Głównym celem artykułu jest analiza pojęcia „nieposłuszeństwo sędziowskie”. Autor opisuje dwa aspekty problemu (indywidualny i instytucjonalny) i porównuje je z nieposłuszeństwem obywatelskim. Zagadnienie jest zaprezentowane w sposób paradygmatyczny na przykładzie orzecznictwa sądów amerykańskich w sprawach niewolnictwa w okresie poprzedzającym wybuch wojny secesyjnej. W oparciu o to autor konstruuje typologię czterech możliwych postaw sędziów orzekających na podstawie ustawy sprzecznej z ich sędziowskim sumieniem i systemem moralnym. W artykule zaprezentowano ten problem na przykładzie sędziego Lemuela Shawa, przewodniczącego Sądu Najwyższego stanu Massachusetts w latach 1830-1860. Szczególną uwagę poświęcono wprawdzie jego wyrokowi w sprawie Commonwealth v. Aves, ale wspomniane są także inne interesujące orzeczenia.
The main purpose of this paper is the analysis of the notion “judicial disobedience”. The author describes two aspects (individual and institutional) and compare them with civil disobedience. The problem is presented in a paradigmatic manner upon the example of case law of American courts relating to slavery in the period of half of the century preceding the outbreak of the Civil War. Based on this, the author constructs a typology assuming four possible opinions of an adjudicating judge based on provisions of law, which are contrary to the judge’s conscience and morality. In this paper the problem is described upon the example of Justice Lemuel Shaw, Chief Justice of the Massachusetts Supreme Judicial Court from 1830 to 1860. However special attention is paid to his judgment in case Commonwealth v. Aves., but his another verdicts have been mentioned as well.

A specialized diving lifestyle has repeatedly evolved in several lineages of modern and fossil waterfowl (Anseriformes), with the oldest previously known representative being the late Oligocene Australian oxyurine ducks Pinpanetta. However, diving specializations have never been previously documented for any of the primitive Paleogene anseriforms (“ stem-anatids”), and thus may be associated with the origin of modern anatid-like body plan. Here I describe a tarsometatarsus of a new duck-sized diving anseriform bird from the latest Eocene (late Priabonian) Kusto Svita in Eastern Kazakhstan, which predates the previously reported occurrence of diving specialization in Anseriformes by at least 6 MA. The new taxon Cousteauvia kustovia gen. et sp. nov. has an unusual and previously undocumented morphology, but partly resembles the stem-anatids Paranyrocidae and Romainvilliidae, thus representing the first known occurrence of diving adaptations in primitive non-anatid anseriforms. The evolutionary appearance of specialized waterfowl taxa in the late Eocene of Central Asia supports a view that this region might have played an important role in the evolution of morphologically derived Anseriformes. The structure of the intertarsal joint in basal and modern anseriforms is here further discussed in relation with adaptations for aquatic locomotion. The presence of elongate and evenly narrow condyles of the tibiotarsus in Anatidae and other swimming/diving birds allows a firm contact with the hyperprotracted tarsometatarsus at the initial phase of the propulsion. This morphology contrasts with the restricted condyles of Presbyornithidae, which indicate a different, strictly wading locomotory specialization. Cousteauvia obviously evolved diving specializations on the basis of a more primitive structure of the intertarsal joint.

The purpose of this paper is to reflect on the importance of evaluation and measurement as a vital field of public relations campaigns. The author gives an insight into the existing literature relevant to the measurement approaches and evaluation of Public Relations programs. This paper also presents the advantages and disadvantages of three different models of measurement and evaluation of PR communication – AVEs, Barcelona Principles and AMEC’s (2015) new Integrated Evaluation framework. The author suggest that measurement and evaluation programs must be part of communication strategy but also it has to have a model, matrix or guideline for analysing and measuring PR effectiveness within an organisation and the targeted audience it is aiming to reach.
Celem niniejszego artykułu jest zastanowienie się nad istotnością ewaluacji i pomiaru jako kluczowego obszaru kampanii public relations. Autor artykułu daje wgląd w istniejącą literaturę istotną dla podejścia do pomiarów i oceny programów Public Relations. Niniejszy artykuł także prezentuje zalety i wady trzech różnych modeli pomiaru i ewaluacji komunikacji PR – ekwiwalent reklamowy (AVE), Zasady Barcelońskie oraz nowy Schemat Zintegrowanej Ewaluacji AMEC (2015). Autor sugeruje, że programy pomiaru i ewaluacji muszą być częścią strategii komunikacji, ale także musi ona mieć model, matryce, lub wytyczne do analizy i pomiaru efektywności PR wewnątrz organizacji i docelowych odbiorców, do których chce dotrzeć.

