    Sea freight prices have risen sharply due to the COVID-19 crisis, global shortages of ships, declining competition in the field, and containers of contagious demand. In Israel, the value for customs purposes includes the transportation costs, as in Singapore and the majority of the states. On the contrary, the United States, Australia and New Zealand, have chosen to exclude transportation costs for customs value purposes. Therefore, the increase in transportation costs leads to the increase in the value of goods for customs purposes. This increase lead to an additional collection of customs duties in Israel. The Israeli Law allows the state to facilitate importers and waive the extra customs duties, and similar and other facilitations have been made in the past, for example, in a war or strike situation. Therefore, all that is required is the flexibility and activation of goodwill on the part of the State when interpreting the Law to relieve the importers from extra duties caused by the COVID-19 crisis.

    W artykule porównano taryfy celne stosowane w wymianie handlowej między UE i USA. Porównaniem objęto częstotliwość stosowania poszczególnych stawek celnych na importowane produkty, średnie stawki na szerokie kategorie towarów oraz produkty obciążone najwyższymi cłami u obu partnerów. Analiza wykazała, że poziom protekcjonizmu celnego UE jest istotnie wyższy w porównaniu z USA. Ze względu na większe rozmiary eksportu UE do USA opłaty celne importerów amerykańskich są jednak wyższe niż importerów unijnych. Również w imporcie do USA wiele grup towarowych i poszczególnych produktów jest obciążone wysokimi cłami. Wniosek końcowy wskazuje na konieczność powszechnej redukcji ceł na świecie w ramach WTO, gdyż ostatnia istotna redukcja odbyła się ćwierć wieku temu w wyniku negocjacji prowadzonych w trakcie Rundy Urugwajskiej GATT.
    The article compares customs tariffs used in trade between the EU and the USA. The comparison covered the frequency of applying individual customs tariffs on imported products, average rates for broad categories of goods and products loaded with the highest tariffs for both partners. The analysis showed that the level of EU customs protectionism is significantly higher than in the USA. However, due to the greater volume of EU exports to the USA, customs duties of American importers are higher than those of EU importers. Also in the import to the USA, many product groups and individual products are burdened with high tariffs. The final conclusion points to the necessity of universal reduction of customs duties in the world within the WTO, as the last significant reduction took place a quarter of a century ago as a result of negotiations conducted during the URANTA Round of GATT.

    Na początku drugiej dekady XIX w. na terenie Rosji pojawiła się instytucja naczelnika okręgu celnego. Pełnił on funkcje nadzorcze w stosunku do urzędów celnych działających na granicy monarchii Romanowów. Ponadto realizował zarządzenia organu zwierzchniego w postaci Departamentu Handlu Zewnętrznego Ministerstwa Finansów. Na podstawie źródeł rękopiśmiennych i drukowanych dokonano analizy, w wyniku której należy stwierdzić, że stanowisko naczelnika okręgu celnego powstało w ramach powolnej modernizacji administracji celnej na przełomie XVIII i XIX w. Ponadto sam proces kształtowania się zakresu praw i obowiązków naczelnika okręgu celnego miał miejsce w drugiej, trzeciej i czwartej dekadzie XIX stulecia. Tak wypracowany model urzędnika nadzorującego działanie administracji celnej i straży granicznej na stałe znalazł się w strukturach rosyjskiej administracji skarbowej. Co więcej, w 1851 r. w wyniku likwidacji odrębności celnej Królestwa Polskiego stanowisko naczelnika okręgu celnego pojawiło się na tych peryferiach Imperium Rosyjskiego.
    In the early 1820s the customs district chief was instituted in Russia. This official was in charge of all the customs offices operating on the borders of the Romanov Empire. Moreover, the customs district chief supervised other structures on behalf of the Foreign Trade Department of the Ministry of Finance (FTDMF). The conducted analysis of handwritten and printed sources justifies the conclusion that the position of customs district chief was instituted as a result of gradual modernisation of the customs administration at the turn of the 18th and 19th centuries. Moreover, the very process of shaping rights and duties of the customs district chief took place in the second, third and fourth decades of the 19th century. Such an operative model of the clerk supervising the functioning of the customs administration and border guards became permanently established in the structures of the Russian customs administration. Furthermore, in 1851, as a result of the liquidation of the customs autonomy of the Kingdom of Poland, the position of the customs district chief appeared in those peripheral territories of the Russian Empire.

