Rozwój cywilizacyjny i związane z tym zmiany standardów funkcjonalnych, technologicznych i wzorców estetycznych wiążą się z przekształceniami istniejącej zabudowy, w tym również zabytków architektury. Uwarunkowane czynnikami pozakonserwatorskimi potrzeby i skala tych przekształceń wpływają na przewartościowania paradygmatu ochrony architektonicznego dziedzictwa. Istotnym tego przejawem, w następstwie transformacji ustrojowej w Polsce po 1989 roku, jest między innymi współzależność skutecznej ochrony zabytków z ich użytkowym wykorzystaniem. Wiąże się to z koniecznością ingerencji modernizacyjno-adaptacyjnych - ze zmianami podziałów wnętrz i potrzebą powiększania użytkowanej powierzchni poprzez rozbudowy zabytkowych obiektów lub założeń lub wznoszenia w ich najbliższym sąsiedztwie nowych. Ochrona zabytków wymaga zatem integracji działań utrwalających dokumentalne wartości historycznej tkanki z zasadami jej przystosowania do aktualnych, utylitarnych potrzeb – jako warunku przetrwania zabytków. W systematyzowaniu zasad przekształceń niezbędne jest uporządkowania nazewnictwa działań podejmowanych wobec zabytków – kluczowego w rozumieniu zasad ochrony i dialogu uczestników procesów konserwatorko-modernizacyjnych. Celem rozważań zawartych w artykule jest: zarys poglądów dotyczących ingerencji w zabytkowe struktury w rozwoju polskiej myśli konserwatorskiej jako punkt wyjścia do kodyfikacji ingerencji; diagnoza istotnych uwarunkowań decydujących o przekształceniach zabytków i potrzeb dialogu uczestników przedsięwzięć konserwatorko-modernizacyjnych; próba zdefiniowania rodzajów przekształceń z ich charakterystyką oraz sformułowanie wniosków.
Civilization development and the related changes in functional, technological, and aesthetic standards are connected with the transformations of the existing buildings, including architectural monuments. Non-conservationist needs and the scale of these transformations influence the reevaluation of the architectural heritage protection paradigm. An important manifestation of this, following the political transformation in Poland after 1989, is the interdependence between effective protection of historic buildings and their utilization. This entails the necessity of modernization and adaptation interventions, i.e. changes of internal divisions and the need to expand the usable area by extending the historic buildings or premises, or construction of new ones in their immediate vicinity. Therefore, the protection of historic monuments requires the integration of activities that preserve the documentary values of the historic fabric with the principles of its adaptation to the current utilitarian needs - as the condition of the monuments' survival. In systematizing the principles of transformation, it is necessary to organize the nomenclature of activities undertaken in relation to historical buildings, which is crucial for the understanding of the principles of protection and dialogue between the participants of conservation and modernization processes. The aim of this paper is: to outline the views on the interference in the monumental structures in the development of Polish conservator's thought as a starting point for the codification of the interference; to diagnose the important conditions which determine the transformation of monuments and the need for dialogue between the participants in the conservation and modernization projects; to try to define the types of transformations with their characteristics, and to formulate conclusions.

The author considers the issue of whether the postulate of creating a new code of civil procedure is still valid. He comes to the conclusion that the following arguments support the new codification: the poor state of the current Code of Civil Procedure and the need to take into account the challenges facing civil procedural law like constitutionalization, Europeanization and digitalization of this law, as well as the creation of new solutions to protect collective interests. However, he indicates, as obstacles to the preparation of the new code, the collapse of the culture of creating law in Poland, problems resulting from changes in the justice system and threats resulting from legal populism.

