Opis:
Artykuł przedstawia argumenty przemawiające w sposób jednoznaczny za procesowym charakterem kanonicznego potwierdzenia świętości, czyli orzeczenia beatyfikacji czy kanonizacji prowadzonego w diecezji. Zostało to także podkreślone w wystąpieniu kardynała prefekta Kongregacji Spraw Kanonizacyjnych 18 lutego 2008 r. podczas prezentacji wydanej przez tę kongregację, a zaaprobowanej przez Benedykta XVI Instrukcji dotyczącej ściślejszego zachowania norm obowiązującego prawa. Kardynał podkreślił, m.in., że dokument ten nie ma charakteru ustawodawczego, ale jest aktem administracyjnym Kongregacji Spraw Kanonizacyjnych. Warto zauważyć, że prefekt odrzucił rozpowszechnianą błędną i pozbawianą podstaw ideę o rzekomym zastąpieniu przez ustawodawstwo Jana Pawła II metodologii procesowej w prowadzeniu spraw kanonicznego potwierdzenia świętości przez metodologię poszukiwań historyczno-krytycznych. Włoskie słowo inchiesta („dochodzenie”) należy zatem rozumieć nie tylko jako dochodzenie czysto naukowe, ale procesowe. Wykładnia regulaminów wewnętrznych Kongregacji jak i doktryna opowiada się także za procedurą kanoniczną, czyli analogiczną do zwyczajnych procesów kanonicznych nie tylko w fazie diecezjalnej spraw, ale i w fazie rzymskiej. Wreszcie rozważania nad charakterem ostatecznej decyzji papieskiej w sprawie beatyfikacji czy kanonizacji dopełniają całości spojrzenia na kanoniczne potwierdzenie świętości w Kościele, jako na akt złożony i specyficzny dla tego rodzaju spraw.
The paper presents unequivocal arguments in favour of the procedural nature of the canonical confirmation of holiness, as regards the process of beatification and canonization on the diocesan level. It was also underlined by Cardinal Prefect of the Congregation for the Causes of Saints on 18 February 2008 in his intervention, concerning the Instruction issued by the Congregation and approved by the Pope, on stricter obeying the existing law. It was clearly stressed by the Cardinal that the document is not legislative in nature but is an administrative act of the Congregation for the Causes of Saints. He also rejected the common and false opinion that Pope John Paul II allegedly replaced procedural methodology in canonical processes of the confirmation of holiness by a methodology of historical-critical research. The Italian term “inchiesta” is to be understood not as a solely scientific inquiry but also procedural. The interpretation of the internal regulations of the Congregation and its doctrine are in favour of the canonical procedure, which is analogous to ordinary canonical processes both in the diocesan and in the Roman phase. Eventually, the paper refers to the nature of the final decision of the pope in cases of beatification or canonization, which proves that the canonical confirmation of holiness in the Church is complex and unique to this kind of cases.
Im Artikel werden Argumente zusammengestellt, die eindeutig zugunsten des prozesshaften Charakters kanonischer Bestätigung der Heiligkeit, d.h. der in der Diözese durchgeführten Festlegung der Selig- bzw. Heiligsprechung dienen. Dies wurde auch in der Ansprache des Präfekten der Kongregation der Selig- und Heiligsprechungsprozesse am 18. Februar 2008 bei der Vorstellung der durch diese Kongregation veröffentlichten und durch Benedikt XVI approbierten Instruktion unterstrichen, bezogen auf die strikte Observanz des geltenden Rechtes. Der Kardinal hat u.a. betont, dass dieses Dokument nicht den Rechtscharakter hat, sondern ein administrativer Akt der o.g. Kongregation ist. Es verdient die Aufmerksamkeit, dass der Präfekt die verbreitete falsche und grundlose Idee verworfen hat, dass in der Gesetzgebung Johannes Paul II. die Prozessmethodologie im kanonischen Verfahren bezüglich der Bestätigung der Heiligkeit durch die Methodologie der historisch-kritischen Untersuchungen abgelöst wurde. Das italienische Wort inchiesta (Ermittlung) soll also nicht nur im Sinne rein wissenschaftlicher Ermittlungen, sondern als eine prozesshafte Ermittlung verstanden werden. Die Auslegung der internen Ordnungen der Kongregation sowie die Rechtslehre plädieren auch zugunsten der kanonischen Prozedur, die zu den ordentlichen kanonischen Prozessen analog ist, und zwar nicht nur auf dem Niveau der Diözese, sondern auch in der römischen Phase der Ermittlungen. Abschließend werden die Überlegungen über den Charakter der endgültigen päpstlichen Entscheidung bezüglich der Selig- oder Heiligsprechung ihm Rahmen einer Übersicht über die kanonische Bestätigung der Heiligkeit in der Kirche ergänzt. Sie ist ein vieldimensionaler Akt, der für solche Angelegenheiten spezifisch ist.

