Аннотация B статье рассматривается возможность признания права на защиту самостоятельным объектом уголовно-правовой охраны с учетом процессуальных, конституционных, международно-правовых и общеевропейских аспектов его ценности. В качестве методологического инструментария для реализации исследовательской задачи выбраны системно-структурный, диалектический и компаративный методы, а также аксиологический (ценностный) подход. В результате исследования выявлены возможные модели криминализации нарушений права на защиту.
The opportunity of admission of the right to defence as an independent object of criminal law protection is analysed in this article. Such opportunity has been considered with the reference to the procedural, constitutional, international law and European aspects of the value of this right. The system-structural, dialectical and comparative methods, as well as the axiological (value) approach were chosen as a methodology for the implementation of the research task. The potential models of criminalisation of violation of the right to defence have been identified as a result.

Opis:
In 2013, Directive 2009/81/EC of the European Parliament and the Council of 13 July 2009 on the coordination of procedures for the award of certain works contracts, supply contracts and service contracts by contracting authorities or entities in the fields of defense and security, amending Directives 2004/17/EC and 2004/18/EC (Directive 2009/81), was implemented into the Polish national law on public procurement. The transposition of Directive 2009/81/EC into the Polish national law should have been carried out with the preservation (as far as possible) of strengthening the Polish defense industry potential, especially its developmental potential, through public contracts awarded by Poland The article assesses the implementation of Directive 2009/81 into the Polish law, as well as the mechanisms for Polish industry development which were used during this process.
W 2013 r. do polskiego prawa zamówień publicznych wdrożona została Dyrektywa Parlamentu Europejskiego i Rady 2009/81/WE z dnia 13 lipca 2009 r. w sprawie koordynacji procedur udzielania niektórych zamówień na roboty budowlane, dostawy i usługi przez instytucje lub podmioty zamawiające w dziedzinach obronności i bezpieczeństwa i zmieniająca dyrektywy 2004/17/WE i 2004/18/WE (tzw. dyrektywa obronna). Transponowanie dyrektywy obronnej do polskiego prawa krajowego powinno było zostać dokonane z zachowaniem (na tyle, na ile to możliwe) możliwości wzmocnienia dzięki zamówieniom publicznym udzielanym przez Polskę potencjału polskiego przemysłu, w szczególności jego potencjału rozwojowego. Przedmiotem opracowania jest ocena implementacji dyrektywy obronnej do polskiego prawa krajowego, m.in. wykorzystania przy tym mechanizmów sprzyjających rozwojowi polskiego przemysłu.

Crimes against freedom of religion or belief, codified in Chapter XXIV of the Criminal Code, have not been amended for a quarter of a century. This situation may be changed by a citizen’s bill to amend the Criminal Code, affirmed by politicians associated with the Suwerenna (formerly: Solidarna) Polska party and the Ministry of Justice. Considering that the legislative project (Parliamentary Paper No. 2756 of the 9th term of the Sejm) proposes significant changes to criminal law protection of freedom of religion and belief, it demands extensive study.This article is the most detailed analysis of the project so far. It discusses the most important assumptions of the draft bill, such as introducing a new “justification”, removing the element of malice from Article 195 of the CC, relinquishing the necessity of confirming an insult to religious feelings for the existence of a crime under current Article 196 of the CC, and introducing a new criminal offence, unknown in the current Code, of lionising or ridiculing a religious association along with a regulated legal situation, its dogmas or rites. The motives guiding the project’s proponent and justifying, in his opinion, the necessity of proposed amendments are also analyzed. What distinguishes this article from previous analyses of the draft is also that it considers of changes that were made to it at the parliamentary stage.The analysis carried out unequivocally indicates that it is questionable whether the draft complies with constitutional principles of the state’s relations with churches and religious associations. The project’s provisions lead to the entanglement of state bodies in ideological disputes, also undermining the mutual independence of the state and religious associations. Moreover, the project’s entry into force may cause a freezing effect, endangering the implementation of the constitutionally guaranteed freedom of speech. Finally, the draft is legislatively controversial and some of its provisions do not comply with the principle of definiteness of criminal law.

