Irregular immigration is a phenomenon with a substantial impact for the majority of the countries. The paper analyses whether there is an adequate human rights framework for protection of irregular immigrants or whether the irregular status exempts the migrants from the protection of international human rights law. If this is the case, then the human rights universality has failed. The paper takes into consideration the developments in the International and EU Law, as well as in the jurisprudence of the international tribunals regarding protection of irregular immigrants. It is divided into three main sections. The first section informs briefly on the dynamics of irregular immigrants; the second section analyses the legislation on irregular immigration from the perspective of the state sovereignty, the third section analyses the human rights law and the protection it affords to irregular immigrants, pursuant to the interpretation of International tribunals.

Linguistic human rights are a concept remaining on the crossroads of several scientific disciplines, e.g. linguistics, anthropology, psychology and, last but not least, human rights law. Taking the latter as a lens, this study seeks to clarify the concept of linguistic human rights in education – presumably, the most linguistically sensitive sphere in the life of individuals and communities. The paper demonstrates that despite little mention of language in the UN treaties (ICESCR, CRC, CERD, CADE), its importance is reflected in the practice of the relevant treaty-based bodies. Moreover, increasing interest from scholars across a range of disciplines is contributing to the development of a linguistic human rights doctrine and is penetrating the UN human rights framework.

The success of democracy depends on the formation of the social capital conducive to the maintenance of democratic patterns of behavior. Civic education is the most important instrument of the formation of such social capital and is, therefore, an essential responsibility of the democratic state. The concept of social capital, introduced in the social science theory by such authors as Pierre Bourdieu (1984) and James Coleman (1988), implies that the quality of democracy depends on the relations between citizens, particularly on the acceptance of such values as trust in others and willingness to accept them as equals. Consequently, the way in which human rights are perceived in a society has profound importance for the quality of political life and constitutes the crucial component of democratic political culture.

The first attempts to combat corruption date back to ancient times and had mainly moral connotation. Despite being an old phenomena, nowadays it takes new shapes and becomes a more common feature of social life, especially in the Latin America region. Corruption is a complex, and multidimensional phenomenon that negatively impacts human rights on many levels. Therefore, serious effort have long been made at global, regional and state levels to combat corruption. The United Nations and regional organizations have adopted numerous non-binding and binding documents with a view to stifling this phenomenon but none of them refer to the issue of impact of corruption on human rights. But it should be stressed that it is very hard to establish a link between corruption and human rights violations. Some efforts has been made by the Inter-American Court of Human Rights (IACHR) and the Inter-American Commission on Human Rights (IAComHR). This article considers whether and how the IACHR and the IAComHR establish the link between corruption and violation of human rights in the inter-American system. It also determines which groups of people are, according the IACHR and the IAComHR, particularly affected by corruption, what measures should be taken to protect those exposed to acts of corruption, what obligations are incumbent on States with a view to preventing, combating and eradicating corruption.

The question of discrimination, as far as it is considered in the field of philosophy, cannot be perceived as a problem which can be effectively combated. Even the most precise diagnosis of human nature will not restrain people from defining others as evil and inferior. The most universal and spacious conventions, declarations, cards or bills will not solve the problem either. They can be regarded as an example of applied philosophy at most. On the other hand, we should pose the question what the world would look like if political pragmatism were the main obligatory rule. Thus, the situation finds us between philosophical wishful thinking about a global order free from discrimination and macro – or micropolitical pragmatism.

The overall objective of this paper is to outline the evolution of human rights policy in the European Union, with particular emphasis on the delimitation of time resulting from the entry into force of the Treaty of Lisbon signed on 13 December 2007, which revealed how strongly law is related to politics. Focusing on that issue is not accidental. This results from the fact that the European Union is an excellent example of an international organization whose priority aim at the moment of its creation was not the protection of human rights treated as an end in itself, and which in the course of its development has made the protection and promotion of human rights, “a silver thread running through all EU actions “. The specific objectives (though no less important from the point of view of the essence of human rights protection in the European Union) are: to show the systemic nature of the protection of those rights, the nature which is increasingly becoming part of the European Union, hitherto breaking somewhat the monopoly of the Council of Europe in this field; and to evaluate the European Union policy on the protection of human rights.

