The history of the Branch of the Polish Tourist and Sightseeing Society in Racibórz, as this is its full name, had a huge impact on the lives of the inhabitants of the Racibórz region. I can tell it very briefly, using mainly the calendar and extracting the most important information about what I was trying to accomplish. I think that further information will be included in a more extensive edition during the celebration of the 70th anniversary of the founding.

W jego biografii są jeszcze dwie inne nieznane karty – życie i ucieczka z getta warszawskiego oraz przynależność do oddziału partyzanckiego AK.
The following text discusses the vicissitudes of Lutek Rozenbaum’s life, known after World War II as Ludwik Sobolewski. He was the founder of the strong and recognisable not only in Poland football club Widzew Łódź. However, the life of this talented sports activist is overshadowed by seven years of service in the security apparatus or, to be more precise, in the Military Information of the Internal Security Corps. There are two other unknown chapters in his biography – his life in and escape from the Warsaw Ghetto and his membership in a partisan unit of the Home Army (Polish: Armia Krajowa, AK).

The analysis of the current state of law indicates that the committees of the Sejm and the Senate competent in European affairs could be equipped by the legislator with instruments to allow them to participate in political discourse with the EU institutions and the committees of other national parliaments. The implementation of this objective requires amending the statute and the rules of procedure of both Houses of Parliament. However, the legislature‘s failure to act cannot stand in the way of the Parliament‘s exercise of powers relating to the integration process. It is necessary to redefine the interpretative assumptions regarding the relevance of the Constitution in determining the position of the Parliament in the legal order determined not only by national legal provisions but also by the EU law.

Opis:
Celem niniejszego artykułu stała się próba odpowiedzi na postawioną hipotezę w brzmieniu: w obowiązującym prawie krajowym brak jednej, kompletnej normy prawnej nakazującej zapewnienie profesjonalnego wsparcia aparatu pomocniczego dla organu stanowiącego i wykonawczego na równorzędnym poziomie. Zasadniczy cel opracowania to zbadanie czynników wpływających na władztwo organizacyjne gminy. W jego pierwszej części analizie poddano normę prawną zawartą w art. 21a ustawy o samorządzie gminnym, badając zakres podmiotowy i przedmiotowy wydawania poleceń służbowych przez przewodniczącego rady gminy. Dalszy cel rozważań stanowiła treść art. 24 ust. 2 ustawy o samorządzie gminnym. Analiza przedmiotowego zagadnienia potwierdziła słuszność postawionej tezy, że w obowiązującym prawie krajowym brak jest jednej, kompletnej normy prawnej nakazującej zapewnienie profesjonalnego wsparcia aparatu pomocniczego dla organu stanowiącego i wykonawczego na równorzędnym poziomie.
The aim of this article was to attempt to answer the following hypothesis: In the applicable national law, there is no single, complete legal norm requiring professional support of the auxiliary apparatus for the legislative and executive bodies at an equivalent level. In the first part of the work, the legal norm contained in Art. 21a of the Act on Commune Self-Government, examining the subjective and objective scope of issuing official orders by the chairman of the commune council. The further purpose of the considerations was the content of Art. 24 sec. 2 of the Act on Commune Self-Government. The analysis of the issue in question confirmed the validity of the thesis that there is no single, complete legal standard in the applicable national law requiring the provision of professional support of the auxiliary apparatus for the legislative and executive bodies at an equivalent level.

