The concept of the synod plays a special role in the Evangelical ecclesiology. In the 20th century, the synod was radically defined as “the personification of the Church.” In the Evangelical tradition, however, there are equal Church management systems: episcopal, synodal-consistory, presbyterian (mainly in the Evangelical-Reformed denomination), and to a lesser extent congregational (especially observed in the so-called free Churches). Reformation theology understands the Church as a community of all saints, where the Gospel is preached purely and the sacraments are properly administered (Augsburg Confession — CA VII). The system of the Church does not belong to the so-called notae ecclesiae. An important theological doctrine of the Reformation is the teaching about the universal priesthood of all believers, which is the theological foundation of the idea of the synodal responsibility of the Church. In the 19th century synods concerned mainly clergy. In the 20th century, in the course of democratisation processes, most Evangelical Churches raised the importance of the synod in the overall management of the Church, and the Polish Lutheran Church introduced a provision into her law which stipulates that the synod is “the embodiment of the Church” and its supreme authority.
Il concetto di sinodo svolge un ruolo speciale nell’ecclesiologia evangelica. Nel XX secolo, il sinodo è stato definito in modo radicale come “personificazione della Chiesa”. Nella tradizione evangelica, tuttavia, ci sono sistemi equiparati di gestione della Chiesa: episcopale, sinodale-concistoro, presbiteriano (principalmente nella Chiesa evangelica riformata) e, in misura minore, congregazionalista (praticato soprattutto nelle strutture della chiesa libera). La teologia della Riforma intende la Chiesa come una comunità di santi in cui il Vangelo è chiaramente predicato e i sacramenti sono amministrati correttamente (Confessione di Augsburgo — CA VII). Il sistema della Chiesa non appartiene alle cosiddette notae ecclesiae. Un’importante dottrina teologica della Riforma è la dottrina del sacerdozio universale di tutti i credenti, che è il fondamento teologico dell’idea di responsabilità sinodale per la Chiesa. Nel XIX secolo, i sinodi riguardavano principalmente il clero. Nel corso dei processi democratici nel XX secolo, la maggior parte delle chiese evangeliche ha sollevato l’importanza del sinodo nella gestione generale della Chiesa, e la Chiesa luterana polacca ha introdotto una disposizione nella sua legge secondo cui il sinodo è l’incarnazione della Chiesa e la sua autorità suprema.

The article compares today’s culture on the family with the conception of the family according to Christian anthropology in order to emphasise how the values underlying the essential structure of the family as outlined by Christian doctrine and canon law are still capable of responding to the most authentic expectations of today’s men and women.

Przedmiotem artykułu jest jeden z najbardziej dyskutowanych tematów w kanonistyce posoborowej, tj. podmiotowe prawo osoby ochrzczonej zawarte w przepisach kodeksu prawa kanonicznego z 1983 roku. Poruszana problematyka została poddana analizie w oparciu o zasady rewizji kodeksu wypracowane przez I Synod Biskupów. Autor podkreśla, że zasadniczym zamierzeniem odnowy prawa kościelnego miała być nie tyle pilna konieczność poszerzenia katalogu praw wszystkich wiernych, ile bardziej kwestia sposobu sprawowania władzy rządzenia przez kościelnych przełożonych, którzy winni się wystrzegać arbitralności lub innych form poważnych nadużyć w tym zakresie. W konsekwencji autor wskazuje na przewagę obowiązków nad tzw. prawami i postuluje, by tzw. prawa podmiotowe wyrażać poprzez termin „wolność”, z uwagi na istotę założeń, na których zbudowany jest prawny system Kościoła katolickiego.
The paper discuses one of the most commented topic in the contemporary science of canon law, that is the bill of subjective rights and obligations set by the ecclesiastical legislator in the Code of canon law for the Western Church. The author analyses the concept of those rights and obligations in the light of the Principles of revision elaborated by the first Synod of Bishops held in 1967. One of the commission’s first actions was to draft a set of principles to guide the work of rethinking the Code, especially the significance of rights and obligations of the Christian faithful. Given the nature of the Catholic Church developed by the Second Vatican Council (communion and participation), the examination of this document let the author to affirm that the main goal was to emphasise the exercise of authority that should have appear more clearly as service and should be free from abuse rather to define and safeguard the rights of persons. Furthermore, it was also possible to determine the correct intention of the Synod Fathers whose idea was to define the subjective rights in term of liberties in the same way in which they are obtainable in catalogues of human rights. Eventually, the author demonstrates consequences related to the new vision of rights and obligations highlighting for example the clear priority of obligations over rights.