The subject of the article are international guarantees of human rights and cases of violation of these rights in Ukraine. The text of the Constitution of Ukraine, adopted in 1996, takes into account the norms of international law in the field of human rights protection. It is a developing country, so there are still many problems related to the protection of human rights. The basic problem is the lack of fair courts, one of the reasons being the high level of corruption. But the most difficult situation from the point of view of human rights protection is the war in the east of Ukraine and the annexation of Crimea by Russia. In the Crimea occupied by Russia, violent disappearances of people are repeated; Russian authorities persecute pro-Ukrainian activists and Crimean Tatars for peaceful resistance to the occupation of the peninsula. Diplomatic procedures are ineffective, and several dozen people are still in custody. Support is provided by organizations such as Amnesty International and cases of violations of human rights are publicized in order to arouse the reaction of international public opinion.

The author introduces a fundamental distinction between human rights and the law of human rights which is subsequent to these rights. While examining these issues, the author follows M. Piechowiak and his way of understanding human rights. According to Piechowiak, human rights are objectively existing relationships between a human being and a global good, welfare that is due to him/her. Particular aspects of this global good are what we used to call an object of a particular human right. Therefore, human rights have an ontic nature. These relationships have their normative consequences. It may be stated that these relationships ontologically justify that the norms protecting these rights (actually these relationships) stay in force. These relationships and the norms protecting them can be recognized. Notwithstanding what was stated above, human rights shall be proclaimed and the ontic norms protecting them, adequately recognized, shall be positivised, that is, acts of positive law shall introduce these norms into legal systems.

The leading motif in the Church’s teaching is the inborn and supernatural dignity of each human being that is the only and supreme moral norm. It is from this norm that human rights and other principles follow. The first and fundamental way of the Church is recognizing each human being’s dignity, and reminding: Respect the dignity and freedom of every human person! During the meetings of the OSCE the Holy See mainly promoted the right to freedom of conscience and of opinions in connection with all human rights. It postulated recognition of human rights as a principle of the international law. Overcoming the dispute concerning the contents of the concept of human rights was possible, among others, at the Vienna Conference. There it was said that all human rights follow from the dignity of the human person and from the human being’s inherent value; it was also stated that the human person is the main subject of human rights and fundamental freedoms, so he should be their main addressee and actively participate in the realization of the rights. In the document accepted at the Copenhagen Conference the human person was recognized as the supreme value that is the foundation of the inborn and inalienable human rights. Moreover, the contents of the concept of the right of man to freedom of conscience, to religious freedom and to freedom of opinions is contained in Art. 18 and 19 of the Universal Declaration of Human Rights and developed in the same articles of the International Convention for Personal and Liberation Rights. The human rights may be protected in democracy and in a law-governed state. John Paul II stressed that real democracy is possible in a law-governed state on the basis of the correct concept of the human person. The essence of democracy is respecting all the human rights.

New technologies, as autonomous vehicles are, disrupt the way people exist, and con-sequently with human rights. Research devoted to artificial intelligence and robotics moves freely and the destination, for the time being, is unknown. This is the reason why special attention should be paid to the ethics of these branches of computer science in order to prevent the creation of a crisis point, when human beings are no longer neces-sary.. The aim of this paper is to examine whether such development is a new challenge to human rights law and what happens when an autonomous vehicle drives an autono-mous human being. The paper also mentions the desirable level of human control over the machine so that human dignity, from which human rights originate, is preserved.

The Universal Declaration of Human Rights adopted in San Francisco stressed that human rights are indivisible and inalienable and that human dignity is inviolable. However, it continues to be a controversy over how human dignity can be manifested. In the Chinese history of ideas no evidence can be found to support the thesis that inalienable human rights stem from human nature. Since the 1970s human rights have been a subject of discussion in China. Previously, the human rights notion was characterized as an imperialist institution. While the western countries see in personal dignity consistency with the development of democracy and pluralism, China maintains that it is providing the conditions for existence that creates the universal dignity of human beings. Priority is given to the people’s rights to existence, development and well-being, which means that the most important thing is to provide the population with food, clothing and shelter. Human rights in China is one of the most explosive political themes in debates between the West and China. The more China opens up, the more political, economic and cultural contacts will be created, improving the prospects for democratisation and human rights situation in China.