The early Eocene locality of La Borie is located in the village of Saint-Papoul, in southern France. These Eocene fluvio- lacustrine clay deposits have yielded numerous vertebrate remains. Mammalian taxa found in the fossiliferous levels indicate an age near the reference level MP 8–9, which corresponds to the middle Ypresian, early Eocene. Here we provide a detailed description of the avian remains that were preliminarily reported in a recent study of the vertebrate fauna from La Borie. A maxilla, a quadrate, cervical vertebrae, a femur and two tibiotarsi are assigned to the giant ground bird Gastornis parisiensis (Gastornithidae). These new avian remains add to the fossil record of Gastornis, which is known from the late Paleocene to middle Eocene of Europe, early Eocene of Asia and early Eocene of North America. Gastornis parisiensis differs from the North American Gastornis giganteus in several features, including the more ventral position of the narial openings and the slender orbital process of quadrate. Two tibiotarsi and one tarsometatarsus are assigned to a new genus and species of Geranoididae, Galligeranoides boriensis gen. et sp. nov. So far, this family was known only from the early and middle Eocene of North America. The fossils from La Borie constitute the first record of the Geranoididae in Europe. We show that Gastornis coexisted with the Geranoididae in the early Eocene of both Europe (La Borie) and North America (Willwood Formation). The presence of Geranoididae and the large flightless bird Gastornis on either side of the present-day North Atlantic provides further evidence that a high-latitude land connection existed between Europe and North America in the early Eocene.

Boobies and gannets (family Sulidae) are the most specialized plunge divers among seabirds. Their fossil record along the Pacific coast of South America extends to the early Middle Miocene. Here we describe three new species of sulids: Sula brandi sp. nov., Sula figueroae sp. nov., and Ramphastosula aguirrei sp. nov., from the early Late Miocene of the Pisco Formation (Peru). Two of them are relatives of the living genus Sula, which represents medium and large-sized boobies. A new species of the extinct genus Ramphastosula is also described, adding to the discussion of possible alternative feeding strategies among sulids. The fossil record suggests that sympatric sulids exhibit different body sizes at least since the Oligocene epoch, a strategy related with resource partitioning. Furthermore, we find current analysis and knowledge of the fossil record unsuitable to evaluate properly seabird diversity changes through time.

The fossiliferous Upper Varswater Formation at Langebaanweg (South Africa) produced remains of at least five species of owls (Strigiformes). Tyto richae sp. nov. is the first palaeospecies of Tytonidae described from an African fossil site, though indeterminate remains referable to the genus Tyto are known from the Middle Miocene of Morocco, the early Pliocene of Ethiopia, and the Pliocene of Tanzania. Athene inexpectata sp. nov. is not only the earliest documented fossil evidence for the genus worldwide, but also the first record of a species of Athene in Africa south of the Sahara. Proportions of its hind limb indicate that At. inexpectata sp. nov. probably has been as terrestrial as its modern relative At. cunicularia. A few additional remains represent the earliest fossil evidence for the genera Asio and Bubo on the African continent, though the poor preservation of these bones prevents more detailed identifications. A distal tibiotarsus of a small owl about the size of At. inexpectata sp. nov. indicates the presence of a fifth, as yet indeterminate, species of owl at Langebaanweg. Biogeographical and palaeoecological implications of this assemblage of owls are discussed.

In 1991, Sabath described “larger avian eggs” from the Upper Cretaceous Barun Goyot and Djadokhta Formations of Mongolia. These were later included in the ootaxon Gobioolithus major. Here we recognize the larger avian eggs of Sabath as a distinct ootaxon, Styloolithus sabathi, oogen. et oosp. nov. These eggs differ from those of Gobioolithus in being larger (70 by 32 mm) and more elongate. Microscopically, the shell bears a third layer (possible external zone) thicker than the mammillary layer and nearly as thick as the second layer (possible squamatic zone); the continuous layer (including layers two and three) to mammillary layer thickness ratio is 3.1:1. Within the clutch, the tightly spaced eggs stand with their long axes steeply inclined. Adult remains are associated with two clutches, suggesting an incubation mode similar to that of troodontid maniraptorans, where adults sat atop largely buried eggs. S. sabathi provides evidence that relative egg size in Mesozoic non-ornithuromorph birds had increased markedly from the non-avian theropod condition in oviraptorids and troodontids, but had not yet reached the modern egg-adult proportions of Neornithes. Sediment-bound upright eggs appear common to Enantiornithes and more basal avians, suggesting that like non-avian theropods, these birds lacked chalazae, the chords of albumen allowing egg rotation in modern birds. Absence of this simple structure may have restricted these basal birds to ground nesting in areas with appropriate substrates and not permitted the type of nesting diversity found in Neornithes. Neornithes are the only Mesozoic clade of Dinosauria to nest completely free of sediment; this may have played a crucial role in their surviving the K-Pg mass extinction event.

