The freedom of media can be understood in different ways. One can speak of the freedom of media as an institution, connoting that there is an absence of any dependence of media on the legal and economic pressures. Secondly, the freedom of media can be understood as belonging to individual entities participating in media as such, their relationships and dependencies, and above all, the scope of their respective independence. Thirdly, the freedom of media can be understood as a rejection of any restrictions of ideological, philosophical, religious or moral character. In the last case, the discussion about the freedom of media is closely associated with the general, philosophical discussion about the limits and criteria of freedoms. Fourthly and finally, the freedom of media can be discussed in the context of various risks that the abuse of this freedom might create not only for an individual, but also for the society. In this article, I am going to discuss the freedom of media as it is understood under the last three definitions given above.

First of all, it seems appropriate to distinguish between the two freedoms: that of the thought and the speech. For the purposes of the current analysis, I would suggest that the following definitions of these two types of freedoms are adopted: the freedom of speech is an unencumbered right to express one’s views on a public forum, whereas the freedom of thought is an unencumbered right to hold such views. The term “views” shall encompass all kinds of judgments, assessments and standards, etc. Both of these freedoms are regularly treated together (when considered under the common slogan of “freedom of speech and conscience”). This approach, however, does not always seem to be right, since the scope of and the type of interaction between the freedom of speech and the freedom of thought turns out to be much more complex than it is generally believed.

The freedom, in Latin libertas, is the object of philosophical reflection since Plato. Yet as the determined philosophical direction it took the form of the „liberalism” on the turning point of the sixteenth and seventeenth century, represented by two philosophers: Thomas Hobbes (1588–1679) and Jean-Jacques Rousseau (1712–1778). Among contemporary scholars Isaiah Berlin is standing out. From his point of view the philosophical problem of the freedom should be examined in two aspects: the negative freedom i.e. the attribute of not hindered freedom in making choices and the positive freedom as opportunity of being the master of one’s own fate. The author of the article, after critical demonstrating the conception of liberalism, sketches the theory of freedom from the position of Christian ethics. As a starting point he takes the conception of man as a person whose rational activities take on the form of twofold freedom of choice. In the psychological aspect, this freedom assumes the ambivalent form of doing good or evil, however in the moral aspect it turns out to be freedom put in order by the hierarchy of objective moral values. In this meaning the freedom also organizes the whole free man's activity and becomes creative strength of his moral personal perfection. It also defines the crucial sense of Christian philosophical science of truth about freedom.

Reflection on human freedom will remain a constant motive for reflection in moral theology. Without freedom, there is no human act, so there is no morality in the strict sense of the term “freedom”. That is why it is worth returning to the issue of freedom, but taking into account new ways of understanding it. Freedom will remain a current problem in the struggle of man for good, especially in social life. For Christian thought on this subject, the encyclical of John Paul II Veritatis splendor will remain relevant – read it again.

The author analyses the problem of freedom of science and art that are integral elements of intellectual culture. Although the Church has always been an inspirer and patron of culture, there have been controversies between this institution and scientists (the cases of Galileo and Copernicus, the Darwinian theory of evolution). Liberalism rightly propagates the idea of freedom of culture but it minimises the role of truth that is the leading value in culture. Totalitarian systems (Hitlerism, Communism) questioned the value of culture and practically destroyed it. Documents of the Vatican Council II and Pope John Paul II's teaching allow formulation of three fundamental paradigms of personalism: 1. Science and culture require freedom in social life (which is confirmed by the pluralism of branches of science and culture currents). 2. Development of authentic culture requires moral righteousness and responsibility from the scientist and one who creates culture. 3. The good of a human person (of his biological and spiritual life) and the society's common good (protection of its integrity and ethos) sometimes require limitation of research freedom that should be regulated by the law (e.g. in genetic engineering).

The author of the article struggles with a paradox: the post-modern age which views itself as pluralistic nonetheless appears to yearn for upbringing. At the beginning of XXI century, the dissonance between human development, full participation in a wide range of spiritual culture and a tendency to strictly technical education, oriented mainly on efficiency and profits appears in a full range. In this context it is important to educate young people in the responsible use of the gift of freedom. The author of this article presents freedom as a characteristic sign of youth education in the present century. He also shows the pluralism of values and upbringing aimed towards freedom. The author also underlines the Christian approach to freedom, understood as both a gift and a task received from God. Pedagogy of freedom is not a question of transmitting human knowledge, even of the highest kind; it is rather a question of responsibly communicating with God and people. God Himself used a pedagogy that must continue to be a model for the pedagogy of freedom.

