Arctic legal status
Opis:
The Arctic is a place which generates widespread interest on the international stage. This region, which was seemingly forgotten after the end of the Cold War, has again become a place of great rivalry. The reason for this is primarily the shrinking of the Arctic ice cap, which has opened up the possibility of exploiting the region’s rich natural resources and using new, attractive, maritime routes. The problem which arises in connection with these possibilities is the lack of a specific legal status for this area. Arctic countries, in this case meaning the big five of the Arctic, which are the states which have direct access to the Arctic Sea: Denmark (via Greenland), Canada, Norway, Russia and the United States, have submitted their own proposals for the regulation of the legal regime around the North Pole. The most important issues are considered to be: the concept of sectors, the common heritage of humanity and the rule of law subjecting the Arctic sea. These three issues arise from different periods and though many of their elements are varied, they also have convergent points. It is likely that the status of this strategic area will be based on one of them.

Opis:
The lifetime of the Kingdom of Poland – a state connected with the Russian Empire by a union – has not been unequivocally assessed in Polish historiography. On the one hand, the Kingdom had its own army, administration and a very liberal constitution, and had quickly achieved economic prosperity. On the other hand, within a few years of its creation, there occurred the fi rst violations of the Constitution and the persecutions of those who opposed these infringements. A significant event was the revolt of the Cadets of 29 November 1830, which turned into a uprising, today referred to as the November Uprising. This article is the analysis of the legal aspects of the Polish-Russian union created in 1815. It is then compared with the Union of Lublin and the drafts of planned unions between the Polish-Lithuanian Commonwealth and the Tsardom of Russia in the 16th and 17th centuries. The circumstances which led to the creation of the Kingdom of Poland and its union with the Russian Empire, as well as the earlier attempts to create one state of the Polish-Lithuanian Commonwealth and the Russian Empire, as well as the principles of a union of the Crown of the Kingdom of Poland and the Grand Duchy of Lithuania are presented. The principles upon which these unions were to be based are subsequently compared and analysed. A particular emphasis has been placed on the issues related to the international legal status of the Kingdom of Poland. In this context questions such as: the treaty-making power and jus legationis have also been asked. Another important issue discussed in the paper is also the role of the king in matters concerning foreign policy and a possible role of Russia in these matters. The results of this analysis allow to formulate a more objective assessment of the period of the Kingdom of Poland, focusing on its legal status and position, and in particular on the relation with the Russian Empire.

Declaration of war from the centuries was one of the main element of armed conflict as an expression of the maturity decision of the relevant state body. The requirement to declare war prevented rashness in starting war. But over time this practice was abandoned. The issue of significance of the declaration of war returned after outbreak „strange war” in eastern Ukraine. Part of the Ukrainian political circles demands from the authorities the official declaration of war on the Russian Federation, which constantly denies the facts of involvement in this conflict. This article focus on the question of significance of the declaration of war, legal implications and the current practice of states. Moreover, there are pointed out the consequences of declaration of war in the conditions of the so-called hybrid war in eastern Ukraine. In this article presented also unclear under international law binding of this conflict with the opinion of whether the declaration of war can help solve them

Opis:
The paper deals with internal conflicts, their internationalisation and a hybrid war. In the 1990s many military conflicts could have been regarded as domestic conflicts or internationalised internal conflicts. According to the authors internationalised internal conflicts and a hybrid war have much in common. The purpose of the paper is to compare and confront distinctive characteristics of internationalised internal conflicts with the model of hybrid war. The authors scrutinize definitions of an internal, domestic conflict and a hybrid war, and the possibilities and likelihood of their occurrence. Finally the issue is analysed in terms of international public law. ‘Hybrid war’ is a term not defined in public international law. However it is commonly used not only by media and politicians, but also by academics in a sci- entific discourse. A question arises to what extent it is justified to use a term in the context of different military conflicts, like for instance the one in the East Ukraine that has been going on since 2015. Therefore it is necessary to explain what the term ‘hybrid war’ means. In order to do so, it is necessary to try to define the term. Its distinctive characteristics must be indicated. Then, many military conflicts will be analysed to determine whether they satisfy the requirements for qualifying them as a ‘hybrid war’ or an internationalised internal conflict. The research leads to a conclusion that an internationalised internal conflict gives many opportunities for applying to it methods characteristic of a hybrid war. In the course of an internationalised internal conflict there are many ways in which the aggressor can evade international liability and the authors attempt to answer how to prevent this.
