the application of the measure (including the possible return of the parental rights), it is important the courts maintain a fair balance between the loss of parental responsibility and the respect of rights of the biological parent, in the highest interest of the child, to be raised and educated in the family of origin. At the end of the paper the authors also suggest the need to improve de lege ferenda the current provisions in order to ensure that the application of the new measure meets its purposes, i.e the removal of the parental rights is applied only in those cases where the parents are considered unfitted to exercise this right over their children.

Opis:
Il presente lavoro ha ad oggetto una pronuncia emessa dalla Suprema Corte di Cassazione, con la recente sentenza del 24 maggio 2018, n.12954, che ha posto l’accento su tematiche riguardanti i minori e la loro educazione religiosa. La vicenda, definendo questioni inerenti alla separazione in presenza di minore, tratta il complesso argomento dell’intesa tra i genitori circa l’educazione da impartire (nello specifico quella religiosa), analizzando la legittimità del comportamento del padre di imporre alla figlia minore una religione diversa da quella dalla stessa praticata con la mamma, rilevando soprattutto l’aspetto del disagio, lamentato dalla stessa minore nel praticare questo “nuovo” culto. L’analisi, inoltre, porta a considerare che la scelta e la pratica di una religione rientra nella manifestazione del diritto di libertà religiosa, tutelato dall’art. 19 della Costituzione, conseguentemente, a poter ritenere ammissibile un autonomo diritto di libertà religiosa da parte del figlio minore, e a domandarci se l’esercizio di questo diritto possa contrastare con la divergente decisione di uno o di entrambi i genitori.
Przedmiotem niniejszego opracowania jest wyrok włoskiego Najwyższego Sądu Kasacyjnego z 24 maja 2018 r., nr 12954, odnoszący się do edukacji religijnej nieletnich. Decydując o kwestiach związanych z separacją małżonków, orzeczenie odnosi się do kompleksowej kwestii ich porozumienia w sprawie edukacji (w szczególności religijnej) potomstwa, analizując legalność zachowania ojca narzucającego nieletniej córce religię odmienną od tej, którą ona praktykowała z matką. Zwrócono przy tym przede wszystkim uwagę na stan dyskomfortu, wywołany przez praktykowanie tego “nowego” kultu, na który skarżyła się nieletnia. Przeprowadzone analizy prowadzą do wniosku, że wybór i praktykowanie religii wchodzą w zakres prawa do wolności religijnej, które jest chronione przez art. 19 włoskiej Konstytucji. Wynika stąd, że należy uznać autonomiczne prawo do wolności religijnej nieletniego dziecka, stawiając jednak pytanie, czy realizacja tego prawa może wchodzić w konflikt z odmienna decyzją jednego lub obojga rodziców.
This work has as its object the judgment of the Italian Supreme Court of Cassation of 24 may 2018, n. 12954, based on issues related to children and their religious education. Involving two separated parents and their minor daughter, the matter deals with the difficult subject of the parental agreement on their child’s education (in this instance the religious one). It analyses how legitimate the father’s behavior was to impose on his minor daughter the practice of a religion that differed from the one followed by the child’s mother and puts out especially the discomfort caused to the minor, and lamented by her, in exercising this “new” cult. The analysis leads furthermore to considering that both the choice and the practice of a religion are part of the right to religious freedom, which is protected by art. 19 of the Italian Constitution, and, consequently, that a minor child’s own right to the religious freedom is considered eligible. Moreover, it allows us to ask ourselves whether this right can still be exercised in case it enters in contrast with one or both parents’ different decision.
