Opis:
The present article discusses results of the research into a number of Sejm deputies elected by the local electoral body in Łęczyca between the years 1764-1792. On the basis of the so-called lauds of these electoral bodies, it has been determined that during the above-mentioned period 15 local elections were held and those gave mandates to 33 people. A number of the elected deputies were given their functions many times. Financial status of those persons was determined upon the basis of a variety of documents showing purchase and selling transactions of the deputies’ properties and tax tables of the years 1775 and 1790. The electoral body in Łęczyca employed a high threshold of wealth in respect to the candidates. The deputies belonged to a narrow wealth elite of the region. Almost a half of them represented the financial status characteristic of only 1,2% of the entire noblemen’s population in the above-mentioned area.

The Four-Year Sejm (diet) was held from October 6th, 1788 to May 29th, 1792 and resulted in significant changes in the composition of parliament, both the Chamber of Deputies and the Senate. To 177 members elected by the regional diets in August 1788 joined 182 new members elected by regional diets in November 1790. Finally, there were 359 deputies. But such number of deputies never worked together because at the time of a single deliberations several members of parliament died, and other were promoted to the senate. In total, during the sessions of the Four-Year Sejm died at least 10 members (8 of the first term and second term of The Sejm), and 15 members (14 first term of the Sejm, including deputy of Bielsko J. K. Ossolinski, whose nomination has been not thoroughly explained, and one during second term of the Sejm) were promoted to the senate. Major changes also occurred in the composition of the senate. During the sessions of the Sejm 38 senator’s seats became vacant. 22 senators died, thus 23 senatorial offices became vacant (two ministries, two bishoprics, 8 provinces (voivodeship) and 11 castellanies). 14 senators resigned from offices (a minister, four voivodes and 9 castellans). A sentence of the Sejm court deprived Grand Treasurer of the Crown of the office. Uniate Metropolitan entered Senate but the resolution of Sejm deprived Field Crown Hetman of the office thereby abolishing offices of the field Hetman. During the Four-Year-Sejm King Stanislaw August nominated 57 senators, including 16 people who were promoted within the Senate. Not all senators joined the confederation. It was joined by 148 senators (including 15 senators who were promoted from among Sejm deputies and accession to the Confederation did as deputies) of a total of 191. Total number of persons entitled to join the Confederacy, including king Stanislaw August Poniatowski was 536 (assuming that Mr Ossoliński, deputy of Bielsko and Castellan of Podlasie Ossoliński is one person). 493 people took advantage of this right: Stanislaw August Poniatowski, all deputies and about 77% of senators.

The conflict between the protection of authors’ work and their right to financial benefits on the one hand and a demand for broad access to cultural goods on the other requires the existence of regulations concerning fair use rules (both personal and public).The bill, however, raises doubts about the compatibility with Article 64 paragraph 1, in conjunction with Article 31 paragraph 3, of the Constitution. The authors consider the bill to be the wrong way to implement Directive 2001/29/EC of the European Parliament and of the Council of 22 May 2001 on the harmonization of certain aspects of copyright and related rights in the information society. There is doubt as to whether the bill is consistent with international conventions.

The author attempts to answer the question: ‘which actions may be taken by a Deputy under Article 19(1) of the Act on the Exercise of the Mandate of a deputy or Senator in relation to companies with State shareholdings’. He provides an analysis of the following phrases ‘the right to obtain information and materials’, ‘the right to enter the premises where the information and materials are kept’ and ‘the right to inspect the activities’. As a consequence of the analysis, the author proposes that a narrowing interpretation of rights resulting from Article 19 of the Act must be adopted, and points to the need for ‘restraint in the exercise of rights specified in Article 19’, particularly ‘the right to inspect the activities’.

The repeal of the resolution of the Ethics Committee by the Presidium of the Polish Sejm under Article 22 Paragraph 3 point 1 in conjunction with Article 147 Paragraph 4 and Article 132 Paragraph 2 of the Standing Orders of the Sejm of the Republic of Poland lead to closure of the case. There are no adequate normative basis, which would indicate the possibility of a retrial by the Presidium of the Sejm. Discontinuance of proceedings by the Presidium of the Sejm stimulates a state of rei iudicatae. Outside the scope of review remains the legal assessment of this resolution and its justification, which implies that the procedural irregularities in the proceedings conducted by the Deputies’ Ethics Committee are a sufficient condition for the repeal of the resolution of the Committee, and consequently the closure of the case.