In Poland, the way to make the constitutional basis of freedom of speech and freedom of the media opened up with breakthrough systemic taking place in 1989. Today it is sanctioned under the Constitution of 1997 (article 14 expresses the freedom of media and article 54 regulates freedom of expression) and a matter of law on the National Council of Radio and Television. The need for free media market, free flow of information and opinions and the need to protect it with a functioning system of judicial instruments – domestic and international – is now the standard functioning of democratic states. If what is more free speech – mainly implemented by means of mass communication is a real value and perform proper function in society – the mass media must be able to operate without restrictions or influence by external actors. Only then they will be able to inform the public about the socio-political events in the most objective way. Everyone has the right to express their thoughts, whether in private life, whether in public life. In addition, each sentence of the people must be respected, even if someone disagrees with him. This rule is reflected not only in Polish law (both in terms of the Constitution and ordinary laws) but also in the program documents, demands and actions of all major Polish political scene at the party. On the basis of the current legal regulations, political parties have the ability to access public radio and television, which have an impact on the implementation of the constitutional right of freedom of expression in practice. For this example, an object of study focused on two levels of analysis, in relation to the p arliamentary elections of 2011 and in the context of political ideology. The analysis of empirical data on two key issues: the use of freedom of speech by the media in Poland and protection of the constitutional right of free speech by the Polish political parties.

In this paper free volitions are construed as a subclass of reflective judgements in the Kantian meaning, i.e. judgements not involving any fixed concepts but displaying a concept-like form. Judgements expressing volitions and issuing in action may be termed volitional judgements, therefore free volitions are construed as reflective volitional judgements. Due to an element of conceptual novelty and the fact that in a reflective judgement volition gets conceptually fixed out of an unstable equilibrium between different conceptualizations, free volitions thus construed seem to be apt candidates for causally undetermined events.

Przedmiotem artykułu jest analiza polskich źródeł prawa w zakresie wolności religijnej. Autor zaczyna od stwierdzenia, że pierwszym i najważniejszym dokumentem prawnym, dokonującym przełomu w ochronie wolności wyznawania religii chrześcijańskiej, był edykt mediolański z 313 roku cesarza Konstantyna. Analiza historyczna w zakresie ochrony wolności religijnej prowadzona była dalej poprzez czasy średniowiecza, oświecenia aż po czasy współczesne. Dokumentami prawnymi poddanymi analizie były przede wszystkim unormowania konstytucyjne i ustawa z 1989 roku o gwarancjach wolności sumienia i wyznania, która uszczegółowia materię wyznaniową, dookreślając ją i konkretyzując.
The subject of this article is an analysis of Polish origins of law on freedom of religion. An author begins his article by saying that the first and most important legal document, which breaks through in protection of the freedom to profess the Christian religion, was the Edict of Milan of 313 of emperor Constantine. Historical analysis for the protection of freedom of religion was carried further, by the author, through the Middle Ages, the Enlightenment to modern times. Legal documents that were analysed were mostly the constitutional norms and the Law on the guarantees of freedom of conscience and confession of 1989, which describes in detail the religious matter, determining and specifying it.

„Wolność twórczości” należy do pojęć intuicyjnych, wymykających się próbom definiowania. Dlatego autor proponuje rezygnację stworzenia definicji „wolności twórczej” na gruncie nauk prawnych. Wskazuje natomiast konstytutywne cechy aktywności twórczej człowieka. Są nimi: „nowość” i „energia umysłowa” zużyta na stworzenie nowego przedmiotu niematerialnego. Autor wskazuje także cechy charakteryzujące człowieka twórczego. O wolności można mówić w kontekście aktywności artystycznej i pozaartystycznej człowieka.  Wolność twórczości nie jest nieograniczona. W praktyce istnieją granice pozaprawne i granice wyznaczone w normach prawnych. Te ostatnie zostały wyznaczone głównie w Konstytucji RP, prawie autorskim, prawie własności przemysłowej, kodeksie cywilnym i kodeksie karnym.
“Creative freedom” belongs to intuitive notions, beyond the attempts to define. Therefore, the author proposes to give up the creation of definition for “creative freedom” within the law . However, he points out constitutive features of human creative activity. They are: “newness” and “mental energy” used for the creation of a new immaterial object. The author indicates the features characterising a creative man also. It is possible to speak about the freedom in the context of human artistic and out of artistic activity. Creative freedom is unlimited .In practice there are the boundaries extralegal and the boundaries defined by the legal norms. The latter were drawn mainly in the RP Constitution, in the copyright law, industrial property law, civil code and penal code.

I examine three accounts of divine freedom. I argue that two recent accounts which attempt to explain God’s freedom without appealing to alternative possibilities fail. I then show how a view of divine freedom based on Robert Adams’s idea that God’s grace means he has no obligation to create the best world is able to explain how God can be free while also being perfectly good and perfectly rational.
W artykule przeprowadzam analizę trzech ujęć Bożej wolności. Staram się wykazać, że dwa teoretyczne ujęcia, które pojawiły się ostatnio i które próbują wyjaśnić Bożą wolność, nie odwołując się do koncepcji alternatywnych możliwości, nie osiągają postawionego sobie celu. Następnie pokazuję, w jaki sposób wizja Bożej wolności oparta na idei Roberta Adamsa, że Boża łaska oznacza, iż nie jest on zobligowany, by koniecznie stwarzać najlepszy z możliwych światów, jest zdolna wyjaśnić, w jaki sposób Bóg może być wolny, a zarazem doskonale dobry i rozumny.