    Towar jest kluczowym elementem szeroko rozumianego prawa celnego. W perspektywie legislacyjnej Unii Europejskiej prawo celne określa zasady i tryb obrotu towarowego z państwami trzecimi. Wynikają z nich obowiązki i uprawnienia organów celnych oraz przedsiębiorców realizujących operacje importowe i eksportowe. Celem publikacji jest analiza roli i znaczenia „towaru” w obrocie towarowym z państwami trzecimi. Realizacja przyjętego celu zmierzała do przyjęcia tezy badawczej, że głównym przedmiotem obowiązujących unormowań unijnego prawa celnego jest „towar” w różnych jego aspektach: prawnych, technicznych, cech fizycznych czy też ekonomicznych.
    Goods are a key element of customs law in its broadest sense. In the legislative perspective of the European Union, customs law defines the rules and procedures for trade in goods with third countries. The duties and powers of customs authorities and economic operators carrying out import and export operations result from them. The aim of the publication is to analyse the role and significance of ‚goods’ in trade in goods with third countries. The implementation of the adopted objective aimed at the adoption of the research thesis that the main subject of the binding norms of the EU customs law is „goods” in its various aspects: legal, technical, physical or economic characteristics.

    The paper examines the effects of a multilateral reduction of customs duties on non-agricultural goods, under a “nonlinear Swiss formula,” on Poland’s foreign trade, including both exports and imports. As part of the Doha Development Round of the World Trade Organization (WTO), countries are trying to work out a mathematical formula according to which national customs tariffs would be reduced. This is the key focus of ongoing negotiations concerning Non-Agricultural Market Access (NAMA). The author analyzes the newest version of the Global Trade Analysis Project (GTAP), known as GTAP 6.0, according to four scenarios. The GTAP model is a multiregional, multi-sector model that is often used to study the effects of commercial policy. The author describes the results of the multilateral negotiations according to their state as of the end of August 2006. The scenarios analyzed by the author differ in terms of “reduction coefficient A” under the Swiss formula. However, in all variants, the coefficient for developed countries is lower than that for developing countries. The analysis shows that the reduction of customs duties will have a limited impact on Poland’s foreign trade. All scenarios point to a small increase in the volume of exports and an insignificant drop in the volume of imports, accompanied by a rise in import prices and a decline of export prices. The deterioration of the country’s terms of trade is the most visible in the most radical scenario. The European Union as a whole would be more visibly affected than Poland by the planned reduction of customs duties. Similarly, the move would lead to limited changes in the overall volume of industrial production in Poland, though, in terms of individual sectors, there will probably be a clear drop in the production of clothing, textiles and leather goods, accompanied by a small increase in output in the wood industry. Changes in the volume of trade, production and employment are the most visible in the radical scenario. In all options, the reduction of customs duties will have no perceptible influence on Poland’s gross domestic product, though GDP in purchasing power parity terms will decrease as a result of deteriorated terms of trade. There will be a marginal deterioration in the overall level of prosperity in Polish society. This will be due to the fact that the drop in terms of trade will outweigh the increase of consumer surplus.

    The author agrees with the interpretation of the notion “occasional import” given by the Customs Service. At the same time he claims that the attitude, according to which any import made in connection with a journey is an “occasional import”, is not legitimate. Moreover, he believes that the Customs Service has no powers that would allow it to independently adopt rigid and general criteria to classify journeys as “occasional” or “non‑occasional”. Hence, the instructions from the Customs Service cannot be a legally effective tool for defining the character of imports.