Opis:
The course of a beatification process of a group of martyrs is no different to a cause concerning a single candidate to the glory of the altars. The most evident differences, potentially having far-reaching consequences in the future, are noticeable at the preliminary stage of such a process. The five sections of the article address the following issues: past canonisation processes of groups of martyrs, reasons and various preferences for the creation of such groups including the present-day consolidation of several causes, the question of a competent bishop, the composition of the group and relevance of collected evidence, and finally the issue of restricting the number of witnesses in this kind of process. In beatification processes that are intended to apply jointly to several persons it is vital at the preliminary stage to pay particular attention to the criterion of selection and joining candidates together: whether death was inflicted in the same place and whether it occurred under the same persecution. During the process itself, evidence concerning individual persons has to be accumulated and processed since the Canon Law elements are verified with respect to each of them. When a resolution is made that the process will follow the path of martyrdom and that a group of candidates will be established, one has to exclude such possibilities as “taking the easier way” or “omitting a cause for a miracle by the intercession of a particular servant of God”, the latter necessary in the case of confessors.

The article discusses the issue of the competences of the Congregation for the Causes of Saints. The Author begins with the origin of the Congregation. It is emphasized that this dicastery is one of the oldest organ of the Apostolic See. The Pope Sixtus V with the Apostolic Constitution Immensa aeterni Dei of 22 January 1588 created the Sacred Congregation of Rites. Thereafter, Paul VI, divided the Congregation of Rites with the Apostolic Constitution Sacra Rituum Congregatio of 8 May 1969 and created two congregations (sections): one for Divine Worship and another for the Causes of Saints. The Congregation is composed of the cardinal prefect, secretary, under-secretary, promoter of the faith, relators and consultors. The Pope has the principal functions in the dicastery. He creates it, indicates the priorities in the aspect of the current needs of the Church and approves each stage of the proceedings with a proper decrees. The procedure in the Congregation for the Causes of Saints has been indicated in the Apostolic Constitution Divinus perfectionis Magister of 25 January 1983. The beatification process has three stages carrying out in the diocese. Then, the documents of the diocesan process are sent to the Congregation.

In connection with beatification of Maria Karlowska (1865-1935) many articles and various studies about life and mission as road to her beatification were published, in which beatification process was generally mentioned as preparation to this beatification. However so far there hasn’t been published any article which would focus on one of the most absorbing aspects of her biography, namely beatification process, in detail, from both professional and practical side. Many of us hear a lot about ongoing beatification processes, but all the procedure and the way of the blessed to the altars is usually strange to us. Maria Karlowska was characterised by both uncommon personality as well as will of action. She devoted everything to her work and pupils. Diversity of talents, which she received and used for pastoral mission realized throughout her life, is amazing. She was really such an admirable woman. No wonder not only she has been highly respected for her charity, social assistance and the other contributions by Polish authorities, but also in spite of many difficulties she reached beatification process which lasted thirty two years, from 1965 to 1997. The article focuses not only on beatification process of Maria Karlowska. It is going to encourage to finding out more about the other lesser-known saints and the blessed as well as to analysing and studying different aspects of their life, not only beatification process. Hopefully this article will bring the effect.
