    The article is analysing dramas from school theatres written between the 16th and the 18th century, containing the infanticide motive. It is seen that infanticide varies in different plays. In no case was it a main theme of dramas. Infanticide was an important component of the plot in martyrological plays. These dramas showed the heroism of martyrs and concentrated on the details of the felony. At the same time, in other plays, manslaughter of the child constitutes a subplot. Very often, the motive for killing children was the anxiety about loss of power. In many dramas, justification for committing such a crime was more important than the crime itself. Manslaughter of children probably was not portrayed directly on stage, according to the rules included in „Ratio Studiorum”. It is possible that it was portrayed with the help of allegorical images or with the magic lantern.

    In 2001, a Texan housewife, Andrea Yates, drowned her five children in a bathtub, claiming that she had killed them to save them from evil. Her life sentence for murder was later suspended, and Yates was transferred to a psychiatric facility. In 2009, Joyce Carol Oates published the short story “Dear Husband,” inspired by the Yates case. The author structured her story as a letter which Lauri Lynn writes to her husband to confess to the murder of their five children before she takes her life. The aim of this article is to analyze the story using the categories elaborated by Paul Ricoeur to define evil and its symbolism and to try to answer the question: is Andrea Yates/Lauri Lynn a villain or a victim?

    Infanticide is a crime with a very interesting history. Over the centuries infanticide has come a long and complicated evolution under the influence of Christianity – from aggravated type of crime to the privileged one. The Polish penal provisions protect human life from the moment of conception until death. It refers to all people including children. However, children’s right to life is not treated the same way as adults when it comes to committing a murder. In case of infanticide possible sentences are much milder compared to a common murder. In the view of existing Polish legal system the issue of infanticide as a crime privileged raises many concerns on the theoretical and practical basis despite many attempts to treat it as a common murder.

    Early Modern Child-Murder Investigations Were Characterized by Many Conflicts and Struggles on Different Levels of the Social Organization. Sources like broadside ballads or pamphlets highlighted the infanticide as a matter of considerable public concern. There the conflict between idea of early modern motherhood and family life and the everyday life of single-mothers dealing with unwanted children was apparent. These moralizing pamphlets were describing virtues of motherhood like self-sacrifice, solicitude, economic and social responsibility and on the other hand authors criticized murdering mothers. Finally, conflicts, antipathy and personal confrontations between members of the family and sexual partners can be traced in these sources. Events prior the crime can be characterized by disagreements between sexual partners, violence and verbal abuse. This contextual analysis of conflicts in five infanticide proceedings from south Bohemia (1690–1710) is the centre of the paper.
    Nowożytne śledztwa w sprawie morderstw dzieci charakteryzowały się wieloma konfliktami i walkami na różnych poziomach organizacji społecznej. Źródła, takie jak ballady czy pamflety, publikowane w gazetach dużego formatu, ukazują dzieciobójstwo jako kwestię, którą żywo interesowała się opinia publiczna. Widać było w tym konflikt między nowożytnym ideałem matki i życiem rodzinnym a samotnymi matkami z niechcianymi dziećmi. Moralizatorskie pamflety przywoływały takie cnoty macierzyństwa, jak samopoświęcenie, troska o innych czy ekonomiczna i społeczna odpowiedzialność, jednocześnie krytykując matki dzieciobójczynie. Co więcej, w tych źródłach można doszukać się konfliktów, antypatii i personalnych konfrontacji między członkami rodziny a kochankami. Wydarzenia poprzedzające zbrodnię dzieciobójstwa to przede wszystkim niesnaski między partnerami seksualnymi, przemoc i słowne zniewagi. Przedmiotem niniejszego artykułu jest analiza kontekstualna pięciu spraw sądowych dotyczących dzieciobójstwa, które to postępowania miały miejsce w południowej Bohemii w latach 1690–1710.

    The Crime of Count Neville is primarily a story of a complex father–daughter relationship, culminating in the attempted murder of the count’s daughter by her own father. Infanticide is inevitable for Sérieuse, which parallels the mythological story of Iphigenia. But Nothomb also develops on an extra-diegetic level, as the meta-narrative of the genesis of the Freudian Family Romance or the Novel itself. Between the concepts of “bastard” and “foundling,” this novel contains many autobiographical elements and borrows from other literary works, most noticeably from Oscar Wilde’s collection Lord Arthur Savile’s Crime.

