This article deals with problem of guilt and punishment in Anna Mostowska’s novel. Although the novelist emphasized amusement character of her works, her intention was to educate and sensibilize of reader. Mostowska’s authorship is an attemption of answering questions about point and source of suffering, justness of this one to honourable people; it includes also problems connected with destiny, guilt and punishment. In this article we can discuss this problems.

Opis:
Guilt, besides punishability and culpability, constitutes an element of the definition of a crime. Scientific literature broadly describes problems pertaining to the essence of guilt and it creates its definitions. However, there is no agreement in this respect and a few more important theories of guilt have been put forward. The 1997 code for the first time introduced the declaration of guilt and the solutions about guilt which principally differ from the previous ones. The Author of the present paper makes an attempt to get a closer look at the problem of guilt, its importance for penal liability as well as trying to point out which solutions concerning the perpetrator’s guilt have been adopted in the present code.

In seiner Untersuchungen, die einen Interdisziplinären Charakter haben, versucht der Verfasser das Schuldgefühl und das Sündenbewusstsein kritisch z behandeln. Die Untersuchungen gehen in zwei Richtungen, zunächst weis der Verfasser auf die wichtigste Elementen der analytischen Psychologie v. G. C. Jung hin, die mit dem Problem des Schuldgefühles eng verbunden sind, danach analisiert der Verfasser das Sündenbewusstsein im Lichte der Theologie. Die kritische Gegenstellung des Schuldgefühles und des Sündenbewusstseins ist sehr interessant dargestellt worden. Die Pastoraltheologische Schlussfolgerungen so wie auch die Pastoraltheologische Reflexionen schlissen die Untersuchungen.

By implementing a narrative analysis, the author tries to provide an answer to the question of what and how does Mathew the Evangelist say about the involvement, guilt, responsibility of pagans, and consequently about the perspectives of their salvation. Such a question seems particularly justified in reference to the Gospel according to Mathew, because – taking into consideration place, circumstances and time of editorial works – he found himself in a situation of being forced to face that problem and give his answer to the Church he himself represented as its future in the ethno-Christian and pagan world depended mostly on that answer.

The author attempts to identify the origins of the famous argument between Miłosz and Konwicki about the film adaptation of Dolina Issy. Konwicki created a film which, although it is an adaptation of the novel, clearly belongs to his own creative output, focused on axiological uncertainty after The Second World War. Konwicki’s work is a record of a quest for enduring points of reference, a quest conducted with realisation that such points cannot be found by a person who feels lost in the modern world. Such a world-view was not acceptable for Miłosz, and it is difficult to expect that the poet would accept an adaptation of his novel created from such a point of view.

When engaging in polemics with Pythagoras, Aristotle observed that the retributive function of punishment, as distinguished from the preventative one, does not involve revenge understood as material retaliation (i.e. suffering for suffering, meaning retaliation proportional to the damage suffered). It does not encompass a simple reciprocity, such as suffering in turn (ἀντιπάσχω), but instead shall be considered as a just reciprocity, meaning doing in return (ἀντιποιέω), whereby the degree of mental contribution is taken into account. The classical theory of responsibility, at least under the meaning assigned to it by Aristotle, considers human responsibility by means of reference to the mental capabilities of the actor in respect to the particular harmful action. An action involving human guilt is consequently contrasted with an accidentally caused action. In the works of Stagirite the mental attitude of the actor towards his action distinguishes human causation from the accidental one and from the forced one. Pythagoras, on the other hand, discussed material retaliation, meaning objective responsibility. At the same time, the author of Nicomachean Ethics had already experienced the system of subjective responsibility based on the concept of knowingly caused damage as opposed to the system of objective responsibility involving the objective causal relationship between actor’s behavior and the resulting damage. Aristotle has extended the concept of subjective responsibility to cover both knowingly caused damage (intentional fault) and unintentional fault, whereby the damage is directly caused by the negligent conduct of the actor, meaning the failure of the latter to observe required objective and abstract standards. The mental component and related to it subjectivization involve the actor possessing required intellectual capabilities, but not using them in a way as to observe the aforementioned imposed standards. Nonetheless, the potential mental component is itself not sufficient to establish guilt. Otherwise, all the people (apart from those lacking capacity at all) shall be declared guilty regardless of the fact that the damage was caused by them accidentally.

This paper contains a polemical analysis of the conception of forgiveness as presented by Paul Ricoeur in his book Memory, history, forgetting, where he defines forgiveness as a liberation of a person from his or her past deed. My main objection is that he mixes up philosophical and theological discourses, which makes his theory paradoxical and vague. I attempt to resolve antinomies of Ricoeur’s view and propose the conception that is based on entirely philosophical, rational argumentation. My principal purposes are, firstly, to present forgiveness as a merely human phenomenon that can be understood without referring to Transcendence and, secondly, to bring out the distinction between an act of forgiveness and a releasing from a punishment which belongs to the order of political institutions and law.

The article searches for the sources of guilt. It evokes Nietzsche’s notion of guilt as a derivative of unpaid mercantile debts. In opposition to this is Bouber’s socio-divine origin of fault. J. Tischner and J. Hołówka are also cited; they ascribe to guilt objective status. There is an important distinction between guilt and reconciliation, as well as a description of the possible contamination by guilt. The article also deals with Jasper's call to accept one’s own fault, otherwise there is a risk of trivialisation of life. The source of fault lies in relations between people and in the "point of holiness" mentioned by M. Blondel.