The focus of this article is to examine the notion of freedom, and more precisely freedom of speech, in the light of The People vs. Larry Flynt. The analysis will pay close attention to what has always been a central concern of American society constituting one of the basic principles on which the new nation was founded. What is more, the article will try to indicate that freedom of speech has been as essential as controversial in many respects, which is proven by numerous examples from American history. As a baseline of this study I have chosen Larry Flynt, whose life and legal battles form the central theme of the selected biopic. The article will scrutinize the plot of the movie, as it provides interesting insights into the life of this controversial advocate of freedom of speech. Flynt made himself well-known, if not notorious, by being the focal point of countless debates that concerned moral issues, public taste, and two basic rights guaranteed by the Declaration of Independence and the First Amendment. Ultimately, the article will try to challenge the concept of a society based on the notion of freedom of speech by asking and trying to answer three questions: What precisely is freedom of speech? Is freedom of speech absolute? Are there any limits of expression and if so, then where to draw the line?

The text considers two metaphors describing creative freedom in modern society: secretiveness and shadow. In the shadow, creative individuals protect themselves against the ubiquitous need to explain and screen life. The text proves that contemporary literature (Sebald, Quinard) and essay (Vuarnet, Maffesoli) search inspiration in secretiveness and shadow while at the same time they see a threat to art in the mechanism of explanation.

This article critically analyses European jurisprudence to ascertain the extent to which the right to freedom of religion has been interpreted as a right of religion to internal autonomy. It asserts that women are being denied an effective right to freedom of religion insofar as they are unable to directly influence the content or structure of their religion. It argues that to fulfil women's equal right to freedom of religion, women's power and position within religion must be equivalent to men's. It therefore asserts that an intrinsic part of States' obligation to secure the right to freedom of religion is the facilitation of gender equality within religion. The article culminates by proposing proportionate and appropriate methods to facilitate gender equality within religion.

In pursuing any kind of scientific activity, we pose a certain problems, and seek solution of them by various methods; as a result, we form our own judgements on the matter to which the given problem pertained, and finally make public this judgement, which is a solution of the problem posed, in conjunction with the relevant evidence. Freedom to pursue science thus requires freedom in each of the four fields mentioned above; that is the individual pursuing scientific activity must enjoy freedom to choose problems, freedom to choose a method, i.e., the means whereby he/she solves his/her problems, freedom of thought, and freedom of speech. Kazimierz Ajdukiewicz (1890–1963), a philosopher of science analyses here all these four “freedoms”, as well as considers both the extent to which each of them is indispensable to the successful advance of science and the extent to which a limitation on them can be justified on other grounds.

The subject of this article is the analysis of selected institutional activities, including drafts of legislative initiatives and social actions that took place between 2018 and 2020 at Polish universities (and outside of them). Its goal is to define what can be expressed, who is entitled to speak within the academic realm and what can be said by an academic teacher or scientist during a public debate. These social actions and legislative initiatives are discussed in the broader context of activities of social movements having a clear ideological face (either left- or right-wing), protests against lectures, debates organised at universities that were labelled as “ideological”, as well as projects intended to promote specific visions of academic freedom along with corresponding regulations for universities.

The most important issue of this paper is contained mostly, though vaguely, in the title. What is agenda-setting and how it is related with freedom of speech domain? In further part I will try to present those, theoretically distant problems. I will also try to present how political and business organizations can affect on daily agenda, so in fact how thy can create access to free speech. There are some situations in mass media world, when those practices can be considered as internal or external censorship. In this paper I specific cases, all selected from American political and media systems. I think that US system is full of contradictions, from law confl icts (state vs federal law, First Amendment), owners of mass media competition (corporations, FCC) and finally state controlled media on the contrary to free speech (censorship).

For the first time, Karl Loewenstein had used the category of militant democracy concerning the Weimar Republic. Although the world’s situation has changed, the process of political systems taking over non-democratic regimes’ characteristics is still visible. Among the indicators that can testify to becoming militant democracy, the restriction of freedom of the press is distinguished. This article attempts to analyze the dynamics of this process in Lithuania based on the Freedom House reports. The research question formulated is: What restrictions on the press’s freedom in Lithuania occurred in the period? The hypothesis is: In 2008-2019 in Lithuania, there has been a regular restriction on the freedom of the press, which may indicate a progressive process of militant democracy. Results: The hypothesis has been partially verified positively. During the period considered, there were regular restrictions on the freedom of the press but were justified mainly by circumstances, or immediate counter-action was taken.

In Economics, the Impossible Trinity of free capital movement, an independent monetary policy and a stable foreign exchange rate is well known. There is a similar, though less explored trilemma in modern governance operating with more basic concepts: that of security, freedom and privacy. The aim of the study is to clarify this latter trilemma, as well as to offer a theoretical long-term solution. After expounding the general nature of trilemmas and the three main concepts, the impossible trinity of security, freedom and privacy is examined by taking three extreme scenarios. The scenarios are based on partially hypothetical situations in developed countries, where encryption debates or terrorist attacks took place recently. The study then turns to the solution of the situation. In order to understand the origin of the problem, it takes a step back to the dilemma of security and freedom. The fourth important concept the study operates with is transparency. The study suggests increasing transparency. A mathematical projection of the scenarios is introduced, and the suggested solution is derived in an equation as well.