    In the last decades of the 19th century, in the Kingdom of Poland, the scale of social pathologies increased, including infanticide and abandonment of children. Such phenomena were conditioned by a number of social, demographic, economic and moral factors; the processes of urbanization and industrialization played a major part as they resulted in the inflow of great masses of people to cities, who experienced difficulties in the adaptation to new conditions. Poverty, illiteracy, often the lack of steady employment, disintegration of the traditional social groups and the system of values lead to the destabilization of the situation of the immigratory population. This made starting a family difficult, leading to a large number of informal relationships, lone mothers and illegitimate children deprecated by public opinion. The hardships of lonely maternity, lack of support on the part of the state administration and shelters determined the increased number of crimes against children. Also, unfavourable was a common practice of employing wet nurses, who left their own children in the care of hired babysitters, who were knowingly called the “producers of angels” because of the fact of a huge mortality rate among such infants, dying as a result of disastrous care, or, sometimes, simply murdered. Social work of pedagogues, doctors and lawyers slightly improved the fate of the poorest mothers, who most often committed infanticide and abandonment of their children, and, consequently, the scale of such phenomena at the beginning of the 20th century slightly decreased.

    The purpose of this presentation is to address the issue of female criminality in early modern Cluj, and to analyze women’s position before the law. Our investigation is based on the records of the secular Court from the town Cluj, where we have identified more than 250 cases of women accused of fornication, adultery, witchcraft, infanticide, theft and drunkenness, poisoning, swearing and slander. There were a significant number of female convictions during the century, from which most ended with light sentences, such as banishment, corporal punishments, stigmatizations with hot iron, mutilations and only occasionally death. We would like to analyze in detail the types of crime  and their punishments presenting the legal background, the jurisdiction and the habitual practices of the Court. We would also like to underline the importance of the narrative strategies used in these inquisitorial trials, since our documents reveal female criminality from a male perspective, as in these times men ran the legal system, consequently the Court records, in our reading contain moral, legal and sexual elements of a male discourse on female crime.

In order to morally evaluate the act of abortion, the author considers both the ontic status of the conceived human being and the criteria usually used for the evaluation.

    Celem artykułu jest przedstawienie jak przez lata kształtowała się przestępczość kobiet, czy ulegała zmianie, czy może w każdym okresie prezentowała się podobnie. Historię podzielono na trzy okresy, przestępczość kobiet do roku 1918, w latach 1918-1939 oraz 1946-1989, bowiem zmiany społeczno-gospodarcze były tak istotne, że z pewnością wpływały na społeczeństwo. W opracowaniu przedstawiono, w miarę możliwości, tendencje, strukturę i dynamikę przestępczości, a także omówiono poszczególne, charakterystyczne dla kobiet przestępstwa. Ukazano więc, czym charakteryzowała się przestępczość w poszczególnych okresach, jak zmiany gospodarcze wpływały na społeczeństwo oraz które czyny najczęściej popełniały osoby płci żeńskiej. Przeanalizowano obraz przestępczości kobiet od starożytności do roku 1989 posiłkując się oficjalnymi danymi (statystyki kryminalne, statystyka sądowa), a także historiami pojedynczych przypadków, jak np. procesem o czary, średniowiecznymi sprawami kobiet oskarżonych o awanturnictwo i pieniactwo czy najgłośniejszym zabójstwem w 20-leciu międzywojennym – sprawą Rity Gorgonowej. W artykule, w miarę możliwości, przedstawiono obraz przestępczości kobiet w ujęciu historycznym, wykorzystując różnorodne źródła. Skorzystano z materiałów sprzed II wojny światowej, a nawet z XIX wieku, posiłkując się także pracami naukowymi najwybitniejszych, ówczesnych kryminologów. Artykuł wzbogacono o dane statystyczne Ministerstwa Sprawiedliwości i przedwojennych roczników statystycznych. W niniejszej pracy wykorzystano trzy metody badawcze, metodę dogmatyczną, analizy piśmiennictwa oraz analizę i interpretację danych statystycznych, aby przedstawiony obraz przestępczości kobiet jak najlepiej, w miarę możliwości, odwzorowywał rzeczywistość.
    The aim of the article is to present how women's crime has evolved over the years, whether it has changed or whether it has looked similar in each period. The story is divided into three periods, women's crime up to 1918, 1918-1939, and 1946-1989, because socio-economic changes in those times were so important that they certainly influenced society. The study presents, as far as possible, trends, structure and dynamics of crime, and also discusses crimes characteristic of women. A paper shows what was characteristic of crime in particular periods, how economic changes affected society and which crimes were most frequently committed by women. The picture of women's crime from antiquity to 1989 is analysed using official data (crime statistics, court statistics), as well as stories of individual cases, such as witchcraft trials, medieval cases of women accused of adventurism, or the most famous murder in the interwar period - the case of Rita Gorgonowa. The article presents, as far as possible, a historical picture of women's crime, using various sources. Materials from before the Second World War, and even from the 19th century were used and also the scientific works of the most eminent criminologists of the time. The article was enriched with statistical data from the Ministry of Justice and pre-war statistical yearbooks. This paper uses three research methods, a dogmatic method, literature analysis and the analysis and interpretation of statistical data in order to present a picture of women's crime in those times as best as possible.