Biskup Michał Klepacz odegrał, w okresie powojennym, kluczową rolę w pracach Konferencji Episkopatu Polski. Latem 1949 r. powołany został w skład Komisji Głównej, pełniącej rolę prezydium Episkopatu. Aktywność ta miała związek z zasiadaniem przez ordynariusza łódzkiego w Komisji do Rozmów z Rządem/Komisji Wspólnej przedstawicieli Rządu PRL i Episkopatu Polski. Pod koniec września 1953 r. wobec aresztowania i uwięzienia kardynała Stefana Wyszyńskiego objął funkcję przewodniczącego Konferencji Episkopatu Polski, stając się pierwszoplanową postacią Kościoła w Polsce. Jego wybór oraz postawa wobec bieżących problemów życia społeczno-politycznego naznaczone były bezpośrednią ingerencją władz PRL. Czas rządów biskupa Michała Klepacza charakteryzowały nasiąknięte językiem propagandy komunistycznej treści nauczania pasterskiego oraz oparte na daleko posuniętym kompromisie relacje z przedstawicielami aparatu władzy. Po powrocie kardynała Stefana Wyszyńskiego jesienią 1956 r. na stolice prymasowskie pozostał jego oddanym współpracownikiem, przede wszystkim angażując się w kształtowanie stosunków państwo-Kościół.
This article focuses on activities of Bishop Michał Klepacz at the Plenary Session of the Episcopal Conference of Poland and the Main Committee of the Episcopal Conference of Poland. In 1953–1956, during imprisonment and internment of the Primate of Poland, Cardinal Stefan Wyszyński, the Łódź ordinary was a chairman of the Episcopal Conference of Poland. Circumstances of his election and his attitude towards problems of social and political life were marked by a direct interference of the Polish People’s Republic (PRL) authorities. The most important tasks executed by Bishop Michał Klepacz included: 1) specifying main directions and contents for pastoral teaching; 2) shaping relationships with the PRL authorities; 3) control and supervision over vicars capitular with powers of the residential bishop in Western and Northern Lands; and 4) general supervision over activities of religious congregations. At the same time, Bishop Michał Klepacz held a position of a chairman of the Main Committee of the Episcopal Conference of Poland, of which he had been a member already since 1949. On the return of Cardinal Stefan Wyszyński to primatial sees in autumn of 1956, he remained his faithful co-worker, mainly involved in shaping relationships between the state and the Church.

Opis:
The article deals with the subject of collegiality and monocracy in the structure of local government authorities in Poland. The author begins his considerations with the characteristics of the collegial and monocratic form of organization of administrative organs. It indicates their essence, advantages and disadvantages and the related possibilities of their application in public administration. The next part of the study analyzes the existence of collegial and monocratic forms in the organizational system of local government authorities, which are treated in a broader sense than just as organs of individual local government units. The author indicates collegial and monocratic structures, emphasizing that the former are clearly preferred, and discusses the postulate of extending the monocratic form to all local government executive bodies; also draws attention to the need for a legal solution to the emancipation of monocratic offices of heads of collegial organs towards the separate and independent offices. An important role is played by the presentation and evaluation of various collegial bodies with which local government organs are enclosed. The considerations end with summarizing reflections, in which the timeliness and importance of the issues under consideration is emphasized, along with the listing of the most important issues.

Problematyka kompetencji przewodniczącego rady gminy nie była zbyt często w nauce analizowana. Celem artykułu było rozróżnienie takich pojęć jak zadanie i kompetencja przewodniczącego rady gminy, jak też wykazanie, że w przedmiotowym zakresie ustawowa regulacja jest fragmentaryczna, a nie całościowa. W opracowaniu tym postawiono hipotezę o dopuszczalności uzupełnienia kompetencji przewodniczącego organu stanowiącego gminy normami statutowymi danej jednostki samorządu. Podstawową metodą badawczą była dogmatyczna metoda badań polegająca na analizie obowiązującego stanu prawnego, orzecznictwa oraz poglądów doktryny. Pomocniczo skorzystano z metody empirycznej obejmującej analizę wybranych statutów gmin. Na podstawie przeprowadzonych badań należy stwierdzić, że organy nadzoru najczęściej stosowały wykładnię zawężającą zakres regulacji uprawnień przewodniczących. Taka restrykcyjna wykładnia była nie do pogodzenia z władztwem statutowym rad gmin i tym samym zawsze tam, gdzie zachodzi taka potrzeba, kompetencje przewodniczącego rady gminy powinny być dostosowane do lokalnych warunków, np. w zakresie przyznania prawa inicjatywy uchwałodawczej. Ponadto sam ustawodawca w wielu przepisach ustawowych przyznał różnorodne kompetencje przewodniczącym rad gmin, niekiedy w żadnej mierze niezwiązane z prowadzeniem obrad tej rady lub organizowaniem jej pracy. Przeprowadzona w tym opracowaniu analiza doprowadziła do przyjęcia za słuszną hipotezę, zgodnie z którą prawidłowa wykładnia art. 19 ust. 2 ustawy o samorządzie gminnym powinna prowadzić do uznania, że zawarta w tym przepisie norma prawna określiła jedynie zadania przewodniczącego organu stanowiącego gminy, kompetencje zaś niezbędne do ich wykonywania powinien przede wszystkim określić statut danej jednostki samorządu terytorialnego.
The subject matter of competences of the chairman of the commune council have not been analyzed too often in the legal scholarship. The aim of the article is to identify institutions such as public tasks and competences of the chairman of the commune council and to show that the relevant statutory regulation is fragmentary, not comprehensive. The hypothesis of this study involves the admissibility of supplementing the competences of the chairman of the commune’s decision-making body by statutory norms of a given local government unit. The basic research method consists in an analysis of the applicable legal status, the established line of judicial decisions and views of legal scholars and commentator. An empirical method, involving an analysis of selected statutes of communes, complements the methodology. The research demonstrates that supervisory authorities most often use an interpretation that narrows down the scope of the regulation of chairpersons’ power. Such a restrictive interpretation cannot be reconciled with the statutory authority of commune councils, and therefore, whenever necessary, the competences of the chairman of the commune council should be adapted to local conditions, e.g. with regard to granting the right to initiate resolutions. Moreover, the legislator himself, in a number of statutory provisions, has granted various powers to the chairmen of commune councils, sometimes not related to the conduct of the council’s sessions or its work. The analysis carried out in this study validates the hypothesis that the correct interpretation of Art. 19(2) of the Act on commune self-government should lead to the recognition that the legal norm contained in this provision only specifies the tasks of the chairman of the commune’s decision-making body, while the competences necessary to perform these tasks should, first of all, be determined by the statute of a given local government unit.