In the Complex of Agricultural Schools in Miętno near Garwolin from December 1983 on the school youth protested in defence of the crosses removed from their classrooms. The protest lasted several months and the school and state authorities exerted pressure on the students. The protest ended in April 1984 with a resolution that the cross would return to the school. The students could continue their studies without signing declarations that the school should have a secular character. This was possible because of strong determination on the part of parents, local priests, and the foreign media. The most important for the completion of the protest was the attitude of the Episcopate and the Siedlce Bishop Jan Mazur. Despite that facts active students and supporting teachers were repressed. The events in the defence of the cross are commemorated, above all, by the erection in 1992 of the Elevation o f the Holy Cross parish in Miętno.

The article discusses the issue of standards of the right to defence and takes into account the recent amendments of the Code of Criminal Procedure. The analysis is conducted against the background of minimum standards of the right to defence set out under European law. A reference introduced to the title of the Code includes the assertion that the legislator has implemented the provisions of Directive of 22 October 2013 on the right of access to a lawyer in criminal proceedings and in European arrest warrant proceedings, and on the right to have a third party informed upon deprivation of liberty and to communicate with third persons and with consular authorities while deprived of liberty as well as Directive of 9 March 2016 on the strengthening of certain aspects of the presumption of innocence and of the right to be present at the trial in criminal proceedings. However, it should be emphasized in this context that as a result of changes made in the discussed scope in the years 2016-2019, the legislator not only failed to fully implement the aforementioned Directives, but even introduced modifications that led to lowering the standards of the right to defence and guarantees of its implementation, both in material as well as formal terms.

In light of contemporary circumstances, on the 30th anniversary of the Nicaragua judgement it is worth revisiting and considering again certain legal problems decided by – and raised by – the ICJ judgement. This article addresses the importance of the judgement in terms of international legal regulations on the use of force. First and foremost, the article examines the concept of armed attack based on the “gravity” criterion elaborated by the Court and the exercise of the right of self-defence. Moreover, the relationship between customary international law and treaty law, as well as forcible counter-measures and military actions against non-State actors are also discussed in the article. It is argued that the “gravity” criterion used by the ICJ seems controversial and, consequently, may limit the right of self-defence. On the other hand, however, the judgement established a strong barrier to the realization of individual political interests by militarily powerful States. This is the Nicaragua judgement’s long-lasting legacy. In this sense the judgement has stood the test of time.

New Zealand has demonstrated strong support for Ukraine since the Russian invasion of February 2022. From logistical support to infantry training, the NZDF has been a key player in helping to deliver on the New Zealand government’s general statements of support. Though located far from the conflict, New Zealand’s traditional values of support for international law, democracy and collective security in the face of external aggression have all been major drivers for these deployments. But certain other drivers, such as recent problems with recruitment and retention in the armed forces, are perhaps lesser known but also important in rounding out an understanding of why and how New Zealand has responded to the situation.

Civil defence, whose main objective is the protection of the civilian population, is a component of the concept of society’s resilience, but in the provisions of international humanitarian law (regulating the conduct of parties fighting in an armed conflict), it is limited to the protection of civil defence organisations (such as a fire brigade) performing strictly defined humanitarian tasks, requiring thorough preparation and securing of appropriate resources. The state-parties to the conflict shall respect and protect civil defence organisations and personnel and military units designated to serve as civil defence on a permanent basis. Also, in the case of belligerent occupation, the occupying state is obliged to enable the implementation of these tasks by civil defence organisations of the occupied territory; in addition, the cases where it is permissible to seize buildings and equipment belonging to these organisations have been seriously limited. Thus, well-organised, efficient, and effective civil defence formations are an important element of the state’s defence system, which serves the population in danger, and its efficient and effective functioning can contribute significantly to building and strengthening the resilience of society in the conditions of armed conflict and belligerent occupation.