    Niniejsze opracowanie dotyczy charakterystyki podstawowych kategorii zabójstw dokonywanych przez kobiety. Opracowanie ma charakter teoretyczny, wykorzystano tradycyjny przegląd literatury stosując pewne zasady, które miały zminimalizować ryzyko błędu. Głównym celem było dokonanie charakterystyki zabójstw seryjnych popełnianych przez kobiety, zabójstw partnera życiowego oraz zabójstw dzieci. W obszarze wskazanych kategorii omówione zostały podstawowe typologie, scharakteryzowano sposób działania sprawczyń i wykorzystywane przez nie narzędzia zbrodni. Zwrócono uwagę na zróżnicowaną motywację towarzyszącą popełnianiu zbrodni oraz scharakteryzowano podstawowe zespoły czynników ryzyka towarzyszących popełnianiu zabójstw koncentrując się na czynnikach osobowościowych i środowiskowych.
    This study deals with the characteristics of the basic categories of homicides committed by women. The study is theoretical issue. A traditional literature review was used, applying certain rules to minimize the risk of error. The main purpose was to characterize serial killings committed by women, murders of a life partner and murders of children. In the area of the indicated categories, the basic typologies were discussed, the way of acting of the perpetrators and the tools of the crime used by them were characterized. The attention was paid to the diversified motivation accompanying committing crimes, and the basic groups of risk factors accompanying committing murders were characterized, focusing on personality and environmental factors.

    This article examines the narrative of the compassionate response of two Hebrew midwives and Pharaoh’s daughter to Pharaoh’s command that Hebrew boys be killed at birth (Ex 1:82:10), and of Medea’s vengeful to her husband Jason’s infidelity in Euripides’ tragedy Medea. The paradox of Medea’s character is reflected in her decision to murder her two sons, whom she loves immeasurably, because by this absurd act she hurts the traitorous Jason to the utmost humanly possible degree. The Hebrew midwives save Hebrew children because they “fear God,” Pharaohs daughter saves a Hebrew child from her father’s murderous plan without explaining the reasons, and Medea, in preparing and carrying out the murderous plan invokes the authority of the gods who mercilessly punish human transgressors. The aim of the article is to show how the Hebrew story, on the one hand, and the Greek drama, on the other hand, present, indicate or explicitly express the reasons for the behaviour of literary characters in relation to human and divine authority.
    Artykuł analizuje narrację o współczującej reakcji dwóch hebrajskich akuszerek i córki faraona na polecenie faraona, by hebrajskich chłopców zabić przy narodzinach (Wj 1,82,10), oraz o mściwej reakcji Medei na niewierność jej męża Jasona w tragedii Eurypidesa Medea. Paradoks charakteru Medei przejawia się w jej decyzji zamordowania swoich dwóch synów, których kocha bezmiernie, ponieważ tym absurdalnym czynem krzywdzi zdradzieckiego Jasona w stopniu najwyższym z możliwych po ludzku. Hebrajskie akuszerki ratują hebrajskie dzieci, bo “boją się Boga”, córka faraona ratuje hebrajskie dziecko przed morderczym planem ojca, nie wyjaśniając przyczyn, a Medea, przygotowując i realizując morderczy plan, powołuje się na autorytet bogów, którzy bezlitośnie karzą ludzkich przestępców. Celem artykułu jest pokazanie, w jaki sposób opowieść hebrajska z jednej strony i dramat grecki z drugiej przedstawiają, wskazują lub wprost wyrażają przyczyny zachowań bohaterów literackich w odniesieniu do autorytetu ludzkiego i boskiego.