These days, economic growth is very important for all countries and this article will discuss the main factors associated with this problem and propose some possible solutions which can be implemented. The importance and relationship of foreign direct investment, economic growth and economic freedom are presented and evaluated by considering literature, and a long run relationship between foreign direct investment and economic freedom in Turkey is empirically analysed in the article. The time period covers the years 1996 to 2018. The data has been obtained from the World Bank and from theHeritage Foundation database. The analysis is based on the time series analysis. An Augmented Dickey-Fuller test hasindicated that the variables are not stationary at levels, but they are stationary at the first difference. The Johansen test hasshown that variables are co-integrated, which means that they move together in the long run.

Zgodnie z art. 65 ust. 1 Konstytucji RP każdemu zapewnia się wolność wyboru i wykonywania zawodu oraz wyboru miejsca pracy. Wpływ wyrażonej we wskazanym przepisie wolności pracy na swobodę kształtowania umownych stosunków pracy jest wciąż otwartym polem do dyskusji prawniczej. W prezentowanym tekście autorzy zmierzają do rozstrzygnięcia, czy zasada wolności pracy może zostać uznana za przesłankę ograniczającą swobodę kontraktowania. Zagadnienie to, mające charakter dogmatyczny, poddane zostało analizie systemowej. Autorzy przyjmują, że z perspektywy stosunków prywatnoprawnych wolność pracy należy ujmować jako element obiektywnego, preferowanego porządku wartości społeczno-gospodarczych (zasad współżycia społecznego). Aplikacyjne znaczenie sformułowanej tezy wyjaśniono na przykładzie zastrzeżenia kary umownej zabezpieczającej wykonanie obowiązków umownych ograniczających wolność pracy.
According to the article 65.1 of polish Constitution, everyone shall have the freedom to choose and to pursue his occupation and to choose his place of work. The impact of the freedom of work on the freedom of contract is still a subject of doctrinal discussion. In the presented text, the authors try to decide whether the principle of freedom of work can be considered a restriction of the freedom of contracts. This dogmatic issue has been subject to a systemic analysis. The authors assume that from the perspective of private-law relations, the freedom of work should be understood as an element of the objective, preferred order of socio-economic values (principles of community coexistence). The presented thesis is explained on the example of a contractual penalty securing a contractual restriction on the freedom of work.

Throughout history, mankind has been inclined to use an increasingly advanced technology to enhance communication skills between them. Communication already represents a need as essential as it is considered one of the funda-mental human rights. This right of communication today translates, among others, as the right to freedom of expression, as well as the right to infor-mation. These rights are provided in the highest acts such as the Universal Declaration of Human Rights, the European Convention on Human Rights, the Constitution of the Republic of Albania as well as other laws or bylaws issued on the basis and implementation of the Constitution. The human right to express oneself, to be informed and at the same time to preserve privacy, is developing along with the great boom that has taken place in the development of communication technology, in an increasingly connected world, so much so that to look like a global village, where information spreads very quickly. The evolution that has taken place with the development of information technology and related digital communications in recent years has changed the communication practices around the world. But in addition to this, the legislation that regulates this field has undergone constant changes, due to the fact of direct implication for human rights.

In its analysis of human freedom, Józef Tischner’s philosophy poses fundamental questions about the essence of freedom, but also about the sense of preservation of freedom in one’s life. Freedom appears as a primary phenomenon, something that is part and parcel of human nature. Freedom as a structural element of human existence manifests itself perhaps most clearly in the sphere of human relations, which, immersed as they are in the eternal drama of good and evil, are played out in the space between salvation and damnation. The binary character of values, best seen in our use of freedom, keeps us for ever mindful of that unavoidable drama a man has to face, owing to his freedom, need not be helpless.Using such categories as election, space and health of the soul in his Rekolekcje Paryskie, Tischner approaches the definition of freedom through a succession of essential modifications which articulate some fundamental points concerning relations between people and man’s relations with God from an anthropological, axiological, ethical, social and theological perspective. Tischner proposes no definitive interpretation of freedom but, viewing the controversy over freedom as one of the most difficult problems in the philosophy of man, he tries to show what man’s inner freedom consists in and what achievements it makes man capable of.