The long progress towards universal human rights is regressing. This regression is pronounced within digital spaces once thought to be potential bulwarks of a new era in human rights. But on the contrary, new technologies have given rise to threats that undermine the autonomy, empathy, and dignity of human beings. Early visions of human rights being strengthened by networked technologies have instead crashed into technological realities which not only fail to advance human rights discourses, but rather serve to actively undermine fundamental human rights in countries around the world. The future of human rights is increasingly threatened by advances that would make George Orwell blush. Omnipresent data collection and algorithmic advances once promising a utopian world of efficiency and connection are deeply interwoven with challenges to anonymity, privacy, and security. This paper examines the impact of technological advances on the regression of human rights in digital spaces. The paper examines the development of human rights through changes in concepts of autonomy, empathy, and dignity, it charts their regression as technologies are used to increasingly prey on these very same characteristics that undergird human rights discourses.

The main scientific purpose of this article is to identify and analyse legal issues that arise between human rights and investment arbitration. At first glance, these two branches of public international law remain completely unrelated and do not have any significant features in common. However, it appears that despite this distinction, there is an interaction between investment arbitration and human rights, which implies a number of significant legal problems. These problems can possibly include the violation of human rights of citizens of the state hosting an investment by a foreign investor. On the other hand, a state can be unable to fulfil its legal obligations regarding human rights due to the necessity to protect foreign investment as agreed in investment treaties or, to the contrary, it may violate its contractual obligations towards an investor and afterwards defend itself throughout arbitration proceedings by stating that this violation has been necessary in order to protect human rights. It turns out that all parties to the dispute, both investors and host States – occasionally turn to human rights in order to reinforce their respective positions. The interaction between human rights and investment arbitration is of a very complex nature and although it is more and more often emphasized that it may occur, the situations in which this occurrence is likely to happen are not entirely clear yet. The author, after presenting some general remarks on the interaction between human rights and investment arbitration, discusses the most common scenarios in which human rights issues may appear in the course of investment arbitration proceedings. Finally, she concludes that there do exist some fields of interaction between human rights and investment arbitration as well as situations in which the conflict between them may appear. Identifying these conflicts would help to understand the complex relationship between the two legal regimes in question. It will also lay the foundation for further research on how to ensure the ultimate scope of human rights protection throughout the different stages of investment arbitration proceedings.
Głównym naukowym celem artykułu jest zidentyfikowanie oraz przeanalizowanie problemów prawnych powstających na styku praw człowieka oraz międzynarodowego arbitrażu inwestycyjnego. Choć wydaje się, że te dwie dziedziny prawa publicznego międzynarodowego pozostają całkowicie odrębne i nie posiadają żadnych elementów wspólnych, w pewnych przypadkach dochodzi między nimi do interakcji, co implikuje szereg problemów prawnych. Tytułem przykładu można wskazać sytuację inwestora, który narusza prawa człowieka mieszkańców państwa przyjmującego inwestycję. W innym scenariuszu to państwo przyjmujące może nie być w stanie skutecznie wypełnić swoich obowiązków w zakresie praw człowieka, z uwagi na wypełnianie zobowiązań wynikających z traktatów inwestycyjnych, bądź też przeciwnie – może złamać zobowiązania, jakie posiada względem inwestora zagranicznego, a następnie w toku postępowania arbitrażowego bronić się, wskazując, iż działania takie były podyktowane koniecznością ochrony praw człowieka w tym państwie. Obie strony konfliktów rozstrzyganych w arbitrażu inwestycyjnym – zarówno inwestorzy, jak i państwa przyjmujące – sporadycznie zatem podnoszą w toku postępowania arbitrażowego argumenty odnoszące się do praw człowieka. Interakcja praw człowieka i arbitrażu inwestycyjnego ma bardzo złożony i trudny do jednoznacznego zdefiniowania charakter i choć została ona już jakiś czas temu dostrzeżona przez przedstawicieli nauki, to jednak w dalszym ciągu sytuacje, w których może dochodzić do tej interakcji, nie zostały kompleksowo scharakteryzowane. Autorka, po zaprezentowaniu podstawowych zagadnień dotyczących natury interakcji zachodzącej pomiędzy arbitrażem inwestycyjnym a prawami człowieka, analizuje najbardziej typowe scenariusze, w jakich może dochodzić do podnoszenia argumentów dotyczących praw człowieka w toku postępowania arbitrażowego. W konkluzji stwierdza, że istnieją pewne punkty styczne pomiędzy omawianymi porządkami prawnymi, w pewnych sytuacjach pojawiają się ponadto między nimi trudne do rozstrzygnięcia konflikty. Identyfikacja tych konfliktów ułatwi zrozumienie złożonej relacji zachodzącej pomiędzy prawami człowieka a arbitrażem inwestycyjnym, a w dalszej konsekwencji – na zapewnienie optymalnego stopnia ochrony praw człowieka na różnych etapach postępowania arbitrażowego.