The opinion concerns the problem of the scope of consultation requirements for bills, referring to the bill specified in the title of the opinion. Based on the provisions of the Constitution and of the Standing Orders, the bill should be consulted with those churches and other religious organizations whose priests would be affected by provisions of the bill. In practice, determining a list of entities entitled to be consulted on the bill may be difficult. Thus the author is of the opinion that legal rules concerning the right of churches and other religious organizations to consult bills should be reviewed and clarified.

The author of the draft claims that the challenged Article 80 paragraph 1 of the Act is in compliance with Article 31, in conjunction with Article 18, of the Constitution. Furthermore, the author requests that the case be discontinued pursuant to Article 39 paragraph 1(3) of the Constitutional Tribunal Act owing to the fact that the challenged provisions had ceased to have effect (Article 244 paragraph 1 and Article 245 paragraph 1 of the above mentioned Act) before the Constitutional Tribunal passed its judgment.

The author provided an assessment of the duties of the Chancellery of the Sejm in relation to provision of information to the public on request. Following an analysis of the provisions of the Act on Access to Public Information, she states that the Chancellery of the Sejm has an obligation to provide, under the procedure for disclosure of publicly accessible information, the information about the names of locations and hotels, in which accommodation of the Deputies were funded by the Chancellery of the Sejm. It is also required – upon request of the person concerned – to provide insights into invoices or receipts documenting Deputy’s stay in a hotel or to prepare and hand out photocopies of these documents.

The amendment of the above mentioned Act results from the implementation of the provisions of five directives of the European Communities into the Polish legal order. Nevertheless, the author points out that the proposed amendment goes beyond the limits specified by EU law, reducing both the autonomy of private entities and constitutional freedom of contracts. He refers to the defective wording of the provisions specifying the substantive scope of the Act, at the same time supporting the proposal for the extension of the scope of claims that can be brought by persons harmed by unequal treatment and provisions modifying the rules for application of statute of limitation of claims.

Both terms are very broad, and the decision on whether particular information may be classified as a trade secret, requires individual examination. Deputies may be given access to information constituting a trade secret, if they are, for example, members of the investigative committee, but only to the extent determined by the scope of examination of the case by that committee, or upon consent of the entrepreneur in relation to whom the secret must be kept. In other cases, Article 19 of the Act on the Exercise of the Mandate of a Deputy or Senator does not give the right of access to information constituting trade secrets. Additionally, such a right cannot be exercised in the course of submitting Deputies interpellations.

The author claims that non‑accountability or non‑liability (parliamentary privilege) provided for in the Act on the Exercise of the Mandate of a Deputy or Senator protects a Deputy (a Senator) only in relation to his/her activity falling with the scope of the exercise of his/her mandate. This privilege is a so‑called permanent immunity, and covers all types of MPs’ liability before the courts, including civil liability. The Act on the Exercise of the Mandate of a Deputy or Senator provides that A Deputy and Senator is entitled to a limp sum to cover the costs related to the functioning of the offices, according to the principles and in amount specified, respectively, by the Marshals of both chambers. These funds cannot be spent for purposes other than those specified above. The absence of insurance (a widely known category of costs) in the list of expenses specified in §9 (1) of the Order No. 8 of the Marshal of the Sejm does not seem to be incidental. In the author’s view, it is deliberately and intentionally omitted in the Order. Civil liability insurance would relate only to organisational and technical aspects of the functioning of a Deputy’s office, but not to the exercise by a Deputy of his/her mandate (i.e. parliamentary duties) in a Deputy’s office

The opinion deals with a motion to convene a meeting of a Sejm committee to consider the consequences of a particular court decision. In the author’s view, the subject matter of the motion is outside the scope of a committee’s competence as provided in the Standing Orders of the Sejm.