Das Ziel des Artikels ist der Versuch einer eigenen ontologischen Analyse des Begriffs der politischen Freiheit unter Anwendung der Erkenntnisse und Betrachtungsweisen des Begriffs Freiheit (moralische und politische, negative und positive Freiheit) auf dem Boden der Philosophiegeschichte. Ich rekurriere unter anderem auf drei bekannte Entwürfe: 1. die Unterscheidung zwischen negativer und positiver politischer Freiheit (positive and negative liberty) von Isaiah Berlin; 2) historische Analysen von Hannah Arendt, die zwischen politischer Freiheit und Willensfreiheit (moralischer Wert) unterscheiden; 3) Nicolai Hartmanns Kritik des Kantischen Verständnisses der Freiheit als positiver Freiheit und seine eigenen Analysen der moralischen Freiheit als Phänomen des geistigen Lebens des Menschen. Zum Abschluss werden die  durchgeführten  Analysen zur  Begründung der These verwendet, dass Menschenrechte erster Generation eine Möglichkeitsbedingung der moralischen Freiheit des Menschen bilden.
The paper is an attempt at ontological analysis of the notion of political freedom taking account of studies and perceptions of moral and political, negative and positive liberties in  the history of philosophy.  Reference is  made in particular to Isaiah Berlin’s  distinction   between  positive and negative political freedom, Hannah Arendt’s historical analysis of the differentiations between the notion of political liberty and free will (moral freedom), and Nicolai Hartmann's criticism of Kant’s perception of liberty as positive freedom and his analyses of moral freedom seen as a phenomenon of man’s spiritual life. On the ground of these analyses the author substantiates  the thesis  that  first generation  human rights constitute the basic prerequisites of man’s moral freedom.
Celem artykułu jest próba własnej ontologicznej analizy pojęcia wolności politycznej z wykorzystaniem rozpoznań i sposobów rozumienia pojęcia wolności (moralnej i politycznej, negatywnej i pozytywnej) na gruncie historii filozofii. Odwołuję się między innymi do trzech znanych koncepcji: 1) Isaiaha Berlina rozróżnienia pomiędzy negatywną i pozytywną wolnością polityczną (positive and negative liberty); 2) Hannah Arendt historycznych analiz związanych z rozróżnieniem między wolnością polityczną i wolnością woli (wolnością moralną); 3) Nicolaia Hartmanna krytyki Kantowskiego sposobu rozumienia wolności jako wolności pozytywnej oraz jego własnych analiz wolności moralnej jako fenomenu duchowego życia człowieka. Na koniec próbuję wykorzystać przeprowadzone analizy do uzasadnienia tezy, że prawa człowieka pierwszej generacji stanowią warunek możliwości wolności moralnej człowieka.

This paper examines the two terms 'state' and 'freedom' in the work of F. W. J. Schelling. It will be argued that, although Schelling refuses the general role of state, criticizing it as 'mechanism', he accepts the fact that the state is the only guarantor - considered as 'second nature' – to restore the 'lost unit', to secure the freedom of men and to realize a 'Höheres Lebens'. For this purpose, Schelling uses powerful metaphors of the state as 'organism' and 'artwork', postulating his ideal of a political community.

Ancient philosophy distinguished three meanings of the notion of freedom: an individual man's freedom of choice and decision, freedom of social-political life and freedom (sovereignty) of the state. This latter meaning was considered the most important form of freedom. In his conception of an “ideal state” Plato advised abolition of private property and monogamy for the political élite (the so called “guards”), which is a feature of a totalitarian state. He distinguished three models of state: monarchic, aristocratic and democratic. He accepted the latter model, but he warned against maximising individual freedom, as it leads to anarchy in social life, which in turn is a source of tyranny. Aristotle appreciated democracy more, as it best puts into effect the postulates of freedom, equality and justice. The other form of freedom, according to his approach, is freedom understood as enabling a man to choose rationally, which should be preceded by reflection. His conception of man's existential freedom (proaíresis) is close to the theory of free will (liberum arbitrium) in the Christian thought. The Stoics concentrated their attention on inner-moral freedom that they identified with the attitude of keeping a distance to man's existential vicissitudes. Some of them (Marcus Aurelius) joined the idea of inner freedom with philosophy of naturalistic pantheism, others (Epictetus) considered God as the source of moral freedom. Plotinus was also mainly interested in man's inner freedom, which he explained in the context of the pantheistic conception of the absolute.

Freedom manifests itself in many areas of social life as a necessary development factor. In economics, freedom is key to ensuring the basic principles of trade and business. In politics, freedom is unfettered exchange of ideas and actions, leading to the best choices authority and directions of social change. Freedom is also necessary for human development, in which individuals realize their life goals and aspirations. The aim of the article is to present the results of research on the impact of freedom on the main areas of social life. It turns out that freedom is a necessary factor of socio-economic development that mobilizes individuals to act. On the other hand, the comprehensive process of socioeconomic development is in essence a process of expanding freedom.

In the philosophy of liberalism, freedom of speech is one of the fundamental rights of the individual, one that is guaranteed by the constitution of a liberal democratic state. Contemporary Western democracies are based on the political culture in which human rights, including the right to free speech, play an important role. This right, however, can be violated by demagogic propaganda both in totalitarian regimes and in democracies. The propaganda mechanism, reaching into the sphere of community values and concepts, presently operates also through the Internet, in which expressions of anger and hatred are disseminated and can lead to the destruction of democracy. I will argue that, in today’s world, restrictions on the freedom of speech through legal norms are necessary, because the threat comes not only in the form of censorship, but also the manipulation techniques used by politicians in democratic regimes. Advances in modern technology can be of service to dictatorship when the media and the Internet are used for propaganda or surveillance purposes, but they also provide a support to freedom and democracy when they serve as the means of the transmission of reliable information, initiating public discussions. As such, they establish a framework for rational debates and peaceful activities that contribute to the maintenance of the democratic political culture. The basic elements of this culture, i.e. legal rules, pluralist media, and education systems are all necessary for the defence of its core value, namely the freedom of speech.