In classical way of thinking sovereignty is defined as a legal independence from any external factors and the competence, which allows to regulate of all relations within the state. However, such way of understanding of sovereignty, in recent years, is a subject of reinterpretation. One of the important determi-nants of this process was the development of ideas and international legal protection of human rights. The article, besides the introduction and recapitulation, consists of three main parts. In the first part, author showed the development of the international regime of human rights and norms protecting sovereignty, which took place after World War II. The second part of the article concerns the relationship between the principle of state sovereignty and human rights, considered in the context of humanitarian intervention. The last part describes the establishment and functioning of the International Criminal Court, perceived as an important factor, which affect the way of thinking about sovereignty.

In the article I attempt to problematize the recent canonization of Junípero Serra, a Franciscan missionary and founder of the California missions. Proposing that Serra’s legend should be seen as part of California’s “fantasy heritage” the article contrasts the rhetoric of the Church with the historical studies, which reveal a radically different image of Serra, than the one, as the Church held it, of a humanitarian defender of the Indians. Citing the arguments of the opponents to this canonization the article reassesses the question of Serra’s responsibility for the genocide of the California Indians, and drawing from Giorgio Agamben, proposes that it was precisely the missionary padre who is responsible for the dramatic Indigenous population drop in the state. It is in this context that the Human Rights implications of this canonization are assessed. Serra’s sainthood is revealed as the breach of UN norms and treaties and a rejection of the injunction to pursue interepistemic parity between cultures.

Our primary aim is to analyze the impacts of technology on people with disability. Persons with a disability can be encouraged to fully engage in society by using specific types of technology (medical devices that target particular limitations). Many experts argue that medical exoskeletons or wheelchairs with motorized stand-up function provide people with severe disabilities with new possibilities. Impact of these opportunities is enormous and they directly influence the quality of life. Philosophers Amartya Sen and Martha Nussbaum in their "capability approach" assume that any form of impact that enables a person to pursue what they deem as essential influences quality of their life. Similarly, Eva Feder Kittay (philosopher) argues that care for the elderly, disabled, or children is crucial for any society. These authors will provide a philosophical basis for our arguments for the enrichment of human rights through technology for persons with disabilities.

Opis:
Trafficking in human beings is one of the most serious transnational organized crime. Despite increased international efforts and resources from states and international organizations, the number of people falling victim to human trafficking worldwide continues to grow. Data on the prevalence of this crime show that the majority of its victims are women and girls – they account for 80% of victims. The above‑mentioned statistics justify the thesis that this form of human rights violation is gender‑determined and as such constitutes discrimination against women. The aim of the article to present and analyze sources of international and European law as a response of the international community to the trafficking in women in human rights perspective. To increase the effectiveness of legal instruments on preventing and combating the offence at issue, account should be taken of both the specificity of women as victims of trafficking and a victim‑centred approach to the human trafficking crime. Only then anti‑trafficking measures won’t adversely affect the human rights and dignity of those who have been trafficked.