New species of eimeriid coccidia (Apicomplexa: Eimeriidae) is described from the Common Wood Pigeon Columba palumbus (Aves: Columbidae). Sporulated oocysts of Eimeria columbapalumbi sp. n. are ellipsoidal 24–17 × 18–15 µm. Micropyle and oocyst residuum are absent. Sporocysts are broadly ellipsoidal, 11–16 × 6–7µm, with Stieda body. Substiedal body is absent. Sporocyst residuum is scattered, composed of hundreds of small granules. Sporozoites are elongate and slightly curved, each with two refractile bodies. There are two irregularly shaped polar granules present in the oocyst. The endogenous development takes place within the enterocytes of jejunum.

We describe a new avian taxon (Sanshuiornis zhangi gen. et sp. nov.) from Middle Eocene black oil shales in the Huayong Formation of Guangdong Province, south China. The specimen consists of a distal tibiotarsus and a complete foot with tarsometatarsus and pedal digits in articulation. A preliminary phylogenetic analysis does not resolve the affinities of the fossil, but the bones show resemblances to some “ciconiiform” birds. The peculiar hypotarsus morphology, which is block−like and exhibits four cristae, resembles that of the early Eocene Rhynchaeites, which is a stem group representative of the Threskiornithidae. The new Chinese fossil has, however, proportionally longer legs than Rhynchaeites and its phylogenetic affinities probably cannot be resolved without further material.

The exquisitely preserved longipterygid enantiornithine Rapaxavis pani is redescribed here after more extensive preparation. A complete review of its morphology is presented based on information gathered before and after preparation. Among other features, Rapaxavis pani is characterized by having an elongate rostrum (close to 60% of the skull length), rostrally restricted dentition, and schizorhinal external nares. Yet, the most puzzling feature of this bird is the presence of a pair of pectoral bones (here termed paracoracoidal ossifications) that, with the exception of the enantiornithine Concornis lacustris, are unknown within Aves. Particularly notable is the presence of a distal tarsal cap, formed by the fusion of distal tarsal elements, a feature that is controversial in non−ornithuromorph birds. The holotype and only known specimen of Rapaxavis pani thus reveals important information for better understanding the anatomy and phylogenetic relationships of longipterygids, in particular, as well as basal birds as a whole.

Penguin bones from the Eocene La Meseta Formation (Seymour Island, Antarctic Peninsula) constitute the only extensive fossil record of Antarctic Sphenisciformes. Here, we synonymize some of the recognized genera (Anthropornis with Orthopteryx, Delphinornis with Ichtyopteryx) and species (Anthropornis nordenskjoeldi with Orthopteryx gigas, Delphinornis gracilis with Ichtyopteryx gracilis). Moreover, we suggest that Antarctic species of Anthropornis and Palaeeudyptes, so−called giant penguins, may in fact comprise only one species each instead of two, based on evidence of well−marked sexual dimorphism. We also present new estimates of body mass based on femora testifying to the impressive scope of interspecific body−size variation in Eocene Antarctic penguins.

Finely−bedded lacustrine deposits of the Aptian (Lower Cretaceous) Xiagou Formation exposed in the Changma Basin of Gansu Province, northwestern China, have yielded numerous fossil vertebrate remains, including approximately 100 avian specimens. Though the majority of these birds appear referable to the ornithuromorph Gansus yumenensis, a number of enantiornithine fossils have also been recovered. Here we report on a specimen consisting of a complete, three−dimensionally preserved sternum, furcula, and sternal ribs that represents a second ornithuromorph taxon from the Xiagou Formation at Changma. The fossil exhibits morphologies that distinguish it from all previously−known Xiagou birds and demonstrate that it represents a derived non−ornithurine member of Ornithuromorpha. Though it is morphologically distinct from the equivalent elements of all other described ornithuromorphs, the material is too incomplete to justify the erection of a new taxon. Nonetheless, it increases the taxonomic diversity of the Xiagou avifauna, thereby expanding our knowledge of Early Cretaceous avian diversity and evolution.
