    The author presents the subject of questions addressed by Deputies to the Bureau of Research, regarding the scope and manner of completing declarations of assets, indicating the most frequent interpretation problems and doubts. Among the issues identified are those relating to indicating in the declaration the value of real estate, gifts, and inheritances, the value of investments in real estate, grants and benefits, income from joint activities, and joint property of spouses.

    The issue under analysis concerns the anonymisation of the data of a natural person to whom the Deputy has a financial obligation. After analysing the provisions of the GDPR, the author concludes that they do not preclude the disclosure of the name of the natural person with regard to whom the liability has arisen and do not provide a legal basis for effectively requesting the Marshal of the Sejm to anonymise the data of private individuals with regard to whom the liability has arisen in the declaration of assets.

    When it comes to the income received from tenancy or lease the vital thing is to qualify them as an economic activities. If the tenancy or lease are undertaken by a Deputy on a large scale what allows to qualify that activity as an economic activity, the Deputy is deprived of the right to salary. But if that sort of Deputy’s activity is not qualified as undertaking of an economic activity, the Deputy ought to reveal income received from that activity because revealing this income is necessary to assess requirement of profitability flowing from the Resolution no. 26 of the Presidium of the Sejm of 25th September 2001. Introduction in an internally binding act – such the above-mentioned resolution – of prerequisites for deprivation of a Deputy’s salary may lead to an inconformity of that resolution with Article 25 para. 2 of the Act on Exercise of the Mandate of a Deputy or Senator.

    A deputy of the European Parliament is obliged to submit an asset declaration to both the Mar‑ shal of the Sejm and the President of the European Parliament. The declaration submitted to the Marshal of the Sejm is verified by the tax authorities with regard to consistency with previous dec‑ larations and the annual tax return. The declaration submitted to the President of the European Parliament is assessed by the President, who pays particular attention to the issue of the existence of a conflict of interest.

    W artykule przedstawiono charakterystykę prawnokarnej ochrony danych osobowych zawartych w oświadczeniu majątkowym funkcjonariusza pożarnictwa. Uwzględniono w nim podstawy prawne wynikające z Ustawy z sierpnia 1997 roku o ochronie danych osobowych, a także Ustawy o Państwowej Straży Pożarnej, odnoszącej się do obowiązku funkcjonariusza pożarnictwa do złożenia oświadczenia o swoim stanie majątkowym. Celem autora artykułu było wzrost świadomości prawnej wśród funkcjonariuszy Państwowej Straży Pożarnej w zakresie ochrony ich danych zawartych oświadczeniu, którego złożenie stanowi jeden z obowiązków wynikających z posiadania statusu funkcjonariusza pożarnictwa. W artykule przedstawiono rozważania na temat prawnokarnej ochrony danych osobowych, traktując o nich szerzej niż jedynie przez pryzmat Ustawy o ochronie danych osobowych. Materiał wzbogacono o ogólne zagadnienie dotyczące problematyki ochrony danych osobowych, jak również przepisy karne.
    The article describes the characteristics of the legal protection of the personal data included in the fire officer’s assets declaration. The paper includes the legal basis resulting from the Law of 29 August 1997 about the personal data protection as well as the Law about the State Fire Service concerning the fire officer duty to provide his assets declaration. The article aims at rising the legal awareness concerning the fire officer’s personal data protection included in the declaration. To provide such a declaration is one of the fundamental fire officer’s duties . The article deeper discusses some legal problems of the data protection than to see it only from the perspective of the Law. The paper has provided, both some general problems concerning the personal data protection and the penal regulations.

    Opis:
    Property components belonging to a joint property of spouses specified in the Family and Guardianship Code are an exemplary calculation and in the context of Deputy’s obligation to disclose financial assets, each of the components requires a separate interpretation. According to the interpretation of the Bureau of Research, a Deputy staying in a spousal property partnership should disclose income received by the spouse in pecuniary resources held on the date of filing the financial declaration. If the property is a part of the spousal property partnership, it must be indicated in the Deputy’s property declaration.

    Z uwagi na szczególną relację, jaka zachodzi pomiędzy wójtem a jego zastępcą, warto zastanowić się nad zagadnieniem dotyczącym tego, jaki wpływ na sferę stosunku pracy zastępcy wójta wywiera zrzeczenie się mandatu przez wójta dokonane przed upływem kadencji. Takie zrzeczenie, zgodnie z art. 492 § 1 pkt 3 kodeksu wyborczego, skutkuje wygaśnięciem mandatu wójta, a to z kolei, w myśl art. 28e ustawy o samorządzie gminnym, jest równoznaczne z odwołaniem jego zastępcy. Problem jednak w tym, że to rozwiązanie wywołuje rozliczne wątpliwości i pytania: Jakie skutki wywołuje takie odwołanie w sferze stosunku pracy zastępcy wójta? Czym różni się ono od tradycyjnego odwołania dokonywanego przez samego wójta? Z jaką chwilą następuje odwołanie zastępcy, a z jaką rozwiązanie jego stosunku pracy? Jaki wpływ na sferę jego stosunku pracy ma niezłożenie w ustawowo zakreślonym terminie tzw. końcowego oświadczenia majątkowego? Autorka w niniejszym opracowaniu dokonuje wnikliwej analizy tytułowego zagadnienia badawczego, próbując odpowiedzieć na wszelkie rodzące się na tym tle pytania i wątpliwości
    Due to the special relationship that takes place between the commune head and his deputy, it is worth considering the issue of the impact of the resignation of the mandate by the commune head on the sphere of the employment relationship of the deputy commune head before the end of the term of office. Such a waiver, in accordance with Art. 492 § 1 point 3 of the Electoral Code results in the expiry of the mandate of the commune head, and this in turn, pursuant to Art. 28e of the Act on Municipal Self-Government, is tantamount to dismissal of his deputy. The problem, however, is that this solution raises numerous doubts and questions about: What are the effects of such a dismissal in the sphere of the employment relationship of the deputy mayor? How is it different from the traditional appeal made by the mayor himself? With what moment is the deputy dismissed and with what termination of his employment relationship? What is the impact of the failure to submit the so-called the final asset declaration? In this study, the author carries out a thorough analysis of the title research issue, trying to answer all the questions and doubts that arise in this context.