The civil law system entered the codification path during the 19th century, enabling the creation of uniformity, such as drafting a civil code and building a new (national) identity. The structure of the code suggests that it provides a comprehensive, internally coherent set of rules for private law. The adopted civil codes secure lawyers a systematic and coherent foundation for the legal system and legal reasoning. Codification allowed laws to be in an easily identified document easily. Traditionally, the civil law system has been subject to several codification and consolidation processes during different periods in time, influenced from political, social or economic reforms. In Albania after the proclamation of the Monarchy, work began on the preparation of various codes, with the crucial one being the Civil Code. The first Albanian Civil Code entered in force on the 1st of April 1929. This process was the first step for the Albanian Legislator to compare the secularity of the European legal framework to that of the Ottoman Empire. In 1991, the end of the communist era in Albania was marked by bringing the transformation of the economy into a market-oriented system and the creation of a legal system that protected the right of private property. The Albanian system as a continental system has developed a system based on systematic approach to laws, a procedure known as dogmatic approach. It has created an internal system of laws based on generally codified norms and principles. The purpose of this paper is to explain the impact of political, social or economic reforms in the codification process and the nature of legal sources in Albania.

The aim of this study was to present private and official codifications concerning the topic of responsibility of international organizations. Moreover, it highlighted some controversial issues which occurred during the work of International Law Commission (ILC). The topic of responsibility of international organizations was analyzed both by private bodies such as Institute de Droit International and International Law Association and – as mentioned above – ILC. The efforts of Institute de Droit International resulted in a resolution on The Legal Consequences for Member States of the Non-fulfilment by International Organizations of their Obligations toward Third Parties. While in 1996 International Law Association studied these topics, a Committee on the Accountability of International Organizations was established. These private drafts paid attention of ILC to some legal issues which helped ILC to identify problems which require further discussion. After completion of its work on State responsibility in 2001, ILC decided to include the topic Responsibility of International Organizations in its work program. Mr G. Gaja was appointed the Special Rapporteur and in years 2003-2011 he presented eight reports which took into account the comments and observations received from governments and international organizations. In his reports he largely followed the model of Articles on State Responsibility for Internationally Wrongful Acts. In 2011 the Commission adopted the draft of 67 articles on Responsibility of International Organizations, divided into six parts. The Draft Articles aimed at codification of a set of secondary rules applicable to a wide range of international organizations. The codifications of rules on the responsibility of international organizations was a very difficult task due to diversity of international organizations, which differ in size, functions and competence. Furthermore, there is a lack of relevant practice that would allow to elaborate the principles relating to responsibility of international organizations. Nonetheless, the responsibility for international wrongful acts is the most important institution of international law irrespective of the subject which committed a wrongful act.

In his contribution, the author presents the work on the codification (initially on the Act) of procedural criminal law in Poland in the years 1919–1928. Those works were initially led by the Criminal Department of the Codification Committee, and then by the Criminal Proceedings Section of the Codification Commission. The first period of the work on the criminal procedure law was characterized by some disputes between the members of the Department, i.e. supporters of the classical school (E. Krzymuski) vs. the sociological school (J. Makarewicz), the discussion aiming at defining the relationship of procedural criminal law and substantive criminal law. The work on the draft law was carried out faster after the appointment (on 16 July 1920) of the Criminal Proceedings Section, which in 1924 published the first version of the draft criminal law bill. E. Krzymuski, A. Mogilnicki, Z. Rymowicz and E.S. Rappaport had played the main role in the development of the project. After a very deep criticism in the columns of Gazeta Administracji i Policji Państwowej [The Gazette of State Administration and Police], Ruch Prawniczy, Ekonomiczny i Socjologiczny [The legal, economic and sociological movement] and Palestra [The bar], the project was rejected. Only the second version of the bill prepared in 1925-1926, re-worked by the committee composed of W. Makowski, A. Mogilnicki and S. Śliwiński (appointed by the Minister of Justice), became the basis for the President of the Republic of Poland to adopt the first Polish Code of Criminal Procedure of 19 March 1928.