Patočka´s and Rorty´s philosophy offer a foundation for the reconstruction of liberalism and a possibility of fulfilling individual´s freedom. Patočka intends to assess the value of transcendence and its relevance to life. He tries to save the metaphysics for it does not need to become necessarily dogmatic. Contemporary people may find Patočka´s reflections on freedom beneficial. Patočka invites people to connect their spirituality with skepticism and modesty, and according to Socratic knowing of unknowing, along with humility which makes man non-dogmatically open to transcendence. In the reflections on man, Rorty holds to moral responsibility and tries to bring man to self-awareness and taking responsibility for his acting, because it is only man who disposes of unique possibilities and abilities to shape his own authentic way of life. Rorty´s concept of freedom as an accidental phenomenon is based on the concept of history of Western philosophy and is closely linked with the problem of metaphysics and truth. Despite timeless reflections of both philosophers, any timeless ideal of human freedom is determined by the context in which we are thinking.

This essay diagnoses the condition of contemporary liberal democracies. It assumes that the current crisis of democracy is not the result of an external ideological threat, but it is the result of the lack of a coherent vision of democracy itself. The author recognises that the key symptom of the contemporary crisis is the decreasing involvement of citizens in public life and their growing reluctance to participate in public debate. He claims that the reason for this is the increasing social polarisation. The article considers two forms of polarisation: vertical (on the line: politicians–voters) and horizontal (on the line of ideological social divisions). The first form is illustrated by Colin Crouch’s considerations, while the second one by Fareed Zakaria’s thoughts. What finds its manifestation in both cases is the phenomenon of citizens’ resignation from participation in the public debate; in the first case it is because of the lack of faith in the effectiveness of this type of opiniongiving mechanism, while in the second case it is because of the lack of recognition of other political and ideological options in society. These reflections are concluded in the postulate that the basic task facing democracy today is to maintain the public sphere as open as possible, i.e. not excluding any ideological position in advance. This kind of conclusion is illustrated with the concepts of Chantal Mouffe (political perspective) and Helmuth Plessner (philosophical-anthropological perspective).

Następnie – charakteryzując prawo do wolności sumienia w Europie wobec aktualnych wyzwań – dokonuje rozróżnienia między wolnością sumienia a prawem, jakie tę wolność chroni. Zauważa, że w Europie, w której prawnie chroniona jest wolność słowa, sumienia i wyznania, dochodzi do naruszenia prawa, zwłaszcza w stosunku do przedstawicieli religii chrześcijańskiej, w tym w szczególności względem katolików.
The author at the beginning of the article describes the genesis of freedom of speech, conscience and religion, and also defines the freedom of conscience. Then – characterizing the right to freedom of conscience in Europe in the face of current challenges – he makes a distinction between the freedom of conscience and the law that protects it. He points out that in Europe in which freedom of speech, conscience and religion is legally protected, there is a violation of the law, especially towards representatives of the Christian religion, in particular against Catholics.

The author takes up the question of the freedom in the moral and sociopolitical context. She distinguishes, besides the freedom “from” and “to”, the outside freedom and the inner freedom. The first is to determine by conditions in which the man is functioning. The second has basis in human psyche. Political system, including the democracy, should guarantee the outside freedom. The sphere of the inner freedom, in which among others the morality is realizing, cannot be limited or imposed by the state and its the laws. Democracy, which the law is a product of the majority not always of conscious people, not enough protect the outside freedom, as well as is often a threat for the inner freedom.
Автор поднимает вопрос свободы в нравственном и социально-политичном контексте. Кроме свободы «от» и «до» она отличает свободу вну-треннюю и внешнюю. Первая определяется условиями, в которых человек функционирует. Вторая основывается на его психике. Политический строй, в том числе демократия, должны гарантировать внешнюю свободу человека. Сфера внутренней свободы, в которой реализуется, между прочим, нравственность, не может быть ни ограничена, ни навязана государством и его законами. Демократия, чьи законы производятся большинством, не всегда сознательных людей, не гарантируют достаточным образом внешнюю свободу, и часто бывают угрозой для внутренней свободы.

The meaning of the concept of freedom has constantly changed in history. In Ancient Greece, freedom referred to making a choice and doing something willingly; Hannah Arendt conceptualized it as a necessary discovery made by people in historical periods when the conditions for manifesting the idea of searching the same concept within oneself as an action were insufficient. Today, the concept of freedom has evolved into a dual meaning as negative and positive, shaped by the expressions of Isaiah Berlin. In this sense, the freedoms that we call classical freedoms, which the individual acquires because of being human, without considering the differences in religion, language, gender, and race, are evaluated in the context of negative freedoms. The basis of this understanding is the absence of pressure and coercion from the environment in which the individual lives rather than the creation of surplus value in the individual by external influence. However, with the deterioration of the freedom concept, the gains included in negative freedom have become a problem that the state needs to solve. The need for state intervention in creating a positive effect on the individual has emerged. The concept of positive freedom that emerged in this sense reveals itself in a structure that requires more than the intervention of others; it requires that individuals have control over their selves and that they have an active role in this dominance. Proponents of positive freedom argue that freedom means the individual dominates their own passions, desires, and all obstacles to self-realization. In order to achieve this, the state must firmly stand by the individual regarding collective freedoms. In this context, since the discussions on the concept of rights and freedoms in Turkey spread to negative and positive areas of freedom, this paper aims to show that presenting the concept with a single definition of freedom would be challenging. The re-reading has shown that the rights and freedoms in Turkey are derived from the concept of both positive and negative individual rights. However, it has been observed that the framers of the Constitution limited the fundamental rights and freedoms based on the idea that there should be a limit to the individual’s rights and covered it in the necessary sections in the Constitution to ensure that the fundamental rights and freedoms could not be abused.