W obecnym kontekście Kościoła powszechnego „jedyne Corpus Iuris Canonici” staje się konkretną rzeczywistością. Kościół oddycha dwoma płucami, wschodnim i zachodnim. Kanony Kodeksu Kanonów Kościołów Wschodnich uzupełniają Kodeks Kościoła łacińskiego, gdy kanon, który odnosi się do Kościoła sui iuris, ale z kontekstu jasno wynika, że przedmiotowa kwestia dotyczy relacji z Kościołem łacińskim.
In the present context of the Universal Church, “the only Corpus Iuris Canonici” is becoming a concrete reality. The Church breathes with two lungs, one in the East and one in the West. The eastern canons supplement the western canons: they do so when a canon refers either to the Latin Church or a Church sui iuris and the when the context makes it clear that the case concerns relations with the Latin Church.
Nel contesto attuale della Chiesa Universale, “l’unico Corpus Iuris Canonici”, diventa realtà concreta. La Chiesa respira con due polmoni, quello dell’Oriente e dell’Occidente. I canoni orientali forniscono il diritto suppletivo ai canoni occidentali: lo fanno quando un canone si riferisce all’ Ecclesia sui iuris e il testo e il contesto rendono chiaro che la questione implica relazioni con la Chiesa Latina.

The article is to illustrate the development of this important part of the Canon law and catholic teaching in the universal Church and in Poland.The first part outlines the history of this catechetical formulation of basic catholic obligations, from the time of the Council of Trent until mid 20th century, including the perspective of the Church in Poland. Fundamental issues, namely the obligation of celebrating Sunday, Easter duty or the fasting precept, have been the same throughout the catholic world, even though their specific wording evolved depending on time and place.The second part touches upon the formulation of the commandements of the Church in the Catechism of the Catholic Church. This fundamental document of the catholic doctrine was first published in French in 1992, while its revised version in Latin was promulgated in 1997. Finally, in 2005 there was issued Compedium of the Catechism. The article contains an analysis of exact wording of the Church precepts in all above mentioned editions of the catechism. The matter is of great importance, since the it refers to the first official and universal formulation of the precepts.The third part deals with the Polish version of the commandements, promulgated by the Polish Episcopal Conference in 2003. Polish bishops took advantage of their right to adjust the universal text to specific needs of particular Church. With approval of the Holy See, the Polish pastors dispensed from certain feasts of precept and introduced the obligation to abstain from dances during Lent and on Fridays throughout the year. In the 2014 revised version the latter ban was lifted and since then only Lent has been the period of party abstinence.Not only does the article highlight the correlation between canon law and pastoral practice of the Church, but refers to the role of implementation of the universal law in the life of particular Churches.
L’articolo espone lo sviluppo di una parte importante del diritto canonico e dell’insegnamento cattolico nella Chiesa universale e in quella presente in Polonia.Nella prima parte viene descritta la storia delle formule catechistiche riguardanti i principali obblighi del fedele dal tempo del Concilio di Trento fino alla metà del ventesimo secolo, prendendo in considerazione la prospettiva della Chiesa cattolica in Polonia. Le indicazioni fondamentali – l’obbligo di festeggiare la domenica, il precetto della confessione e della comunione pasquale, le esigenze circa il digiuno – sono presenti in tutto il mondo cattolico, anche se le specifiche condizioni del tempo e del luogo hanno influenzato la loro forma concreta.Nella seconda parte è dibattuto il problema dei precetti ecclesiali nel Catechismo della Chiesa Cattolica. Questo documento fondamentale fu pubblicato per la prima volta in lingua francese nel 1992. Dopo molte correzioni, nel 1997 è stata presentata l’editio tipica in lingua latina. Infine nel 2005 papa Benedetto XVI ha ordinato la pubblicazione del Compedio del Catechismo della Chiesa Cattolica. Nell’articolo vengono analizzate le formule dei precetti ecclesiali in tutte e tre le versioni del catechismo. Va notato che, malgrado 500 anni di storia della propagazione dei precetti della Chiesa, solo adesso sono stati formulati come vincolanti in tutta la Chiesa universale.La terza parte verte sulla versione polacca dei precetti della Chiesa, promulgata dalla Conferenza Episcopale Polacca nel 2003 e riformata nel 2014. I vescovi polacchi hanno approfittato della possibilità di accomodare il testo dei precetti agli specifici bisogni e aspettative delle Chiese particolari. Con il consenso della Sede Apostolica, i pastori della Chiesa cattolica in Polonia hanno esonerato i fedeli dall’obbligo di festeggiare alcuni giorni festivi, ma nello stesso tempo hanno confermato la proibizione di partecipare ai divertimenti durante la Quaresima, ampliandola anche a tutti i venerdì dell’anno. Nel 2014 fu introdotto l’ultimo cambiamento nel testo dei precetti, con la decisione di lasciare la proibizione dei divertimenti solamente nel tempo di Quaresima.In conformità con il suo titolo, l’articolo espone il profondo legame tra il diritto e la pastorale, ma anche la relazione tra il diritto universale e il suo adattamento nel diritto particolare.