The paper examines strengths and weakness of the French system of competition enforcement, with the aim of contributing to the discussion on the institutional design of systems of competition law enforcement. L’article examine les forces et les faiblesses de l’Autorité de la concurrence française, dans le but de contribuer au débat sur la structure institutionnelle la plus appropriée pour les autorités de la concurrence. À cet égard, une attention particulière sera accordée à l’introduction – dans le même Autorité – d’une séparation entre les services d’instruction et le Collège: une solution qui assure l’impartialité des choix pris par l’institution, mais qui détermine aussi une manque de coordination entre le Collège et le Services d’instruction qui peut avoir des effets négatifs sur l’activité administrative de l’institution.

The European Commission (EC) and the European Courts have being reaffirming in the Deutsche Telekom and Telefónica cases that guide-prices established by sector regulators upon electronic communications incumbents cannot per se exclude that conducts with anticompetitive foreclosure effects, such as margin squeeze undertaken within the boundaries of those pre-established prices, can be considered abusive under Article 102 TFEU. The paper aims to show that the reasoning put forward by the EC and Courts not only dismantles the defensive reasoning put forward by the incumbents before the EC and on appeal before the Courts but actually reaffirms the centrality of the enforcement activity of the EC. The paper examines the reasoning behind the “regulatory authority’s instructions defence” – the argument of the incumbents stating that their actions were justified because they had set their wholesale access prices and retail prices in line with the guidelines imposed by the sectorial regulators. Recalled in this context were also the principles of proportionality, subsidiarity and fair cooperation between the EC and individual Member States. The affirmation of the “heliocentric” doctrine that puts the EC at the hearth of competition law enforcement vis á vis national regulators and domestic legislation (provided decisions of the regulatory authorities can be considered secondary law sources) should take into consideration the important precedent of Consorzio Industrie Fiammiferi. The latter affirms that competition authorities can automatically put aside legislation that goes against Article 101 TFEU. However, they cannot impose pecuniary fines when certain behaviours are imposed by national legislation (while they can impose fines if those behaviours were suggested or facilitated by national legislation).
La Commission européenne (CE) et les juridictions européennes ont réaffiré dans les cas de Deutsche Telekom et Telefonica que les prix-guides établis par les organismes de réglementation du secteur sur les titulaires de la communication électronique ne peuvent pas en soi exclure ces pratiques avec des effets d’éviction anticoncurrentielle, tels que la compression des marges réalisée dans le limites de ces prix pré-établi. Les prix-guides peuvent être considérés comme abusifs vertu de l’article 102 du TFUE. L’article vise à montrer que le raisonnement présenté par la CE et les juridictions européennes ne démonte que le raisonnement défensif avancé par les titulaires auprès de la CE et en procédure d’appel devant les tribunaux, mais réaffirme en fait la centralité de l’activité de l’application accomplie par la CE. L’article examine le raisonnement derrière « la défence des instructions de l’autorité réglementaire» – l’argument des titulaires affirmant que leurs actions étaient justifiées parce qu’ils avaient mis leurs prix d’accès de gros et les prix de détail en ligne avec les directives imposées par les régulateurs sectoriels. Les principes de proportionnalité, de subsidiarité et de coopération équitable entre la CE et les États membres sont également rappelés dans ce contexte. L’affirmation de la doctrine «héliocentrique» qui place la CE dans le foyer de l’application des lois de la concurrence vis-à-vis des régulateurs nationaux et la législation nationale (à condition que les décisions des autorités réglementaires peuvent être considérées comme des sources secondaires du droit ) devrait prendre en considération le précédent important du cas Consorzio Industrie Fiammiferi. Ce jugement affirme que les autorités de la concurrence peuvent automatiquement ettre à côté une loi qui va à l’encontre de l’article 101 TFUE. Toutefois, ils ne peuvent pas imposer des amendes pécuniaires lorsque certains comportements sont imposés par la législation nationale (alors qu’ils peuvent infliger des amendes si ces comportements ont été suggérés ou facilités par la législation nationale).