A political thought is an area of legitimate contribution of competitive ideas. Liberalism is often considered as one of the most significant and influential paradigm of our times. The common acceptance of liberal conception of negative liberty can be acknowledged as a proof of this tendency. At the same time clearly visible is the renaissance of republicanism and the conception of active participation in governance. The liberal and republican assumptions have similar roots but different social practices. The aim of this paper is to examine in contrast liberal and republican conceptions of freedom. The author discusses main categories of both political traditions: state, commonwealth, common good, citizen, individualism, law, limited power and freedom itself. The author attempts to compere republicanism and liberalism as the competitive political paradigms to show the dilemmas of modern states and societies where there is no common consensus referring to definition of liberty.

Freedom from fear is one of the four freedoms (along with freedom of speech, freedom of religion, freedom from want) that President Franklin D. Roosevelt presented first to the US Congress on 6 January 1941, and later to the entire world in the fight against Germany, Italy and Japan. They covered all areas of human life, guaranteeing security in the private and family spheres, in public life and in relations with other people and, above all, with any authority (especially the State). These freedoms became the basis of the human rights enshrined in the Universal Declaration of Human Rights, proclaimed on 10 December 1948, and other national and international documents. Freedom from fear has become a symbol of the protection of human rights and a guarantee of a safe life for every person everywhere in the world. The vast majority of conflicts in the world originate within national borders and their main victims are innocent civilians. States have a primary duty to protect everyone. They must create strong security instruments to prevent a repetition of the crimes of the Second World War. The quest for universal and individual security is constantly intertwined with new threats that grow with the development of civilisation, in particular through the evolution of technology and information. Today, we are also confronted with various aggressors - bandit states, cruel terrorists and populist governments on the verge of enslavement and incitement to violence. Education, cooperation, human rights and shared responsibility for others build respect for every human being - not only fellow citizens, but other people from distant parts of the global village. This shared responsibility began in the Congress of the United States of America on 6 January 1941.

The purpose of this article is to reflect on what freedom of speech in the web is. In the age of universal freedom of access to the Internet, controversy is growing between supporters of full freedom and supporters of legal restrictions on the use of global Internet resources. Should the Internet be the space of unlimited freedom? Surprisingly enough, the answer to this question is not obvious, although intuitively one would like to answer in the affirmative. By definition, the Internet is an egalitarian tool of communication, a space for free creation and flow of content, for which the only limit is technology and human imagination, whose boundaries cannot be determined. The global network is a field completely unregulated and not bound by any rules. This situation is slowly changing and legislators and courts are beginning to set the boundaries of online proceedings. People posting content on the Internet must do so with precaution so as not to violate the limits of freedom of speech, especially in the field of broadly understood public security, crime, morality, public order, other people’s personal rights, and confidential information.

Freedom of speech and, stemming from it, freedom of the press, are un-challenged grounds of every democratic society. The author relying on the limits of the allowed journalist criticism, normatively outlined and earned by the judicature and doctrine, considers the issue of applying the limits to judges. It is also indicated that protecting judges from unjustified criticism is necessary and the range of this protection should be wider than the range specified by the legislator in relation to politics and people holding social functions.