Non c’è cultura storica, che non conosca la magia. Per quanto riguarda la situazione in Calabria, le pratiche superstiziose blasfeme della magia furono ininterrottamente combattute in tutti i Sinodi bisignanesi. Si deve osservare, che la rigidità delle norme ed appropriati interventi pastorali non riuscirono a debellarle definitivamente. I Sinodi di Bisignano, occupandosi di arte magica e di malefici, puntarono su una maggiore opera di catechesi. Al vescovo fu riservata la scomunica per le azioni di sacrilegi, magiche indovini.
The origins of witchcraft and superstition date back to the “wild” world of humanity. The Synods of Bisignano in XVII-th century dealing with magical art and evil, aims at greater catechesis. The documents reserve to the bishop (with attached excommunication) the cases referred to the action of sacrilegious, magicians, fortune tellers. The magical practices are signs of distrust of God.
Magia i wiara w zabobony towarzyszą ludzkości od zarania dziejów. Synody w Bisignano, które miały miejsce w XVII w., zajęły się tym zagadnieniem ze względu na powszechność zjawiska. Dekrety nakazywały duchownym odpowiednie nauczanie w odniesieniu do zabobonów, iż są to znaki nieufności Bogu. Nakładały surowe kary, zarówno na parających się magią, jak i na tych, którzy korzystali z usług takich osób (ekskomunika, kara więzienia).

(Cardinal Congar) The canonists have been developing the rule of law of Western Europe. After there had been much debate (Acts 15:7), they decided together with the Holy Spirit. The Apostolic Nuncio gave the permission for lay persons (including women) to participate at the Synod. Synod ’72 is a process involving seven synods of local Churches in Switzerland. As an instrument of “processing” Vatican II, Synod ’72 discussed implementation options like Ecclesiastical Offices of the local Church. (LG 33; Paul VI’s Ministeria quaedam; John Paul II’s Christifedles laici; c. 228 CIC 1983). The tradition of shared decision-making of the baptised was been activated.
Le Synode ‘72 est un processus de sept synodes d’Églises locales en Suisse. En tant qu’instrument pour la mise en oeuvre du Concile Vatican II, le Synode 72 a discuté des options du Concile, telles que les offices ecclésiastiques dans l’Église locale (LG 33; Paul VI, Ministeria quaedam ; Jean-Paul II, Christifedles laici ; c.228 CIC 1983). La tradition de codécision des baptisés a été activée. « Quod omnes tangit, ab omnibus tractaristanprobari debet ». Les canonistes ont développé l’état de droit en Europe occidentale. Après de longs débats (Actes 15 : 7), ils ont décidé avec le Saint-Esprit. Le Nonce apostolique a permis aux laïcs (femmes) de participer au Synode.
Il Sinodo’72 è un processo di sette sinodi di Chiese locali in Svizzera. Come strumento per l’attuazione del Concilio Vaticano II, il Sinodo 72 ha discusso opzioni del Concilio, come ad esempio gli uffici ecclesiastici nella Chiesa locale (LG 33; Paolo VI, Ministeria quaedam; Giovanni Paolo II, Christifedles laici; c. 228 CIC 1983). Si attivava la tradizione della codecisione dei battezzati. «Quod omnes tangit, ab omnibus tractaristanprobari debet». I canonici hanno approfondito la questione dello stato di diritto nell’Europa occidentale. Dopo un lungo dibattito (Atti 15: 7), decisero insieme allo Spirito Santo. Il Nunzio Apostolico ha permesso la partecipazione al Sinodo dei laici (donne).