    Dzieciobójstwo było zawsze potępiane. W końcu XVIII w. włączył się do tego król pruski, który wydał kilka zarządzeń chroniących samotne matki i ich dzieci. Na terenach zaboru pruskiego wydawał je w języku niemieckim i polskim. Zachowało się tylko kilka egzemplarzy druku. Król poucza w nim społeczeństwo i administrację, jak ma się zachować wobec samotnych matek, aby nie dochodziło do dzieciobójstwa i ustala kary za przekroczenie zarządzenia.
    Instances of infanticide have always been condemned. The Prussian king got involved in the issue at the end of the 18th c. by editing several regulations protecting single mothers and their infants. They were published in both German and Polish on the annexed territory during the period of Partition. A few copies have been retained. The king instructs the society and the administrative powers how to deal with single mothers in order to avoid infanticide; he also defines penalty for disobeying the law. The above mentioned document has been kept in the State Archives in Gdansk.

    Opis:
    Artykuł ma charakter przeglądowy. W pierwszej części Autor prezentuje przegląd poglądów na temat przerywania ciąży od czasów starożytnych aż do nowożytnych, kładąc szczególny akcent na rozwój terminologii i ukryte w niej znaczenia. Dowodzi, że szczegółowa penalizacja czynu, jakim było przerywanie ciąży – utożsamiane do czasów nowożytnych z zabójstwem – uzależnione było od chronologii ciąży. Dokonuje również rozróżnienia między aborcją (przerwaniem ciąży) a zabójstwem dziecka już narodzonego. Obydwa czyny w prawie pruskim były obwarowane wysokimi karami, z karą śmierci włącznie. W drugiej części artykułu omawia praktyczne aspekty ochrony życia nienarodzonych i zjawisko przerywania ciąży oraz zabójstwa dzieci narodzonych dokonywane przez matki, położne i znachorów.
    The article is a review study. In the first part the author presents a review of the opinions on the termination of pregnancy from the ancient times until modernity, focusing particularly on the development of terminology and meanings implied in it. The article proves that detailed penalization of the termination of pregnancy – until modern times equated with a murder – depended on the chronology of pregnancy. The author distinguishes an abortion (termination of pregnancy) from the murder of a newborn child. In the Prussian law, severe punishments (including the capital punishment) were administered for both deeds. In the second part of the article, the author discusses practical aspects of the protection of unborn children, the problem of pregnancy termination and murders of newborns committed by mothers, midwifes and folk healers.

    Przedmiotem opracowania jest wysoce sporne w literaturze z zakresu prawa karnego zagadnienie związane z karnoprawną oceną czynu intraneusa za niewykonawcze formy współdziałania przestępnego. Rozważania prowadzone są w kontekście przestępstwa dzieciobójstwa określonego w art. 149 k.k. W wyniku poprowadzonych rozważań autor ustala, iż w języku prawnym Kodeksu karnego dany typ czynu zabronionego określony w części szczególnej k.k. bądź ustawy karnej pozakodeksowej, swoje odniesienie ma zawsze do wszystkich form popełnienia czyn zabronionego w ujęciu rozdziału II k.k., a więc form wykonawczych, niewykonawczych, a także form stadialnych.
    The subject of the study is a highly controversial issue related to the criminal law assessment of an intraneus act for non-executive forms of criminal cooperation, which is discussed in the literature on criminal law. Deliberations are conducted in the context of the crime of infanticide specified in Article 149 of the Penal Code. As a result of the deliberations, the author determines that in the legal language of the Penal Code a given type of prohibited act specified in the special part of the Penal Code or the Non-Codex Criminal Act, it always refers to all forms of committing a prohibited act in terms of Chapter II of the Penal Code: executive, non-executive forms, as well as stadium forms.