„Wolność gospodarcza” jest terminem, który często pojawia się w publikacjach oceniających wpływ czynników doktrynalnych, politycznych i ustrojowych na gospodarkę poszczególnych państw. W praktyce służy porównaniu, w jakim zakresie i stopniu władza publiczna oddziałuje w nich bezpośrednio lub pośrednio na procesy gospodarcze. Stan faktyczny zostaje skonfrontowany z modelem wolnego rynku, w którym nie ma władczych działań, regulujących nie tylko funkcjonowanie gospodarki, ale nawet otoczenia społecznego, które wpływa na decyzje przedsiębiorców. Termin jest w języku znakiem pojęcia. Wskazuje konstrukcję myślową, w której skupia się abstrakcyjnie ujęta istota oznaczonych nim zjawisk albo idei. W publikacjach posługujących się terminem „wolność gospodarcza” z reguły nie definiuje się treści tego pojęcia. Brak także refleksji metodologicznej nad modalnością jego stosowania. Jest ona jednak potrzebna, gdyż „wolność gospodarcza” występuje w języku kilku dziedzin wiedzy, posługujących się zróżnicowanymi instrumentami opisu rzeczywistości. Ma to istotny wpływ na rozumienie, a zwłaszcza na kreację rzeczywistości gospodarczej przez władze publiczne. Samo pojęcie „wolność gospodarcza” zrodziło się i ustaliło swój zakres w XVIII i XIX wieku jako postulat polityczny oraz doktrynalny ruchów liberalnych. Jego treść była przedmiotem szczegółowej analizy wedle kryteriów ekonomicznych pod koniec XX wieku, gdy nurt neoliberalny znalazł w nim podstawę porównań i ocen wolności w skali globalnej. Wolność gospodarcza stała się jednak również elementem prawnego porządku normatywnego. Na skutek realizacji liberalnych żądań ustrojowych jest dziś chronionym dobrem prawnym traktowanym jako naturalne prawo człowieka. W prawie aparatura pojęciowa odgrywa znacznie większą rolę niż w ekonomii. Stosowanie przepisów dokonuje się w rozumowaniu dedukcyjnym, opartym na zestawieniu pojęć ogólnych i stanów faktycznych. Jeśli brak precyzyjnego pojęcia tego, co należy chronić, nie można w systemie prawnym ustanowić gwarancji prawnych ochrony. Wolność gospodarcza wymaga tymczasem ochrony, co wynika z ocen ekonomistów, niezależnie od opinii w kwestii zakresu ochrony. Analiza zawarta w prezentowanej publikacji prowadzi do wniosku, że uformowane w XVIII i XIX wieku fundamenty doktryny liberalnej wyznaczają nadal podstawy rozumienia wolności gospodarczej w naukach ekonomicznych i naukach prawnych – z jedną różnicą. W naukach ekonomicznych inspiracje neoliberalne doprowadziły do ustalenia kilkudziesięciu składników, które łącznie definiują obecnie treść tego pojęcia. W ekonomii sformułowano złożone i wieloczynnikowe pojęcie, które musi stanowić punkt odniesienia dla innych nauk. Tymczasem nauce prawa oraz prawodawcom i sądom wyniki ustaleń ekonomistów nie są znane. Stosowana przez prawników terminologia jest zmienna i nie ulega wątpliwości, że w prawie brak całościowego pojęcia „wolność gospodarcza”. Wskazuje się w nim tylko niektóre jej aspekty i ustala cząstkowe zakresy ochrony. Nie jest ona zresztą ani pełna, ani konsekwentna. Niezależnie od tego, w jaki sposób należy w przyszłości formułować przepisy gwarantujące wolność gospodarczą w jej ekonomicznym rozumieniu, pierwszym postulatem, który wynika z przedstawionej analizy, jest przeniesienie wiedzy ekonomicznej w tym zakresie na grunt nauk prawnych.
The notion of „economic freedom” very often appears in publications evaluating the influence of political, doctrinal and constitutional factors on the economy of particular countries. The term servers the comparison of the degrees of governmental direct and indirect impact on economic processes in those countries. The actual situation is confronted with a model of free market which is devoid of the state actions regulating the economy, as well as devoid of any social environment influencing entrepreneurs’ decisions. In language a term signifies an idea. It denotes a mental construction in which an abstract idea is contained. Publications on „economic freedom” usually do not define this term. However, a methodological reflection on the modality of its usage is needed, since „economic freedom” appears in vernaculars of a few disciplines of knowledge, each of which describing the reality by means of differing instruments. This fact considerably moulds the understanding, as well as the creation of economic reality by governments. The term „economic freedom” itself was begotten and established in its scope in the 18th and 19th centuries as a political and doctrinal proposition of liberal movements. At the end of the 20th century it was subject to detailed economic analysis when the neoliberal trend took it as the basis for comparisons and assessments on a global scale. Also, economic freedom became an element of legal normative order. Due to the realization of liberal constitutional demands at present economic freedom is taken as a legal interest and a natural human right. In the sphere of law regulations are applies after deductive reasoning consisting in the combination of facts and general notions. In the absence of a precise concept of what is to be protected, it is impossible to establish a guarantee of legal protection. Meanwhile, economic freedom must be protected, which is indisputable among economists irrespective of their opinions on the scope of the said protection. The present analysis leads to the conclusion, that the 18th and 19th century liberal foundations continue to define the concept of economic freedom in the realm of economy and law. There exists, however, one distinction. In economy neoliberal inspirations helped establish a few dozen components jointly defining the discussed notion. This complex definition is a reference point for other disciplines. Nevertheless, in the sphere of law, legislators and justices are unaware of the economics’ approach to the term. The terminology used by lawyers is volatile and undoubtedly lacks a cohesive notion of „economic freedom”. Law accounts for only some of its aspects and determines merely partial scopes of protection, which is neither comprehensive nor consistent. Irrespective of the future formulation of the regulations on economic freedom as defined be the science of economy, the utmost proposition resulting from the present analysis is the transfer of economic knowledge to the realm of law.

The phrase ‘libel tourism’ appeared for the first time in 1990, when a Hollywood star ArnoldSchwarzenegger sued American author Wendy Leigh for his unauthorized biography in an English court[Rayner 2010; Sanchez 2011]. A number of recent cases included wealthy libel tourists such as NicoleKidman, David Hasselhoff, Roman Polański, Jennifer Lopez, Marc Anthony, Britney Spears, Tiger Woodsand Cameron Diaz. Since 2005, the number of libel actions in the High Court has doubled, and in 2009, therewere 219 defamation cases issued; 34 of them were identified as having a “foreign connection” [Ministryof Justice, Report of the Libel Working Group]. In a short time, the widespread opinion has appeared thatLondon has become the “Libel Capital of the World” [London “The Times”, Be Reasonable; Carvajal,Britain, a Destination for ‘Libel Tourism’]. Through an extensive review of relevant case law and studiesI would like to draw attention to the problem of libel tourism which creates a chilling effect on press freedom.