    Niniejsza publikacja ma na celu kompleksowe omówienie przepisów odnoszących się do zagadnienia kredytu celnego w okresie II Rzeczypospolitej. W dotychczasowej literaturze przedmiotu brak publikacji analizujących przepisy dotyczące tej instytucji, dlatego też artykuł opary został przede wszystkim na analizie ustawodawstwa międzywojennego związanego w przedmiotowym zagadnieniem. Warto zaznaczyć, iż kredyt celny w dwudziestoleciu międzywojennym był stosowany zarówno w transporcie lądowym, jak i morskim. W prowadzonych badaniach zastosowana została metoda historyczno-prawna, dogmatyczno-prawna oraz pomocniczo metoda komparatystyczna.
    This publication aims at a comprehensive discussion of the provisions relating to the issue of customs credit during the Second Polish Republic. In the current literature, there is no publication examining the provisions concerning this institution, and therefore the article of the fumes was first and foremost an analysis of the interwar legislation related to the issue. It is worth noting that the customs credit in the interwar period was used for both land and sea transport. The study will apply the historical-legal, dogmatic-legal and comparative method.

    Przepisy prawa celnego ustanawiają prawa i obowiązki osób przywożących i wywożących towary z terytorium Unii Europejskiej oraz uprawnienia i obowiązki organów celnych. Jednym z podstawowych obowiązków osób przywożących lub wywożących towary z terytorium Unii jest obowiązek uiszczenia należności celnych. Nakładane one są nie tylko w celach stricte fiskalnych, ale służą ochronie rynku unijnego przed konkurencyjnymi towarami sprowadzanymi z zagranicy. Należności celne są jedną z podstawowych instytucji prawa celnego Unii Europejskiej. Pomimo to wciąż brakuje opracowań teoretycznych poświęconych tej instytucji prawnej.
    Customs legislation establish rights and obligations of importing and exporting goods from the territory of the European Union and the powers and duties of the customs authorities. One of the primary responsibilities of the persons importing or exporting goods from the territory of the state is obliged to pay customs duties. They are not imposed only for strictly fiscal, but serve to protect the EU market against competing goods imported from abroad. Customs duties are one of the basic institutions of the European Union customs law. Despite it still lacks theoretical studies devoted to this legal institution.

    Artykuł jest poświęcony Palmyrskiej taryfie celnej, pierwszemu pisemnemu, w znanej nam historii celnictwa, dokumentowi regulującemu zasady poboru i wysokość danin publicznych w starożytnym mieście Palmyra, położonym na terenach dzisiejszej Syrii. Dokument pochodzący z pierwszej połowy drugiego stulecia naszej ery został wyryty na kamiennym bloku w dwóch językach: greckim i aramejskim. W artykule przedstawiono tło historyczne powstania dokumentu oraz opisano jego odkrycie i okoliczności, którym zawdzięczamy jego zachowanie do dzisiaj. Z wykorzystaniem obecnie już raczej trudno dostępnej literatury, głównie w języku rosyjskim, niemieckim, francuskim i angielskim, wiążącej się przede wszystkim z badaniami archeologów i lingwistów, autor przeprowadził analizę prawno-ekonomiczną taryfy oraz przetłumaczył jej pełny zachowany tekst na język polski.
    The article is dedicated to the Palmyra Customs Tariff, the first written document in the history of Customs, regulating rules of collection of public levies in Palmyra, the ancient city located in modern-day Syria. The document from the first half of the second century A.D. was engraved on a block of stone in two languages: Greek and Aramaic. The paper presents the historical background of the document’s creation and describes its discovery and circumstances, that we owe its preservation to this day. On the basis of an literature study (positions mainly in Russian, German, French and English that are rather difficult to access nowadays) mostly related to the research of archaeologists and linguists, the author has conducted a legal and economic analysis of the Tariff and translated its full preserved text into Polish.