Ze względu na rolę żywności w życiu człowieka i dla gospodarek całego świata, zarówno żywność, jak i cały łańcuch żywnościowy są bardzo podatnym celem ataku terrorystycznego. Terroryzm żywnościowy nie jest zjawiskiem nowym, a bieżące doświadczenia potwierdzają, że jest nadal bardzo groźny. Celem artykułu jest uzyskanie odpowiedzi na dwa pytania badawcze: (1) Czy i w jakim zakresie prawo stanowione wyznacza ramy ochrony żywności przed celowym zanieczyszczeniem? (2) Jaką rolę w zakresie obrony żywności przed terroryzmem pełni prywatne prawo żywnościowe? W wyniku przeprowadzanych analiz prawa, w tym prawa żywnościowego i prywatnego prawa żywnościowego, potwierdzono, że w prawie krajowym oraz europejskim prawie żywnościowym nie ma odniesienia do terroryzmu żywnościowego oraz obrony żywności. Jedyne regulacje, które istnieją, dotyczą ochrony tzw. infrastruktury krytycznej, w tym zapewniającej dostawy żywności i wody. Najbardziej w tym względzie rozwiniętym prawem na świecie jest amerykańskie prawo żywnościowe, w tym tzw. ustawa modernizacyjna, nakładająca obowiązek wdrożenia przez organizacje systemu analizy zagrożeń i opartych na ryzyku środków zapobiegawczych wobec żywności (Hazard Analysis and Risk-Based Preventive Controls, HARPC). Bardzo ważną rolę w temacie obrony przed terroryzmem żywnościowym odgrywa prywatne prawo żywnościowe, a także dobrowolne pod względem ich wdrożenia narzędzia oceny ryzyka (np. system TACCP), wypracowywane przez różne agendy i stowarzyszenia branżowe.
Due to the role of food in human life and for the economies of the whole world, both food and the entire food chain are very vulnerable to terrorist attacks. Food terrorism is not a new phenomenon, and current experience confirms that it is still very dangerous. The aim of the article is to answer two research questions: (1) Does statutory law define the framework for protecting food against deliberate contamination and, if so, to what extent? (2) What role does private food law play in defending food against terrorism? As a result of the conducted analyses of law, including food law, and private food law, it was confirmed that in national and European food law there is no reference to food terrorism or food defence. The only regulations that exist concern the protection of the so-called critical infrastructure, such as those that ensure the provision of food and water supplies. The most developed law in the world in this respect is the American food law, including the so-called modernization act, which imposes an obligation on organizations to implement the HARPC system. Private food law plays a very important role in food defence against food terrorism, as well as voluntary – in terms of their implementation – risk assessment tools, such as the TACCP system, developed by various agencies and industry associations.

Opis:
The primary goal of the study is to conduct analyses, on the basis of theoretical and empirical knowledge to describe the level of using and processing the verifying testimony on the spot in the Slovak criminalistics. For this method, it is typical that it is less frequent for use in investigative practice. The research, which was significantly larger than the results published here, shows that there is relatively little knowledge about this method among the police. Another important knowledge from research is the interest in the method in general, but its immediate application can be imagined by considerably fewer police officers. The secondary goal was to find out lacks and troubles in practical applying the verifying testimony on the spot, in the process of investigating crimes in Slovakia last years. The specific part of the study and research is also devoted to the history of the development of the concept and content of the method. These are very important parts of the study. They help to understand not only the formal legal definition in the legal regulation but also the true nature of the method and its structure. The author makes short concepts to propose changes necessary for effective using the verifying testimony on the spot in the Slovak police practice however mainly in the process of investigation.