Dostoyevsky’s famous novel Crime and Punishment can be interpreted as an argument with Nietzsche’s view on the genealogy of conscience. While Nietzsche believes that conscience is a product of a disease and inhibits the will to power, Dostoevsky shows the situation of crossing the border as a source of moral illness and self-destruction of the human person. Crime and Punishment, as well as Dostoevsky’s novel Demons and The Trial of F. Kafka, also criticize modern and postmodern society, in which there is a strong trend, stimulated by psychoanalysis, to liberate people from guilt. With reference to Martin Buber’s views, the author of the article formulates a thesis on the ontological nature of guilt, treating its confession as a necessary act of self-enlightenment in conscience.Examining the structure of conscience in the context of guilt, a deeper level must be indicated, called synderesis in the scholastic tradition. Considering the elements of experience present in the experience of conscience, the author criticizes the intellectualist interpretation of synderesis. He takes into account the deep level of understanding of conscience in the category of heart made by D. v. Hildebrand and the anamnesis category of J. Ratzinger.

Opis:
The author analyzes the main problems in defining semantic, psychological and social dimensions of conscience. Starting with etymology and with the research of linguistic tradition he distinguishes causative fault and guilt. Internalisation of guilt is treated as the most important issue for morality. This issue essentially creates a major “knot” of morality, however, it points to the objectified, social sense of guilt. From the perspective of conscience guilt reveals and makes possible genuine morality and the chance to adapt human own guilt in view of their personal development and of preserving dignity. The perspectives of the conscience analysis distinguished in the article require a thorough examination and discussion.

This is an attempt of a mimetic interpretation of Acts 5:1‒11. The article juxtaposes the narrative of Ananias and Sapphira with the story of the sudden death of Nadab and Abihu from Lev 10:1‒7. The Author argues that apart from situational resemblance, both passages are similar on a deeper level: they are set at the beginning of new orders. Ananias and Sapphira are Adam and Eve of the early Christian community and like them violate their marital unity. Since marriage has become a symbol of Christ’s faithful and loving relationship to humanity, the couple’s treacherous connivance constitutes the ‘original sin’ of Christianity. Nevertheless, as a sacrificial text, Acts 5:1‒11 has had a negative influence on Christian religiosity.
Autorka podejmuje próbę mimetycznej interpretacji Dz 5,1‒11. W artykule opowiadanie o Ananiaszu i Safirze zostaje zestawione z historią nagłej śmierci Nadaba i Abihu z Kpł 10,1‒7. Autorka stwierdza, że poza sytuacyjnym podobieństwem oba teksty są podobne na głębszym poziomie: umiejscowione są u zarania nowego porządku. Ananiasz i Safira tworzą Adama i Ewę wczesnochrześcijańskiej wspólnoty i podobnie jak oni niszczą małżeńską jedność. Ze względu na to, że małżeństwo stało się symbolem wiernej, miłosnej relacji Chrystusa do ludzkości, oszukańcze współdziałanie pary małżeńskiej z Dz 5,1‒11 stanowi „grzech pierworodny” chrześcijaństwa. Tym niemniej, jako ofiarniczy tekst, Dz 5,1‒11 wywarł negatywny wpływ na chrześcijańską religijność.

In einer gängigen Interpretation des Romans „Die Brüder Karamasow” wird die Verantwortung für den Vatermord in unterschiedliche Komponenten zerlegt, deren jede in der Gestalt eines der vier Brüder allegorisch auskomponiert sei. Die „Komponente Smerdjakow” liege dabei als bloße physische Ausführung des Verbrechens außerhalb der Sphäre ethischer Betrachtung. Damit wird Smerdjakow aber noch in der Interpretation einmal mehr in seinem Menschsein verkannt. Eine durch Girard geschulte Lektüre zeigt hingegen, wie gekonnt Dostojewskij – ob intuitiv oder mit Absicht – diesen Charakter mit Kriterien der Opferselektion ausstattet und ihn so der Leserschaft als Sündenbock regelrecht anbietet.
In a common interpretation of Dostoyevsky’s The Brothers Karamasov, Dmitri Karamasov is held guilty of murdering his father in a moral sense, while the character of Smerdyakov is put beyond the range of ethic consideration as he is seen as an allegory of the merely executing factor of the act of violence. Hence, his suicide is read as a proof that the evil itself doesn’t take over responsibility; in face of the accusation it fades away, leaving the charge of responsibility to the human moral subject. Dostoyevsky, however, seems not wanting to stress such a kind of moral hero that, in this interpretation, could be seen in Dmitri. With introducing Alexey in his preamble, he is in fact presenting us a „weak” hero, leading us to another understanding of the story. Yet Alexey is still not the weakest. It is Smerdyakov. What this article pleads for is that Smerdyakov is systematically made a scapegoat, as Dostoyevsky is illustrating in several pertinent scenes. It is only coherent that interpreters, while completely ignoring this fact, continue this scapegoating in dehumanising him by taking off him of all ethic consideration, reducing him to a personification of a merely mechanic component. By contrast, this is an apology for Smerdyakov as a human being. And as a son of Fyodor and brother of Alexey, Dmitri and Ivan.