    Postawy społeczne wobec karalności za wybrane przestępstwa są tematem licznych badań. Wskazują one jasno na określone ustosunkowanie obywateli wobec wymiaru kary, z punktu widzenia ich zasadności i sprawiedliwości. Niniejsze badanie miało na celu przeanalizowanie pod kątem psychologicznym współzależności między zmiennymi o charakterze demograficznym, społecznym i emocjonalnym a ustosunkowaniem wobec penalizacji wybranych przestępstw. Wyniki pokazały, że kobiety mają średnio wyższe nasilenie stopnia empatii, ogólnie częściej postawę rygorystyczną, w tym za przestępstwo dzieciobójstwa. Osoby o najwyższych średnich wynikach w teście Kwestionariusza Rozumienia Empatycznego, prezentowały średnio częściej postawę bardziej rygorystyczną, niż jest to przewidziane w prawie karnym. Pewne kategorie przestępstw: 1) gwałtu ze szczególnym okrucieństwem, 2) zabójstwa ze szczególnym okrucieństwem, 3) propagowania lub pochwalania zachowań pedofilskich, 4) przymuszania do prostytucji, jednogłośnie zostały ocenione jako niezasługujące na łagodniejszy niż przewidywany, wymiar kary. Istnieje potrzeba dalszych analiz, które wskazywałyby, w jaki sposób cechy indywidualne człowieka decydują o wyborze kary w obliczu oceny czyjegoś bezprawnego zachowania.
    There is a bulk of research on social attitudes to the penalization of selected crimes. Studies clearly show that citizens tend to adopt a specific attitude to penalties, which is conditioned by their appropriateness and fairness. The aim of our study was to analyze, in psychological terms, the relation between demographic, social and emotional variables and the attitude adopted towards the incrimination of some illegal acts. The results show generally higher empathy levels and stricter attitudes among women, especially to infanticide. Individuals with the highest average results in the EUQ (Empathic Understanding Questionnaire) displayed on average a more rigorous attitude than the one specified by the criminal code. For certain categories of crimes, such as: 1) rape with extreme cruelty; 2) murder with extreme cruelty; 3) dissemination and welcome of pedophile activity; and 4) forced prostitution, there was a unanimous agreement that penalties should not be less than those already set forth in legislation. There is a need for further analyses to demonstrate how the individual’s specific characteristic may influence their choice of penalty when faced with the task of assessing an illegal behavior.

    W artykule został omówiony przebieg prac kodyfikacyjnych Sekcji Prawa Karnego Komisji Kodyfikacyjnej z okresu międzywojennego dotyczący kwalifikacji prawnej czynu zabronionego jako dzieciobójstwo lub zabójstwo dziecka. Analizą zostały objęte zapisy redakcyjne projektów kodeksu karnego z 1932 r. przyjętych przez Sekcję Prawa Karnego oraz towarzysząca pracom kodyfikacyjnym dyskusja na przedmiotowy temat. Zasadność nowelizacji i ujednolicenia regulacji karnych w analizowanym zakresie przedstawiono na przykładzie archiwalnych akt Sądu Okręgowego w Piotrkowie Trybunalskim. W dotychczasowej literaturze przedmiotu zagadnienie kodyfikacji zabójstwa dziecka i dzieciobójstwa w okresie II Rzeczypospolitej nie zostało omówione.
    This article discusses the course of the codification works of the Criminal Law Section of the Codification Commission during the interwar period concerning the legal qualification of a criminal act as infanticide or child murder. The editorial records of the drafts of the 1932 Criminal Code adopted by the Criminal Law Section as well as the discussion on the subject which accompanied the codification works are subjected to analysis. The legitimacy of amending and unifying criminal regulations in the analyzed area is presented on the example of the archival records of the Piotrków Trybunalski Regional Court. The issue of the codification of child murder and infanticide during the Second Polish Republic period has not been hitherto discussed in the literature on the subject.

    Opis:
    The study comprises an introduction, main body, and a conclusion. In the introductory part presented is the issue of Code of Chief and Correctional Penalties introduced in Autonomous Polish Kingdom by the decree of 1 January, 1847, in place of the current Polish Penal Law of 1818. The author discusses the principles underlying the nature of crime, punishment, responsibility, and a system of penalties which is to act as a deterrent. The article presents the state of research, sources and literature of the subject, as well as the aim of the study. The article comprises three parts. They deal with offences against life, matrimony and parental authority, caretaker's authority, and legal guardianship. The discussed offences against life include: patricide, killing of a family member, killing of a pregnant woman, infanticide, abortion, abandonment of a child, and suicide. The part that deals with offences against matrimony contains three spheres of offences and misdemeanours, often closely linked with the civil norms of marital law: punishable violation of essential conditions of entering into marriage, punishable violation of legal impediments to marriage, criminal responsibility of parents, guardians and priests for the violation of legal impediments to marriage, and the abuse of marital rights and obligations, as well as sexual offences against family. The last part of the article deals with offences against parental authority, caretaker's authority and guardianship, listing different types of authority abuse, offences committed by children against their parents, and abuse of authority by caretakers and guardians. The conclusion contains a succinct appraisal and an analysis of the issues in focus.