Wraz z wejściem w życie przepisów ustawy z dnia 11 stycznia 2018 r. o zmianie niektórych ustaw w celu zwiększenia udziału obywateli w procesie wybierania, funkcjonowania i kontrolowania niektórych organów publicznych, przewodniczący rady gminy otrzymał nowe kompetencje. Kompetencje przewodniczącego rady gminy do wydawania poleceń służbowych pracownikom urzędu gminy ograniczają się do jego zadań związanych z organizacją pracy rady gminy, nie obejmując aktywności przewodniczącego organu stanowiącego i kontrolnego jako radnego. Przewodniczący rady gminy jest uprawniony wydawać polecenia służbowe pracownikom urzędu gminy wykonującym zadania organizacyjne, prawne oraz inne zadania związane z funkcjonowaniem organu stanowiącego, komisji i radnych. Zawarte w gminnej ustawie samorządowej sformułowanie, że przewodniczący rady gminy wykonuje uprawnienia zwierzchnika służbowego w stosunku do pracownika urzędu gminy należy odczytać w sposób ścisły, uwzględniając regulację art. 21a u.s.g.
With the entry into force of the provisions of the Law of 11 January 2018 on amending certain laws to increase the participation of citizens in the process of election, operation and control of certain public bodies, the chairman of the municipal council received new powers. The competence of the chairman of the municipal council to give official instructions to the employees of the municipal office is limited to his tasks related to the organization of the work of the municipal council, not including the activity of the chairman of the establishing and controlling body as a councillor. The chairman of the municipal council is entitled to give official instructions to the employees of the municipal office performing organizational, legal and other tasks related to the functioning of the governing body, committees and councillors. The wording contained in the Municipal Self-Government Act that the chairman of the municipal council exercises the powers of an official superior in relation to the municipal office employee should be read strictly, taking into account the provisions of Article 21a of the Municipal Act.

This article is devoted entirely to the institution of the President on the example of the Congress of the United States of America. The office of the chairman, whose competence is to conduct deliberations, is characteristic of bodies with a collegial structure. This applies especially to those of them whose composition consists of more than a few persons. The author of the article focus on all aspects concerning this office. In the first part there is a brief characterization of the models of the institution of the speaker of parliament, as well as a historical outline of this institution. In the next part an author present the systemic position of the presiding officers of the chambers of the American Parliament.

For 10 years, Bishop Jerzy Mazur SVD held the responsible position of the Chairman of the Polish Episcopal Commission for Missions. The authors of the article consider his most important initiatives and achievements as Chairman of this Commission. The article is published in two parts. Part 1 begins with the presentation of the missionary profile of Bishop Jerzy Mazur. Then, the authors discuss his undertakings aimed at strengthening the mission structures and integrating the mission environment in the Church in Poland. They pay attention to mission animation and formation activities as well as mission cooperation with the Pontifical Mission Societies, religious congregations, diocesan mission groups, foundations, Catholic movements and associations supporting missions. Special place is given to the importance of material and spiritual support of missionaries and assistance for projects carried out in missions. In Part 2, the authors, among other items, present Bishop’s initiatives on mission outreach through media, both print and electronic ones. They also mention initiatives regarding the participatory involvement of laity in missionary service. Finally, they consider two most important events for the mission environment in Poland, namely, the 4th National Mission Congress, prepared and conducted by the Bishop, and the Extraordinary Mission Month.

