Opis:
The advantages of the introduction of information and communication technologies (ICT) in the complex healthcare sector are already well known and well stated in the past. It is common knowledge that in order to install any type of information system in healthcare, six main groups of issues have to be dealt with: organizational and cultural matters related to healthcare, technological gap between healthcare professionals and information science experts, legal requirements on the confidentiality of personal data, of patient related data and on data privacy, industrial and market position of healthcare informatics and interoperability complexity, lack of vision and leadership of the health care managers and health authorities and user acceptability and usability of the proposed information systems. In order to meet these issues stated above, a special focus group (Z3) performed an assessment of the situation of healthcare informatics in Greece and of the main key points that would lead to success. In that sense it is now common knowledge that Greece is lagging information and communication technology progress in healthcare because almost none of the above mentioned issues were dealt with. This assessment is the result of the interaction of more than 150 decision makers, medical informaticians, healthcare practitioners and other individual involved in healthcare. As a conclusion, this focus group resulted in 4 major propositions that will lead to healthcare informatics introduction with better success chances: focus on terminologies and standards, focus on interoperability and information systems sustainability, focus on clear goals and system metrics that can create a healthcare performance management cockpit, and focus on people and what they have to say, by creating a e-health forum. These conclusions were taken into consideration by the Greek government and are incorporated the IASYS project, the national healthcare informatics framework for the next ten years.

Artykuł przedstawia Osobę św. Jana Pawła II jako ustawodawcę, jedynego papieża w historii Kościoła, który promulgował całość prawodawstwa powszechnego Kościoła katolickiego: Kodeks prawa kanonicznego dla Kościoła łacińskiego w 1983 roku i Kodeks kanonów Kościołów wschodnich w 1990 roku. W ustawach przez niego promulgowanych wyraźnie zaznaczają się akcenty: antropologiczno-personalistyczny i eklezjologiczny. Papież nie tylko promulgował kodeksy, a także wniósł osobisty wkład w treść prawa Kościoła, bo chociaż nie był kanonistą, to wraz z grupami specjalistów przed aktem promulgacji starannie przestudiował projekty. Ważnym rysem kodeksów Jana Pawła II jest ich łączność z decyzjami Soboru Watykańskiego II, stąd też można je nazwać ostatnimi dokumentami soborowymi.
The article presents the person of Saint John Paul II as a supreme legislator and sole Pontiff in the history of the Church that had promulgated an entire universal legislation of the Catholic Church, that is: the Code of Canon Law for the Latin Church in 1983 and the Code of Canons of the Eastern Churches in 1990. The laws promulgated by the Pontiff posses two distinct motifs: an anthropologically-personalistic one and an ecclesiological one. The Pope had not only promulgated the texts of the Codes, but what is more, he provided a personal contribution into the content of the law. Albeit, not a canonist himself, he nevertheless in cooperation with various groups of experts, had carefully analyzed the projects prior to their promulgation. What is an important aspect of the codes of John Paul II is their concordance and continuity with the decrees of the Second Vatican Council, therefore it is possible and appropriate to call them the final.

In the first part of his work, the author presents two attempts at the codification of Polish law undertaken at the end of the 18th century, while in the second deals with the problem of a heated discussion, commenced in 1800, on the role and position of Roman law in Polish law of the pre-partition epoch. The author emphasizes the unfortunate fact that both codification enterprises remained attempts only. The so called “Zamoyski Code” of 1778 did not gain the force of binding law, both for substantive and political reasons. Work on the so called “Stanislaus August Code” did not go beyond the stage of acquiring materials and sending prospectuses. In both these projects one can find a considerable number of references to legal solutions of the ancient Romans, especially in widely understood civil law (right in property, obligation law, law of inheritance, family law). The discussion on Roman law and its presence in former Polish law initiated by Tadeusz Czacki, and soon (1806) undertaken by his adversary, Jan Wincenty Bandtke, found many outstanding followers in the persons of J. Lelewel, R. Hube, A. Kraushar or W. Maciejowski. Czacki sought the provenance of Polish law in northern laws and did not see any influences of ius romanum. Bandtke, on the other hand, regarded Roman law as a binding force in the development of Polish law. The seasoned expert of the course of that discussion, J. Kodrębski, states that in the first half of the 20th century it still antagonized scholars and virtually it was not definitely resolved. The beginnings of this polemics perfectly corresponded with the introduction of the Napoleonic Code in the Duchy of Warsaw. Kodrębski perceives in this process the only successful attempt of reception of Roman law in Poland.