The popularisation of drawing up codes that are addressed to various social groups is one of the features of the modern world. However, researchers of the phenomenon have not yet reached a consensus about the moral validity and utility of this activity. The article thoroughly reviews the Polish literature on the subject with regard to the reasons for taking a moderate stance on the codification of ethical standards. The essay describes the main concepts of ethical codes as well as arguments for their approval and rejection. Attention is drawn to the ways of improving the effectiveness of codes and to the ethical decision-making procedure that reconciles the positions of the supporters and opponents of codification.

The result of the codification works that were carried out in the years 1960-1971 on substantive misdemeanour law in Poland was a Code on Misdemeanours of 1971. The measures created in this Code were strongly influenced by the idea of misdemeanours polarization and stratification of responsibilities. According to this idea, severe repression was supposed to be limited to the most serious misdemeanours. Towards other offenders progressive leniency was provided, with non-criminal means replacing them. Under influence of political factors the character of general part of Code on Misdemeanours was determined by provisions which were introduced aimed at severe treatment of serious offenders. Also the specific part was shaped in the repressive spirit. The conditions to realise the assumptions accepted by codifiers of the substantive misdemeanour law were created only after the fall of communist system in Poland, when in 1990 the adjudicating boards were cut off from the influence of Ministry of Internal Affairs and placed in the structures of the Ministry of Justice.

The purpose of this article is to analyze the ideological basis of concepts that underpinned the establishment of the Codification Commission by virtue of the Act of 3 June 1919 and to assess its position within the system of authorities of the Second Republic of Poland. The author has found that the issues around shaping the relations of the Codification Commission with the Government and the Sejm have been covered in literature of the subject in a one-sided manner. Authors who have devoted their attention to the issue of autonomy of the Codification Commission formulated their evaluations based on the interpretation of the regulations in the drafts of the Act that established the Commission, as well as on their subsequent application that enabled the restriction of this autonomy. They did not, however, sufficiently account for the ideological declarations, thus in fact rejecting the deputies’ assertions of their striving to ensure “complete autonomy and self-sufficiency” of the Codification Commission, and the Government’s affirmations that it did not aim to “subject” the Commission to its control. Meanwhile, the author’s intention is to show that there was a widespread consensus at the time, especially at the Sejm, which sovereignly decided on the wording of the Act on the Codification Commission, that deputies had adopted a law that sufficiently protected the autonomous status of the Commission and its apolitical nature.

Zaczął się na początku XX wieku, kiedy stało się jasne, że potrzebny jest wspólny język, by zjednoczyć Chińczyków. W ten sposób powstała koncepcja Guóyǔ — „języka narodowego”. Po założeniu Chińskiej Republiki Ludowej prace zostały wznowione, standard został przemianowany na Pǔtōnghuà — „wspólną mowę”. Jego wymowa opiera się na dialekcie Pekinu, dialekty mandaryńskie były źródłem leksyki, a gramatykę oparto na „modelowych pracach w báihuà”. Jak jednak dokładnie wyglądały prace nad stworzeniem nowego standardu? Ten artykuł ma na celu pokazanie procesu kodyfikacji wymowy tego, co obecnie znamy jako Pǔtōnghuà. Dlaczego postanowiono wybrać mowę Pekinu jako punkt wyjścia, jak przebiegały prace, a także jak zmieniał się sam standard?
The process of creating a modern national standard language for the whole of China has been long. It started in the beginning of the 20th century, when it became clear that a common spoken tongue was needed to unite the Chinese people. Thus the concept of Guóyǔ — ‘national language’ — was created. After the founding of People’s Republic of China, the work was taken up anew, the standard was renamed Pŭtōnghuà — ‘common speech.’ Its pronunciation is based on the dialect of Beijing, the Mandarin dialects have been the source of lexicon, and grammar has been founded on “model works in báihuà.” But how exactly did the work on creating the new standard look like? This paper intends to show the process of codification of the pronunciation of what we now know as Pŭtōnghuà. How it was decided to choose the speech of Beijing as the starting point, how the work was carried out, and also how the standard is changing.