For 10 years, Bishop Jerzy Mazur SVD held the responsible position of the Chairman of the Polish Episcopal Commission for Missions. The authors of the article consider his most important initiatives and achievements as Chairman of this Commission. The article is published in two parts. Part 1 begins (Nurt SVD, no. 1, 2021, p. 8-42) with the presentation of the missionary profile of Bishop Jerzy Mazur. Then, the authors discuss his undertakings aimed at strengthening the mission structures and integrating the mission environment in the Church in Poland. They pay attention to mission animation and formation activities as well as mission cooperation with the Pontifical Mission Societies, religious congregations, diocesan mission groups, foundations, Catholic movements and associations supporting missions. Special place is given to the importance of material and spiritual support of missionaries and assistance for projects carried out in missions. In Part 2, the authors, among other items, present Bishop’s initiatives on mission outreach through media, both print and electronic ones. They also mention initiatives regarding the participatory involvement of laity in missionary service. Finally, they consider two most important events for the mission environment in Poland, namely, the 4th National Mission Congress, prepared and conducted by the Bishop, and the Extraordinary Mission Month.

How do you nurture common welfare in a modern city? What is the role of local urban communities and the networked cooperation of numerous bodies like community councils,district NGOs, neighbourhood initiatives and particular individuals (animators, activists, involved citizens) – in creating a community, which, being subject to the municipality’s activity, does not patiently await its fate, but takes matters into its own hands? What impact does the history, tradition, urban planning and architecture, local symbols, rituals and institutions of a location have on creating a sense of identity for that given place and for creating an atmosphere of education, animation and activity in the public sphere in cooperation ‘with’ (and not ‘for’) the local community? How do Community Councils support and develop neighbourhood communities? An interview with Remigiusz Kaczmarek, the Chairman of the Józef Montwiłł-Mirecki Community Council in Łódź, reveals how the difficult heritage of this district provided the residents with a model of collaboration and social participation. The case of this modernist housing estate constructed in Łódź beforethe Second World War shows the dynamics of urban local community development based on the common experience of its residents.

W artykule ukazano złożoną postać Jana Lembasa (1914–2000). Wywodzący się z rodziny związanej tradycyjnie z PPS, w okresie okupacji członek AK, po wojnie przeobraził się w żarliwego komunistę. Wszedł w skład partyjnej „nomenklatury” i szybko robił karierę. Jako zwierzchnik administracji państwowej w województwie zielonogórskim, w latach 1956–1980 okazał się niezłym gospodarzem. W dużej mierze dzięki jego staraniom zaniedbane wcześniej województwo rozwijało się. Jan Lembas był jednak postacią powszechnie nielubianą w lokalnym środowisku z racji swojego trudnego, despotycznego charakteru oraz niechętnej postawie wobec Kościoła katolickiego.
The article shows the complex figure of Jan Lembas (1914–2000). A family member of the Polish Socialist Party (PPS), a member of the Home Army (AK), who came out of the family traditionally associated with the Polish Socialist Party (PPS) during the occupation, turned into an ardent communist after the war. He became a member of the party’s “nomenclature” and quickly made a career. As the head of state administration in Zielona Góra Province, in the years 1956–1980 he proved to be a good host. To a large extent thanks to his efforts, the previously neglected voivodeship developed. However, Jan Lembas was a widely disliked figure in the local community due to his difficult, despotic character and reluctant attitude towards the Catholic Church.

Artykuł omawia kwestie ewolucji pozycji ustrojowej szefów rządów w Republice Czeskiej. Cezury czasowe mieszczą się pomiędzy 1992 r. a 2019 r. Instytucja premiera stała się realnym instrumentem władzy politycznej dla liderów ugrupowań politycznych w omawianym państwie. Parlamentarny model rządów obowiązujący w Republice Czeskiej zakłada ścisłą współpracę władzy ustawodawczej i wykonawczej. W analizie uwzględniono zarówno regulacje konstytucyjne, jak i praktykę polityczną ostatnich blisko 30 lat.
The article discusses the evolution of the political position of heads of government in the Czech Republic. Time censures are between 1992 and 2019. The institution of the Prime Minister has become a real instrument of political power for the leaders of political groups in the country discussed. The parliamentary model of government in force in the Czech Republic assumes close cooperation between the legislative and executive authorities. The analysis includes both the constitutional regulations and political practice of the last nearly 30 years.