    The COVID-19 pandemic has unprecedented and multidimensional repercussions for economic systems both at a national and a global level. The EU legislation provides for unique instruments designed, among other things, to extend aid to the victims of natural disasters (but not only), which may be utilised in order to respond to an unprecedented health crisis caused by the coronavirus. Customs administrations must play an important role here. Countries which reduced the time and costs of customs clearance at their borders are gaining advantage over those which failed to do so. The crisis sparked off by the COVID-19 pandemic led to questions about the application of customs regulations, customs procedures and customs formalities. Customs clearance should be assigned a high priority when it comes to “critical” goods relating to the protection of human health or life, whereas some imports should be exempt from the customs duty and (national) VAT, if it is possible to demonstrate that such commodities have been given free of charge as a donation. This article aims to describe actions and initiatives associated with customs procedures, which were taken by the EU to combat the pandemic. Measures relating to COVID-19, which concern customs procedures and trade, provide, at the same time, a review of challenges that both Member States and the whole European Union must confront to ensure the availability of goods on the one hand, and to facilitate the movement of goods and guarantee the safety of trade in goods on the other.
    Pandemia COVID-19 wywołała bezprecedensowe i wielowymiarowe reperkusje dla systemów gospodarczych zarówno na poziomie krajowym, jak i globalnym. W prawodawstwie UE dostępne są wyjątkowe narzędzia mające na celu m.in. pomoc ofiarom klęsk żywiołowych (ale nie tylko), które można wykorzystać do stawienia czoła bezprecedensowemu kryzysowi zdrowotnemu spowodowanemu przez koronawirusa. Administracje celne mają tu do odegrania kluczową rolę. Kraje, które zminimalizowały czas i koszty odpraw celnych na granicy, zyskują przewagę nad tymi, które tego nie zrobiły. W wyniku kryzysu wywołanego pandemią COVID-19 pojawiły się pytania dotyczące stosowania przepisów, procedur i formalności celnych. Odprawa celna powinna zostać potraktowana priorytetowo dla towarów „krytycznych” związanych z ochroną zdrowia czy życia ludzi, a niektóre towary importowane powinny być zwolnione z cła i (krajowego) podatku VAT, jeśli udowodni się, że zostały nieodpłatnie przekazane w formie darowizny. Celem artykułu jest charakterystyka działań i inicjatyw związanych z procedurami celnymi podjętych przez UE w ramach walki z pandemią. Środki dotyczące COVID-19, które odnoszą się do procedur celnych i handlu, dają jednocześnie przegląd wyzwań, przed którymi stoją zarówno poszczególne państwa członkowskie UE, jak i cała Unia Europejska, aby zapewnić dostępność towarów przy jednoczesnym ułatwieniu ich przepływu i zapewnieniu bezpieczeństwa obrotu towarowego.

    Opis:
    The first difficulty in liberalization agricultural trade stemmed from his position as the United States and the application of ny quantitative restriction. But then the main reason for the exclusion of agriculture from the negotiations was the first position of the EWG, and then of the European communities. Community countries already in the mid-sixties introduced protectionist common agricultural policy (CAP: Common Agricultural Policy). Generally speaking, liberal trade policy brings benefits in comparison with protectionism. This was reflected in the main principles of the international trade policy in the framework of the WTO and the EU. Also the introduction and opening of the Polish economy was made possible thanks to the progressive liberalization of this policy. The most important were tariff reductions resulting from the agreements of the WTO and of the Europe agreement with the EU.

    The article is devoted to the political and legal analysis of integration processes in the post-Soviet states – Russia, Kazakhstan and Belarus. It reviews the activities of the Customs Union and its economic and political expediency, as well as the creation and functioning of the Eurasian Economic Union. The author has revealed the reasons for the ineffectiveness of the EAEC activities and proposed a number of legal, political and economic measures to improve it. The paper provides examples of internal economic and political contradictions of the Eurasian Economic Union and offers a legal mechanism to resolve them, and further regulation on the basis of creating a single legal space.