The paper answers one of fundamental questions for the Polish private international law (narrowly understood): is the principle of equal treatment all legal systems in this law illusion or reality? Achievement of the intended goal needed investigation of following issues, which related to this principle: genesis and theoretical basis, content and indications, deviations, domestic legislative tendency and views in domestic doctrine. Considerations included in the paper confirmed the existence of the principle of equal treatment all legal systems in the Polish private international law. However the realization of this principle is not fully satisfied and needs certain improvements.

Modern civil law’s roots can be traced back to the 19th century, when its basic institutions were comprehensively regulated in three civil codes: the French Civil Code of 1804, known since 1807 as the Napoleonic Code, the Austrian Allgemeines Burgerliches Gesetzbuch (ABGB) of 1811 and the German Burgerliches Gesetzbuch (BGB) of 1896–1900. In the literature, these codes are commonly referred to as the Great Civil Codifications, as they have been influential in shaping European civil law doctrine from their inception to the present day. Although they were drafted under different political conditions (the French and Austrian Codes originated in 18th-century philosophy of natural law, with its individualistic treatment of private law subjects, while the German Code resulted from the triumph of positivism in the second half of the 19th century), and their original content was subject to far-reaching revisions over the years, their invariable merit lay in creating a legal framework guaranteeing the inviolability of individual rights, based on respect for the individual’s fundamental subjective rights under civil law and respect for the autonomy of the will in their implementation. These rights included: the equality and universality of civil rights; the treatment of marriage as a civil contract; the guarantee of the inviolability of private property; the freedom to shape civil law relations by contract; the autonomy of the will of the individual in disposing his or her succession rights. Yet these rights were accompanied by a whole range of limitations and exclusions, particularly for women, whose legal position in terms of civil rights vis-à-vis men was far from the equality and universality of civil law subjects as declared in each of the aforementioned codes. This handicap was only to be remedied in the century that followed.

After successful process of unification of Polish civil law in 1946, in the period 1947–1949 works on the codifications of this branch of law were held. In February 1947 the Co- dification Commission was established. The Commission was to prepare the version of Civil Code, based on the existing acts and decrees. The changes in the existing law could be done only exceptionally. The draft of inheritance law, as a part of civil code, was prepared by Seweryn Szer and Jan Witecki. The first reading was concluded in December 1948. There were some important changes in inheritance law, for example provisions concerning statutory scuccesion and – in particular, groups accepting suc- cession. At last, the draft of inheritance law was not even published. In 1949 the work on new code was stopped beacuse of political reasons (the Stalinisation of Poland).

With the “glosa” on the Siete Partidas (13th century) by G. López (16th century), Latin America possesses an excellent example of a commentary on a civil law code, actually one of the greatest of the civil law tradition. Yet, the Latin American countries did not develop, as a rule, a proper culture of commentaries, albeit they gave themselves civil codes around the middle of the 19th century. The most important of these codifications, the Chilean civil code by Andrés Bello, is even a conscious continuation of the tradition enshrined in the Siete Partidas. In most countries, authors prefer instead to write textbooks. This choice seems to be explained by the fact that this literary form gives them more freedom to distance themselves from their civil codes, which are considered rather historical monuments than living legal texts. Commentaries appear only where the civil lawyers deal with a modern codification which is the case in Argentina and Brazil.
